Choose the tool for the job, the people who will rely on it, and the harm a wrong answer could cause—not for the words “healthcare-specific” on a product page. For a clinical function, require evidence for the exact task and population, understand the U.S. regulatory position, build human review into the workflow, and verify how patient data is handled. A general-purpose model may be reasonable for lower-risk administrative drafting when your organization’s privacy, security, and governance controls permit it.

Neither category is automatically safer, more accurate, HIPAA-compliant, or clinically valid. The product’s documented intended use, evidence, data flow, oversight, integrations, update process, and contract determine whether it belongs in your workflow.

Start with the task, not the label

“Healthcare AI” describes a market category, not a guarantee. A specialized product might support image analysis, clinical documentation, triage, patient education, scheduling, or revenue-cycle work. A general-purpose model might summarize a meeting, draft an appointment reminder, translate nonclinical material, or help an administrator rewrite a policy. Those uses have different risks and requirements.

Write the intended use in one sentence before comparing vendors. Include the user, input, output, setting, and consequence of error. For example: “A licensed clinician uses the system to prioritize chest X-rays for review in an emergency department.” That is materially different from “Staff use an AI assistant to turn an already-approved visit summary into a plain-language handout.”

FDA’s approach is function-based. Its official statement is: “The FDA does not regulate AI as such; it regulates medical devices, including AI-enabled medical devices.” The relevant questions are what the software does, who is intended to use it, and how its technological characteristics affect risk.

Classify the work by consequence

  • Clinical decision or diagnosis: The output can influence diagnosis, treatment, triage, medication, monitoring, or referral. Demand task-specific clinical evidence, a documented intended use, qualified oversight, and a clear escalation process.
  • Patient-facing health function: The output goes directly to patients or caregivers, such as symptom guidance, instructions, or a portal chatbot. Review the intended audience, safety boundaries, escalation to a human, and how uncertainty is communicated.
  • Administrative support: The system drafts, classifies, summarizes, schedules, or routes information without independently making a clinical decision. Risk may be lower, but privacy, accuracy, accessibility, and workflow controls still matter.
  • General productivity: The tool handles content that contains no identifiable health information and has no clinical consequence. Organizational policy may allow a general-purpose service, subject to security and confidentiality rules.

If one product performs several functions, assess each function separately. A vendor’s clinical module may have a different intended use, evidence package, regulatory status, data flow, and contract from its note-writing feature.

Healthcare-specific and general-purpose AI: what the categories mean

Healthcare-specific tools

A healthcare-specific tool is designed, configured, or marketed for healthcare workflows. It may use medical terminology, connect to an electronic health record, provide specialty templates, or include controls for clinical review. Those characteristics can improve workflow fit, but they do not establish accuracy, authorization, or compliance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask the vendor to identify the exact product name, version, module, intended user, intended use, and supported population. “Built for healthcare” is too broad to evaluate. Request evidence tied to the task you plan to perform rather than a demonstration of a different feature.

General-purpose tools

General-purpose models are built to generate or transform many kinds of content. The World Health Organization’s March 25, 2025 guidance describes large multimodal models (LMMs) as “general-purpose foundation models,” while cautioning that “it is not yet proven whether LMMs can accomplish a wide range of tasks and purposes.” Broad capability should therefore not be treated as proof of reliable clinical performance.

A general-purpose service can be a candidate for low-risk drafting or analysis when your organization can prevent inappropriate data disclosure and keep a person accountable for the final work. It should not be given clinical authority merely because it produces fluent medical language.

Build a decision table for each candidate

Use the same questions for every product and version. Record the vendor’s answer, the evidence supplied, the owner who approved it, and the date checked.

Decision axis Questions to ask What a satisfactory answer includes
Task and intended user What exact function does the product claim to perform? Is it for clinicians, patients, administrators, or another user? A precise use statement, named user group, setting, population, inputs, outputs, and boundaries.
Evidence and scope What evaluation supports this exact use, population, setting, and workflow? What failure modes are known? Methods, sample or validation context, performance limits, exclusions, and a way to review representative outputs.
Regulatory context Does the function meet a device definition or fit a relevant non-device policy? What U.S. authorization or clearance, if any, applies to this function? A product- and version-specific explanation. Do not infer status from a brand, category, or marketing phrase.
Human oversight Who checks the output, what can they inspect, and what happens when it is uncertain or wrong? A named accountable role, review points before action, access to source information, override controls, and escalation.
Data handling Does the service create, receive, maintain, or transmit identifiable health data? What are retention, permitted-use, security, deletion, and subcontractor terms? A documented data flow, contract terms, access controls, retention limits, incident process, and return or deletion procedure.
Integration and operations Does it fit local systems and workflow? How are updates, downtime, incidents, and performance changes handled? Interface details, identity management, audit logs, support commitments, downtime procedures, change notices, and rollback options.
Total cost and support What are licensing, implementation, training, integration, support, and contract costs? A written quote and service commitments for your organization; official sources do not establish current cross-product price comparisons.

