The safest choice is not the tool with the longest compliance page. It is the tool whose data practices, security controls, model behavior, contract, and operating procedures match your specific use case, legal obligations, and risk tolerance. Start by documenting what the AI will do and who could be affected; map the laws and policies that apply; require service-specific evidence; test the configured system with representative tasks; and approve it only with documented controls, owners, and monitoring.

Why compliance starts with the use case, not the vendor

“Compliant AI” is not a universal product category. The same model can present very different obligations when used as an internal drafting assistant, a hiring screener, a credit-decision input, a clinical support tool, or a customer-facing chatbot. The data, people affected, degree of automation, jurisdiction, sector rules, and consequences of an error determine the review required.

A security certification, SOC report, privacy statement, or AI label can provide useful evidence, but none of them automatically proves that a particular deployment satisfies every law or internal policy. The organization remains responsible for deciding whether the proposed use is lawful and appropriately controlled.

The NIST AI Risk Management Framework (AI RMF) is a useful voluntary structure for organizing that work. NIST released AI RMF 1.0 on January 26, 2023 and describes it as intended for voluntary use. It supports risk management across design, development, deployment, use, and evaluation; it does not make a legal-compliance determination.

1. Create a use-case record before reviewing products

Write one record for each materially different AI use. A broad statement such as “we want generative AI for productivity” is too vague to support procurement or a defensible risk decision.

Record the business purpose and users

  • State the task and the outcome the organization expects.
  • Identify employees, contractors, customers, applicants, patients, students, or members of the public who will use or be affected by the system.
  • Describe whether the AI drafts, recommends, ranks, predicts, classifies, takes action, or makes a decision without human approval.
  • List the business owner, technical owner, privacy owner, security owner, and final approver.

Describe inputs, outputs, and connected systems

  • List every input category: prompts, uploaded files, images, audio, source code, identifiers, financial records, health information, employment data, confidential business information, and telemetry.
  • Describe the expected outputs and where they will be stored, displayed, or sent.
  • Document integrations with identity systems, email, customer databases, document stores, ticketing systems, payment systems, or production infrastructure.
  • State whether the tool can act autonomously or only provide information for a human to review.

Describe the consequences of failure

Record what could happen if the system is wrong, biased, unavailable, manipulated, or discloses information. A mistaken internal summary and an erroneous employment recommendation do not have the same impact. Note foreseeable physical, financial, legal, employment, privacy, safety, discrimination, reputational, and operational harms.

Define human oversight

Specify who reviews outputs, what they must check, when they may override the system, and whether the reviewer has enough time, expertise, and information to detect an error. “Human in the loop” is not a control if the reviewer merely accepts every output or cannot reconstruct how a recommendation was produced.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Map the requirements that actually bind your organization

After documenting the use, involve qualified legal, privacy, security, procurement, records, accessibility, and sector specialists. Map requirements by geography, affected people, data, industry, contractual commitments, and organizational role. The relevant role may be provider, deployer, controller, processor, employer, public body, or another designation under a specific law.

Separate voluntary guidance from binding law

NIST’s AI RMF and its companion Playbook organize work under Govern, Map, Measure, and Manage. They are voluntary guidance, not a substitute for statutes, regulations, regulator guidance, court orders, or contractual duties. Use the framework to make the review systematic, then map each requirement to the law or policy that creates it.

Check privacy roles and contracts under GDPR where applicable

If a provider processes personal data on your behalf under the GDPR, examine the processor arrangement required by Article 28. The contract should address documented instructions, confidentiality, security, subprocessors, assistance with data-subject rights, support for breach and impact-assessment duties, audits, and return or deletion at the end of service. Article 32 requires security measures appropriate to processing risk.

Also test purpose limitation, data minimization, and storage limitation against the proposed configuration. A provider’s statement that it does not train on customer content does not answer whether it collects prompts for abuse monitoring, retains logs, transfers data internationally, or exposes information to subprocessors.

Check the EU AI Act by system, role, and date

The European Commission’s current information, checked October 13, 2026, states that general-purpose AI provider rules became effective in August 2025. It also states that the AI Office and Member State authorities have implementation, supervision, and enforcement responsibilities from August 2, 2026, and that the AI Omnibus entered into force on July 27, 2026. Confirm the current consolidated legal text and guidance before relying on a deadline or classification in a procurement decision.

Article 50 transparency obligations apply from August 2, 2026. Commission guidance describes provider duties for direct interaction with AI and machine-readable marking, plus deployer disclosure scenarios involving emotion recognition or biometric categorization, deepfakes, and specified public-interest text published without human review or editorial control. Whether a duty applies depends on the system, activity, exceptions, and the organization’s role. A vendor’s general statement about the Act does not resolve the deployer’s own obligations.

3. Turn obligations into a pass/fail requirements matrix

Write an acceptance test for every requirement. “Strong security” is not testable; “single sign-on, role-based access, administrator audit logs retained for 12 months, and documented incident notification” is.

