Preserve the application and every decision-relevant record, identify the exact model and underwriting-policy versions, retain the model output and any human intervention, and make sure an adverse-action notice states the real principal factors that drove the decision. That is the practical standard for an auditable AI-assisted mortgage process in the United States. Artificial intelligence does not create an exception to the Equal Credit Opportunity Act (ECOA) or Regulation B. As the Consumer Financial Protection Bureau (CFPB) puts it, “The adverse action notice requirements of ECOA and Regulation B, however, apply equally to all credit decisions, regardless of the technology used to make them.”

This guide separates records the law expressly addresses from additional governance evidence that helps a reviewer reconstruct what happened. It is general information, not institution-specific legal advice. A lender should confirm the current federal, state, investor, agency, charter and internal records requirements that apply to its products and footprint.

What an AI mortgage decision record must prove

A compliance reviewer should be able to start with a specific application and answer five questions without relying on an engineer’s memory:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What information was received, from which source, and when?
  • Which model, configuration and underwriting policy were active?
  • What did the model produce, and how did the lender turn that output into an action?
  • Did a person review, override or otherwise change the result?
  • If the applicant was denied, received less favorable terms or was otherwise subject to adverse action, do the stated reasons accurately identify the principal factors actually considered or scored?

The first four questions establish reconstructability. The fifth is the legal test that most often exposes a weak AI record: a notice cannot be accurate if the lender cannot determine what factors the system actually used.

Keep legal records distinct from governance evidence

Regulation B identifies application, evaluation and notice records that generally must be preserved for specified periods. A model-governance file can contain more information—version manifests, validation links, monitoring results and change approvals—to make those records understandable and reproducible. The extra fields are recommended controls, not a single federally prescribed “AI file.” Label them accordingly in policy and procedures.

How ECOA and Regulation B apply when software makes the recommendation

The CFPB’s Circular 2022-03 says creditors must provide specific and accurate adverse-action reasons even when a complex algorithm is involved. A lender cannot defend an unexplained denial by saying the model is too complicated, proprietary or “black box” to interpret.

A statement such as “you did not meet our internal standards,” “the system score was below the cutoff” or “the application failed policy” does not identify the principal reasons with enough specificity. Nor is it safe to select the closest item from a sample reason list when that item does not describe a factor the system actually considered. The reasons delivered to the applicant must correspond to the factors that drove the credit action.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Adverse-action reasons and credit-score disclosures are different

When the Fair Credit Reporting Act (FCRA) requires key factors associated with a credit score, those factors do not automatically satisfy ECOA’s separate requirement to explain the reasons for the credit action. Your notice workflow should therefore store the ECOA/Regulation B reasons and any FCRA-related information as separate data elements, even when they appear on the same communication.

What the reason trace should show

For each principal reason, retain a traceable path from the input or derived variable through the model or rules to the customer-facing text. If a reason is generated by a post-processing service, record the mapping logic and the test showing that the text remains faithful to the model behavior. If a human selected or edited a reason, preserve the original machine output, the edit, the person’s role and the rationale.

Which records Regulation B generally requires you to retain

Under 12 CFR Part 1002 (Regulation B), the general consumer-credit rule calls for retaining specified records for 25 months after the creditor notifies the applicant of action taken or of incompleteness. The period is not a universal retention rule for every mortgage document, vendor log or model artifact. Exceptions, other credit categories and enforcement holds can change the result.

Record category General rule described in Regulation B How to handle an AI-assisted file
Application Retain for 25 months after the action or incompleteness notice for covered consumer credit. Store the submitted application plus a controlled pointer to the authoritative loan file.
Compliance-monitoring applicant characteristics Retain the specified characteristics gathered for monitoring. Keep the captured values and collection context under restricted access; do not create unnecessary duplicate copies.
Other written or recorded evaluation information Retain information used in evaluating the application that was not returned to the applicant on request. Include decision-relevant data snapshots, derived-variable definitions, model inputs and rule evaluations, with source and retrieval times.
Action notifications and adverse-action reasons Retain copies of written notifications and specific reasons, or a memorandum when reasons were provided orally. Preserve the exact rendered notice, delivery method and date, plus the structured reason codes and text.
Applicant allegations of a violation Retain applicant statements alleging a violation as required by the rule. Link complaints, escalations and correspondence to the decision record and apply any legal hold.

The rule describes a 12-month period for certain business-credit records and special provisions for some large-business or trade-credit applications. If a creditor has actual notice of an enforcement investigation or proceeding, relevant records generally must be kept through final disposition. Have counsel or the compliance function classify the application before applying a schedule.

Mortgage valuations need their own control

For a first-lien dwelling application, Regulation B § 1002.14 requires copies of appraisals and other written valuations developed in connection with the application. For closed-end credit, the general timing is promptly upon completion or at least three business days before consummation, whichever is earlier; open-end credit uses the account-opening timing in the rule. Permitted waivers and other provisions can affect delivery.

