The fairest comparison is not “How much investment did the project announce?” It is a ledger that puts tax relief, verified public receipts, and costs shifted to utilities, residents, local services, and the environment on the same geographic and time basis. Identify the exact incentive first, then test whether measured benefits exceed the incentive and the public costs required to support the facility.

Use three ledgers, not one headline number

A data-center incentive can look successful when an announcement reports billions in construction spending. That is gross economic activity, not net public revenue. A credible comparison keeps three separate ledgers visible:

  1. Public cost of the incentive: taxes forgone by the state, county, city, school district, or other government, including sales-and-use-tax exemptions, property-tax abatements, credits, grants, and payments-in-lieu arrangements.
  2. Additional public receipts and enforceable benefits: taxes and fees actually collected, verified jobs and wages, infrastructure payments, and other commitments that the host government can document and enforce.
  3. Costs or risks shifted outside the tax ledger: power generation and transmission, utility upgrades, water supply, roads, emergency services, environmental effects, administrative work, and future liabilities.

Keep observed collections separate from modeled effects. A tax receipt recorded by a treasury is not the same as an economic-impact estimate produced with multipliers. Neither proves that the incentive caused the project; that requires a counterfactual showing what would have happened without the preference.

Identify the actual incentive before comparing outcomes

“A data-center tax break” is not a single policy. Record the legal instrument and its boundaries before looking at benefits.

Record the government and tax type

  • Name the granting government and every government whose revenue is reduced. A state sales-tax exemption can affect state and local distributions differently from a county property-tax abatement.
  • Specify the tax: sales and use, property, public-utility, corporate income, payroll, or another levy.
  • List eligible purchases and construction categories. Some programs cover servers and related equipment; others cover construction materials, electricity, or only narrowly defined machinery.
  • Capture eligibility thresholds such as minimum investment, power capacity, payroll, location, or job creation. Note whether a project must be in a particular county or designated zone.

Record duration, caps, and take-up

Write down the statutory start and end dates, phase-outs, per-project or annual caps, renewal rules, and any sunset or legislative change. “Available” does not mean “used”: report the number of beneficiaries, the amount each claimed, and any unclaimed authority. A preference used by most eligible facilities has a different fiscal exposure from one used by only a few.

Include negotiated local terms

Local development agreements may add property-tax abatements, infrastructure reimbursements, discounted land, impact-fee waivers, or payments in lieu of taxes. Put those terms beside the state incentive rather than treating them as unrelated benefits. Identify the recipient of each payment and whether it is guaranteed, contingent, or subject to clawback.

Put costs and receipts on comparable terms

Choose one time horizon—such as the first ten operating years—and one geographic boundary before calculating a return. Allocate every dollar to the government that pays or receives it. A state may collect a sales tax while a county funds a substation; combining them into a single “public return” hides who bears the burden.

Item to compare Required treatment If evidence is missing
Tax relief Report by tax type, government level, fiscal year, beneficiary, and statutory authority. Write “not measured” or “not available,” not zero.
Taxes and fees collected Separate audited or treasury receipts from forecasts and economic models. Identify the collecting agency and collection period.
Jobs Separate construction and trade work from permanent operating positions; show duration, wages, benefits, and local hiring. State whether targets were verified and whether hours or tenure were reported.
Capital investment Show completed taxable value and timing, not only announced investment. Explain whether the counterfactual investment is known.
Utility and public-service costs Assign costs to the utility, ratepayers, host government, or developer and include future projects. List the item as unresolved rather than assuming no cost.
Environmental effects Report water demand, emissions, land, noise, and mitigation obligations over the same horizon. Identify the measurement method and reporting frequency.

Use nominal or inflation-adjusted dollars consistently and disclose the treatment of one-time construction receipts. If a model discounts future cash flows, publish the discount rate and sensitivity range.

What current state evidence shows

State reviews illustrate why a common method matters. Their figures are jurisdiction-specific and should not be treated as a national average.

