Short answer: A foreign SaaS or cloud subscription used by a GST-registered Indian business can be an import of services. When the supplier is outside India, the recipient is in India and the place of supply is in India, the recipient generally has to discharge IGST under reverse charge. After paying that liability, the business may claim input tax credit (ITC) only to the extent the service satisfies the normal business-use, taxable-supply, documentation, apportionment and blocked-credit rules. Paying the vendor in Indian rupees does not, by itself, remove the reverse-charge obligation.

Start with the legal test: is the subscription an import of services?

Do not decide the GST treatment from the product label alone. “SaaS”, “cloud”, “software licence” and “online platform” describe how a service is delivered, not whether a particular invoice is an import of services. Establish the facts for the actual contracting entity and the GST-registered establishment that receives and uses the service.

The three conditions that matter

The import-of-services analysis turns on three core questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Where is the supplier? The supplier named in the agreement, invoice or billing record must be outside India for this import analysis. A global product name is not enough; identify the legal entity that contracts with your business.
  2. Where is the recipient? The recipient must be in India. Use the GST-registered business and the establishment that receives the service, rather than assuming that a payment card, a parent company or an employee’s location determines the recipient.
  3. Where is the place of supply? The place of supply must be in India. If the applicable place-of-supply rule puts it outside India, the registered-business import treatment described here may not apply.

Cloud services are expressly included in the Integrated Goods and Services Tax Act’s definition of online information and database access or retrieval (OIDAR) services. That inclusion helps identify the nature of many cloud arrangements, but it does not replace a transaction-specific place-of-supply analysis.

Payment currency does not decide the result

CBIC’s FAQ addresses the question of foreign software bought for use in a GST-registered Indian firm when the supplier accepts payment in Indian rupees. Its answer is that reverse charge still applies when the import conditions are met. The FAQ states: “The factum of which currency was used to pay the consideration is immaterial.” Therefore, an INR invoice, an INR card charge or an Indian bank payment is not evidence that the supply is domestic.

Use the contracting entity, not the brand or interface

Many subscriptions show a product name on the login screen while the invoice names a different overseas company. Retain the agreement, order form, invoice and vendor tax details so you can establish which entity supplied the service. If an Indian affiliate, reseller or distributor is the actual contracting supplier, analyse that transaction separately rather than applying the foreign-supplier conclusion automatically.

Classify the service and verify the current rate before calculating tax

Reverse-charge liability depends on the service classification, the applicable notification and the tax period. The available official guidance does not support one universal GST rate for every SaaS, hosted software, infrastructure, platform or other cloud arrangement. Do not hard-code a rate merely because a similar subscription used one.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to verify for each invoice

  • The contractual description and actual functionality supplied.
  • The relevant service classification under the current GST rate notification.
  • Whether any exemption, special rule or amendment applies during the filing period.
  • The taxable value and currency-conversion method required for the transaction.
  • The place-of-supply rule applicable to the facts.

Document the classification and rate source used for the period. If the supplier bundles software access with implementation, support, advertising, data processing or professional services, determine whether the components have different treatments instead of assuming the entire invoice is one service.

Decision table: how common fact patterns differ

Supplier named on the contract Recipient and use Place of supply Likely treatment to investigate
Supplier outside India GST-registered Indian business uses the service for its business India Import of services; IGST under reverse charge may arise, followed by ITC only if eligible.
Supplier outside India Indian recipient, but the applicable place-of-supply rule places the supply outside India Outside India The import-of-services test described here is not satisfied; obtain advice on the correct treatment.
Supplier in India GST-registered Indian business Normally analysed as an Indian supply Do not apply the foreign-supplier reverse-charge conclusion without checking the actual arrangement.
Supplier outside India Unregistered individual or non-business recipient Facts and statutory category need separate review This registered-business RCM and ITC workflow should not be assumed to apply.
Supplier outside India Registered business uses the service partly for exempt supplies, non-business activity or other restricted purposes India RCM may still arise, but ITC must be restricted or apportioned under the eligibility rules.

