The safest way to choose a crypto exchange is to verify five things for your country and the exact assets you plan to use: the contracting legal entity, its permissions for each service, the custody agreement, the ability to withdraw your specific asset over your intended network, and the provider’s insolvency arrangements. A registration or licence is useful evidence of oversight, but it does not guarantee that withdrawals will be immediate or that every asset will be recoverable if the provider fails.
Use the checks below before depositing significant funds. Regulatory scope, supported networks, fees, withdrawal limits, review procedures and custody locations can change, so confirm the current position with the relevant regulator and the exchange’s current terms.
What strong compliance and withdrawal protection actually mean
“Compliant” is not a single feature. An exchange may be registered for one activity while offering other services that require different permissions. Strong protection means the provider can show, in documents you can read, who is responsible for your account, how your assets are held, how withdrawals are authorised, and what happens if the business becomes insolvent.
Assess an exchange against these five tests:
- Correct legal counterparty: You know the exact company that contracts with you, where it is incorporated and which law governs your agreement.
- Activity-specific permission: The company’s regulator record covers the services you intend to use, such as exchange, custody, transfer or staking. Permission for one activity must not be assumed to cover another.
- Documented custody: The terms explain who controls private keys or other access credentials, how client positions are recorded, what security systems apply and what fees and laws govern the arrangement.
- Practical withdrawals: The platform supports the asset and network you need, states limits and fees clearly, and explains address restrictions, identity checks and review holds.
- Failure planning: The provider identifies the custody location, treatment of client assets and process that would apply if it stopped operating.
Do not substitute a large brand, a polished app or a headline security claim for evidence on these points.

1. Identify the legal entity and verify its permissions
Map your own situation first
Write down your country of residence, the assets you intend to buy or hold, the networks you will use for withdrawals, and any additional service you need. A person buying bitcoin and sending it to a personal wallet is assessing a different service bundle from a person using derivatives, lending, staking or an institutional custody account.
Exchanges often operate several companies across countries. The name displayed in an app may not be the company named in the customer agreement. Record the legal name, registration number if shown, registered jurisdiction, contracting address and the entity that will actually hold your assets.
Check the regulator’s record for the same entity
Search the relevant regulator’s current register using the legal name, not only the trading name. Confirm that the record is active and that the listed permissions match the activities you will perform. Save the date of your check and the register entry for your records.

| Service you plan to use | Evidence to verify | Why the distinction matters |
|---|---|---|
| Spot exchange | Permission or registration covering the exchange activity in your jurisdiction | A company may be authorised for another activity but not for operating a trading venue or brokering trades. |
| Custody | Permission covering safeguarding or custody of cryptoassets | Holding keys or controlling transfers creates different obligations from simply transmitting an order. |
| Transfers and withdrawals | Permission and terms covering transfers, network use and payout processing | Transfer controls, sanctions screening and destination checks can affect when and where funds move. |
| Staking, lending or yield products | Separate permission and a product-specific agreement | These products can involve additional counterparties and different loss or insolvency risks. |
United Kingdom: do not confuse registration with every permission
UK Financial Conduct Authority guidance explains that the permissions required depend on the activities a firm performs. An existing registration does not automatically establish that the firm has every permission needed for a particular service. The FCA’s standards page says its final rules published on 30 June 2026 apply to firms granted permission to operate under the Financial Services and Markets Act on or after 25 October 2027. That future regime date is not a current authorisation check; verify the firm’s present status and scope for the service you want.
2. Read the custody agreement, not just the marketing page
The custody agreement and policy tell you what the platform is actually promising. In the European Union, MiCA Article 75 describes the information a custody policy should address, including the authentication system, security systems, fees, applicable law, client-position registers and measures intended to reduce risks from fraud, cyber threats or negligence. This is EU legal context, not a universal requirement in every country.
Questions the custody documents should answer
- Who controls the private keys or other means of access?
- Are client assets recorded in an individual position register, an omnibus record, or another structure?
- Can the provider reuse, lend, pledge or otherwise encumber assets, and only if you give separate consent?
- Which company and country hold the assets or control the wallets?
- What happens to an asset when a network forks, pauses, changes its rules or becomes unsupported?
- Which fees apply to custody, transfers, conversions and withdrawals?
- Which law governs the contract and where would a dispute be handled?
- How are account recovery, lost authentication devices and suspected compromise handled?
Look for a dated policy and a clear method for obtaining amendments. If the terms reserve unlimited discretion to suspend withdrawals, change custody arrangements or substitute another asset without explaining triggers and notice, treat that uncertainty as a material risk.