Track the valuation document, version, completion date, delivery date and delivery evidence separately from the underwriting model record. Do not assume that documenting an automated valuation model (AVM) or another property tool satisfies every valuation-quality or disclosure obligation. AVM-specific rules should be analyzed on their own.

A practical AI decision-record schema

The following control set is designed to let an independent reviewer recreate a decision while limiting unnecessary exposure of sensitive personal data. It supplements, rather than replaces, the records Regulation B expressly addresses.

1. Case and decision identity

  • Application or loan identifier, product and transaction type.
  • Decision stage—for example, prequalification, underwriting, pricing, counteroffer or servicing-related credit action.
  • Decision date and time, including time zone where systems operate across regions.
  • Action taken and responsible business unit.
  • Unique event or correlation ID linking the origination platform, model service and notice system.

2. Inputs, sources and transformations

  • The decision-relevant data received, source system or vendor, and retrieval timestamp.
  • Transformations, derived variables, imputation or missing-data treatment used before scoring.
  • Data-quality flags, validation failures and any fallback values.
  • A pointer to the controlled loan file when the raw value is already retained there, rather than a second unrestricted copy.
  • Consent, authorization or permissible-purpose metadata where applicable to the source.

3. Model and policy identity

  • Model name, vendor or internal owner, release and version.
  • Deployment, endpoint or configuration identifier, including feature flags and threshold settings.
  • Underwriting policy, rule-set or pricing-policy version and effective date.
  • Material model or policy change that affected this decision, with approval reference.
  • Fallback model or manual path used if the primary service was unavailable.

4. Output and reason trace

  • Raw score, probability, recommendation or rule result, retaining the units and scale.
  • Thresholds, cutoffs or policy bands applied at the decision time.
  • Reason-generation method, including the model explanation technique or rules engine.
  • Principal factors used and the mapping to customer-facing reason text.
  • Evidence that reason text was tested against actual model behavior for the deployed version.

5. Human involvement

  • Reviewer identity or role and review timestamp.
  • Override, exception, counteroffer or escalation status.
  • The reviewer’s rationale and supporting evidence.
  • Final disposition and the person or service that committed it.
  • An explicit “no human review” value when the path was fully automated; never imply a review that did not occur.

6. Notice and delivery evidence

  • The exact adverse-action or other action notice delivered, including rendered language and reason order.
  • Delivery date, channel, address or account destination and delivery status.
  • Structured ECOA reasons and any FCRA-related information stored in separate fields.
  • Appraisal or written-valuation disclosure, delivery date and evidence for first-lien dwelling applications.
  • Records of corrected, reissued or returned notices.

7. Validation, monitoring and governance references

  • Links to validation, performance, bias or fair-lending assessment, including population, time window and model version.
  • Change-approval record and effective date.
  • Monitoring alerts, incidents, remediation and release decisions.
  • Decision owner, approval status, vendor documentation and known limitations.
  • Escalation route and retention/disposal schedule, including legal-hold handling.

How to document a decision for an audit: an operational workflow

  1. Create the case record at intake. Generate a stable application identifier and capture product, transaction, stage and decision-owner fields before the first model call.
  2. Snapshot the inputs used. Record source, retrieval time, transformations, missing-data handling and quality flags. Use immutable or tamper-evident storage for the snapshot and preserve a pointer to the authoritative file.
  3. Resolve model and policy versions. At scoring time, write the model release, deployment configuration, underwriting-policy version, threshold set and effective dates into the event record. Do not infer versions later from a current production label.
  4. Persist the raw result. Save the score or recommendation, rule evaluations, confidence or band where applicable, and the exact decision path. Keep both the machine output and any post-processing result.
  5. Capture human action. Require a reviewer identifier, timestamp and rationale for overrides, exceptions, counteroffers or escalations. For straight-through processing, record that no human intervention occurred.
  6. Generate and test reasons before release. Map actual contributing factors to specific principal reasons. Block a notice when the mapping is missing, stale or inconsistent with the deployed model version.
  7. Archive the notice and delivery proof. Store the rendered communication, reason data, delivery channel, date and status. Keep ECOA reasons distinct from FCRA score-factor fields.
  8. Attach mortgage valuation evidence. For a first-lien dwelling application, link the appraisal or written valuation, version and delivery evidence under the separate valuation control.
  9. Link lifecycle evidence. Attach validation, monitoring, fair-lending assessment, incident and change-approval references with their covered population and version.
  10. Apply retention and holds. Start the applicable clock from the action or incompleteness notice, classify exceptions, and suspend disposal when an investigation, proceeding, complaint or legal hold requires it.
  11. Run a retrieval test. Periodically select closed cases and verify that an authorized reviewer can reproduce the inputs, versions, output, intervention, final action and notice without querying an obsolete system.

