Use two public records together, not one: USCIS H-1B Employer Data Hub results show approved petition and beneficiary counts, while Department of Labor (DOL) Labor Condition Application (LCA) disclosures show applications, requested positions, wages, occupations and worksites. Compare the same fiscal years, the same legal employer, and roles that resemble your offer. Then obtain written confirmation that this employer will sponsor this specific position; historical filings cannot guarantee sponsorship, a petition approval or a hire.
What the two records actually measure
The records describe different stages of the process, so a high number in one database should not be treated as a high number in the other. Start by labeling every figure with its source and what it counts.
| Record | What you can observe | Useful comparison | What it cannot establish |
|---|---|---|---|
| USCIS H-1B Employer Data Hub | Employer-submitted H-1B petition data, including approved petition and beneficiary counts. Filters include fiscal year, employer name, employer city, state, ZIP code and NAICS industry; filtered results and individual fiscal-year data can be downloaded. | Whether an employer has a recurring history of approved H-1B petitions and how that history compares across employers and years. | Whether the offered job is eligible, whether the employer will file for you, whether a particular petition became a hire, or where the beneficiary actually worked. The employer address is a mailing address and may differ from the worksite. |
| DOL OFLC LCA disclosure files | Quarterly disclosure records for LCAs in the H-1B, H-1B1 and E-3 programs. Fields include job title, number of workers requested, employment dates, employer contacts, worksite address and wage level. | Whether the employer has recently filed for occupations, locations, wage levels and employment periods resembling your offer. | Approval of an H-1B petition, a worker hired, an open job, or sponsorship of your individual role. One LCA can cover multiple positions. |
The Congressional Research Service (CRS) describes both datasets and their limits in H-1B, H-2A, and H-2B Temporary Worker Programs: Resources for Data and Statistics. Keep the distinction visible in your notes: “approved petitions/beneficiaries” is not the same measure as “LCA applications or requested workers.”

Federal fiscal years run from October 1 through September 30. USCIS and DOL releases may cover different periods, and DOL publishes its LCA files quarterly. Do not compare a complete fiscal year for one employer with a partial quarter for another as though they represent equal exposure.

The DOL Performance Data page currently displays FY2026 Q3 records covering determinations issued October 1, 2025 through June 30, 2026. DOL notes that a small percentage of determinations can change in later releases because of appeals or redeterminations. Check the page again immediately before quoting a count or making a decision: DOL OFLC Performance Data.
Record the exact coverage beside every result: fiscal year, quarter (if applicable), date downloaded and whether the period is complete. A trend is more meaningful when each employer is measured over the same set of completed years and quarters.
Publication timing can also create an apparent gap. A quarter may have ended while its disclosure file is not yet posted, and a later file may revise a small number of determinations. Keep the original download, but mark it as a snapshot rather than a permanent total. When two employers are close, compare the same release version and state the coverage in your notes.

1. Resolve the employer’s legal identity
Begin with the employing entity named in the offer, not only the brand shown on a careers page. Search the USCIS Hub and DOL files for the exact legal name, then test likely punctuation, abbreviations, former names and subsidiary names. Use city, state, ZIP code and NAICS industry filters in the USCIS Hub to distinguish similarly named companies.
Keep an identity log with the spelling used, related entities found and the address shown in each source. A parent company’s filings do not automatically prove that its subsidiary—or the entity signing your offer—will petition for you. Ask which entity would be the petitioner before treating a record as relevant.
Also preserve the employer contact and address fields from LCA records. They can help distinguish two companies with similar names, but they are not a substitute for the legal name in your offer. If a staffing company, affiliate or acquired business appears in the records, ask whether that entity—not the customer or parent—would employ and petition for you.
2. Set one comparable time window
Choose several completed fiscal years rather than relying on a single recent hit. For DOL data, align quarters or aggregate complete fiscal years; label the latest period as partial when it is not finished. Save the publication date and note that later DOL updates can revise determinations.

For a fair side-by-side review, make a simple calendar showing each fiscal year from October 1 through September 30 and mark which USCIS and DOL periods are available. If one employer has a record only in a partial latest quarter, compare both employers over the last common completed period first, then discuss the partial data separately.
3. Download and label USCIS results
In the USCIS H-1B Employer Data Hub, filter by the employer name and, where useful, city, state, ZIP and industry. Download the filtered results and the individual fiscal-year data available from the Hub. For each year, record approved petition count and approved beneficiary count separately.
Those two USCIS measures answer different questions: petitions describe filings approved for an employer, while beneficiaries describe the people represented in those approvals. Neither is a headcount of current employees or a promise that a new petition will be filed.
Recommended Free Tools
Do not collapse several fiscal years into one unexplained grand total. A year-by-year line can show whether activity is recurring, concentrated in one hiring cycle or declining. If you calculate a total for convenience, retain the annual figures alongside it and identify exactly which years are included.
4. Download and label DOL LCA records
Use the OFLC performance-data page to obtain the quarterly LCA disclosure files and their record layouts. Filter for the employer identity and retain the fields that relate to your offer: job title or occupation, workers requested, employment start and end dates, wage level, wage information where provided, employer contact and worksite address.
Do not count rows as workers without checking the requested-worker field. A single LCA may cover multiple positions, and DOL’s LCA program also includes H-1B1 and E-3 cases. CRS found that 97% of LCA cases in its analysis of first-quarter data from FY2020–FY2024 were H-1B cases, but the remaining cases mean the disclosure file is not an H-1B-only petition list.
Read the record layout before sorting or adding columns. A field that looks like a count may identify a number of workers requested on one application, while another row may represent a different filing or worksite. Keep program labels and the quarter attached to every extracted row.

