Choose a European cloud provider by specifying what “European” must mean for your workload, then requiring service-level evidence for data location, legal jurisdiction, operational control, security and portability. EU data residency alone does not establish GDPR compliance or prevent foreign access, and a legal export right does not make a complex application easy to migrate.

The defensible process is to define measurable requirements, verify the exact product and contract, score comparable evidence, and test an exit before production. The European Commission’s sovereignty framework and its 2026 procurement shortlist are useful starting points, not universal provider rankings.

What “European cloud provider” should mean for your workload

“European” is not a single technical or legal property. A service can store production data in an EU region while being owned by a company controlled elsewhere, operated by staff in several countries, dependent on non-European technology, or subject to another jurisdiction’s lawful-access rules. Conversely, a European-owned provider may use components or subprocessors from outside Europe.

Write down the requirements that matter to your organization before looking at provider names. Turn each requirement into a question that can be answered with a document, configuration, test or contract clause.

  • Location: Which EU or EEA country must contain production data? Where are backups, replicas, logs, support records, telemetry and disaster-recovery copies kept?
  • Ownership and control: Which legal entity signs the contract? Who owns it, controls it and directs the relevant operation?
  • Jurisdiction: Which laws apply to the provider and its parent entities? What process is followed when a public authority requests access?
  • Operations: Who administers the service, approves privileged access and provides support? Can support staff access customer content, and from where?
  • Technology and supply chain: Which hardware, software, identity services, virtualization layers and subprocessors are essential? Are non-EU dependencies acceptable for this workload?
  • Workload fit: Does the service provide the required compute, storage, databases, networking, resilience, recovery objectives, support and performance?

The Commission’s Cloud Sovereignty Framework organizes these questions into strategic, legal and jurisdictional, data and artificial-intelligence, operational, supply-chain, technological, security and compliance, and environmental categories. Its structure helps procurement teams ask consistently; it does not replace a workload-specific risk assessment.

Does EU data residency make a service GDPR compliant?

No. GDPR compliance depends on the processing activity, roles, purposes, safeguards and organizational controls, not simply on the country in which a server is located. Treat a European region as one control in a larger assessment.

Classify the data before selecting a region

Separate personal data, non-personal data and mixed datasets. EU guidance describes personal data as information relating to an identified or identifiable person. Mixed datasets are common; where personal and non-personal parts are inextricably linked, the data-protection rules apply to the whole dataset in the circumstances described by EU guidance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For each dataset, record the controller and processor roles, processing purposes, retention period, categories of people, special-category data, transfers, encryption requirements and deletion obligations. Include temporary copies created by autoscaling, analytics, caching, observability and support tools.

Understand the EU location baseline and its exception

EU rules generally allow data to be stored and processed anywhere in the EU. National restrictions can still apply on public-security grounds, so a country choice should be checked against sector-specific and national requirements rather than treated as automatically unrestricted.

The Data Act does not prohibit cross-border data flows. It provides safeguards for access requests by foreign public bodies to non-personal data held in the Union and describes reasonable measures such as encryption and audits. That is not a promise that data can never be accessed from abroad. Ask how the provider detects, challenges and documents such requests.

Use sovereignty levels without treating them as a product guarantee

The Commission’s June 2026 explanation describes a Cloud Sovereignty Framework with 48 specific criteria in eight categories. Its Sovereignty Effectiveness Assurance Levels (SEALs) distinguish progressively stronger outcomes: SEAL-2 represents data sovereignty, SEAL-3 technological autonomy and SEAL-4 full sovereignty.

These levels are framework thresholds, not a universal certification that every product from a provider is suitable. A score or level must be tied to an assessed service, contract scope, evidence date, dependencies and exceptions. Ask which of the 48 criteria were evaluated and which were not.

The Commission encourages public and private organizations to use the framework to strengthen digital sovereignty and resilience. In the Commission’s words: “The Commission encourages all organisations, both public and private, to consult and use this framework to strengthen their digital sovereignty and resilience.” Read the framework explanation at Sovereign Cloud Framework explained.

What to ask when a provider cites a SEAL

  1. Identify the assessed legal entity, service family, regions and operating model.
  2. Request the assessment date, assessor or assurance method, criteria coverage and unresolved exceptions.
  3. Map the result to your workload: identity, support, backups, observability, managed databases and third-party integrations may sit outside the cited scope.
  4. Check whether the result is contractual, independently assessed, self-declared or merely an intended target.
  5. Require notification and remediation terms if ownership, technology, region or subcontractors change.

The Commission’s cloud policy page describes a European cybersecurity certification scheme for cloud services (EUCS) as work being developed by ENISA. Verify the current status and an actual service certificate before relying on EUCS; do not describe the scheme as finalized or assume a provider holds it.

Current EU Commission procurement shortlist: useful leads, not a league table

In April 2026, the Commission announced four provider groupings selected for EU institutions and related Union entities. The award was described as worth up to €180 million over six years. The reported SEAL levels apply to the awarded scope, not automatically to every product or customer.

Provider grouping named by the Commission Reported level in the awarded scope How to use the information
Post Telecom with CleverCloud and OVHcloud SEAL-3 Investigate the assessed services, regions, operating controls and contract boundaries.
STACKIT SEAL-3 Request current service-specific evidence and dependency disclosures.
Scaleway SEAL-3 Validate the exact products, support model, recovery design and portability terms.
Proximus with S3NS, Clarence and Mistral SEAL-2 Check which components are in scope and whether the data-sovereignty level meets your requirement.

The Commission stated that Proximus uses an environment based on Google Cloud technology operated exclusively by EU companies. That example shows why technology origin, operational control and the achieved sovereignty level must be examined together: non-European technology can meet a stated minimum level under an appropriate framework, but the result is still scope-specific.

Use these names as a current, evidence-backed starting list for sovereignty-conscious procurement. The award does not prove that every listed service is available in your country, meets your sector rules, has identical controls, or offers the best price, latency, uptime or feature set. No comparative provider performance result is established here.

How to assess portability before signing

Portability is both a legal right and an engineering property. The EU Data Act’s cloud-switching chapter covers providers of data-processing services, including cloud and edge services. The Commission says the data needed for switching includes customer input and output data and associated metadata generated through use, subject to exclusions for provider intellectual property and trade secrets.

Match the obligation to the service model

  • SaaS and PaaS: Providers must make open interfaces available and, at minimum, export data in a commonly used, machine-readable format. Confirm that the export includes relationships, metadata, permissions, audit records and configuration needed to use the data elsewhere.
  • IaaS: Providers must facilitate materially comparable outcomes for shared features when a customer moves to a service of the same type. The Commission gives shifting workloads across virtualization technologies as an example. This does not mean every proprietary managed service has an equivalent elsewhere.
  • Multi-cloud: Providers must remove obstacles to switching or using several services at once. You still need compatible identity, networking, monitoring, encryption and deployment processes.

The Commission summarizes the objective this way: “The Data Act will make switching free, fast and fluid.” It also states: “All providers are required to remove obstacles that their customers may face when they want to switch to another provider or use several services at the same time.” Both quotations are from the European Commission Data Act explainer.

Run a realistic migration exercise

  1. Inventory dependencies. List managed databases, proprietary APIs, queues, event formats, identity integrations, certificates, keys, logging pipelines, scheduled jobs, dashboards and data-retention rules.
  2. Request a sample export. Obtain representative records with schemas, metadata, relationships, timestamps, permissions, encryption-key requirements and audit history. Mark what is excluded as intellectual property, trade secret or provider-generated material.
  3. Build an independent target. Use a separate account or another provider and deploy the application with infrastructure-as-code, documented secrets handling and a clean identity boundary.
  4. Restore and reconcile. Load the export, verify record counts and checksums, replay required events, test permissions and compare application behavior with the original.
  5. Measure the move. Record data volume, transfer time, downtime, manual work, reconfiguration, test failures, rollback time and any service-specific conversion.
  6. Repeat for a critical change. Test a provider outage, contract termination or region loss, not just a planned copy. Preserve the runbook, owner and test date.

The Interoperable Europe Portal identifies low interoperability and low portability as mechanisms that can lock customers into a provider. Export rights therefore need an operational test and a funded exit plan.

Put exit terms in the contract

  • Export formats, interfaces, included metadata and the time window for retrieval.
  • Notice periods, termination rights, transition assistance, named technical contacts and response times.
  • Data-retention and deletion certificates for primary systems, replicas, caches and backups.

  • Change-control rights if a region, subprocessor, ownership structure or critical dependency changes.

The Commission says switching charges, including egress charges, are to be entirely removed from 12 January 2027. Before that date, EU guidance allows limited switching or egress costs subject to the stated limitation to costs of enabling the switch. Check the law and contract effective on the date of your transaction; do not assume that every migration is already free.

