Do not simply add the account to your next return. A forgotten foreign account can create separate obligations for taxable income, an electronic FBAR (FinCEN Form 114), Form 8938, and other international information returns. The correction depends on what was missed, whether the conduct was non-willful, your residence and filing history, and whether the IRS or another agency has already contacted you.
Start by reconstructing each affected year, then choose the filing route before sending anything. An amended income-tax return does not replace an FBAR, and filing an FBAR does not amend income or satisfy Form 8938.
What you may need to correct
The existence of a foreign account alone does not identify the required filing. Review the account’s type, highest value, ownership or signature authority, income, transactions, and your personal circumstances for every affected year.
| Possible omission | What it addresses | Where it is filed |
|---|---|---|
| Taxable income | Interest, dividends, gains, or other income that should have been included in gross income | Amended federal income-tax return, with any required supporting schedules |
| FBAR (FinCEN Form 114) | Reportable foreign financial accounts when the aggregate value exceeded the applicable threshold during the calendar year | Electronically through FinCEN’s BSA E-Filing System; it is not attached to the federal income-tax return |
| Form 8938 | Specified foreign financial assets meeting that form’s definitions and filing thresholds | Attached to the federal income-tax return when required |
| Other international information return | Particular ownership, transfers, entities, trusts, or investments | The form and filing method depend on the asset and transaction; IRS examples include Forms 3520, 3520-A, 5471, 5472, 926, and 8621 |
One account can trigger several rows in this table. Correcting one filing does not automatically correct the others.

Step 1: Build a year-by-year inventory
Collect the original U.S. returns, statements from every foreign institution, opening and closing balances, maximum balances, ownership records, tax slips, transfer records, and correspondence. Work by calendar year for FBAR purposes and by tax year for income-tax and information-return purposes.
Record the facts that determine filing duties
- Account or asset type: bank, brokerage, pension, insurance, trust, company interest, or another financial asset.
- Whether you owned the account, jointly owned it, controlled an entity that owned it, or only had signature or other authority.
- Highest value during the year, not just the balance on the last day.
- Interest, dividends, gains, distributions, fees, and currency-conversion information.
- Whether an account was closed, transferred, inherited, or opened during the year.
- Your residence, citizenship or tax status, and whether each original return was filed on time.
- Any IRS notice, examination, criminal-investigation contact, or other inquiry concerning the account or return.
Do not assume that an account omitted from a return means every international form was required. The asset and the surrounding facts control.
FBAR and Form 8938 are different filings
FBAR (FinCEN Form 114)
IRS guidance describes a general FBAR trigger when the aggregate value of foreign financial accounts was more than $10,000 at any time during the calendar year. That threshold is not a Form 8938 threshold. The FBAR is filed electronically with FinCEN through the BSA E-Filing System and is never attached to the federal income-tax return.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsIf an FBAR was filed but contains an error, submit a new FBAR with the corrected information and identify it as amended. If no FBAR was filed, submit a delinquent FBAR for each required year. The IRS states that it will not penalize a properly reported late account when it determines that reasonable cause explains the lateness, but that determination depends on the facts and applicable law.
Form 8938
Form 8938 has its own definitions, asset categories, and filing thresholds. When required, attach it to the applicable income-tax return. A reasonable-cause exception can apply to a failure to disclose a specified foreign financial asset, but the IRS decides it case by case. The Form 8938 instructions state: “The determination of whether a failure to disclose a specified foreign financial asset on Form 8938 was due to reasonable cause and not due to willful neglect will be determined on a case-by-case basis, taking into account all pertinent facts and circumstances.”

Because the forms serve different purposes, file each one that the facts require. An FBAR cannot substitute for Form 8938, and Form 8938 cannot substitute for an FBAR.
Choose the correction route before filing
The IRS lists three principal paths for prior failures involving undisclosed foreign assets: the Criminal Investigation Voluntary Disclosure Practice, the Streamlined Filing Compliance Procedures, and the Delinquent International Information Return Submission Procedures. They are not interchangeable.

