Evaluate the work and the money separately, then recombine them into comparable, risk-adjusted terms. An unusual title is not automatically a promotion, and an impressive on-target-earnings figure is not guaranteed income. Before accepting, document the actual duties and authority, split guaranteed pay from conditional pay, price benefits and time demands, verify the written plan, and check the legal and fraud risks that apply to your location.
Start with a six-part comparison, not the headline number
Put every offer on one worksheet. Score each offer against the same questions so an unfamiliar title or elaborate pay plan cannot dominate your judgment.
| Comparison axis | What to record | Why it matters |
|---|---|---|
| Role substance | Core duties, decision authority, reporting line, team, success measures, level, and work explicitly outside the role | Actual work is more useful than title wording for career fit and for comparing roles. |
| Guaranteed pay | Salary or guaranteed hourly amount, pay frequency, and conditions attached to receiving it | This is the money you can plan around before uncertain incentives. |
| Variable pay | Commission or bonus formula, target, thresholds, caps, discretion, measurement period, payment date, and forfeiture terms | “Target” or “on-target” pay has no fixed value until the rules and probability are clear. |
| Benefits and equity | Employer contributions, insurance, paid leave, retirement, equity vesting and exercise terms, and other written benefits | These can materially change the package, but uncertain equity should not be treated as cash. |
| Time and risk | Expected hours, overtime treatment, travel, on-call work, stability, and dependence on conditions outside your control | A larger nominal package can be poor value if it requires substantially more time or carries high payout risk. |
| Evidence and clarity | Which promises are in the offer letter or plan documents, and which exist only in conversation | Unwritten terms are difficult to enforce, budget for, or compare. |
Keep a separate column for assumptions. Label each assumption as confirmed, employer-stated but undocumented, your estimate, or unknown. Do not allow an unknown to appear in the guaranteed-pay total.
Translate the title into the job you would actually do
Titles are often created for recruiting, organizational design, or internal status. They may not map cleanly to common market levels. Ask the hiring manager to describe the role in operational terms and write the answers down.

Questions that reveal the role
- What are the five most important activities in a normal week?
- Which decisions can I make without approval, and what budget, customer, or personnel authority comes with the role?
- Who is my direct manager, and which teams will set priorities for me?
- How many people are on the team, and will I manage employees, contractors, or neither?
- What outcomes define success at 30, 90, and 365 days?
- Which tasks are explicitly outside the role, and which “other duties” are expected in practice?
- What level is this role internally, and what role would normally be the next step?
- How often has the scope changed for people previously in this position?
Build a role scorecard
Create one row for each major responsibility and record its frequency, authority, measurable output, and career relevance. For example, “owns customer renewals” is materially different from “assists the account team with renewals”: the first suggests control over a result and possibly a commission trigger; the second may not.
Compare that scorecard with roles you have held, roles you are considering, and postings that describe similar work. Compare duties, level, location, and industry—not just the label. The Department of Labor’s equal-pay guidance likewise focuses on job content rather than title when assessing whether work is substantially equal. That principle is useful for career comparison even when you are not making a legal claim.
Look for title inflation and title compression
- Inflated title: a grand label paired with routine execution, little authority, and no level or pay progression. Treat the title as marketing until the scope is documented.
- Compressed title: a modest label attached to broad ownership, technical depth, or people leadership. The work may be more senior than the title suggests, but confirm how the employer records level and promotion history.
- Hybrid title: two disciplines combined, such as operations and sales. Ask how priorities are resolved when the functions conflict and which results drive pay.
Ask for an organizational chart or a written reporting description if the chain of command is unclear. A title cannot compensate for a role with undefined authority or incompatible objectives.
Separate guaranteed compensation from conditional compensation
Make two totals: guaranteed annual cash and conditional annual cash. Put salary or guaranteed hourly wages in the first. Put commissions, bonuses, equity, signing payments, retention payments, and profit-sharing in the second unless the offer makes receipt unconditional.
What to obtain for each variable component
- The exact formula, including the revenue, margin, bookings, hours, or other metric used.
- Eligibility rules: start date, employment status on the payout date, territory, quota assignment, and any required approvals.
- Thresholds, accelerators, decelerators, caps, draw arrangements, and whether negative performance carries forward.
- The measurement period and payment date, including whether a customer must pay before your commission is earned.
- Whether the employer may change the plan or exercise discretion.
- What happens when you transfer roles, take protected leave, resign, or are terminated before the payout date.
- Examples using actual numbers from a prior period, if the employer can provide them without disclosing confidential information.
The Department of Labor explains that commissions may be paid in addition to salary or instead of salary, and that the Fair Labor Standards Act (FLSA) does not require commissions. Therefore, an “on-target earnings” figure is not a substitute for the written commission plan.
Use scenarios instead of one optimistic estimate
| Scenario | How to construct it | Use |
|---|---|---|
| Floor | Guaranteed pay plus only variable amounts you can receive under the least favorable ordinary conditions described in writing | Tests whether you can meet essential expenses if incentives underperform. |
| Expected | Guaranteed pay plus a variable result supported by documented historical attainment for this role, territory, and plan | Useful only when the employer supplies comparable evidence. |
| Upside | Guaranteed pay plus the stated target or accelerator result, with caps and eligibility conditions applied | Shows potential, not a budgetable promise. |
If the employer provides no attainment history, mark the expected variable amount as unknown rather than assuming the target is typical. Ask whether quotas, territories, or formulas have changed recently; historical results from a different plan may not be comparable.