For scale, CRS reported 95,755 H-1B labor condition applications certified in the first quarter of FY2025. That is a quarter-specific LCA figure, not a count of hires and not a USCIS approval total. Use it only with that qualification.
An LCA is a labor-condition filing that precedes or supports an immigration process; it is not proof that a petition was submitted, approved or used. Conversely, an approved petition count does not reveal how many LCAs were filed, how many beneficiaries remain employed or whether the employer is accepting new sponsorship requests now.
6. Test whether the history resembles your job
Compare the substance of past records with the offer, not just the employer name.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problems- Occupation and duties: A matching or closely related title is more informative than an unrelated filing. Titles can vary, so read the occupation and duties fields where available.
- Worksite: Compare the LCA worksite address with the location promised in the offer, including remote or multi-site arrangements. Do not substitute the USCIS employer mailing address for a worksite.
- Wage information: Note wage level and disclosed wage amounts, and whether they cover the same role and location. A historical wage is not a quote for your compensation.
- Timing: Check expected employment dates. An old filing for a discontinued project is weaker evidence than repeated recent filings for the same type of work.
- Scale: Record requested positions on each LCA and approved beneficiaries in USCIS results without assuming either number equals hires.
Location deserves particular care for remote jobs. An LCA worksite is the location identified in that filing; a company mailing address in the USCIS Hub may be a headquarters or administrative address. If your offer allows relocation, travel or several worksites, ask which location will be used for the filing and whether the arrangement could change.
7. Obtain a written answer about this position
Public records cannot answer the individual question that matters most: whether the hiring team will sponsor your offer. Ask the recruiter or immigration contact to confirm in writing:
- Whether this exact role is sponsorship-eligible.
- Whether the employer intends to file for you, and under what timing or internal approval conditions.
- The full legal name of the petitioning employer.
- The anticipated worksite or worksites and whether they match the offer.
- Whether the role, duties and compensation may change before filing.
Save the response with your offer documents. Treat an answer limited to “we have sponsored before” as historical context, not confirmation of this job.
Ask whether sponsorship is available at the start of employment or only after a probationary period, and whether an internal immigration review is still required. These are employer-policy questions, not facts that the public datasets can resolve. Request the answer in an email or offer addendum rather than relying on a recruiting call that is difficult to document.
8. Request the applicable public access file information
DOL’s H-1B Advisor says that a worker and the general public may inspect specified materials that an H-1B employer must make available at its principal U.S. place of business or designated place of employment within one working day of filing an LCA. The guidance is available at DOL H-1B Advisor: Public Access.
Ask the employer how to inspect the public access file for the LCA applicable to your role. The listed materials include:

- The LCA itself and the wage rate.
- The employer’s actual-wage-system explanation.
- The prevailing wage and its source.
- Notice documentation.
- A summary of fringe benefits.
These documents can help you verify the worksite, wage basis and role-specific filing details. They still do not replace a written answer about whether the employer will submit a petition for you.
If the employer says there is no applicable LCA yet, that is different from refusing access to a filed LCA’s public materials. Ask which filing, if any, covers the position and where the file may be reviewed. Keep a note of the request and response with your comparison worksheet.
Use a side-by-side scorecard without overstating the evidence
When comparing two or more offers, use the same rows for each employer. A narrative note beside each number prevents false precision.
| Comparison row | What to enter | How to interpret it |
|---|---|---|
| Recentness and continuity | Completed fiscal years and DOL quarters with records; latest publication period checked. | Repeated activity across comparable periods is stronger historical evidence than one isolated record. |
| USCIS outcomes | Approved petitions and approved beneficiaries by fiscal year. | Shows approved H-1B petition history, not current staffing or a future commitment. |
| DOL activity | LCA records and requested-worker totals, clearly labeled by program and period. | Shows labor-condition filings; do not call every row an H-1B petition or every requested worker a hire. |
| Role match | Titles or occupations, duties and employment dates related to the offered job. | Closer matches make the historical comparison more relevant. |
| Wage match | Wage level and disclosed amount, with location and period. | Useful context for the offered role; historical wages do not set your individual terms. |
| Location match | LCA worksite address versus the offer’s work location; USCIS mailing address recorded separately. | Worksite evidence is more relevant to the job than a mailing-address match. |
| Direct confirmation | Written response about eligibility, intent to file, petitioner and location. | This is the decisive evidence for your offer; public history cannot substitute for it. |
Use qualitative labels such as “strong match,” “partial match” and “no comparable record,” and explain why. Avoid inventing a probability of approval from a filing count.
For each employer, add a “questions still open” column. Examples include an unexplained subsidiary name, a worksite that differs from the offer, a wage level without a disclosed amount or a latest quarter that is not complete. This keeps uncertainty visible instead of allowing a large historical total to dominate the decision.

