In most cases, you cannot claim GST input tax credit (ITC) on the cost of constructing a commercial building on your own account. Section 17(5) of India’s Central Goods and Services Tax (CGST) Act blocks credit for construction of immovable property, even when the property is used in business or rented to customers. The main statutory exceptions are qualifying plant and machinery and works-contract services used for further supply of works-contract services.

Commercial renting, taxable business use, and correct invoice reporting may satisfy other GST conditions, but they do not by themselves remove the construction-credit restriction. The result must be tested cost by cost, based on who procured the work, what asset was created, how it is used, and whether the statutory documentation and time limits are met.

What the GST construction-credit rule actually blocks

Section 17(5)(c) blocks ITC for works-contract services supplied for construction of immovable property, except where the service is an input service for the further supply of works-contract service. Section 17(5)(d) separately blocks goods or services received by a taxable person for construction of immovable property on the taxpayer’s own account, other than plant and machinery. The own-account rule applies even when the construction is undertaken in the course or furtherance of business.

For this purpose, “construction” is broader than new construction. The statutory explanation includes reconstruction, renovation, additions, alterations and repairs to the extent the expenditure is capitalised to the immovable property. A project therefore cannot be made eligible simply by describing an invoice as renovation, fit-out or repair if the cost is capitalised into the building or civil structure.

The first question is not whether the property is commercial. It is whether the particular inward supply falls within one of these blocked categories.

Commercial building, rented property and plant: the distinctions that decide eligibility

Own-account construction by the owner or occupier

If a company, partnership or other registered person buys materials and services, appoints contractors and creates a building for its own ownership or use, section 17(5)(d) generally blocks the related ITC. The business may operate offices, shops, warehouses, factories or rental premises from the property; business use alone does not overcome the block.

Works-contract service used for onward works-contract supply

A works contractor may receive a works-contract service as an input while supplying a further works-contract service to its customer. Section 17(5)(c) contains a narrow exception for that onward supply. This is different from a property owner receiving construction services for its own building. The recipient must examine whether the input service is genuinely used for further supply of works-contract service, rather than merely supporting the recipient’s own immovable property.

Plant and machinery

The construction restriction does not apply to qualifying plant and machinery. The statutory definition covers apparatus, equipment and machinery fixed to earth by foundation or structural support and used for making outward supplies. It includes the foundations and structural supports of that apparatus, equipment or machinery.

The definition expressly excludes land, buildings and other civil structures. It also excludes telecommunication towers and pipelines laid outside factory premises. A machine being bolted to a floor, or a system being essential to a building’s operation, does not automatically make it plant and machinery. The asset’s engineering function, attachment, purpose and relationship to outward supplies must be documented.

Taxable renting and construction eligibility

Schedule II treats renting of immovable property—including commercial, industrial and residential complexes let for business or commerce—as a supply of services. That classification concerns the outward transaction. It does not override section 17(5)’s separate restriction on construction inputs.

Similarly, the GST treatment of construction intended for sale does not create a general right to claim building-construction ITC. Schedule II treats specified construction of a building intended for sale as a supply of services, except where the entire consideration is received after the completion certificate or first occupation, whichever is earlier. The timing and nature of the outward supply must therefore be analysed separately from the blocked-input rule.

Building and civil structure versus plant and machinery

Use an asset-level schedule rather than a single conclusion for the entire project. The following comparison shows the statutory starting point:

Project item or arrangement How the CGST framework treats it What must be verified
Building, office block, shop, warehouse or other civil structure constructed on the taxpayer’s own account ITC generally blocked under section 17(5)(d) Who procured and owns the construction, whether the cost is capitalised, and whether the item is truly separate plant and machinery
Works-contract service received by a property owner for its own building ITC generally blocked under section 17(5)(c) and/or 17(5)(d) Whether the recipient is making an onward supply of works-contract service or merely creating its own immovable property
Works-contract input service used for further supply of works-contract service Potentially eligible under the statutory exception The recipient’s output contract, the nature of the input service and the direct onward-supply link
Equipment or machinery fixed to earth and used for outward supplies Potentially eligible as plant and machinery Technical specifications, foundation or structural support, business function and proof that it is not a building or civil structure
Land, building or other civil structure Excluded from plant and machinery Do not rely on commercial use to reclassify the asset
Telecommunication tower or pipeline outside factory premises Excluded from the statutory plant-and-machinery definition Location and asset type

Items such as lifts, HVAC systems, electrical installations, fire-safety systems, refrigeration equipment and specialised production systems should not be treated as automatically eligible or automatically blocked. Separate the equipment from the surrounding building work and obtain technical evidence showing what performs the outward-supply function, how it is attached, and whether the expenditure creates or improves a civil structure. The statute, not the label on the purchase order, controls.

