Choose an AI provider only after you map your jurisdictions, data, use case, risk category, and organizational roles. Then compare the provider’s actual product, endpoint, region, contract, and data flows against those obligations. No provider is universally “compliant”: the answer depends on which laws apply, whether personal or regulated data is processed, where people can access it, and how the system’s output is used.
A residency label is evidence about one part of that picture, not a legal conclusion. A useful procurement decision therefore combines an obligation map, a product-specific data-flow review, transfer analysis, technical controls, contract terms, and an exit plan.
1. Map the obligations before comparing vendors
Start with your organization and the proposed deployment, not with a vendor’s compliance page. Record each legal entity involved, the countries of establishment, the users’ locations, the location of affected individuals, and the countries in which outputs will be used. Include affiliates, contractors, customers, and any third party that will operate or rely on the system.

- Data categories: personal data, sensitive or special-category data, confidential business information, trade secrets, authentication material, payment data, children’s data, or information subject to sector rules.
- System category: a general-purpose model, an embedded feature, an agent that can take actions, or a high-risk system connected to a regulated process.
- Lifecycle: collection, prompt submission, inference, output delivery, logging, support access, backups, deletion, and any later training or evaluation use.
Keep the matrix tied to a particular product and tier. “The provider supports the EU” is too broad to answer whether your selected endpoint, account type, model, support channel, and logs meet your requirements.
Account for extraterritorial reach
EU rules can apply even when a provider or deployer is established outside the Union. The consolidated EU AI Act can cover systems placed on the EU market and systems whose output is used in the Union. The Commission’s scope explanation also means that an organization outside the EU cannot assume that its location alone removes EU obligations. Determine whether your product is offered into the EU, whether an output is used there, and which party has the relevant provider or deployer role.
The AI Act does not replace EU data-protection law. If your system processes personal data, GDPR duties can apply at the same time as AI Act duties. Treat the two analyses as connected but separate: one concerns the AI system’s classification and obligations, while the other covers lawful processing, data-subject rights, security, and international transfers.
2. Understand the EU rules that affect provider selection
AI Act classification is use-specific
Do not select a provider by asking whether it is “AI Act compliant.” First classify the system and the activity. A general-purpose model supplied to your team may be used in a low-risk drafting tool, while the same model connected to an employment, credit, education, or essential-service workflow may create different duties for the deployer and other participants in the value chain.
For high-risk systems, the Commission’s navigation material describes obligations that can include conformity assessment, quality-management arrangements, and registration in an EU public database. Whether those obligations apply depends on the system’s classification, intended purpose, role allocation, and any applicable exception. Require the provider to identify the documentation and responsibilities it supplies, then have your legal and compliance teams determine what your deployment must do.
General-purpose AI obligations
The European Commission’s GPAI FAQ states that obligations applying from 2 August 2025 include technical documentation, information for downstream providers, a copyright-compliance policy, and publication of a sufficiently detailed summary of training content. A provider established outside the EU must appoint an authorised representative before placing its model on the EU market.

The FAQ presents compute above 1023 FLOP, together with specified generative capabilities, as an indicative criterion for identifying a general-purpose AI model. It is not a universal bright-line legal test. Ask the provider how it classifies the model, which obligations it accepts, and what downstream documentation it will make available for your intended use.

Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →GDPR transfers are broader than data-center location
When personal data leaves the European Economic Area, or can be accessed in a third country, analyze GDPR Chapter V. Article 44 requires transfers to third countries or international organizations, including onward transfers, to meet the chapter’s conditions. Article 45 allows transfers based on an adequacy decision. Other routes may be available depending on the facts, but the correct route is not determined by a marketing label.
Ask where prompts, outputs, logs, backups, support records, telemetry, and abuse-monitoring data are processed. Identify every subprocessor and the countries from which personnel can access data. Then document the applicable transfer mechanism, onward-transfer controls, supplementary safeguards, and how you will respond if a subprocessor or processing location changes.
EU residency can reduce some transfer paths, but it is not a blanket GDPR requirement or a complete transfer solution. A service can store primary data in Europe while using global support, security telemetry, remote administration, or subprocessors elsewhere. Conversely, a lawful transfer mechanism may exist even when processing is not exclusively European. Your assessment must follow the actual flow.
3. Test the provider’s real data flows
Obtain architecture and contract answers for the exact product, plan, endpoint, model, and region you intend to buy. Ask the provider to distinguish data in transit, data used for inference, data at rest, operational logs, safety or abuse logs, support tickets, backups, and data supplied to subprocessors.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Questions to answer for every endpoint
- Where is inference performed for each region and request type?
- Where are prompts and outputs stored, for how long, and in which systems?
- Are requests or outputs used to train, fine-tune, evaluate, or improve models? Is that use on by default, opt-in, or contractually prohibited?
- Which logs are retained, and can an administrator disable or shorten retention?
- Can provider support, trust-and-safety, or engineering personnel access content? From which countries and under what controls?
- Which subprocessors handle storage, monitoring, identity, customer support, content filtering, or billing?
- How are deletion requests propagated to replicas, backups, caches, and derived records?
- What incident-notification timeline, audit evidence, and customer investigation support are included?
Residency is endpoint-specific
Provider documentation illustrates why endpoint names matter. Google Cloud’s Gemini Enterprise Agent Platform documentation says a request sent to a global endpoint may be processed in any Google Cloud location worldwide and therefore provides no data-residency guarantee. The same documentation describes an EU multi-region endpoint covering EU member states and location-specific endpoints that constrain processing to the associated broader geographic area. Those statements are product-specific; verify the current behavior for your model, API method, account, and logging configuration before deployment.