Match evidence to the exact clinical use

Evidence is useful only when it matches the decision you will make. A study in one hospital, specialty, age group, or imaging device may not establish performance in your setting. Ask whether the evaluation used the same type of input, the same users, the same workflow, and the same threshold for action.

Questions for the evidence package

  • What outcome was measured: diagnostic accuracy, prioritization, documentation quality, time saved, or another endpoint?
  • Was the evaluation retrospective, prospective, simulated, or conducted during routine care?
  • Which patients, sites, devices, languages, and clinical conditions were included or excluded?
  • How were missing data, unusual cases, and incorrect outputs handled?
  • What are the documented failure modes, confidence limits, and known areas of weak performance?
  • Can your team inspect examples and test the system on a controlled, representative set before live use?

FDA describes lifecycle considerations from development and validation through deployment, monitoring, maintenance, and modification. Treat validation as an ongoing responsibility rather than a one-time vendor claim. A model that performed acceptably at launch can behave differently after a model, prompt, interface, data source, or workflow change.

Understand the U.S. regulatory position

FDA’s final Clinical Decision Support Software Guidance, dated January 2026, explains that some clinical decision support functions may meet statutory criteria for exclusion from the device definition. Functions that meet the device definition remain subject to applicable digital-health policies, including when the intended user is a patient or caregiver. This is U.S. context; other jurisdictions use different laws and classifications.

Ask the vendor to identify the regulatory basis for the specific function and version you will deploy. Request the relevant authorization, clearance, exemption rationale, or other documented status rather than accepting “FDA-approved AI” as a category claim. A company can offer several modules with different regulatory positions.

FDA reported more than 1,600 AI-enabled medical devices authorized for U.S. marketing as of September 2026 and says its searchable inventory is updated periodically. The count describes the inventory at that date; it does not mean every listed device is suitable for your task or that all healthcare AI products are devices.

FDA’s “Considerations for the Regulation of Generative AI-Enabled Medical Devices” discussion paper sought comments by October 19, 2026. FDA characterizes that paper as discussion only—not draft or final guidance—and it does not communicate binding regulatory expectations. Do not present its topics as new requirements.

Trace patient data from entry to deletion

Privacy decisions depend on the actual data flow and the vendor’s role. Draw a simple map showing where data originates, what fields are sent, which subcontractors receive it, where it is stored, how long it remains, who can access it, and how it is returned or deleted.

When HIPAA may apply

HHS guidance says a cloud service provider that stores or processes electronic protected health information (ePHI) on behalf of a covered entity or business associate generally needs a HIPAA-compliant business associate agreement (BAA). The regulated organization must understand the particular service and conduct its own risk analysis; signing a BAA does not transfer that responsibility.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Merely selling or supplying software without access to PHI does not by itself create a business-associate relationship. If a vendor needs PHI access to provide the service, the analysis changes. HHS gives a third-party AI chatbot on a provider portal that handles PHI as an example of a vendor that can be a business associate.

Check whether the proposed workflow sends identifiable information at all. De-identification, limited data sets, role-based access, encryption, audit logging, retention controls, and contractual restrictions can reduce exposure, but your privacy and security teams must determine whether the controls satisfy your obligations. HHS OCR states: “OCR does not endorse, certify, or recommend specific technology or products.” A BAA or security badge is not a blanket approval.

Contract terms to verify

  • Whether prompts, files, outputs, or metadata are used to train or improve a service.
  • Retention periods, backup retention, deletion timing, and proof of deletion.
  • Subprocessors, storage locations, cross-border transfers, and breach notification.
  • Administrative access, logging, identity controls, and customer audit rights.
  • Ownership and permitted reuse of inputs, outputs, and derived data.
  • What happens to records when the contract ends or the service is unavailable.

Design human oversight before deployment

Human review is a control, not a slogan. Define who reviews an output, when review occurs, what source information is visible, what level of disagreement requires escalation, and who can stop the system.

For clinical functions

  1. Show the output alongside the source record, image, or measurement on which it is based.
  2. Require a qualified clinician to verify the result before diagnosis, treatment, triage, or patient communication.
  3. Make uncertainty, missing inputs, and known limitations visible rather than hiding them behind a single score.
  4. Record the reviewer, final decision, override, and reason when the system is not followed.
  5. Provide a rapid route to a supervisor or specialist for unsafe, ambiguous, or unexpected results.