Score options on evidence that matters

After defining mandatory requirements, score only comparable evidence. A high corporate score should not compensate for a failed requirement in the exact service you will deploy.

Decision axis Evidence to compare
Location Named service regions; production, backups, logs, support and recovery locations; national restrictions.
Legal and jurisdictional control Contracting and parent entities, control rights, access procedures and lawful-request handling.
Privacy and compliance Processing terms, subprocessors, purposes, security evidence, retention, deletion and incident clauses.
Sovereignty and supply chain Applicable framework criteria or level, operational control, non-EU technology, dependencies, evidence scope and date.
Technical fit Compute, storage, databases, networking, platform features, APIs, support, performance and recovery tests.
Portability Export completeness, formats, interfaces, dependencies, functional equivalence, tested restore, assistance and contract terms.
Resilience Failure domains, backups, redundancy, recovery objectives and tested failover.
Total cost and contract Usage, support, transfer or egress, assistance, notice, minimum terms, price changes and date-specific switching rules.
Sustainability Energy and environmental evidence relevant to your policy and reporting obligations.

Set “must pass” gates for data location, prohibited jurisdictions, recovery objectives, regulatory controls and export testing. Then weight the remaining axes according to business impact. Record a confidence level for each score: contract clause, independent report, provider statement, demonstration or untested assertion.

Common selection mistakes and their fixes

Using geography as a shortcut

Mistake: Selecting a provider because its website says “European.” Fix: Verify ownership, jurisdiction, operations, supply chain, locations and the precise service boundary.

Accepting a region selector as proof of residency

Mistake: Assuming a chosen EU region also covers backups, logs, support and disaster recovery. Fix: Obtain a location map and contractual commitment for every copy and access path.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Treating a sovereignty label as universal

Mistake: Applying a SEAL level or procurement award to unrelated products. Fix: Tie the evidence to the assessed scope, date, dependencies and exceptions.

Confusing export with portability

Mistake: Seeing a downloadable file and declaring the application portable. Fix: restore representative data elsewhere, test application behavior and measure reconfiguration and downtime.

Ignoring operational access

Mistake: Reviewing storage location while overlooking support consoles, telemetry and privileged administrators. Fix: map every access path and require approvals, logging and notification controls.

Assuming legal switching rights eliminate engineering work

Mistake: Waiting until termination to discover proprietary queues, identity dependencies or incompatible databases. Fix: maintain an exit architecture, automate deployment and test migration at a frequency proportional to business impact.

A practical procurement sequence

  1. Define the workload. Document users, data classes, regulators, regions, recovery objectives, integrations and unacceptable jurisdictions.
  2. Set measurable “European” requirements. Separate location, ownership, jurisdiction, operations, technology and supply-chain controls.
  3. Create a longlist. Include providers selected in the Commission procurement where their scope appears relevant, plus other candidates that can supply equivalent evidence.
  4. Issue an evidence request. Ask for the service-specific documents, locations, access model, security assurance, subprocessors, export samples and contract terms.
  5. Run technical and legal reviews in parallel. Privacy, security, engineering, procurement and finance should each record conditions and open risks.
  6. Test portability. Perform an export, restore and application test before signing or before the workload becomes difficult to replace.
  7. Negotiate the exit. Fix assistance, notice, deletion, export, charges and change-control terms in the contract.
  8. Approve with residual risks. Assign owners, deadlines and compensating controls for anything not proven.
  9. Reassess periodically. Recheck ownership, regions, subprocessors, certificates, legal developments, service changes and the exit test.

What the current market evidence does—and does not—tell you

The Commission’s preliminary June 2026 Digital Markets Act statement characterized AWS and Azure as the largest and second-largest cloud computing services in the EU and considered them for gatekeeper designation. That is a preliminary, market-level regulatory characterization, not a finding that a particular service is unsuitable for privacy, compliance or portability.

There is no single official figure here that establishes comparative provider market share, migration cost, latency, uptime or performance. Treat any such number as a separate claim requiring its own source, date, region, service and test method.

Final decision rule

Select the provider whose exact service can prove the controls your workload requires and whose exit can be demonstrated, not the provider with the broadest “European” label. Keep the evidence file, migration test and contract together: sovereignty answers who can control data and technology; privacy and compliance answer whether processing is lawful and safeguarded; portability answers whether you can leave without an unplanned operational crisis.