How to explain an AI mortgage denial to an applicant

Write the explanation from the decision record, not from a generic policy catalogue. Identify the principal factors that materially led to the action in language the applicant can understand. Examples of potentially specific reasons include a documented debt-to-income calculation above the applicable limit, insufficient verified income for the requested amount, or a credit-history characteristic that the model actually used and that the notice rules permit you to disclose.

Avoid replacing the factor with an outcome label. “The algorithm declined your application,” “you failed our score,” and “the file did not meet investor requirements” do not tell the applicant what principal consideration caused the action. If several factors were scored, select the principal ones according to a documented, version-controlled method and preserve that selection.

When a human changes the model recommendation, the notice must still describe the reasons for the final credit action. Store both the machine recommendation and the human rationale so a reviewer can distinguish model-driven and policy-driven factors.

Using NIST AI RMF without mislabeling it as law

NIST describes the AI Risk Management Framework as voluntary. Its lifecycle orientation—govern, map, measure and manage—can organize evidence for pre-deployment, deployment, monitoring and retirement. NIST’s trustworthiness characteristics include validity and reliability, security and resilience, accountability and transparency, explainability and interpretability, privacy and fairness.

Use those concepts to index validation reports, data documentation, access controls, incident records and monitoring results. Do not tell auditors or applicants that NIST AI RMF is a mortgage regulation or a substitute for ECOA, Regulation B, FCRA, valuation or state requirements. Its value here is a consistent filing and governance structure.

Comparing documentation approaches

No source establishes one universally compliant vendor, database or template. Evaluate an approach against the following practical criteria:

Criterion What to test
Reconstructability Can an authorized reviewer recover inputs, transformations, model and policy versions, output, human intervention and final action?
Reason accuracy Do adverse-action reasons correspond to factors actually considered or scored, with evidence for the deployed version?
Retention and retrieval Can records be preserved for the applicable period, produced promptly and protected from deletion during a hold?
Mortgage-specific evidence Are appraisal or written-valuation copies, versions, disclosures and delivery dates tracked separately?
Lifecycle governance Can testing, validation, monitoring and change approvals be tied to the exact model and time window?
Privacy and access Are sensitive values minimized, encrypted or access-controlled while remaining usable for a legitimate review?

Common failure modes and fixes

“The model is too complex to explain”

Why it fails: Technology complexity does not remove the adverse-action duty. Fix: select an explainability and reason-generation process before deployment, test it on the production configuration and retain the factor-to-reason mapping.

Using a generic policy reason

Why it fails: “Failed internal policy” or “score below cutoff” states an outcome, not the principal factors. Fix: record the actual variables, thresholds and policy provisions that drove the action and convert them into specific, accurate reasons.

Choosing the nearest sample checklist item

Why it fails: a convenient form label may not describe what the model considered. Fix: maintain a controlled reason catalogue tied to model factors, and block unmapped or stale reasons.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keeping only the final decision

Why it fails: a PDF denial notice cannot show which input, version or intervention produced it. Fix: retain the input snapshot, raw output, configuration, human events and notice as one linked case.

Applying 25 months to everything

Why it fails: Regulation B’s period covers specified records and contains exceptions; other obligations can be longer or different. Fix: use a records schedule that classifies product, record type, jurisdiction and legal holds.

Overlooking valuation delivery

Why it fails: appraisal and written-valuation delivery is a separate first-lien dwelling control. Fix: record valuation completion, version, delivery timing and evidence independently.

Deleting vendor logs after a short operational window

Why it fails: the lender may be unable to reconstruct a decision during a later review. Fix: contractually define export, access, retention, audit and hold capabilities before production use.

2026 legal-status checkpoint

The CFPB’s ECOA resource page reports a final rule issued April 22, 2026 concerning disparate impact, discouragement of applicants or prospective applicants and special purpose credit programs. The detailed text, effective dates and litigation or application status should be confirmed before changing policy. Maintain a documented legal-review checkpoint rather than assuming the announcement alone changes every workflow.

What an auditor should receive in a sample case

Prepare a read-only case packet or controlled evidence view containing the application identifier, submitted and derived inputs, source timestamps, model and policy versions, raw output, reason trace, human events, final action, rendered notice, delivery proof, valuation records when applicable, and links to the relevant validation and monitoring documents. Include retention classification and any hold status. Redact or tokenize data that the reviewer does not need, while preserving the ability to verify the actual decision.

A reviewer should be able to follow the record in chronological order and reach the same principal reasons shown to the applicant. If a value, version or intervention cannot be recovered, document the limitation, assess whether the notice or decision must be corrected, and route the issue through the lender’s incident and compliance processes.