Many USCIS approvals, few recent LCAs
This can reflect a different hiring cycle, an incomplete DOL period, or activity under another legal entity. Check the fiscal-year alignment and identity log before drawing a conclusion. It does not prove that sponsorship has stopped.

Many LCAs, few USCIS approvals
LCAs are an earlier and broader filing record. One LCA can request multiple positions, and the disclosure program includes H-1B1 and E-3. The pattern is evidence of labor-condition filing activity, not evidence that all requested positions were filled or that petitions were approved.
Records under a different address
USCIS employer address is a mailing address; DOL records identify the intended worksite. A mismatch may be normal for a headquarters, subsidiary or distributed workforce. Verify the legal entity and the actual worksite with the employer instead of discarding the record automatically.

No public record found
Check spelling, subsidiaries, older names, ZIP and city filters, and the coverage period. Confirm that you searched both datasets and that the latest DOL quarter has been released. After those checks, report “no matching record found in the reviewed period,” not “the employer never sponsors.”
One unusually large filing
A large requested-worker number on one LCA may represent a project or group of positions rather than a continuing sponsorship program. Compare the occupation, dates and later USCIS outcomes, and do not infer that the same number of openings exists today.
Frequent mistakes and safer alternatives
- Calling an LCA an approved petition: Label the source and program exactly.
- Counting rows as people: Read the number of workers requested; one LCA can cover several positions.
- Using a mailing address as the worksite: Compare the DOL worksite field with the offer location.
- Mixing periods: Align complete fiscal years and identify partial quarters.
- Ignoring corrections: Recheck DOL releases because appeals and redeterminations can alter a small percentage of determinations.
- Assuming history equals a promise: Ask for role-specific written confirmation and the petitioning entity.
- Treating every disclosure as H-1B: Remember that DOL files also contain H-1B1 and E-3 cases.
- Making a legal decision from a spreadsheet alone: Individual immigration circumstances are not established by these public datasets; obtain qualified legal advice for case-specific questions.
- Annualizing a partial quarter: Report the quarter as published and wait for a comparable complete period before drawing a trend.
- Relying on a brand name: Match records to the legal entity that will employ and petition for you.
A practical decision sequence before you accept
- Identify the exact legal employer in the offer and search name variants.
- Choose a common, completed fiscal-year window and record each dataset’s latest coverage.
- Download USCIS approved-petition and beneficiary results by year.
- Download DOL LCA files and record program, requested workers, occupation, wage and worksite fields.
- Compare role, location, wage context and timing without combining counts.
- Ask for written confirmation that this position is sponsorship-eligible and that the employer intends to file for you.
- Request instructions for reviewing the applicable LCA public access file.
- Keep the records, screenshots or downloads and the employer’s written response with your offer materials.
The sound conclusion is deliberately narrow: public history can show whether an employer has filed and obtained approvals in the past, and whether prior filings resemble your role. Only the employer can confirm its plan for this position, and only a case-specific immigration assessment can address your personal circumstances.
Frequently Asked Questions
How can I tell whether a company sponsors H-1B visas?
Check the USCIS H-1B Employer Data Hub for approved petitions and beneficiaries, then review DOL OFLC LCA disclosures for occupations, requested positions, wages and worksites. Match the records to the legal entity and ask the employer to confirm in writing that it will sponsor your specific role.
Is an LCA the same as an approved H-1B petition?
No. An LCA is a Department of Labor filing, and one LCA may cover multiple positions. It is not proof that a USCIS petition was filed or approved, that a worker was hired or that an opening remains.
Why do the USCIS address and DOL worksite differ?
The USCIS Employer Data Hub uses the employer’s mailing address, while DOL LCA records identify the intended worksite. A difference can be normal, but confirm the legal entity and work location with the employer.
What does a high number of H-1B filings prove?
It shows historical filing activity only. Counts do not establish that the employer will sponsor your role, that every requested position was filled or that a petition became a hire.
How current are DOL LCA records?
DOL publishes quarterly files organized by federal fiscal year. The Performance Data page displayed FY2026 Q3 determinations from October 1, 2025 through June 30, 2026, and DOL cautions that a small percentage may change after appeals or redeterminations. Check the latest release before relying on a count.
Can I inspect the LCA connected to my job?
DOL’s H-1B Advisor says workers and the general public may inspect specified public-access materials within one working day of filing, including the LCA, wage rate, actual-wage explanation, prevailing wage and source, notice documentation and fringe-benefit summary. Ask the employer how to review the applicable file.
The Bottom Line
Use USCIS approvals and DOL LCA disclosures as complementary historical evidence. Align fiscal years, verify the legal employer, compare role, wage and worksite details, and obtain written confirmation for the exact offer. No public count can guarantee sponsorship or approval.