Jurisdiction and program Reported fiscal measure What the figure does and does not establish
Washington urban-county sales-and-use-tax preference (King, Pierce, and Snohomish counties) Washington State JLARC’s 2026 review estimated beneficiary savings of $42.4 million for fiscal years 2023–2026: $4.1 million in FY2023, $10.3 million in FY2024, $13.4 million in FY2025, and an estimated $14.6 million in FY2026. These are program-specific savings estimates. After a statutory narrowing effective July 1, 2026, JLARC projected no savings beyond FY2026 under the reviewed conditions. They are not a national estimate.
Virginia data-center sales-and-use-tax exemption Virginia JLARC reported $928 million in tax savings in FY2023 and use by about 90 percent of the industry in its review published in 2025. The values describe Virginia’s exemption and its estimated take-up; they do not measure net community cost or prove that every dollar of investment depended on the exemption.
Ohio data-center activity A 2025 Ohio Chamber Foundation study, summarized in a Georgia State Auditor report, estimated more than $1 billion in state and local tax revenue in 2024 and about $5.2 billion cumulatively from 2017–2024. It estimated a $2.7 billion cumulative net fiscal gain and $2.10 of receipts per dollar of forgone revenue. These are commissioned-study estimates, not an independent causal evaluation. The discussion cautions that construction is cyclical and future grid-modernization costs were not fully incorporated.

Washington JLARC also found that taxable values at reviewed facilities rose by $111 million since 2022 and that owner taxes increased by nearly $1.2 million between 2022 and 2025. The value analysis included tenants’ personal property. JLARC cautioned that it is unclear how much growth would have occurred without the preference, so the increase cannot be credited entirely to the incentive.

For three participating Washington centers, JLARC estimated $1.7 million in state public-utility tax and $2.5 million in local public-utility tax. Those amounts were not wholly new or attributable to the preference, and electricity-use reporting was insufficient for a year-over-year comparison.

What is the property tax revenue impact of data centers?

Start with the assessor’s taxable value and the applicable millage or rate, then separate owner real property from tenants’ personal property and identify which jurisdictions receive the levy. Report gross property-tax collections, abatements, negotiated payments, and the public services required to support the site.

A higher assessed value can produce substantial gross revenue while still leaving a host jurisdiction with a negative net position if it must finance roads, fire protection, water systems, or transmission facilities. Compare the value with a no-project or alternative-development scenario, and state whether the assessment is current, projected, or subject to appeal. Washington’s $111 million increase demonstrates the measurement issue: it is an observed change, but the review could not determine the share caused by the preference.

Test jobs and investment claims

Separate temporary from permanent employment

Construction jobs can be valuable without becoming a permanent operating workforce. Report job category, start and end dates, labor hours, wages, benefits, residency, and subcontracting. A target should specify the measurement period and the records used to verify it.

Washington beneficiaries reported 296 construction and trade jobs in 2023 and 2024. The statute did not require detailed reporting of job duration, wages, or labor hours, so that count cannot be converted into permanent full-time-equivalent employment or a wage-quality result.

Measure additionality

Ask what would have happened without the incentive. Useful evidence includes competing sites that lacked the benefit, project delays tied to the tax cost, internal location analyses, and changes in eligibility or rates followed by investment decisions. A facility receiving an incentive and later opening establishes sequence, not causation. Washington JLARC reported that the preference lowered business costs but that the investment attributable to it was uncertain; no new urban data centers had been built under the preference during the period reviewed.

Verify capital and tax-base claims

Reconcile announced investment with building permits, completed construction, assessor records, equipment placed in service, and actual tax filings. Distinguish a multi-year buildout from a one-time project total. If a model counts supplier spending or induced activity, identify the multiplier, geographic boundary, and time horizon rather than presenting the modeled amount as taxable investment.

Count utility, infrastructure, and environmental costs

Electricity demand can shift costs even when the data center pays its own utility bill. Examine generation, transmission, substations, capacity reservations, interconnection studies, and reliability upgrades. Ask whether the developer pays incremental costs or whether they are recovered from a broader rate base. Include planned upgrades that will be needed later, not only invoices issued during construction.

Review water withdrawals and consumption, cooling technology, drought restrictions, wastewater capacity, and disclosure obligations. Check road construction, traffic management, police and fire staffing, hazardous-material response, building inspection, and emergency planning. Quantify land conversion, noise, air emissions, backup-generator testing, and disposal requirements where data exist. Identify who pays for each mitigation measure and whether it is enforceable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not hide an unresolved impact in a favorable fiscal total. A table entry such as “future transmission cost: not measured” is more informative than assuming the cost is zero.

Use enforceable safeguards in local agreements

A public commitment should have an owner, deadline, reporting source, verification method, remedy, and cost bearer. The following structure can be used for a development agreement or incentive ordinance.

