To check whether a crypto exchange can provide a service to you in Germany under MiCA, identify the legal entity in your customer agreement, verify that entity in the ESMA Interim MiCA Register and relevant BaFin records, and confirm the authorisation covers the service you plan to use. A provider authorised in another EU country may also serve German customers after the required cross-border notification, so check the entity, service and Germany availability—not just the exchange’s brand or a claim that it is “licensed.”
How to verify an exchange’s MiCA authorisation
Follow this check before opening an account or transferring assets. MiCA authorisation belongs to a particular legal entity and specifies the crypto-asset services it may provide; it does not automatically apply to every company using the same brand.
- Identify the contracting entity. Check the customer agreement, account-opening disclosures and legal notices for the full name of the company that will provide your service. A group may use different companies for different customers or services. ESMA cautions that MiCA protections attach to the specific authorised EU entity, not automatically to another group company or a non-EU entity with the same brand. Read ESMA’s consumer statement.
- Search ESMA’s Interim MiCA Register. Search by the legal entity’s name, rather than relying only on the exchange’s consumer-facing brand. ESMA describes the register as a central record of authorised crypto-asset service providers and non-compliant entities, populated with information from national competent authorities and the European Banking Authority. Start at the ESMA Interim MiCA Register.
- Cross-check German records. For a German-authorised provider, check BaFin’s company database and the Federal Gazette as well as the ESMA register. BaFin explains the national framework on its crypto-asset services page.
- Match the service you intend to use. Read the register entry to confirm it covers the relevant activity—for example, operating a trading platform, exchanging crypto-assets, or custody. MiCA Article 59 provides that a provider’s authorisation specifies the services it may provide. See the Article 59 text in ESMA’s Interactive Single Rulebook.
- Confirm German availability under that entity. If the provider is authorised in another EU Member State, establish that it has completed the required cross-border notification and that German residents can actually sign up with the listed authorised entity. BaFin says authorised providers may offer services throughout the EU after notification; Article 59 also addresses cross-border provision.
- Resolve any mismatch before proceeding. If the agreement names a different company, the service is missing from the entry, or the provider cannot explain how it serves German residents, pause before depositing or transferring assets. Ask the provider to clarify and verify the answer with the relevant regulator.
What MiCA authorisation does—and does not—tell you
What it establishes
MiCA sets an authorisation framework for covered crypto-asset services. ESMA says authorised providers must meet requirements relating to governance, capital, conduct and consumer protection. An entry helps answer whether a particular entity is permitted to provide the listed service; it is not a general approval of a brand or everything it offers. See ESMA’s MiCA consumer factsheet.

What it does not guarantee
Authorisation is not a promise of investment returns or a guarantee against insolvency, cyber incidents or loss. It also does not establish that every token or crypto-related product advertised by a provider is covered by MiCA. The joint European Supervisory Authorities’ crypto-assets factsheet distinguishes covered services and asset categories from excluded or separately regulated instruments, including certain financial instruments and genuinely unique non-fungible assets.

The MiCA transition period has ended
As of 9 October 2026, the EU-wide transition period has expired. ESMA said it ended on 1 July 2026 and that providers serving EU clients without a MiCA licence after that date must cease those services. A pending application, former status under a national regime, or an authorised company elsewhere in the same corporate group is not proof that the contracting entity has MiCA authorisation. How to compare providers after verification
Authorisation is a threshold check, not a complete measure of whether an exchange suits you. Once you have verified the entity, service scope and German availability, compare the practical terms for your intended use:
