To identify the current U.S. copyright owner of an old video game, first pin down the exact release, then use its notice and credits as search leads, check Copyright Office registrations and recorded transfers, trace any corporate successor, and ask the apparent rights holder to confirm the rights for your specific use. A registration or old copyright notice is evidence, not automatic proof that the named party still owns every right today.
What you are actually trying to identify
“Who owns the game?” can mean different things. A video game may contain separately created code, artwork, music, dialogue, cinematics, manuals, packaging and other audiovisual material. One company might control the game code while another party controls a soundtrack or a contributor’s licensed work. Your research should therefore identify both the work and the right you need.
This workflow is focused on United States records and law. Copyright ownership can differ by country, and public records may not include every private agreement. Use the result as a documented lead; obtain legal advice if you need a conclusive chain of title for a major commercial project or a dispute.
Step 1: Identify the exact game and version
Start with the copy you intend to use, not a broad franchise name. Write down the information from the package, cartridge or disc, manual, title screen and in-game credits.

- Platform and hardware generation.
- Original release or publication date shown in the materials.
- Publisher and developer names.
- Edition, port, compilation, rerelease, remaster or regional version.
- The particular material you want to copy, display, perform or distribute.
U.S. Copyright Office Circular 22 advises determining whether the examined copy is an original edition or a new version. A port, sequel, remaster or compilation can have different registrations, authors and contracts. Photographing labels and scanning the credits gives you a dated record of the evidence you used.
Why version precision matters
A registration for an arcade release may not cover a later console port. A remaster may add new art, music or code. A regional publisher may have obtained rights only for a territory or a particular platform. Keep each version in a separate research file rather than treating every release under one title.
Step 2: Treat the copyright notice and credits as leads
Record every copyright notice exactly as printed, including the year and legal name. Also capture company names, individual authors, licensors and “published by” or “developed by” statements in the credits.

Circular 22 explains that a notice can point you toward a claimant or other records. It is not a current ownership certificate. For later-published works, the name in a notice can differ from the claimant listed in a registration. The Copyright Office’s permission guidance likewise warns that a notice may not identify the present owner.
Search spelling variations, former company names and abbreviations. Preserve screenshots or scans showing where each name appeared, because a name in a developer credit may describe authorship rather than ownership.
Step 3: Search Copyright Office registration records
Use the Copyright Office’s online public records for registrations from 1978 onward. Search the exact title first, then likely variations and the names of the publisher, developer, claimant and prominent credited companies. Review every plausible result rather than stopping at the first matching title.
What to capture from each registration
- Registration number and registration date.
- Title as recorded, including any alternate title.
- Work type and description of the material covered.
- Authors and their contributions, when listed.
- Claimant named at registration.
- Publication or completion information.
- Any notes identifying a prior version, derivative work or preexisting material.
A registration record shows what was claimed and the facts recorded at registration. It does not, by itself, establish that the claimant remains the owner, that the registration covers every component in your copy, or that no later agreement changed the rights.

When the title search is inconclusive
Try the original publisher, developer, individual author and successor-company names separately. Older records may use a corporate name that no longer appears on the product. A game may also have been registered under a series title, a work-for-hire description or a component title rather than the retail title.
Step 4: Search recorded assignments and other transfers
After locating registrations, check the Copyright Office’s public recordation materials for documents that may transfer or qualify rights. Look for assignments, exclusive licenses and other recorded instruments connected to the claimant, title or successor.
The Recordation Overview explains that indexed documents are available for public inspection. Section 205 of Title 17 sets statutory rules for recording transfers and for priority in specified conflicts. A recorded document is important evidence, but its legal effect depends on the document’s language, execution, scope and the surrounding facts.
Build a chronology

Put the evidence in date order: creation or publication, registration, each recorded transfer, and any later corporate event. Note the exact work, parties, rights, territory and dates described in every document. If a document covers only a soundtrack, artwork or a particular edition, do not extend it to the entire game.

The Copyright Office states that pre-1978 registrations, renewals and recorded transfers require a manual search of its files rather than the ordinary online search. You can request records assistance or arrange a search through the Office.
Give the records staff as many identifiers as possible: title variants, publisher, developer, author, approximate publication date and registration or renewal numbers if you find them elsewhere. Ask specifically about registrations, renewals and recorded transfers for the exact version or component. Allow for the possibility that a manual search will locate a record but not a complete chain of later private agreements.
Step 5: Trace a publisher, developer or catalog successor
Compare the original claimant with the names on recorded documents and the current rights or licensing contact identified by the publisher or its successor. If a company merged, dissolved, sold assets or transferred a catalog, corroborate the successor relationship with reliable corporate or transaction records before treating it as established.

Do not assume that the first company you contact controls every right. Circular 16A notes that an initial publisher may need to refer a permission request because it no longer controls the relevant material. Ask the recipient whether it controls the specific version and component you identified, and request the correct contact if it does not.