Requirement area Questions to answer Example acceptance test
Data use What prompts, files, outputs, feedback, and telemetry are collected? Is content used for model training or product improvement? What are retention, deletion, location, transfer, and subprocessor practices? Contract and configuration prohibit training on organizational content; retention is set to the approved period; deletion is verified through a documented process.
Security and access How are users authenticated and authorized? Are tenants separated? What encryption, logging, vulnerability management, incident response, resilience, and recovery controls apply? Only approved identity groups can access the workspace; privileged actions are logged; controls and recovery objectives match the data sensitivity and impact.
Privacy and rights Who is controller or processor? What is the lawful purpose? Can the organization support access, correction, deletion, objection, and other applicable rights? The processor agreement contains required terms, and the organization can locate, export, restrict, and delete relevant data within its stated response process.
AI behavior and governance What are the intended-use limits, known limitations, reliability, harmful-bias risks, explainability needs, transparency duties, human-oversight controls, and change-management rules? Representative evaluation meets the task threshold; prohibited uses are technically or procedurally blocked; reviewers receive limitations and escalation instructions.
Third-party and supply chain Which models, software libraries, data sources, hosting providers, and subprocessors are involved? What provenance, resilience, and cyber practices apply? The supplier provides an up-to-date dependency or software bill of materials where appropriate, identifies material subprocessors, and discloses change and incident procedures.
Contract and exit What service levels, evidence rights, notification duties, data-use restrictions, material-change notices, portability, deletion, return, and transition support are promised? The agreement allocates responsibilities, permits proportionate assurance, requires cooperation after incidents, and provides a tested exit path.
Operational fit Can staff use the system safely and accessibly? Is support available? Can the organization monitor usage, quality, incidents, and policy violations? Named owners have dashboards or reports, users complete training, accessibility requirements are met, and an incident route is exercised before production.

NIST identifies validity and reliability, safety, security and resilience, accountability and transparency, explainability and interpretability, privacy enhancement, and fairness with harmful bias managed as relevant trustworthiness characteristics. They can conflict: for example, greater interpretability may affect accuracy or privacy. Record the trade-off, the reason for prioritizing one objective, and the residual risk accepted by an authorized owner.

4. Ask vendors for evidence about the service you will buy

Request current, product-specific material for the exact edition, region, hosting option, model, and configuration under consideration. A corporate trust center may describe several services and exclude the one you plan to deploy.

Data-handling questions

  • What content is collected at input, output, and telemetry layers?
  • Is customer content used to train, fine-tune, evaluate, or improve any model? Is that setting different for free, business, enterprise, API, or managed deployments?
  • How long are prompts, files, outputs, safety logs, backups, and account records retained?
  • Can administrators configure retention and deletion, and what remains in backups or legal holds?
  • Where is data stored and processed? What international transfers and transfer mechanisms are used?
  • Which subprocessors can access content, for what purpose, and with what notice or objection process?

Security and access questions

  • Which authentication methods, single sign-on options, roles, privileged-access controls, and customer-managed keys are supported?
  • How are tenants isolated, and how are production and support access logged?
  • What vulnerability-management, penetration-testing, backup, disaster-recovery, and resilience evidence covers the purchased service?
  • What constitutes a security incident, how quickly will the organization be notified, and what cooperation is included?
  • Can the provider restrict support personnel from viewing customer content, and how are exceptional accesses approved?

AI behavior and governance questions

  • What is the intended use, prohibited use, model version, training-data description, and known limitation set?
  • How does the provider measure reliability, harmful bias, unsafe outputs, privacy leakage, and adversarial robustness for this service?
  • What controls support citations, explanations, confidence information, content provenance, or user disclosure where needed?
  • How are model updates, system prompts, safety policies, and feature changes tested and announced?
  • What incident taxonomy and escalation path cover harmful or materially incorrect outputs?

Supply-chain questions

  • Which foundation models, hosted components, open-source packages, data providers, and infrastructure suppliers are material to the service?
  • Can the provider supply relevant software or model bills of materials, provenance information, and dependency notices?
  • How are foreign ownership, control, or influence; supplier resilience; foundational cyber practices; and supply-chain tiers assessed?

NIST Special Publication 1326, finalized July 8, 2026, groups ICT-supplier due diligence around those categories. It can inform supplier review, but it is not an AI certification scheme.