Commitment Responsible party and deadline Evidence and verification Remedy for nonperformance Who bears cost
Local hiring target Developer; each construction phase and annual operating period Payroll, residency, hours, wages, and contractor records audited by the host jurisdiction Withhold payment, reduce benefit, or claw back a defined amount Developer unless the agreement says otherwise
Tax and payment reporting Developer and tax administrator; quarterly or annual filing Tax returns, assessor records, and payment receipts Interest, penalty, or loss of eligibility under published rules Party responsible for inaccurate filing
Grid and utility upgrades Utility and developer; before energization and at expansion Interconnection studies, invoices, cost-allocation decisions Security, escrow, or prohibition on expansion until payment Specify whether developer, utility, or ratepayers pay
Water availability Developer and water authority; before permits and during drought review Metered use, source, discharge, and contingency plans Operating limits, surcharge, or permit enforcement Assign incremental supply and treatment costs
Community reporting Host government; at least annually Public dashboard, hearing record, and independent review Corrective-action schedule and public escalation Budgeted administrative cost, disclosed in advance

Maryland’s Executive Order 01.01.2026.16 offers a current review checklist: calculate net fiscal impact after incentives and public costs; make commitments measurable, time-bound, publicly reported, and periodically reviewed; assess job quality and local hiring; engage the community; and disclose water availability. Its governing principle is: “Communities must have a decisive voice and remain central to decisions about whether and how data center projects proceed within their jurisdictions.”

Compare policy choices explicitly

Virginia JLARC frames three legitimate choices. A jurisdiction may extend an exemption to support industry growth, allow it to expire to reduce growth and related energy impacts, or modify it—for example, by adopting a partial exemption. The appropriate choice depends on stated priorities, fiscal capacity, grid conditions, and the strength of safeguards. An audit does not by itself select one option.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Modification can be designed around evidence: limit eligible equipment, require verified jobs or local spending, phase the benefit down, cap annual exposure, or condition expansions on payment of incremental infrastructure costs. Any change should include a transition rule so existing commitments and new applicants are not mixed in one calculation.

A practical comparison procedure

  1. Define the unit of analysis. Name the facility or program, host jurisdictions, fiscal years, operating horizon, and currency basis.
  2. Inventory the legal benefit. Copy the statute or agreement’s tax type, eligible purchases, thresholds, duration, cap, application process, and reporting duties.
  3. Build the incentive ledger. Record forgone revenue by government and year, distinguishing estimates, appropriations, and actual claims.
  4. Build the receipt ledger. Obtain treasury collections, assessor values, utility taxes, fees, and payments in lieu. Mark each as observed, allocated, or modeled.
  5. Audit jobs and investment. Reconcile permits, payroll, hours, wages, local residency, taxable equipment, and completed—not merely announced—capital.
  6. Price shifted costs. Request utility, transmission, water, roads, emergency-service, environmental, and administrative estimates. Assign each cost to the payer and record future obligations.
  7. Test additionality. Document the counterfactual and uncertainty. Do not infer causation from timing alone.
  8. Score safeguards. Check public reporting, review dates, expansion terms, clawbacks, measurable targets, and community participation.
  9. Publish sensitivity cases. Show results with and without uncertain grid or water costs, different construction cycles, and alternative assumptions about what would have happened without the incentive.
  10. State a bounded conclusion. Say what is observed, what is modeled, who gains, who pays, and which unanswered item could change the decision.

Common comparison errors

  • Calling gross investment “revenue” or treating a multiplier estimate as a tax receipt.
  • Combining state savings with local infrastructure costs without identifying the government on each side.
  • Counting construction jobs as permanent employment without duration, wages, or hours.
  • Crediting all post-incentive growth to the incentive while ignoring the counterfactual.
  • Using a statewide figure to describe a county program or comparing different fiscal years.
  • Omitting tenants’ equipment, negotiated payments, or property-tax abatements from the tax-base calculation.
  • Assuming unmeasured electricity, water, transmission, or emergency costs are zero.
  • Ignoring statutory changes, take-up rates, sunset dates, and expansion eligibility.
  • Publishing a net-benefit total without the model’s boundary, multipliers, discounting, and treatment of future costs.

How to write the final finding

A defensible finding uses precise language: “The program reduced eligible buyers’ taxes by the reported amount during the stated fiscal years; observed property and utility receipts were this amount; job duration and incremental grid costs were not measured; and the evidence does not establish how much investment depended on the preference.” That format preserves useful benefits without disguising uncertainty.

For comparisons, present the same rows for every program and the same time horizon. A program with smaller tax relief may be more favorable if it has verified permanent jobs, developer-funded infrastructure, transparent water data, and enforceable remedies. Conversely, a large modeled fiscal gain can be overstated when it excludes future grid modernization or treats cyclical construction as recurring revenue.
