If you or someone with you has been arrested at a protest in India, focus first on locating the person, recording the arrest details, obtaining the grounds of arrest, and arranging a lawyer before the next production or remand hearing. The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) is the current central criminal-procedure statute and has been in force since 1 July 2024. It sets national procedural safeguards, but the alleged offence, arrest legality, bail prospects, and any restrictions on the protest depend on the state, facts, documents, local orders, and any special statute.
This is general information, not a decision about a particular arrest. A local criminal lawyer or the District Legal Services Authority (DLSA) must review the FIR, arrest record, remand papers, and applicable state or special-law provisions.
What to do in the first hour
Act in parallel rather than waiting for one answer. A person may be moved from the scene to a police station, hospital, another station, or court custody, and the first production or remand hearing can occur quickly.

Call the police station closest to the arrest and the district police control room where appropriate. Ask whether the person is there or has been transferred, when the arrest was recorded, the legal grounds or sections recorded, and the FIR or case number if available.
- Write down every contact. Record the date and time of each call, the number dialled, the name and rank given by the official, the answer received, and any instruction to call back. Keep screenshots of messages and call logs.
- Contact legal help immediately. Call a local criminal lawyer or the DLSA for the district where the person is held. Say that the matter concerns a protest arrest and identify any imminent production, remand, or bail hearing.
- Preserve documents and evidence. Lawfully obtain and send counsel photographs or copies of any notice, arrest memo, FIR, medical record, remand paper, court order, or bail document. Keep the originals safe.
- Flag urgent welfare needs. Tell counsel at once if the person is injured, ill, pregnant, a child, disabled, taking regular medication, or needs an interpreter or other communication support.
- Protect privacy. Do not publish a detainee’s identity documents, phone number, medical information, or unverified accusations online. Preserve relevant photographs, videos, messages, and witness details for the lawyer instead.
Do not obstruct an arrest or assume that asserting a right will produce immediate release. Calmly ask for the information and let counsel challenge an unlawful step through the proper authority or court.

What are my rights if I am arrested at a protest in India?
Ask for the grounds of arrest
Ask the arresting authority to state the grounds of arrest in a language you understand and to identify the legal provisions being invoked. Note the officer’s name, rank, police station, and the time and place. If you cannot understand the explanation, request an interpreter or ask your lawyer to explain it.
The BNSS text hosted by the National Crime Records Bureau states: “No arrest shall be made except in accordance with the provisions of this Sanhita or any other law for the time being in force providing for arrest.” That sentence does not decide whether a particular protest arrest complied with the law; the facts, the FIR, and any special statute still have to be examined.
Ask for access to a lawyer
Tell the police that you want to consult a lawyer and ask that counsel be allowed to assist in accordance with the applicable procedure. If you cannot afford private representation, ask for legal aid and tell the officer that you want the DLSA or another legal-services authority informed.
A request for counsel is not a promise that questioning will stop or that release is automatic. Do not sign a statement, blank paper, inventory, or other document you do not understand. Ask to read it, request an explanation, and tell your lawyer what you were asked to sign.
Nominate a relative or friend for notification
Give the police the name and contact details of a relative or friend to be notified. Ask that the notification be made and recorded, and ask where the record is kept. The support person should independently note when and how the notification occurred.
Ask where you are being held
Ask the police to state the place of custody and whether you are being taken to another station, hospital, lock-up, or court. A family member needs the exact location to arrange counsel, medication, clothing, or other assistance.

Request medical attention when needed
Report injuries, illness, medication requirements, disability-related needs, pregnancy, or any risk of harm immediately. Ask that the request and any examination be recorded. Give the same information to counsel so it can be raised with the police, medical officer, magistrate, or other appropriate authority.

How long can police hold someone before taking them to a magistrate?
The general constitutional safeguard is production before a magistrate within 24 hours of arrest, excluding the time necessary for the journey to the magistrate. Detention beyond that period requires magistrate authority. The journey-time qualification matters, and the rule does not by itself determine whether an arrest was lawful or whether bail will be granted.
Write down the exact arrest time, departure time, arrival time, and any stated reason for delay. Tell counsel promptly if the 24-hour period appears to have been exceeded or if the person was moved without a clear record. Counsel can examine the arrest memo, station diary, medical record, transit details, and remand application and raise the issue before the appropriate court.
How can a family member find out which police station has the person?
- Start with the arrest location. Call the station with territorial responsibility for the protest site and ask for the duty officer or station house officer.
- Call the district control room. Provide the person’s full name, approximate age, time and place of arrest, and any identifying information that can be shared safely.
- Ask about transfers. Request the name and address of every station, hospital, or court to which the person was moved, plus the time of transfer.
- Request the case reference. Ask for the FIR or case number, sections cited, arrest time, and the expected place and time of production, if already known.
- Check with counsel. A local lawyer can make enquiries, attend the station or court when permitted, and inspect documents through the appropriate process.
- Keep a written trail. Send counsel a single chronological note rather than conflicting messages from several relatives.
Officials may limit information for lawful reasons, and a protest-related detention may involve more than one case or police unit. If the first station denies custody, ask whether the person was transferred and record the denial, the official’s name or rank, and the time.
Can I get a free lawyer while in police custody?
Yes, a person called for questioning or arrested can ask for free legal aid. The National Legal Services Authority (NALSA) says in its FAQ that “persons called for questioning i.e. suspects and persons arrested by the police can also avail free legal aid.” NALSA’s early-access framework covers the pre-arrest, arrest, and remand stages.
NALSA also states that a person facing criminal trial in police or judicial custody is entitled to free legal aid regardless of financial status or social standing. The legal-services authority still has to process the request and arrange assistance; do not assume that a particular lawyer or immediate outcome is guaranteed.