- Do you control U.S. rights in the named game version?
- Does your control include the particular material I want to use?
- Are any music, artwork, code or audiovisual elements licensed from another party?
- Was the catalog acquired from the original publisher or another successor?
- Who can issue written permission for my proposed use?
Keep replies, referral emails and attached documents with your chronology. A company’s informal statement is useful evidence and a practical lead, but significant uses should be supported by a written license or other documentation that defines the permission.
Step 6: Define the permission you need
Describe your proposed use precisely. “Using the game” is too vague for a rights inquiry. State whether you want to reproduce box art, show gameplay footage, distribute game code, use a music track, publish screenshots, quote dialogue, or make another use. Identify the platform, territory, audience, distribution method, duration and whether the use is commercial.
Only the current owner of the exact material to be used can grant permission for that use. A contact who controls the game code may not control a separately licensed song. Request confirmation that the permission covers each listed element.
Examples of narrower rights questions
- Gameplay video: Ask about audiovisual footage, music and any separately licensed content in the recording.
- Box-art reproduction: Ask about the package illustration, logos and photographs, not just the underlying game software.
- Code distribution: Ask about the executable, source code, third-party libraries and any platform-specific port.
- Music release: Identify the exact track and recording; composition and sound recording rights may involve different parties.
- New remaster or adaptation: Ask whether the permission covers the original work, the newer version or both.
Understand what copyright does and does not cover in a game
Copyright exists automatically in an original work of authorship once it is fixed, according to the Copyright Office’s “What Is Copyright?” guidance. Registration is not what creates copyright, but registration records can provide valuable evidence about claimed authorship and ownership history.
Copyright guidance for games distinguishes expressive elements from ideas, titles and methods of play. Code, original artwork, music, text and audiovisual expression can be protected when they meet copyright requirements. The underlying game idea, title or rules of play are not themselves protected by copyright. Other legal regimes may apply to names, branding, inventions or confidential material, but those questions are outside this ownership workflow.

When two or more parties appear to claim the game, compare them using the same five questions:

- Which work or version? Is the evidence about the original, a port, rerelease, remaster or a specific component?
- What kind of evidence? Is it a notice, registration, recorded assignment, exclusive license, corporate succession record or unsupported web statement?
- What is the chronology? Do creation, publication, registration and transfer dates make the claimed sequence plausible?
- What is the scope? Does the document cover all copyright or only a component, territory, term, platform or exclusive right?
- How authoritative is the source? Prefer official records and executed documents over secondary catalogs or uncited claims.
Mark unresolved gaps instead of choosing a party by reputation. A transfer can be recorded after a registration, and private agreements may never be recorded. If the conflict affects a commercial release, a valuable license or a potential dispute, have a qualified copyright lawyer review the documents.
What the Copyright Office can and cannot tell you
The Office can provide information shown in its records and explain how to request searches. Its Services FAQ states that it does not give legal opinions about contracts, alleged infringement or the copyright status of a particular work beyond information shown in its records.

Create one file for each version and fill these fields before contacting anyone:
- Exact title and title variants.
- Platform, region and edition.
- Release or publication date.
- Publisher, developer and credited contributors.
- Notice wording and a copy of the notice.
- Registration numbers, claimants and recorded authors.
- Renewal or manual-search results for older works.
- Recorded assignments, licenses and other transfer documents.
- Corporate successor evidence and dates.
- Specific material and proposed use.
- Names, dates and contents of every rights-holder response.
- Open questions and documents still needed.
This worksheet prevents a common error: combining evidence from different ports or editions and presenting it as one ownership history.
Common mistakes and how to avoid them
Relying on the name in the copyright notice
The notice is a starting point, not proof of current ownership. Use it to search registrations, transfers and successor information.
Assuming the registration claimant is still the owner
Later assignments, exclusive licenses, corporate sales and unrecorded agreements can change who controls a right. Check recordation materials and confirm with the apparent current contact.

Searching only the retail title
Registrations may use alternate titles, component descriptions or series names. Search names of publishers, developers and credited authors as well as title variants.
Ignoring the version
A port, remaster or rerelease may add or replace expressive material. Match every record to the platform and edition you plan to use.
Assuming one permission covers the whole game
Separate code, artwork, music and audiovisual elements may involve different rights holders. List the material individually in your request.
Treating an online catalog or forum claim as proof
Use secondary claims to generate leads, then verify them against Copyright Office records, executed documents and a direct rights-holder response.
When to stop researching and obtain legal advice
Consult qualified copyright counsel when ownership records conflict, a proposed use is commercially significant, a chain of title must be established conclusively, or you may face an infringement claim. A lawyer can interpret assignment language, work-for-hire issues, termination provisions, territorial limits and other facts that a public index cannot resolve.
For a low-risk inquiry, your documented version identification, registration search, transfer search and written contact trail may be enough to locate the correct licensing department. For a high-stakes release, do not treat an unresolved record as permission.
U.S. source guidance to keep with your notes
Circular 22 covers notices, editions and registration research. The Copyright Office Services FAQ explains online and manual searches and the limits of the Office’s role. “What Is Copyright?” explains automatic protection at fixation and what registration records can show. Circular 16A addresses permission requests, current-owner uncertainty and situations in which the first contact does not control the rights. The Recordation Overview and 17 U.S.C. § 205 describe the public recordation framework. The Office’s video-game guidance, Circular 61 and the Compendium support the distinction between a game’s expressive elements and its ideas, title and methods of play.