Step-by-step: account for reverse charge and claim eligible ITC

1. Build a transaction file before posting the invoice

Capture the supplier’s legal name, country and contracting entity; the Indian GSTIN and establishment receiving the service; the subscription period; the invoice or billing record; the currency and consideration; and the business purpose. Note whether the account is shared across registrations or business units. These facts support both the import determination and the later ITC review.

2. Check the place of supply

Apply the current IGST Act place-of-supply rule to the actual service and recipient. Do not treat the vendor’s billing address, the location of a cloud server or the currency of payment as a substitute for that analysis. Record the conclusion and the facts supporting it. If the service is supplied to multiple establishments, determine which establishment receives it and how the use is allocated.

3. Confirm the reverse-charge entry and current rate

Use the applicable classification and rate notification for the filing period. Compute the IGST on the value determined under the applicable valuation rules. Keep the calculation showing the invoice value, exchange-rate basis where relevant, rate used and resulting liability. If the arrangement contains multiple supplies, preserve the allocation rather than applying one unsupported rate to the whole bill.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Discharge the reverse-charge liability

Report and pay the reverse-charge tax through the GST return and payment process applicable to the period. Reverse charge is the recipient’s liability; it is not converted into ordinary vendor-collected GST simply because the overseas supplier’s invoice displays a tax line or because an Indian payment intermediary was used.

5. Report the liability in GSTR-3B

The prescribed GSTR-3B includes table 3.1(d) for inward supplies liable to reverse charge. Enter the import-of-services liability in the appropriate field for the period and reconcile it to your calculation and payment records.

6. Report the corresponding ITC in the correct field

GSTR-3B separates import-of-services ITC in table 4(A)(2) from other inward reverse-charge ITC in table 4(A)(3). GST portal guidance states that reverse-charge liability is reported in table 3.1(d) and that credit for the covered reverse-charge supply may be taken under table 4(A)(3) on payment. Because return layouts and instructions can change, select the current field that matches the transaction and filing period, and retain the reasoning for that selection. Do not duplicate the same credit in both rows.

7. Test eligibility under section 16

Payment of IGST under reverse charge does not create an automatic full-credit entitlement. Section 16 requires the statutory conditions for ITC and business use to be satisfied. Check that the service is received for the business, that the tax has actually been paid under reverse charge, and that the return and record requirements applicable to the period are met.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. Apply section 17 restrictions and apportionment

Section 17 restricts credit attributable to non-business use or exempt supplies and blocks specified categories. If one subscription supports both taxable and exempt activities, or both business and personal activity, calculate the eligible portion using the applicable apportionment rules. Keep the method, allocation keys and supporting schedules with the return reconciliation.

9. Take the credit only after the required payment and checks

CBIC has stated that tax paid by the recipient under reverse charge can be credited, including in the same month, subject to the normal ITC conditions. “Same month” is not a waiver of those conditions: the liability must be correctly determined and paid, and the credit must survive the business-use, apportionment and blocked-credit tests.

How to decide whether the credit is fully, partly or not eligible

Use of the subscription RCM liability ITC approach Evidence to retain
Exclusively supports taxable business operations Check and discharge when the import conditions are met. Potentially the full eligible tax, subject to section 16 conditions and blocked-credit rules. Department or project assignment, user list, workflow records and business-purpose note.
Shared between taxable and exempt supplies Usually determined from the import facts for the whole service. Apportion and restrict the exempt-attributable portion under section 17. Revenue or activity allocation and the calculation used.
Shared between business and non-business activity Import analysis still depends on supplier, recipient and place of supply. Restrict the non-business portion; claim only the eligible business share. User or cost-centre allocation and approval records.
Falls within a specified blocked-credit category Reverse charge may still be payable if the import test is met. Do not claim the blocked portion. Category analysis and the statutory provision relied upon.
Recipient is not GST-registered Do not assume the registered-business workflow applies. No ITC claim under this article’s process. Recipient-status evidence and separate advice on any OIDAR rule.