3. Verify that withdrawals work for your exact asset and network
Match the asset, network and destination
“Withdrawals supported” is not precise enough. Confirm the exact token, the network on which it is issued and the address format accepted by your destination wallet. A platform may support an asset for trading while supporting only one network for withdrawals, or it may temporarily disable a network.

| Item | What to record |
|---|---|
| Asset and network | The exact asset name, network identifier and any memo, tag or destination field required. |
| Minimum and maximum | Per-transaction and daily limits, including limits that change after identity or risk reviews. |
| Fees | The stated withdrawal fee, whether it is fixed or variable, and when it can change. |
| Address rules | Whitelisting, cooling-off periods, address-book requirements, or restrictions on smart-contract and exchange addresses. |
| Processing stages | When the request is accepted, when it enters review, when it is signed, and when the transaction is broadcast. |
| Verification | One-time passwords, authenticator approval, biometric checks, confirmation emails or manual questions. |
Run a small test withdrawal
- Confirm that your destination wallet displays the same asset and network, and copy the address without changing its format.
- Enable the strongest available account authentication and complete any address-book or cooling-off requirement before you need the funds.
- Send the platform’s minimum practical test amount, after checking the fee and minimum.
- Record the request time, status messages, transaction identifier and the amount that arrived.
- Repeat the check only after confirming that the destination wallet can safely receive a second transaction; do not assume a successful test proves every network is supported.
A test withdrawal demonstrates the current process for one asset and network. It does not guarantee that a different token, larger amount or later request will receive identical treatment.
EU rule on returning the asset held
For a custodial crypto-asset service provider covered by MiCA, the European Commission’s answer published in the European Securities and Markets Authority Q&A on 18 February 2026 explains Article 75(6): “The words “return crypto-assets held” in Article 75(6) should be understood as meaning that the same type of crypto assets as the crypto-assets held at the time of the client’s request must be returned.”
The provider may allow you to choose conversion into fiat currency or another cryptoasset where the relevant service and execution rules permit it, but it cannot substitute that option for returning the asset when you request the asset itself. Technical requirements, fees, account types and destination-address limitations may apply, yet they must not make return difficult for most clients. This interpretation applies in the MiCA context; it is not a worldwide withdrawal guarantee.
4. Understand why a withdrawal can be delayed
A delay is not automatically evidence of misconduct. Exchanges can pause a request for several different reasons, and you should know which one applies before depositing.

- Security confirmation: A new device, password reset or newly added destination can trigger a cooling-off period.
- Fraud or coercion screening: The platform may check whether someone is forcing you to send funds or has taken control of your account.
- Compliance review: Sanctions screening, transaction monitoring or a request for updated identity information can stop processing until a review is complete.
- Network conditions: Congestion, a wallet maintenance event, a protocol upgrade or a suspended chain can prevent broadcast.
- Technical limits: The amount may be below a minimum, above a daily cap or incompatible with the selected network.
- Destination restrictions: The address may not meet a required format, memo, tag, allow-list or travel-rule data requirement.
Read the service-level language for each cause. A useful policy identifies the event that starts a review, the information you must provide, the communication channel, and what happens to a request that remains pending. Be cautious when a provider gives only a generic “security reasons” explanation with no escalation path.
5. Look for operational withdrawal safeguards
Security should be visible in the withdrawal workflow, not only in a compliance statement. The Hong Kong Securities and Futures Commission’s guidance for licensed virtual-asset trading platforms describes a useful model: controls against fraudulent or coerced withdrawal requests, limits on staff directing assets to other addresses, and checks that prevent a destination from being changed before a transaction is signed and broadcast. These are Hong Kong regulatory examples, not proof that every exchange elsewhere has the same controls.
Controls to look for
- Independent approval for adding or changing a destination address.
- A delay or notification period after a new address is added.
- Clear confirmation of the asset, network, amount and full destination before signing.
- Alerts through a channel separate from the login session.
- Limits on employees initiating or redirecting customer withdrawals.
- A documented process for suspected coercion, account takeover and emergency account freezes.
- Transaction records that let you match your request to the eventual blockchain transaction.
Ask support whether these controls apply to retail accounts, institutional accounts and API withdrawals. An exchange may offer stronger protection in one channel than another.