How to assess a construction-cost ITC claim step by step

1. Identify the claimant and the exact inward supply

  1. Confirm that the claimant is registered under GST in the state or Union Territory concerned.
  2. For every invoice, identify the recipient named on the tax document, the contracting party, and the person that received the goods or services.
  3. Record whether the claimant is the property owner, developer, tenant, occupier, or works contractor.
  4. Describe the supply precisely: cement or other goods, architectural or engineering service, labour contract, composite works contract, equipment, installation, repair, or another service.

Ownership and procurement matter because the own-account rule applies to goods or services received by the taxable person for construction of its immovable property. A group company, landlord, tenant or project company cannot assume that another entity’s contract determines its own eligibility.

2. Classify the cost before calculating any credit

  1. Separate building and civil-structure costs from machinery, equipment and systems.
  2. Determine whether the contract meets the statutory concept of a works contract involving construction or related work on immovable property.
  3. For each possible plant-and-machinery item, document the asset’s function, foundation or structural support, connection to outward supplies and treatment in the fixed-asset register.
  4. Check whether the cost is capitalised to the immovable property. Capitalised renovation, additions, alterations and repairs remain within the construction analysis.
  5. For a contractor, establish whether the received works-contract service is used for further supply of works-contract service.

Do not calculate a percentage of the total project invoice before this classification. A single contractor invoice can contain both blocked building work and separately identifiable equipment or services requiring different treatment.

3. Test the business-use and output-supply conditions

Section 16 generally requires that goods or services be used or intended to be used in the course or furtherance of business. That condition is necessary for otherwise eligible inputs, but it does not make a section 17(5) blocked item eligible.

Next identify the related outward use. Is the property self-occupied, commercially rented, used to make taxable supplies, used for zero-rated supplies, used for exempt supplies, or used partly for more than one category? Renting may be a taxable supply of services, but the rental purpose does not by itself reverse the construction block.

4. Reconcile invoices and portal data

Section 16 generally requires a tax invoice, debit note or other prescribed document; communication of supplier-furnished invoice details to the recipient; receipt of the goods or services; and filing of the applicable return. Rule 36 sets out the documentary basis for claiming credit, while the GST system provides the monthly GSTR-2B statement of ITC details.

  1. Match the supplier’s GSTIN, invoice number, invoice date, taxable value and tax amount to your purchase register.
  2. Check that the invoice appears in the relevant GSTR-2B period or investigate why it is absent or incorrect.
  3. Obtain corrected reporting or a credit/debit note where supplier data is wrong.
  4. Keep the contract, work-completion evidence, goods-receipt records and asset classification with the invoice.

Portal visibility is evidence of supplier reporting; it is not a waiver of section 17(5). A correctly reported invoice for blocked building construction remains blocked.

5. Check payment and depreciation restrictions

If the recipient does not pay the supplier the value of the supply plus tax within 180 days from the invoice date, the Act requires reversal of the credit with applicable interest, subject to the statutory treatment for reverse-charge supplies. The credit may be re-availed after payment. Maintain payment dates and ledger evidence rather than relying on an assumption that the project is still commercially active.

Do not claim ITC on a tax component where depreciation has been claimed under the Income-tax Act. Coordinate the GST credit schedule with the income-tax fixed-asset register and depreciation workings.

6. Apply the time limit and claim through the return

The general section 16(4) deadline is 30 November following the end of the financial year to which the invoice or debit note relates, or the filing of the relevant annual return, whichever is earlier. This is a legal filing deadline, not a recommendation to delay review until November.

