“Retirement plan insurance” can mean three different protections in the United States: Pension Benefit Guaranty Corporation (PBGC) insurance for eligible defined-benefit pensions, an ERISA fidelity bond that protects a plan from covered fraud or dishonesty, or fiduciary-liability insurance that may respond to claims against fiduciaries. They protect different parties and risks, so a plan can have one, two, all three, or none. Start by identifying your role: a participant checking whether promised pension benefits have PBGC protection, or a sponsor or administrator checking bonding and liability policies.

This guide explains how to verify each protection. It is educational, not a determination of your plan’s legal status or a legal opinion on a particular policy. Coverage and adequacy depend on the plan documents, facts, current regulations, and policy wording.

First identify which protection you are checking

Protection What it protects Usually relevant to What it does not do
PBGC insurance Statutory guarantees for certain benefits under covered private-sector defined-benefit pension plans Participants and sponsors of traditional pensions It does not insure 401(k) accounts or other defined-contribution balances
ERISA fidelity bond The plan’s property against loss caused by fraud or dishonesty by covered people who handle plan funds or other property ERISA plan sponsors and administrators It is not insurance for a fiduciary’s personal liability
Fiduciary-liability insurance Specified claims and defense costs involving insured fiduciaries, subject to the policy Sponsors, fiduciaries, and sometimes service providers It does not eliminate fiduciary duties or automatically cover every mistake, loss, or exclusion

Job titles are not a reliable guide to fiduciary status. Under IRS guidance, status generally follows the functions and discretion a person exercises. A provider’s policy also does not remove the sponsor’s continuing responsibility to select and monitor that provider prudently.

If you are a participant: check PBGC protection for a pension

1. Obtain the current Summary Plan Description

Ask your employer or plan administrator for the current Summary Plan Description (SPD), including any updates. The Pension Benefit Guaranty Corporation (PBGC) says the SPD should state whether a pension plan is covered. Read the description of the benefit formula and determine whether the arrangement is a defined-benefit plan, which promises a stated benefit usually based on pay and service, or an individual-account plan such as a 401(k), which records contributions and investment results.

A plan name containing “pension” is not enough to establish coverage. Keep the SPD, annual funding notices, benefit statements, and correspondence together; those records help distinguish the plan’s promises from any separate PBGC guarantee limits.

2. Check whether the plan falls within PBGC’s general category

Most private-sector defined-benefit plans are insured by PBGC. Coverage is not universal, however. PBGC and employer guidance identify exceptions that can include certain professional-service employer plans, church plans, and certain plans based in Puerto Rico. Governmental plans are generally outside PBGC coverage. A defined-contribution plan, including a 401(k), is not PBGC-insured: PBGC does not guarantee the account balance, investment performance, or employer contributions in that type of arrangement.

Use the plan’s legal documents and employer information to establish the plan sponsor, plan type, and location. Do not infer coverage from a former employer’s practice, a plan’s marketing name, or the fact that premiums may have been paid in the past.

3. Ask PBGC for a formal coverage determination when there is doubt

If the sponsor or administrator cannot be absolutely certain, the appropriate route is PBGC’s coverage-determination process. PBGC’s employer guidance, updated September 23, 2026, emphasizes that coverage depends on the law and the particular plan’s facts and circumstances. A formal determination is more reliable than an informal conclusion based on category or prior filings.

PBGC’s participant guidance, last updated August 5, 2025, directs participants to ask the employer or plan administrator first. If the response is incomplete or contradictory, ask for the plan’s written coverage explanation and contact PBGC through its official channels. Preserve the plan number and documents when making an inquiry.

4. Separate “covered” from “fully protected”

PBGC coverage answers whether the pension is in the insurance system; it does not by itself calculate the amount of your personal guarantee. Statutory guarantees can depend on the type of benefit, your age when payments begin, payment form, plan amendments, and other legal limits. To evaluate your own protection, compare the plan’s benefit statement and governing documents with PBGC’s current benefit information. Do not describe a promised benefit as guaranteed merely because the plan is PBGC-covered.

If you sponsor or administer a plan: check the ERISA fidelity bond

What the bond is supposed to protect

ERISA section 412 generally requires a fidelity bond for people who handle plan funds or other plan property. The protected party is the plan itself. The bond responds to covered loss from acts of fraud or dishonesty by a covered person, subject to its terms. It is different from fiduciary-liability insurance, which addresses specified claims against insured people.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Handling” is broader than physically writing checks. Access, authority, control, or the ability to transfer or disburse plan property can create handling exposure. Review employees, trustees, investment personnel, payroll staff, and service providers rather than limiting the review to people whose titles include “fiduciary.” Identify who can initiate, approve, direct, reconcile, or custody transactions.