| Streamlined domestic offshore procedures | A U.S.-resident taxpayer whose failures were non-willful and who meets the procedure’s filing conditions | Generally covers the most recent three tax years whose due dates have passed and six FBAR years whose due dates have passed; requires filed returns for each covered tax year, amended returns where needed, required information returns, delinquent FBARs, tax and interest, and a Title 26 miscellaneous offshore penalty |
| Streamlined foreign offshore procedures | An eligible taxpayer who meets the IRS non-residency test and whose conduct was non-willful | Generally covers three due tax years and six due FBAR years; requires delinquent or amended returns and required information returns, plus tax and interest; no Title 26 miscellaneous offshore penalty for an eligible compliant participant under the procedure |
| Delinquent international information return submissions | A taxpayer who is not under civil examination or criminal investigation and has not already been contacted about the delinquent returns | Most delinquent international information returns other than Forms 3520 and 3520-A are generally attached to an amended income-tax return; penalties may be assessed, and a reasonable-cause statement may be submitted |
| Criminal Investigation Voluntary Disclosure Practice | Cases involving possible willfulness or significant criminal exposure that require individualized legal advice | A separate IRS disclosure framework; its eligibility, terms, and penalty treatment are not the same as streamlined procedures |
The IRS emphasizes that individual circumstances vary and encourages qualified tax or legal advice. Do not select a route solely because it is described as the fastest or least expensive.
Streamlined procedures: the requirements that matter
Non-willfulness
Both streamlined programs require that the failures resulted from non-willful conduct. The IRS describes non-willful conduct as negligence, inadvertence, mistake, or a good-faith misunderstanding of the law. A taxpayer who intentionally concealed an account, used misleading records, or otherwise acted willfully should not certify non-willfulness without advice from qualified counsel.
Domestic streamlined procedure
The domestic procedure is generally for U.S.-resident taxpayers who satisfy its eligibility rules and have already filed original returns for each of the three covered tax years. It is not the route for filing missing original income-tax returns.

The taxpayer must pay the additional tax, statutory interest, and the Title 26 miscellaneous offshore penalty, and must complete the current certification and other forms required by the IRS.

Foreign streamlined procedure
The foreign procedure is available only to taxpayers who meet the IRS non-residency test and the other eligibility rules. An eligible participant generally submits delinquent or amended returns for the most recent three due tax years, required information returns, and delinquent FBARs for the most recent six due FBAR years.
Tax and statutory interest remain due. The IRS states that an eligible taxpayer who complies with the foreign streamlined procedure is not subject to the specified failure-to-file, failure-to-pay, accuracy-related, information-return, or FBAR penalties covered by that procedure. Eligibility and complete compliance are essential; this is not an automatic waiver for every nonresident.
How the domestic 5% offshore penalty is calculated
The domestic streamlined penalty is not simply 5 percent of every foreign account or of one current balance. Under the IRS streamlined FAQ, the calculation uses a defined base: certain accounts and assets are valued at year end for each of the three covered tax years, and the highest aggregate amount is used. The FAQ also describes exclusions for years in which relevant accounts or assets were compliant.
Use the current Form 14654 instructions and the IRS streamlined FAQ to identify the assets included in the base, the covered dates, and permitted exclusions. Keep workpapers showing the exchange rates, year-end values, ownership percentages, and treatment of previously reported assets.

When the delinquent-information-return route may apply
The IRS describes delinquent international information-return procedures for taxpayers who are not under civil examination or criminal investigation and have not already been contacted about the delinquent returns. Most delinquent international information returns other than Forms 3520 and 3520-A should generally be attached to an amended income-tax return.
You may attach a statement explaining reasonable cause. The IRS notes that, for many forms, it may assess a penalty before considering that statement. If the IRS sends correspondence, respond by the deadline with the explanation and supporting evidence rather than assuming the original statement was accepted.
This route does not erase omitted income. If interest, dividends, gains, or other taxable amounts were missing, correct the income-tax return and pay the resulting tax and interest.
How to submit a late or corrected FBAR
- Determine the covered calendar years. For each year, calculate the highest aggregate value of all foreign financial accounts and identify every account that was reportable.
- Gather identifying information. Obtain the institution’s name and address, account number, account type, ownership status, and maximum value for the year.
- File electronically. Use FinCEN’s BSA E-Filing System to submit a delinquent FBAR for each required year. Do not attach it to an income-tax amendment.
- Explain lateness when appropriate. Preserve a concise, factual reasonable-cause explanation and records supporting it. The IRS says properly reported late accounts may avoid an FBAR penalty when reasonable cause is found; the finding is not automatic.
- Amend an existing FBAR if needed. Submit a new FBAR containing the corrected information and mark it amended, following current FinCEN instructions.
FBAR penalty exposure is sensitive to the year, the violation, the taxpayer’s conduct, and current law. Do not rely on a generic penalty ceiling or an online calculator without matching it to those facts.