5. Understand what assurance documents do—and do not—prove

Evidence What it can support What it cannot establish by itself
SOC report or similar assurance report Independent information about specified controls, period, scope, and testing procedures. That the report covers your product tier, configuration, jurisdiction, use case, AI behavior, or every legal obligation.
Security or privacy certification Evidence that the provider met the stated scheme’s requirements within its defined scope and date. That the service is suitable for your risk, that outputs are accurate, or that your deployment satisfies sector-specific rules.
AI governance statement or principles Information about the provider’s stated objectives, policies, and accountability approach. Operational effectiveness, contractual commitment, or compliance with a particular law.
Software or model bill of materials Visibility into components and dependencies that can improve supply-chain review. Security of every component, lawful provenance of every data item, or acceptable model behavior.
Service-level agreement Defined availability, support, response, or recovery commitments. Privacy law compliance, output quality, fairness, or legal permission to use the system.
Vendor questionnaire Structured answers that identify gaps and topics for verification. Independent proof; answers require evidence, contract language, and testing.

Check each document’s issuer, date, service boundary, exclusions, locations, control period, exceptions, and whether it covers the exact plan and deployment architecture. Preserve the version reviewed in the procurement file.

6. Test the configured system in its deployment context

Do not treat a benchmark score or a vendor demonstration as a compliance answer. NIST’s generative AI profile, published July 26, 2024, warns that available pre-deployment tests can be inadequate, non-systematic, or mismatched to the deployment context. Use iterative, documented testing, evaluation, validation, and verification (TEVV) with representative AI actors and tasks.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Define test objectives. Tie each test to a matrix requirement: reliability, privacy leakage, access control, harmful bias, human review, transparency, latency, availability, or recovery.
  2. Build a representative test set. Use approved, minimized data that reflects languages, formats, edge cases, user groups, and operating conditions. Do not upload live sensitive records unless the approved risk assessment permits it.
  3. Test normal and adversarial use. Include ambiguous requests, malformed files, prompt injection, attempts to retrieve another user’s content, sensitive-data entry, abusive content, and conflicting instructions.
  4. Measure more than average accuracy. Record false positives and negatives, severe failure modes, unauthorized disclosure, subgroup differences relevant to the use, refusal behavior, citation quality, and the reviewer’s ability to detect errors.
  5. Test the surrounding workflow. Verify permissions, logs, exports, deletion, incident alerts, human approvals, rate limits, integrations, and behavior after a model or policy update.
  6. Set release thresholds and stop conditions. Define which failures block launch, which require mitigation, who may accept residual risk, and when testing must be repeated.
  7. Document results and retest. Keep prompts or test cases, versions, configuration, outputs, evaluator identity, dates, defects, mitigations, and approval decisions. Repeat after material changes.

7. Compare remaining tools on the same axes

Use a weighted score only after identifying non-negotiable pass/fail requirements. A high total cannot compensate for a failed legal requirement or an unacceptable data practice.

Comparison axis Decision questions
Legal fit Does the documented use fit the organization’s role, jurisdictions, sector rules, contracts, and intended-use boundaries?
Data handling Are collection, training use, retention, deletion, location, transfers, and subprocessors acceptable and verifiable?
Security and resilience Do controls and independent evidence match data sensitivity, integration depth, threat exposure, and impact?
AI behavior Does deployment testing show reliable performance, manageable limitations, acceptable bias risk, explainability, and effective human oversight?
Transparency and governance Can users receive required disclosures? Are documentation, change notices, incident reporting, and accountability mechanisms adequate?
Contract and exit Are responsibilities, evidence rights, cooperation, data return or deletion, portability, and transition support explicit?
Operational fit Can the organization integrate, secure, support, monitor, and use the tool accessibly with available staff?
Total cost and risk What are subscription, integration, testing, monitoring, training, review, replacement, and failure costs?

8. Put conditions in the contract and deployment plan

Translate the accepted requirements into enforceable terms and technical settings. Tailor the agreement to the service architecture instead of assuming a standard data-processing addendum covers every risk.

  • Restrict use of organizational content to documented purposes and state whether training or product improvement is prohibited.
  • Specify retention, deletion, backup handling, data location, transfer mechanisms, and subprocessor notification.
  • Require proportionate incident notification, investigation support, evidence preservation, and remediation cooperation.
  • Define material changes that require notice, reassessment, or approval, including model, hosting, subprocessor, safety-policy, and data-use changes.
  • Require documentation and assistance needed for data-subject requests, impact assessments, regulator inquiries, and legally required disclosures.
  • Set service, support, recovery, portability, return, deletion, and transition commitments that can be tested.
  • Limit administrator and support access, require logging, and define the organization’s audit or evidence rights.

9. Approve, monitor, and reassess after launch

Keep the use-case record, applicability map, requirements matrix, vendor evidence, test results, contract, configuration, training records, approvals, and exceptions together. Assign owners for access reviews, incident intake, vendor changes, output-quality monitoring, user feedback, and periodic reassessment.

The decision standard

Approve an AI tool only when the organization can explain, in writing, what the system does, whose interests and data are affected, which requirements apply, what evidence supports each control, how the configured system performed in representative testing, who accepts residual risk, and how the organization will detect and respond to change. If those answers are incomplete, the appropriate outcome is to narrow the use, add controls, seek better evidence, or defer deployment—not to infer compliance from a vendor label.