Confirm the bond and its parties

  1. Read the bond and endorsements. Confirm that the plan, not merely the employer, is protected for covered losses and that the named plan or plans are correctly identified.
  2. Review employer crime coverage. If an employer crime policy is being used, verify that an ERISA rider or equivalent terms satisfy the bonding requirements. A general crime policy is not automatically an ERISA bond.
  3. List every covered person and arrangement. Include outsourced recordkeepers, custodians, investment managers, and other providers with handling authority, then check any statutory or regulatory exemption.
  4. Check surety eligibility. The surety must meet applicable Department of Labor requirements. Confirm that the insurer or surety remains eligible at each renewal.
  5. Check continuity. Verify annual continuation, effective dates, cancellation provisions, and the process for adjusting the amount when plan assets or responsibilities change.

Calculate the general required amount

Department of Labor Field Assistance Bulletin No. 2008-04 describes the general calculation as at least 10% of the funds handled by each covered person during the preceding year. The bond amount is generally subject to a $1,000 minimum and a maximum of $500,000 per plan official per plan. For a plan holding employer securities, the stated maximum is generally $1,000,000, subject to the bulletin’s rules and exceptions.

Rule described in DOL guidance Figure Qualification
General percentage At least 10% Applied to funds handled in the preceding year for the covered person
Minimum $1,000 General minimum amount
General maximum $500,000 Generally per plan official per plan
Plans holding employer securities $1,000,000 Generally the maximum under the stated rules, with exceptions

Calculate separately for each person and each plan. A single bond covering several plans may need a higher aggregate limit so that each plan can recover its required amount if losses affect more than one plan. Check aggregation, shared limits, and sublimits in the actual wording; a headline limit can conceal an insufficient per-plan recovery.

Check the small-plan audit-waiver condition

Some small plans use an audit waiver that has an enhanced bonding condition. DOL guidance explains that when non-qualifying plan assets exceed 5% of total plan assets, the bond may need to cover 100% of the value of those non-qualifying assets for the waiver to apply. This is a conditional rule, not a universal replacement for the ordinary calculation. Classify assets under current regulations, measure the percentage accurately, and confirm the result with a qualified benefits professional before relying on the waiver.

Decide whether the statutory amount is prudent

The statutory figure is a floor, not an automatic adequacy verdict. DOL states that deciding whether to purchase more than section 412 requires is a fiduciary decision subject to ERISA’s prudence standards. Consider the maximum realistic loss, transaction authority, concentration of assets, cyber-enabled access, number of plans sharing a bond, detection and reporting time, and the financial impact of a deductible.

Check whether a deductible or retention shifts a prohibited risk back to the plan. Confirm that exclusions for employee dishonesty, impersonation, electronic funds transfer, investment transactions, or service-provider conduct do not defeat the protection the plan actually needs. Document the calculation, the people reviewed, the reasons for any higher limit, and the renewal date.

If you are reviewing fiduciary-liability insurance

Collect the complete policy package

Request the declarations, policy form, endorsements, exclusions, definitions of insured persons, limits, sublimits, defense-cost provisions, retention, claims-made trigger, reporting period, and any indemnification agreements. A certificate or summary page cannot establish adequacy. Confirm whether the plan, sponsor, committee members, trustees, employees, and service providers are insured, and whether coverage applies to former fiduciaries and newly appointed people.

Match coverage to actual governance

Map who selects investments, approves distributions, hires and monitors providers, communicates with participants, handles claims, and signs plan amendments. Compare those functions with the policy’s definition of a wrongful act and its exclusions. Review separate limits for investigations, settlements, penalties, cyber events, or regulatory proceedings where applicable. Examine defense-cost treatment: costs inside the limit reduce the amount available for settlement, while costs outside the limit have a different practical effect.

Claims-made policies require particular attention to retroactive dates, prior-acts wording, notice deadlines, extended reporting periods, and related-claims provisions. A late notice or change in control can affect protection even when the underlying conduct occurred during the policy period.

Do not assume there is a universal adequate limit

The official materials reviewed do not establish one fiduciary-liability limit that is adequate for every plan. Size, participant count, asset concentration, investment complexity, litigation profile, geographic exposure, and the work retained by providers all affect the decision. Obtain qualified ERISA and insurance advice for unusual structures or large exposures. The existence of a provider’s insurance does not transfer the sponsor’s duty to select and monitor that provider prudently.