An OpenAI announcement describes at-rest data residency for eligible API customers and for new ChatGPT Enterprise and Edu workspaces across a list of regions. For eligible API customers, it also describes choosing regional processing for eligible endpoints. Availability is limited to the products, customers, endpoints, and regions identified in the current documentation and contract. Do not extend that announcement to every product, plan, endpoint, or data category.
| Option to compare | What it establishes | What it does not establish |
|---|---|---|
| Global endpoint | Usually the broadest routing and capacity option. | No guaranteed processing country; it may conflict with a geographic restriction. |
| EU multi-region endpoint | Processing constrained to the documented EU member-state scope for that product. | It does not automatically resolve support access, subprocessors, transfers, retention, or AI Act duties. |
| Location-specific endpoint | Processing constrained to the documented geographic area. | It does not prove that every log, backup, support action, or downstream service stays there. |
| At-rest residency | Specified stored data is kept in selected regions. | Inference routing, transient processing, support access, and other data categories may follow different rules. |
| Regional processing | Eligible requests are processed in a selected region. | It may be unavailable for some endpoints, models, customers, or ancillary services. |
4. Compare providers with a weighted scorecard
Use a scorecard that records evidence rather than checkmarks. A contract, technical specification, audit report, or reproducible configuration is stronger evidence than a general webpage. Score only the product you can actually purchase and configure.
| Comparison axis | Questions for procurement and legal review | Evidence to retain |
|---|---|---|
| Jurisdiction and reach | Which laws apply to our entities, users, data subjects, customers, and output locations? Does the provider market or operate in those jurisdictions? | Scope analysis, legal memo, provider entity details, regional availability. |
| Roles and system category | Who is provider, deployer, controller, processor, importer, or distributor? Is the use high-risk or otherwise regulated? | Intended-purpose statement, role allocation, classification record. |
| Data and purpose | What data enters prompts, context retrieval, files, logs, and support channels? What decisions or actions depend on output? | Data inventory, data-flow diagram, impact assessment. |
| Processing and storage | Where do inference, storage, backups, telemetry, support, and subprocessors operate? | Product documentation, subprocessor list, regional configuration, written answers. |
| Transfer mechanism | Which GDPR Chapter V condition applies? How are onward transfers and government-access risks addressed? | Data-processing agreement, transfer assessment, safeguards, change-notice process. |
| Retention and training | Can content training be disabled or prohibited? What are retention periods and deletion guarantees? | Contract clauses, administrative settings, deletion procedure, test evidence. |
| Security and incidents | What encryption, identity, isolation, monitoring, audit, vulnerability, and incident-notification controls exist? | Security documentation, certifications where relevant, incident SLA, audit reports. |
| Tier and endpoint availability | Are the required regions and controls available on our plan, model, API, throughput level, and support package? | Order form, service description, endpoint list, configuration screenshots. |
| Portability and exit | Can prompts, files, fine-tuning assets, logs, evaluations, and application data be exported? What switching assistance and fees apply? | Export specification, termination terms, deletion certificate process. |
Assign weights based on harm and legal exposure. For a healthcare workflow, data handling, access, retention, and incident response may outweigh model price. For a public-content drafting tool, portability and output governance may carry more weight. Reject a provider that fails a mandatory requirement even if its total score is high.