A licence does not make an exchange solvent and does not by itself guarantee immediate access to your assets after a failure. The legal treatment of customer cryptoassets depends on the contract, custody structure and law that applies where the assets are held.
Questions about failure scenarios
- Which legal entity holds the client relationship if the app or local subsidiary closes?
- Where are the wallets or keys located, and can assets be moved across borders?
- Are client positions separately identified in records that an administrator could reconcile?
- Does the agreement say that client assets are held for customers rather than owned by the provider?
- Can the provider use client assets for its own borrowing, trading or collateral?
- What notice and withdrawal process applies during an orderly wind-down?
- Which court or insolvency regime would decide competing claims?
FINMA’s statement of 12 January 2026 warns that cross-border custody can create additional legal issues if a custodian becomes insolvent. It says customer cryptoassets should not form part of the custodian’s bankruptcy assets. That is Swiss regulator guidance, not a universal guarantee under other countries’ laws and not an assurance that an exchange will remain solvent.
Prefer terms that identify the custody chain and explain how records are reconciled. If the provider will not disclose the custody jurisdiction or the treatment of client assets, you cannot evaluate this risk properly.

7. Compare candidates with a consistent scorecard
Compare only like with like: the same country, legal entity, asset, network and service. A simple scorecard helps prevent a low fee or attractive interface from hiding a withdrawal or custody weakness.
| Category | 0 points | 1 point | 2 points |
|---|---|---|---|
| Entity and permissions | Entity or permissions cannot be verified. | Entity is identified but activity scope is unclear. | Entity and activity-specific permissions are current and documented. |
| Custody terms | No usable custody agreement or key-control explanation. | Basic terms exist but omit important custody or law details. | Policy explains access control, records, security, fees and governing law. |
| Withdrawal capability | Asset or required network is unsupported or unclear. | Supported with material limits or incomplete instructions. | Asset, network, limits, fees and destination rules are explicit. |
| Withdrawal safeguards | No clear confirmation, alert or recovery process. | Some controls exist but review and escalation are vague. | Destination protection, alerts, anti-coercion controls and escalation are described. |
| Insolvency and custody location | Custody location and failure treatment are undisclosed. | Some information is available but cross-border exposure is unclear. | Custody chain, applicable law and client-asset treatment are stated. |
| Operational fit | Does not support your required asset, network or security method. | Works with compromises you accept. | Supports your use case without weakening your security or recovery practices. |
Set your own minimum threshold. For example, you may reject any candidate scoring zero for permissions, withdrawal capability or insolvency disclosure, regardless of its total.
8. Decide how much to keep on an exchange
Custodial trading is convenient because the provider manages keys, authentication and transaction execution. It also means the provider controls the mechanism that transfers the asset. Keep only the amount needed for your trading or near-term activity unless you have reviewed the custody and failure risks carefully.
Self-custody changes the risk rather than removing it. The UK FCA describes the distinction this way: “This means that where a firm supplies a customer with a solution for the customer to keep their own cryptoasset secure by exercising control themselves, and the firm itself has no means to bring about the transfer of the benefit of the cryptoasset to another person, the firm will not be carrying on the activity of safeguarding cryptoassets.”
In practical terms, self-custody can remove the exchange from control of the transfer, but you become responsible for the signing device, recovery material, backups, address verification and protection against theft or coercion.