Records that make the claim defensible

The law and official guidance require you to substantiate the transaction facts and statutory eligibility. Maintain an audit trail that lets another reviewer reproduce the conclusion:

  • Master service agreement, order form, renewal notice and terms of service.
  • Invoice, receipt, billing statement or other vendor record showing the supplier and service period.
  • Evidence of the supplier’s legal entity and location, including tax or registration details where available.
  • Your GST registration details and the Indian establishment receiving the service.
  • Payment and exchange records, including the currency actually used and the conversion basis applied.
  • Written place-of-supply and service-classification analysis.
  • Rate notification or other current authority used for the tax-period calculation.
  • Reverse-charge computation, return workings and proof that the liability was paid.
  • Business-purpose evidence, user or cost-centre allocation and any taxable/exempt apportionment schedule.
  • GSTR-3B reconciliation showing the amount in table 3.1(d) and the corresponding ITC field.

This is a practical audit file, not a claim that every item is a separately prescribed document for every transaction. Retention periods and format requirements should follow the current GST rules and your record-retention policy.

Common mistakes and how to correct them

“The card was charged in rupees, so no reverse charge is due.”

Currency is not the deciding test. Revisit the supplier entity, recipient and place of supply. CBIC’s FAQ expressly treats the currency as immaterial in the foreign-software example.

“The vendor is a familiar global brand, so the Indian affiliate must be the supplier.”

Check the legal name on the contract and invoice. A product’s marketing identity does not establish the contracting entity. If an Indian entity actually supplies the service, analyse that supply on its own facts.

“Every cloud invoice qualifies for full ITC.”

Cloud services can fall within OIDAR, but classification does not override section 16 or section 17. Review business use, taxable versus exempt activity, non-business use and blocked categories before claiming the amount.

“I can report the tax but ignore the ITC field distinction.”

GSTR-3B distinguishes import-of-services ITC from other inward reverse-charge ITC. Map the transaction to the current return instructions and avoid entering the same amount twice.

“The return will show the credit automatically.”

“One rate works for all subscriptions.”

Rates depend on classification and the period. Recheck the notification whenever the product, contract, billing model or tax period changes.

“A shared account is entirely business or entirely personal.”

Where users or activities are mixed, create a reasonable allocation and retain the supporting data. Claim only the eligible portion and update the allocation when usage changes.

Illustrative calculation framework without assuming a GST rate

Suppose an overseas supplier invoices an Indian registered company for a subscription used by both taxable and exempt operations. Let V be the taxable value after applying the relevant valuation and exchange-rate rules, and let r be the current notified IGST rate for the service classification. The reverse-charge liability is calculated as V × r. If the documented eligible business-and-taxable-use proportion is e, the maximum credit before any other restriction is (V × r) × e. This is a method illustration, not a suggested rate or a conclusion that every invoice has the same value, classification or eligibility.

What changes when the recipient is not registered?

This article’s workflow is designed for a GST-registered Indian business. If the recipient is an individual, an unregistered entity or a non-business consumer, do not copy the registered-business RCM and ITC conclusion. OIDAR supplies to non-taxable online recipients have separate statutory rules, and the recipient’s status, location and use must be checked independently. There is no ITC claim through a GST registration that the recipient does not hold.

Period-end checklist

  1. Match every foreign subscription to the legal supplier named in the contract and invoice.
  2. Confirm the recipient GSTIN, establishment and business purpose.
  3. Document the place-of-supply conclusion and whether the service is an OIDAR or another service category.
  4. Verify the current classification, rate, exemption and any period-specific amendment.
  5. Prepare the value and exchange-rate calculation.
  6. Record the reverse-charge liability in GSTR-3B table 3.1(d) and discharge it through the applicable process.
  7. Determine the correct ITC row, distinguishing import of services from other inward reverse-charge supplies.
  8. Apply section 16 conditions, section 17 restrictions and any required apportionment.
  9. Reconcile the tax paid, ITC claimed and remaining restricted amount to the ledger.
  10. Archive the contract, invoice, payment proof, calculations, allocation schedules and return evidence.

When to obtain transaction-specific advice

Escalate the transaction before filing when the supplier uses several contracting entities, the invoice bundles materially different services, multiple Indian registrations share one account, the place of supply is disputed, the subscription supports exempt and taxable operations, or the classification and rate are unclear. Also recheck the treatment after a contract renewal, supplier migration, change in user location or amendment to the return form. A general workflow cannot resolve facts that are absent from the invoice or agreement.