- Define the use case and prohibited uses. Describe inputs, outputs, users, decisions, human review, connected tools, and actions the system may take. State what the system must never do, such as making an unreviewed eligibility decision.
- Inventory and classify data. Separate personal, sensitive, confidential, regulated, and public information. Decide whether production data is necessary or whether masking, tokenization, synthetic data, or retrieval from a controlled store can reduce exposure.
- List applicable jurisdictions and roles. Include the EU wherever an in-scope system is placed on the EU market or its output is used in the Union. Add sector and national rules identified by counsel; do not infer a complete US federal, state, or global matrix from EU analysis.
- Write non-negotiable controls. Examples include EU-only inference, no provider training, customer-managed deletion, a maximum log period, named subprocessors, regional support, encryption, audit rights, and a defined incident-notification deadline.
- Request product-specific evidence. Ask each provider for the exact endpoint map, processing locations, retention defaults, training policy, subprocessor list, transfer terms, support-access model, and availability by plan.
- Validate configuration in a test account. Confirm that the selected region is enforced, that global fallbacks are disabled, that logs follow the promised setting, and that administrative controls work for every API or interface your application uses.
- Assess transfers and contracts. Identify the GDPR Chapter V route where relevant, document onward transfers, negotiate data-processing and security terms, and attach the approved configuration to the order form.
- Test realistic failure cases. Simulate a regional outage, endpoint failover, support ticket, deletion request, subprocessor change, compromised credential, and provider incident. Record what data would move and who must approve the response.
- Approve, monitor, and re-evaluate. Assign an owner, review provider and legal changes, watch for new models or endpoints, and repeat the assessment when the purpose, data, region, or contract changes.
6. Put the decision into the contract and architecture
Contract terms to negotiate
- A precise definition of customer content covering prompts, files, retrieved context, outputs, and logs.
- A prohibition or tightly limited permission for training, model improvement, human review, and secondary use.
- Documented processing locations and a notice-and-objection process for new subprocessors or countries.
- Retention periods, deletion deadlines, backup treatment, and a practical certificate or evidence of deletion.
- Confidentiality, access controls, encryption, vulnerability management, audit cooperation, and incident-notification commitments.
- Assistance with data-subject requests, regulatory inquiries, impact assessments, and investigations.
- Service-specific regional processing commitments, including what happens during failover or capacity shortages.
- Export formats, switching assistance, transition periods, termination rights, and limits on exit fees.
Architecture controls that reduce exposure
- Remove unnecessary personal and confidential data before sending a request.
- Keep identity mapping and authoritative records in your controlled system rather than in prompts.
- Use allowlisted models and endpoints, with policy enforcement that blocks unapproved global routes.
- Separate development, testing, and production accounts; prohibit production secrets in prompts and logs.
- Require human review for consequential decisions and log the reviewer, source material, model version, and final action.
- Monitor region, retention, and training settings as configuration drift, not as a one-time checkbox.
- Maintain a second-provider or conventional-software fallback for critical functions, subject to the same data rules.
7. Treat portability as a compliance and resilience question
The European Commission’s Data Act explainer describes minimum requirements for cloud-service contract content and an objective of making it easier to switch between data-processing services. Use that as a procurement prompt, not as a guarantee that any particular AI workload is portable.
Ask whether you can export source documents, embeddings, prompts, evaluation sets, fine-tuning data, tool definitions, safety policies, audit logs, and application state in usable formats. Determine whether another provider can reproduce the workflow without proprietary agents, undocumented system prompts, or inaccessible vector indexes. Test an export before signing a long-term commitment, and document how data will be deleted after migration.
8. Regional examples and limits of generalization
When the EU is one of several markets
Run the EU AI Act and GDPR analysis alongside the rules of every other market in your matrix. A single global configuration may be attractive operationally but could force all data through the strictest region, reduce available features, or still fail to satisfy a local requirement. Separate common controls from jurisdiction-specific controls, and route only the workloads that need regional isolation.

When the United States or another region is involved
The sources summarized here do not establish a complete US federal, state-law, or worldwide compliance matrix. Do not claim that one provider is compliant across the United States or globally. Identify the applicable state, federal, sector, contractual, and public-sector rules for your use case, then obtain current primary-source guidance for those jurisdictions.
Do these 3 things before closing this tab:

“The provider has an EU region, so we are compliant.”
Why it fails: Region labels may cover only inference or primary storage, while logs, support, backups, or subprocessors remain elsewhere; they also say nothing about system classification or lawful purpose.
Fix: obtain a complete data-flow diagram and match each flow to a contract term and technical setting.
“We will use the global endpoint unless something goes wrong.”
Why it fails: global routing can process requests anywhere and may invalidate a geographic restriction before an outage occurs.
Fix: use a documented location-specific endpoint when geographic processing is mandatory, disable unapproved fallbacks, and test failover behavior.
“At-rest residency answers GDPR transfers.”
Why it fails: Article 44 covers transfers and onward transfers, not just where a database is physically stored.

“The provider’s enterprise plan has the same controls as its API.”
Why it fails: residency and retention commitments can differ by product, tier, endpoint, model, and customer eligibility.
Fix: assess the exact interface your application will call and attach its configuration to the contract.

“The model is general-purpose, so our use is low risk.”
Why it fails: risk depends on intended purpose, deployment context, affected people, and the decisions or actions influenced by output.
Fix: classify the complete system and workflow, including connected tools and human oversight.
“We can switch providers later.”
Why it fails: proprietary prompts, indexes, evaluations, agents, and logs can make migration expensive or impossible.
Fix: specify export formats, test a migration, preserve evaluation datasets, and negotiate deletion and transition assistance before purchase.