Compare policies and bonds on the points that change protection

For fidelity-bond arrangements

  • Who is covered and what activities count as handling.
  • Whether the plan is the protected party and every plan is correctly identified.
  • Covered fraud or dishonesty, electronic-transfer wording, exclusions, and reporting requirements.
  • Per-person, per-plan, aggregate, and shared limits.
  • Surety eligibility, ERISA riders, endorsements, and renewal terms.
  • Deductibles, retentions, and other amounts left with the plan.
  • Whether asset growth or changed responsibilities trigger an adjustment.
  • Whether the small-plan audit-waiver condition changes the amount required.

For fiduciary-liability policies

  • Insured persons, entities, committees, former fiduciaries, and service providers.
  • Covered claims and alleged wrongful acts, including defense and investigation costs.
  • Exclusions, sublimits, retention, and whether defense costs erode the limit.
  • Claims-made, prior-acts, notice, related-claims, and extended-reporting provisions.
  • Fit with the plan’s actual decision-making and delegated functions.

When retirement-income insurance is an annuity contract

A plan fiduciary evaluating an annuity that will provide guaranteed retirement income is making a different insurance decision from checking PBGC, bonding, or fiduciary-liability coverage. ERISA’s statutory safe harbor calls for an objective, thorough, analytical search among insurers, consideration of each insurer’s financial capability, and comparison of contract cost—including fees and commissions—with benefits, features, and administrative services. The statute does not require choosing the lowest-cost contract.

Document the insurer search, financial-strength review, benefit comparison, contract expenses, administrative services, and reasons for the final selection. The annuity contract’s guarantees come from the issuing insurer under its contract; they are not PBGC guarantees of a 401(k) balance and do not replace the plan’s other compliance protections.

A practical evidence checklist

  • Current SPD and amendments.
  • Written classification of the plan as defined-benefit or defined-contribution.
  • Plan number, sponsor identity, and relevant location or employer-status information.
  • PBGC coverage correspondence or formal determination, if applicable.
  • Bond, riders, declarations, renewal evidence, surety eligibility, and claims instructions.
  • List of everyone with authority or access to plan property.
  • Prior-year amounts handled and the calculation supporting each bond limit.
  • Asset classification supporting any audit-waiver analysis.
  • Fiduciary-liability policy, endorsements, exclusions, limits, retentions, and reporting terms.
  • Minutes or memoranda documenting provider selection, monitoring, and any decision to buy coverage above a statutory minimum.

When to obtain specialist help

Ask ERISA benefits counsel or a retirement-plan compliance consultant to resolve uncertain PBGC status, exemptions, unusual asset arrangements, or bonding calculations. A specialist employee-benefits insurance broker can help compare bond and fiduciary-liability wording, but a broker is not a substitute for legal advice or a PBGC determination. Escalate promptly when a policy has shared limits across plans, a large deductible, unclear electronic-transfer coverage, a claims-made reporting problem, or a change in trustee, recordkeeper, or investment authority.

Frequently Asked Questions

Is a 401(k) covered by PBGC?

No. PBGC generally insures eligible private-sector defined-benefit pensions, not defined-contribution plans such as 401(k)s. A 401(k) balance depends on contributions, investments, and plan terms rather than a PBGC guarantee.

Where can a participant find out whether a pension is PBGC-covered?

Request the current Summary Plan Description from the employer or plan administrator. PBGC says the SPD should identify coverage. If the sponsor is uncertain, a formal PBGC coverage determination is preferable to guessing from the plan name.

Does an ERISA fidelity bond protect a fiduciary from being sued?

Not generally. The bond protects the plan against covered losses caused by fraud or dishonesty by people who handle plan property. Fiduciary-liability insurance addresses specified claims against insured fiduciaries and has separate terms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is the 10% bonding calculation always the right final limit?

It is the general minimum calculation described in DOL Field Assistance Bulletin No. 2008-04: at least 10% of funds handled in the preceding year, subject to stated minimums, maximums, exceptions, and special rules. A fiduciary may prudently choose more coverage, and current regulations and the plan’s facts should be checked.

What fiduciary-liability limit is adequate for every retirement plan?

There is no universal limit established in the official materials reviewed. Adequacy depends on the plan’s size, assets, governance, delegated functions, claims exposure, exclusions, retentions, and defense-cost structure.