- Verify that the wallet supports your exact asset and network, not merely a similarly named token.
- Buy or configure the device through a trustworthy channel and verify its authenticity according to the manufacturer’s instructions.
- Write the recovery material down using a method that survives device loss, fire and water; never store it in a screenshot or share it with support.
- Practice recovery with a small amount before transferring a substantial balance.
- Send a test transaction and check the destination address on the signing device itself.
- Plan what a trusted person would need to recover the assets if you become unavailable, without exposing the recovery secret during your lifetime.
A hardware wallet does not make an exchange compliant, protect funds that remain on the exchange or guarantee recovery. It is simply one possible tool for managing self-custody, and compatibility must be checked for each asset and network.
9. A due-diligence workflow before depositing
- Define the use case. List your jurisdiction, assets, networks, services, expected transaction size and whether you need API access or institutional controls.
- Identify the counterparty. Capture the legal entity, registration jurisdiction, customer-support entity and custody entity if they differ.
- Verify permissions. Check the current regulator record for each planned activity and save evidence with the date.
- Read the agreements. Download the customer, custody, fee, privacy and withdrawal terms. Highlight governing law, asset-use rights, suspension powers and amendment clauses.
- Inspect withdrawal instructions. Confirm the exact asset, network, limits, fees, address rules and review process.
- Ask targeted support questions. Request written answers about custody location, client-asset treatment, new-address delays, API withdrawals and unresolved reviews.
- Secure the account. Use an authenticator-based second factor or stronger method, unique credentials, withdrawal alerts and a protected email account.
- Test with a small amount. Complete one deposit and one withdrawal on the network you intend to use, then reconcile the blockchain transaction.
- Set exposure limits. Keep a defined operating balance and establish a schedule for moving longer-term holdings to a custody arrangement you understand.
- Recheck periodically. Review regulator records, terms, supported networks, fees and custody disclosures after major product, entity or jurisdiction changes.
10. Warning signs that should change your decision
- The app name, terms and regulator record identify different companies without explaining their roles.
- The provider claims to be “regulated” but will not state the jurisdiction, licence type or permitted activity.
- Withdrawal support is described only as “available” with no asset, network, minimum, fee or address details.
- Terms allow the provider to convert your asset unilaterally without a clear trigger or process.
- A new destination can be changed immediately before signing, with no independent confirmation.
- Support cannot explain why a withdrawal is pending or how to escalate a review.
- The custody location, key-control model or insolvency treatment is undisclosed.
- The provider pressures you to disable security controls, move funds to an employee-supplied address or share recovery credentials.
Any one warning sign may have an explanation, but an inability to obtain a clear explanation is itself a reason to reduce exposure or choose another provider.
11. Regional context to keep in mind
| Region | Relevant official context | How to use it |
|---|---|---|
| European Union | MiCA Article 75 sets custody-policy and record expectations. The European Commission answer published in ESMA Q&A 2320 on 18 February 2026 states that the same type of cryptoasset held at the time of a return request must be returned. | Check that the provider is a custodial crypto-asset service provider covered by MiCA and examine the asset, network and fee conditions attached to return. |
| United Kingdom | FCA guidance distinguishes activity-specific permissions and explains the control test for safeguarding. Final rules published 30 June 2026 apply to firms granted FSMA permission on or after 25 October 2027. | Use the current FCA record and permission scope for the exact firm and service; do not treat the future regime date as evidence of present authorisation. |
| Hong Kong | SFC guidance for licensed virtual-asset trading platforms describes anti-fraud and anti-coercion withdrawal controls, staff restrictions and destination-integrity checks. | Use these controls as a benchmark when questioning a platform; they are not a universal requirement outside the Hong Kong licensed context. |
| Switzerland | FINMA’s 12 January 2026 statement discusses custody and insolvency, including additional legal complexity when assets are held abroad, and says customer cryptoassets should not form part of a custodian’s bankruptcy assets. | Confirm which Swiss entity and custody arrangement apply. Do not extend the statement automatically to another country’s insolvency law. |
Bottom line: choose evidence over labels
The strongest exchange for you is the one whose legal entity, permissions, custody terms and withdrawal process match your jurisdiction and actual use. Verify the specific asset and network with a small transaction, understand the conditions that can delay a withdrawal, and find out where client assets are held and how they would be treated in an insolvency. If the provider cannot answer those questions in clear, current documents, a low fee or familiar interface is not enough reason to entrust it with your funds.