For patient-facing functions

State clearly that the system is automated, limit the topics it can answer, and provide an immediate path to a clinician or emergency service when symptoms may be urgent. Test the handoff, not just the conversation. A polished answer that delays care is a workflow failure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For administrative drafting

Require staff to check names, dates, numbers, recipients, and policy references before sending. Keep the model away from automatic decisions about eligibility, treatment, or access unless those functions have separately passed governance review.

Check workflow fit and operational resilience

A technically capable model can still fail if it adds duplicate entry, interrupts care, or makes responsibility unclear. Observe the real workflow with representative users before rollout.

Integration checklist

  • Does the tool use your identity provider and role permissions?
  • Can users see which source data produced an output?
  • Are corrections written back safely, or must staff copy and paste?
  • Are audit logs available for prompts, outputs, edits, and approvals?
  • What is the response when the electronic health record, network, or vendor service is down?
  • Can administrators disable a feature without taking unrelated systems offline?
  • How much training is required for each user group?

Useful monitoring signals

  • Agreement with qualified reviewers on the intended outcome.
  • False positives, false negatives, unsafe omissions, and escalation rates.
  • Performance by site, language, age group, sex, device, and other relevant populations.
  • Override frequency and the reasons reviewers reject outputs.
  • Changes in input quality, workflow timing, or data distribution.
  • Latency, outages, failed integrations, and incomplete records.
  • User and patient complaints, near misses, and confirmed incidents.

Set thresholds that trigger investigation, temporary suspension, retraining, configuration changes, or vendor escalation. Revalidate after material changes to the model, data source, interface, intended users, or clinical workflow. Keep a versioned record of what was evaluated and what was actually deployed.

A practical selection process

  1. Write the use case. Name the task, users, setting, population, inputs, output, and consequence of error.
  2. Separate functions. Split clinical, patient-facing, administrative, and general productivity uses even when one platform offers all of them.
  3. Shortlist by evidence. Remove candidates that cannot document the intended use, evaluation scope, limitations, and product version.
  4. Review regulation and privacy. Confirm the U.S. regulatory position for the function, map data flows, determine whether a BAA is required, and complete your organization’s risk analysis.
  5. Test with representative work. Use a controlled dataset or supervised pilot that reflects your users, population, language, devices, and workflow.
  6. Define oversight. Assign accountable reviewers, escalation routes, audit requirements, downtime procedures, and stop criteria.
  7. Negotiate operations. Set update notices, incident response, support, retention, deletion, subprocessors, access, and exit terms in writing.
  8. Approve and monitor. Record the decision, launch gradually, measure the agreed signals, and revisit the approval after changes.

Examples of sound choices

Drafting a nonclinical staff memo

A general-purpose tool may be suitable when the memo contains no ePHI, the organization permits the service, and a staff member checks facts, recipients, and tone. Do not paste identifiable patient details merely because the final memo is administrative.

Summarizing a patient encounter

This is more than generic writing when the input contains ePHI and the output may become part of a medical record. Verify the vendor’s role, BAA requirements, retention and training terms, source visibility, clinician review, and correction process. A healthcare-specific interface may fit better, but its label does not replace those checks.

Prioritizing diagnostic images

Treat the function as clinical decision support. Require evidence for the relevant modality and population, the applicable FDA status or rationale, review before action, performance monitoring, and a safe fallback when the system is unavailable or uncertain.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Answering patient portal questions

Assess it as a patient-facing health function. Limit scope, test urgent and ambiguous scenarios, show escalation instructions, protect PHI, log interactions, and require a human path for questions the system cannot safely answer.

Common procurement mistakes and fixes

Mistake: choosing the most fluent demo

Fix: Score representative tasks, factual errors, omissions, uncertainty handling, and reviewer workload. Fluency is not clinical validation.

Mistake: treating a healthcare label as proof

Fix: Verify intended use, evidence, regulatory context, HIPAA role, contract, and monitoring separately.

Mistake: assuming a BAA solves privacy

Fix: Map the service, conduct your own risk analysis, restrict access, and confirm retention, subprocessors, security, and deletion terms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Mistake: approving an entire platform at once

Fix: Approve each function and version. A low-risk drafting feature does not automatically authorize a clinical module.

Mistake: ignoring updates

Fix: Require change notices, regression testing, version records, and a rollback or suspension procedure.

Mistake: automating the handoff

Fix: Keep a named human accountable for the final decision, with source visibility and an escalation route.

Bottom line for the buyer

Select a healthcare-specific tool when its documented clinical or operational function, evidence, regulatory context, data controls, workflow integration, and lifecycle support fit your use case better than the alternatives. Select a general-purpose tool only for tasks whose risk your organization can control, with explicit restrictions on health data and human review where appropriate. The defensible choice is the product-and-deployment combination that can demonstrate fitness for the exact job—not whichever category sounds more specialized.