  1. Assign each invoice to its financial year.
  2. Track the applicable 30 November date and the annual-return filing date.
  3. Claim only the amount that survives the section 17(5), documentation, payment, depreciation and business-use tests.
  4. Retain the working papers supporting the return entry and any later audit response.

7. Apportion eligible credit for mixed use

Sections 17(1) and 17(2) restrict credit to the attributable portion where otherwise eligible inputs are used partly for business and partly for other purposes, or partly for taxable or zero-rated supplies and partly for exempt supplies. Perform this apportionment only after removing items that section 17(5) blocks altogether. Apportionment cannot convert an ineligible building-construction cost into eligible ITC.

How common project structures compare

Project structure Primary GST question Likely analysis
Company constructs and owns its headquarters Is the building received for the company’s own account? Building and civil-structure construction is generally blocked, even if all operations are taxable.
Owner constructs a shopping or office complex and rents units Does taxable commercial rent permit construction ITC? Renting classification does not remove the separate section 17(5) construction restriction.
Works contractor hires another contractor for part of a customer project Is the received service used for further supply of works-contract service? The statutory onward-supply exception may apply if the contractual and factual link is established.
Factory installs a production machine on a foundation Is the asset qualifying plant and machinery rather than a civil structure? Analyse the machine, support and outward-supply function separately; the foundation or support may be included when it belongs to qualifying plant and machinery.
Property is used for taxable and exempt activities What portion of otherwise eligible ITC is attributable to taxable use? Apply section 17 apportionment after excluding blocked construction items.
Developer receives consideration after completion certificate or first occupation How is the outward transaction classified? Schedule II timing rules may affect whether the construction is a supply of services, but they do not create a blanket construction-input credit.

Frequent mistakes and how to correct them

“The property earns taxable rent, so all construction GST is creditable.”

Taxable rent and construction-input eligibility are different questions. Reclassify the project under section 17(5), then test only separately identifiable qualifying plant and machinery or an applicable onward works-contract exception.

“The contractor charged GST, so the recipient can claim it.”

GST on an invoice does not override a statutory blocked-credit rule. Review the nature of the service, the recipient’s role and the asset created before recording ITC.

“Everything fixed to the building is plant and machinery.”

The definition excludes buildings and other civil structures. Prepare an engineering-based asset schedule rather than relying on physical attachment alone.

“GSTR-2B shows the invoice, so the credit is safe.”

GSTR-2B supports the supplier-reporting condition but does not decide classification, own-account construction, payment, depreciation or mixed-use restrictions.

“The project is still under construction, so the deadline does not matter.”

The section 16(4) period is linked to the invoice or debit-note financial year and the annual return. Track invoices as they arrive, even when the property will be completed later.

“A capitalised repair is not construction.”

The statutory explanation includes repairs, renovations, additions and alterations to the extent capitalised to the immovable property. Review the accounting treatment and the substance of the work together.

A practical decision path

  1. Start with the recipient. Confirm who contracted for and received the supply.
  2. Identify the asset. Mark each cost as building or civil structure, qualifying plant and machinery candidate, or another input.
  3. Test the works-contract route. If it is a works-contract service, ask whether it supports the recipient’s further supply of works-contract service.
  4. Remove blocked items. Exclude own-account construction and other section 17(5) items before any apportionment.
  5. Verify section 16. Check document, supplier reporting, receipt, return and business-use conditions.
  6. Check payment and depreciation. Record the 180-day position and ensure no income-tax depreciation is claimed on the same tax component.
  7. Apportion where required. Allocate any remaining eligible credit between taxable or zero-rated, exempt and non-business use.
  8. File within time. Claim through the return before the applicable section 16(4) deadline and retain the complete audit trail.

When a project-specific opinion is necessary

The central CGST framework cannot resolve a claim without project facts. Obtain a detailed review when contracts combine civil work and equipment, several group entities share procurement, a tenant funds improvements, the property is partly exempt-use, or the project involves sale before or after completion or first occupation.

Have the adviser examine the current CGST Act, rules, notifications and commencement dates applicable to the relevant state or Union Territory, together with the contracts, invoices, technical records, accounting entries and return history. A GST accounting or return-preparation system can help reconcile invoices, GSTR-2B and filings, but software cannot make a credit blocked by section 17(5) eligible.