Amending the income-tax return and attaching Form 8938
- Recompute income. Translate foreign income and transactions using a consistent method, add omitted interest, dividends, gains, or other taxable items, and recompute tax, interest, and any affected schedules.
- Add required information returns. Include Form 8938 and any other international forms triggered by the asset or transaction. A foreign account may involve an entity, trust, transfer, or passive investment form in addition to Form 8938.
- Prepare the explanation. State which years and forms were omitted, why the error occurred, when it was discovered, and how the corrected amounts were calculated. Keep the explanation consistent with any streamlined certification or reasonable-cause statement.
- Pay the calculated amount. Pay additional tax and statutory interest with the amended filing or through the payment method specified in the applicable procedure. Procedure-specific penalties, if any, must be included as instructed.
- Retain evidence. Keep account statements, exchange-rate support, ownership documents, filed forms, delivery confirmations, and copies of all explanations.
Do not file a standalone Form 8938 without correcting omitted income when income was also missing, and do not assume an amended return will transmit an FBAR.

What changes if you were contacted or examined?
Contact from the IRS, a civil examination, or a criminal investigation can make a delinquent-information-return or streamlined route unavailable or inappropriate. Stop and identify exactly what agency contacted you, which years and forms are covered, and the response deadline. A voluntary disclosure or examination response may require a different strategy from a self-initiated late filing.
Possible willfulness, false statements, deliberate concealment, or substantial unreported income raises legal risk beyond a routine amendment. Seek advice from a qualified tax attorney or other professional experienced in international tax before submitting a certification that describes the conduct as non-willful.
If an earlier streamlined submission was wrong
The IRS foreign streamlined FAQ says a taxpayer may correct an error in a previous submission with amended returns and/or an amended certification when the prior filings are not under examination. Explain the facts and circumstances and follow the current IRS FAQ and instructions for labeling and delivery. Do not silently replace a filed submission without preserving the original package and documenting the correction.

- Income omitted? Prepare an amended income-tax return and pay the additional tax and interest.
- FBAR omitted or inaccurate? File or amend the FBAR electronically through FinCEN; it is a separate filing.
- Form 8938 omitted? Attach it to the appropriate income-tax return when the asset and threshold rules require it.
- Another international form involved? Identify the specific asset or transaction and its form before choosing a procedure.
- Non-willful and otherwise eligible? Compare domestic and foreign streamlined rules, including residence, prior filing, three-year and six-year coverage, and penalty treatment.
- Not under examination or contacted? Consider whether delinquent-information-return procedures fit, while recognizing that penalties may still apply.
- Possible willfulness or government contact? Obtain individualized legal advice before filing a streamlined certification or voluntary disclosure.
Common mistakes to avoid
- Filing an FBAR as an attachment to the income-tax return.
- Assuming the $10,000 FBAR threshold is also the Form 8938 threshold.
- Reporting the account but not the interest, dividends, gains, or other taxable income.
- Using streamlined procedures without checking residence, non-willfulness, prior-return, and government-contact requirements.
- Describing the domestic penalty as 5 percent of every account instead of applying the specified three-year calculation.
- Filing missing original income-tax returns through the domestic streamlined procedure, which requires previously filed returns for its covered years.
- Assuming a reasonable-cause statement guarantees penalty relief.
- Ignoring a notice because a delinquent form was already mailed; many penalties require a timely response to IRS correspondence.
When professional help is warranted
Professional advice is particularly important when more than one form was missed, account ownership changed, a trust or company is involved, income is substantial, records are incomplete, the taxpayer lived outside the United States, the IRS has made contact, or the facts could be characterized as willful. Ask the adviser to analyze each year and each filing separately and to explain the tax, interest, penalty, and disclosure consequences before anything is submitted.
IRS administrative procedures and forms change. Confirm the current instructions, covered years, filing addresses or electronic systems, and eligibility tests at the time of filing. The three-year and six-year periods described above refer to the most recent years whose relevant due dates have passed under the applicable streamlined procedure, not a permanent rule for every case.