Annualize guaranteed cash correctly
For salary, use the stated annual amount and pay frequency. For hourly work, multiply the guaranteed hourly rate by the guaranteed hours and the number of paid weeks specified by the employer. Do not annualize overtime, discretionary bonuses, or variable hours as if they were guaranteed.
For a commission-only or commission-heavy role, show guaranteed cash as zero or the stated guarantee, then display commission scenarios separately. This makes the income risk visible instead of hiding it in a blended headline number.
Price benefits without pretending they are cash
Record the employer’s documented contribution to health insurance, retirement, paid leave, allowances, and other benefits. Separate the employer contribution from your own payroll deduction. For equity, record the number and type of awards, vesting schedule, exercise price or other purchase terms, expiration, and treatment at termination. Until those terms and a realistic value are established, label equity as contingent rather than adding it to guaranteed cash.
The Department of Labor’s equal-pay material identifies salary, overtime, bonuses, stock options, profit sharing, insurance, leave, allowances, and other benefits as compensation forms worth considering. Use that broad inventory to avoid comparing salary alone.
Account for time and availability
Estimate the hours required to meet the stated objectives, including travel, customer events, on-call rotations, preparation, and unpaid administrative work. Divide each cash scenario by expected annual hours to obtain an approximate cash-per-hour comparison. Keep the estimate visibly labeled as yours; it is a decision aid, not a payroll determination.
Ask whether travel time, training, mandatory meetings, and after-hours communications are treated as work time. If the offer uses a salary label to imply unlimited availability, request the expected schedule and overtime treatment in writing.

Check U.S. wage-and-hour classification separately from the title
This section is general U.S. information, not a conclusion about your offer or the law in your state or city. Federal and local rules can differ, and enforcement positions can change.
Why the label is not decisive
The Department of Labor’s Fact Sheet 17U states: “Job titles alone do not determine exempt status.” The agency says the employee’s specific duties and earnings must satisfy the applicable requirements. A “manager,” “director,” or “professional” label therefore does not by itself remove minimum-wage or overtime protections.
The DOL page also reports that, after a federal court vacated the 2024 overtime rule on November 15, 2024, the agency was applying the 2019 rule. That is an agency enforcement statement tied to a particular page and date, not permanent legal advice. Verify the current federal rule and the requirements in the state or locality where you work before relying on any salary threshold or exemption assumption.

Ask the employer for the classification basis
- Will I be classified as exempt or nonexempt under the FLSA?
- Which duties test does the employer believe applies?
- What is the expected work schedule, and how are overtime hours recorded and approved?
- Are bonuses or incentive payments included in any regular-rate calculation used for overtime?
Fact Sheet 82 explains that, in the covered fluctuating-workweek method it describes, non-excludable incentive pay must be included in the regular-rate calculation. That fact sheet is not a universal explanation of every commission or bonus plan; obtain a plan-specific answer from payroll or a qualified employment lawyer.
Get material terms in writing before accepting
A practical offer file should contain the offer letter, commission or bonus plan, benefits summary, equity agreement, employee handbook sections that affect pay, and any written clarification from the employer. Ask for these documents before your acceptance deadline.
Written-term checklist
- Legal employer name and work location, including remote-work limits.
- Job title, level if used, reporting line, principal duties, and expected schedule.
- Salary or guaranteed hourly rate, pay frequency, and classification.
- Commission or bonus formula, quota, examples, caps, timing, and forfeiture rules.
- Signing or retention payment amount, payment date, repayment or clawback conditions, and what happens if employment ends.
- Equity type, grant date, vesting, exercise or purchase terms, expiration, and termination treatment.
- Insurance costs, employer contributions, retirement contributions, paid leave, and eligibility dates.
- Contingencies such as background checks, references, funding, customer contracts, or board approval.
- Acceptance deadline and the person authorized to answer compensation questions.
A concise clarification email
You can write: Please confirm in the offer documents the role’s reporting line and expected weekly schedule; the guaranteed cash amount and pay frequency; the complete commission or bonus formula, quota, payout timing, caps, discretion, and termination treatment; all signing, retention, and equity conditions; benefits and eligibility dates; classification and overtime treatment; and any contingencies that could delay or cancel the offer.

Save the response with the offer. If the employer says a plan will be supplied after you start, ask what governs the period before delivery and whether the employer may change the plan retroactively.