Who may qualify under the statutory categories?
NALSA’s eligibility information identifies categories under section 12 of the Legal Services Authorities Act, 1987. They include:
- people in custody;
- members of a Scheduled Caste or Scheduled Tribe;
- women and children;
- people with disabilities;
- industrial workmen; and
- people in specified circumstances of underserved want or other categories recognised by the Act and applicable rules.
Even when a person is not relying on one of those categories, NALSA’s early-access information addresses suspects and arrested people seeking assistance at the questioning, arrest, and remand stages. Ask the DLSA to assess the application rather than trying to decide eligibility yourself.
What can free legal services include?
NALSA describes legal services that may include representation, legal advice, drafting and preparation of legal documents, and certain process or case expenses where appropriate. The authority decides the scope of assistance after considering the application and the case. Free legal aid is not a guarantee of bail, dismissal, acquittal, or a particular strategy.

- Identify the detention district. Use the station, lock-up, hospital, or court location where the person is actually held, not merely the place where the protest occurred.
- Ask for the DLSA. Contact the DLSA serving that district and explain that the person is in police or judicial custody after a protest-related arrest.
- Also contact the State Legal Services Authority. If the district office cannot be reached, ask the relevant State Legal Services Authority for the current district contact or application route.
- Use NALSA’s current official contact instructions. NALSA’s website and legal-services management system publish the directions and contact details in force at the time of the request. Service hours and contact channels can change, so verify them there rather than relying on an old number copied from social media.
- State the deadline. Give the person’s name, station or jail, arrest time, FIR or case number if known, and the date and time of the next production, remand, or bail hearing.
- Follow up in writing where possible. Ask for an acknowledgement or reference number and keep the message, email, or application receipt.
A relative, friend, social worker, or the arrested person may ask for assistance. Tell the authority about language, disability, hearing, vision, mobility, or communication needs so an appropriate arrangement can be considered.
Private lawyer or free legal services: which route should you use?
These are access routes, not a ranking of the quality of representation. A private lawyer may be available immediately if the family already has a trusted local criminal practitioner. The DLSA or State Legal Services Authority is the route for statutory free assistance and can be particularly important when money, distance, or custody makes private instruction difficult.

A family may pursue both routes while the request is being processed, but tell each lawyer or authority who else has been contacted to avoid conflicting instructions. A paid lawyer does not guarantee a better result, and free legal aid is not a lesser legal right.

What documents should I give the lawyer after a protest arrest?
Send a clear timeline first, then attach whatever can be obtained lawfully. Do not delay urgent legal contact while waiting to assemble a perfect file.

- full name, age, address, phone number, and an emergency contact;
- the protest date, location, and approximate time;
- the time, place, and manner of arrest or detention;
- names, ranks, unit, vehicle details, or identifying features of arresting officers when known;
- the police station, lock-up, hospital, or jail where the person is believed to be held;
- the FIR or case number and sections, if supplied; and
- the expected production, remand, or bail date.
Documents and records
- notice to appear, arrest memo, seizure or personal-search record, and any receipt;
- FIR, complaint, station notice, or written grounds of arrest;
- medical examination report, prescriptions, injury photographs, and medication list;
- remand application, remand order, bail application, court order, or release document;
- messages, photographs, videos, livestream links, and witness names that can be authenticated; and
- records of every call or visit made to locate the person.
Label files with the date and source, keep an untouched copy, and tell counsel if a photograph or video has been edited, reposted, or obtained from someone else. Do not alter metadata, delete messages, contact a witness in a way that could be seen as pressure, or publish allegations that have not been verified.

At production, the magistrate considers the material placed before the court and the requests for custody or other orders. The applicable procedure, offences, and bail rules depend on the FIR and any special law. A protest arrest can involve ordinary penal provisions, public-order provisions, or state-specific restrictions; the title of the protest or the fact of arrest does not reveal the legal outcome.
Give counsel the exact arrest and transfer times, medical concerns, and any failure to notify a nominated person or provide the grounds of arrest. Ask counsel to explain whether the immediate application concerns police custody, judicial custody, bail, discharge, or another remedy. Do not miss a hearing because a family member assumes that a legal-aid request has already produced representation; confirm the lawyer’s name and attendance.
What if police refuse information or a requested safeguard?
Stay calm, ask the official to record the request, and note the refusal, time, and identity of the official. Tell the lawyer or DLSA immediately. Counsel can decide whether to raise the issue before the magistrate or through another lawful complaint or court process.

Do not threaten officers, interfere with transport, take documents by force, or encourage a crowd to block the station. Those actions can create new allegations and make it harder for counsel to obtain access.

How state and special-law differences affect the answer
The BNSS is the current central procedural statute, but it does not erase state-specific rules, local orders, or special legislation. The same conduct may be described differently in different FIRs, and a special statute may contain additional arrest, investigation, remand, or bail provisions. A lawyer must read the actual sections, notifications, and court orders.
Do not infer that an arrest is lawful merely because officers cite a section, or unlawful merely because the protest was peaceful. The evidence, the authority relied upon, compliance with arrest safeguards, and the court record determine the available challenge.
Keeping a reliable case record
Create one shared folder controlled by a trusted person. Put a short chronology at the top, followed by identity details, arrest and transfer times, documents, medical information, contact logs, and witness material. Use a consistent date and time zone, mark facts as confirmed or unconfirmed, and identify who supplied each item.