Test whether the offer is legitimate
Unusual compensation can be a legitimate incentive design, but vague job details combined with a request for money is a serious warning sign. The Federal Trade Commission describes fake recruiters who make offers with little job detail and later ask candidates to send money. Its consumer advice is direct: “Never pay to get paid or get a job.”
Verification steps
- Find the employer’s official website and contact information independently rather than using only the details in an unsolicited message.
- Call the company’s publicly listed number and ask whether the recruiter and requisition exist.
- Check that the email domain, interview process, work location, and legal employer name are consistent.
- Refuse requests for application fees, equipment payments, gift cards, cryptocurrency, wire transfers, or deposits to release wages.
- Do not send identity documents or banking details until you have independently verified the employer and reached the normal hiring stage.
A legitimate offer can still have an unusual title or incentive plan; legitimacy is tested by verifiable employer identity, substantive job information, and the absence of pay-to-work demands.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Compare two offers with a weighted decision sheet
After calculating the scenarios, assign weights that reflect your priorities. For example, you might give role substance 30%, guaranteed cash 25%, variable-pay confidence 15%, benefits and equity 10%, time and stability 15%, and documentation 5%. Multiply each offer’s score in each category by the weight, then examine the assumptions behind the score. The exact weights are yours; the value is making trade-offs explicit.
| Offer feature | Offer A | Offer B | Decision question |
|---|---|---|---|
| Core work and authority | Record confirmed scope | Record confirmed scope | Which role builds the experience you want? |
| Guaranteed annual cash | Use documented amount | Use documented amount | What can you safely budget? |
| Variable-pay floor, expected, upside | Show three scenarios | Show three scenarios | Which assumptions are evidence-based? |
| Benefits and equity | List contributions and terms | List contributions and terms | What is certain, and what is contingent? |
| Hours, travel, and stability | Document expectations | Document expectations | What is the approximate value of your time and risk? |
| Clarity and contingencies | Count unresolved items | Count unresolved items | Which employer answers material questions in writing? |
Do not average away a deal-breaking risk. A role with a lower score may still be right if it meets a non-negotiable need; a high score should not override an unresolved legality, scam indicator, or inability to support your baseline expenses.
Red flags that warrant a pause or a revised offer
- The title is senior, but the employer will not identify decision rights, level, manager, or measurable outcomes.
- Most of the advertised pay is a target, while the formula, quota, or payout conditions are missing.
- The employer refuses to provide a plan document or says terms can be changed without notice.
- Commission depends on events you cannot control, such as an unassigned territory or an undefined customer-payment event.
- A signing or retention payment has a broad repayment clause that could leave you owing money after ordinary departure.
- The schedule implies substantial overtime or on-call work, but classification and time recording are not explained.
- The offer requires payment, purchases from a designated vendor, or transfer of money before employment begins.
- Recruiter answers change between conversations, or the legal employer and work location remain unclear.
Ask for a correction, clarification, or additional guaranteed pay when risk is measurable. If the employer will not clarify a material term, treat that uncertainty as part of the offer rather than assuming the most favorable interpretation.

When professional advice is worthwhile
Consider an employment lawyer in the relevant state or locality when the offer involves disputed overtime classification, a complex commission plan, a clawback, restrictive obligations, or a substantial equity grant. A tax professional can explain the personal tax consequences of equity, bonuses, and signing payments; those consequences depend on your circumstances and are not established by the headline offer.
Bring the complete written package and your questions. Ask the adviser to identify which conclusions are certain, which depend on missing facts, and which rules could change. Do not rely on a title, a recruiter’s summary, or a generic online calculator for a jurisdiction-specific legal or tax decision.
A final acceptance test
- I can describe the day-to-day work, authority, manager, success measures, and exclusions in my own words.
- I know my guaranteed cash and can fund my baseline budget without counting speculative incentives.
- I can reproduce every variable-pay calculation from the written plan.
- I have valued benefits, equity, hours, travel, and stability as separate factors.
- I know the employer’s stated classification and have checked current federal and applicable state or local guidance.
- I have the material terms, contingencies, and acceptance deadline in writing.
- I independently verified the employer and have not paid to obtain the job or wages.
If any answer is “no,” pause acceptance and request the missing evidence. The strongest unconventional offer is not the one with the fanciest title or largest theoretical total; it is the one whose work, guaranteed pay, upside, risks, and conditions you can explain and verify.

Frequently Asked Questions
What does “on-target earnings” mean?
It usually combines guaranteed pay with a target commission or bonus. Treat the target portion as conditional until the formula, eligibility, timing, and historical attainment for the comparable role are documented.
Can an employer make me exempt by calling me a manager or director?
No title alone decides U.S. FLSA exemption. The Department of Labor says duties and earnings must meet the applicable requirements, and current federal and state or local rules should be checked.
Should I count equity as salary?
No. Record the grant, vesting, exercise or purchase terms, expiration, and termination treatment separately. Count it as guaranteed cash only if the value and conditions are genuinely certain, which is uncommon.
What should I do if a recruiter asks for money?
Stop the transaction and independently verify the employer. The FTC’s rule is: “Never pay to get paid or get a job.”
