Do not decide from a product name or the phrase “trade deal.” First identify the direction of trade, classify the product under the importing country’s tariff system, verify the current tariff measure, and then prove the product’s origin and any shipment-specific conditions.
As of October 13, 2026, the official U.S. materials reviewed describe the February 6, 2026 announcement as a framework for an Interim Agreement. They do not provide a final product-by-product schedule or complete origin procedures. A lower rate is therefore unconfirmed for an individual shipment until the current implementing notices and tariff schedule support the claim.
What the India–US framework currently establishes
The White House joint statement of February 6, 2026 says the United States and India reached a framework and that its key terms will include tariff changes, rules of origin and further work toward finalization. That wording describes an announced framework, not a complete operative preference program for every product.

For Indian-origin goods entering the United States, it describes an 18% reciprocal tariff for specified categories. It also says the United States would remove the reciprocal tariff on a wider group only subject to successful conclusion of the Interim Agreement.
#1 Best Overall
A February 9 White House fact sheet reports that the U.S. reciprocal tariff on India would be lowered from 25% to 18% and that an additional 25% tariff would be removed by executive order. Those figures can change through later executive action, so they are not a substitute for the tariff schedule in force on the entry date.
The 2026 National Trade Estimate from the Office of the United States Trade Representative (USTR) and USTR’s tariff-actions index likewise describe the February announcement as a framework. The reviewed materials do not show a later India-specific product schedule or final origin procedure. Until those documents are available, treat any product-level eligibility conclusion as provisional.
The seven-part eligibility check
- Identify the importing country. The treatment for a U.S. product entering India is different from the treatment for an Indian-origin product entering the United States.
- Determine the exact tariff classification. Use the importing country’s tariff code, based on material, function, composition, technical characteristics and other customs facts. A label such as “machinery,” “textile” or “food” is not a tariff-line determination.
- Read the current tariff measure. Check the ordinary most-favoured-nation duty, any reciprocal or additional tariff, and any preferential measure for the exact tariff line, origin, entry date and applicable conditions.
- Establish customs origin. The seller’s address, shipping route or country of dispatch does not by itself make a product originating in that country.
- Check claim conditions. Look for an origin declaration or certificate, production and input records, quota limits, end-use rules, exclusions and any other requirement in the current implementing rule.
- Calculate the duty using the rule effective on entry. Keep the classification, origin analysis, rate calculation and supporting documents together in the shipment file.
- Escalate unresolved issues. A customs broker, trade-compliance adviser or applicable binding-ruling procedure may be appropriate when classification or origin facts are difficult.
Step 1: confirm the direction of trade
| Shipment | Framework treatment described in official material | What still must be verified |
|---|---|---|
| U.S. goods entering India | India would eliminate or reduce tariffs on all U.S. industrial goods and a wide range of food and agricultural goods. | The Indian tariff line, current Indian measure, effective date, origin requirement and shipment conditions. |
| Indian-origin goods entering the United States | An 18% reciprocal tariff is described for specified originating Indian categories, with broader removals conditional on successful conclusion of the Interim Agreement. | The current U.S. tariff schedule, any additional duties, the final origin rule, exclusions, quotas and entry-date requirements. |
Do not apply the announced 18% figure to every Indian product, and do not treat the U.S.-export provisions as if they were the same as the Indian-export provisions. The framework is reciprocal in concept but not uniform in product coverage or conditions.
Step 2: classify the exact product
Classification is the gateway to every later check. Begin with a technical description of what the product is, what it does, how it is made and how it is packaged. Record the principal material, constituent parts, processing, power source, intended use and whether it is imported as a complete article, component, set or unfinished good.
Use the tariff nomenclature administered by the importing country. A broad commercial category can contain lines with different ordinary duties, additional tariffs, exclusions or quota treatment. For example, “machinery” may describe many tariff lines, while “textiles” can cover different fibers, construction methods and finished articles. The framework’s category references do not replace classification.
Rank #2
If two classifications appear plausible, document why one better fits the tariff rules and product facts. Do not select the line with the lowest apparent rate without resolving the legal classification question. Where the importing authority offers a binding ruling, check that country’s procedure and timing before shipment.
Step 3: verify the current tariff schedule and effective date
For the selected tariff line, identify every layer that may apply:
- the ordinary tariff rate for the product and origin;
- any reciprocal tariff announced for the country of origin;
- additional duties imposed under another legal authority;
- a preferential or reduced rate under an operative agreement or implementing notice;
- quota, tariff-rate-quota or safeguard treatment; and
- the date on which each measure takes effect and any date on which it expires or changes.
The February 2026 statements use conditional language. The joint statement says the United States would remove the reciprocal tariff for a wider list only subject to successful conclusion of the Interim Agreement. It also describes separate treatment for certain aircraft and aircraft parts, an automotive-parts tariff-rate quota and pharmaceutical outcomes contingent on a Section 232 investigation. These measures cannot be collapsed into a general “duty-free” result.
For a live entry, use the schedule and implementing notice issued by the country collecting the duty. If a government summary and a later legal schedule differ, the current legal schedule controls the amount charged at entry. Record the version or publication date you relied on.
Step 4: prove that the product originates in the claimed country
USTR explains that “rules of origin determine whether a good is originating and qualifies for preferential tariff treatment under an FTA.” Origin is a production-based customs concept, not simply the place where a seller is located or where a parcel was shipped.
Rank #3
The White House joint statement says the countries will establish rules of origin intended to ensure that agreement benefits accrue predominantly to the United States and India. Because the reviewed framework materials do not provide the final rule, do not assume that a product assembled in India automatically qualifies. The eventual rule could address substantial transformation, regional value content, specified processing, non-originating inputs, direct shipment or other tests.

Keep bills of materials, supplier origin statements, production records, purchase invoices, manufacturing records and transport documents in a form that supports the claim. A certificate or declaration, if required, should match the shipment and the legal wording in force on the claim date.
Step 5: check quotas, end use, exclusions and investigations
A product can fit a named category and still fail a claim because of a condition attached to the measure. Check each of these separately:
- Quota or tariff-rate quota: Determine whether the shipment falls within an available quantity, who administers the quota and what happens after the quota is filled.
- End use: Confirm whether a reduced rate depends on use in a specified industry, facility or application, and identify any post-entry recordkeeping.
- Exclusions: Read the tariff line and annexes for products removed from the category or excluded from the reduction.
- Investigations: A measure linked to an investigation, such as the announced pharmaceutical outcome tied to a Section 232 investigation, is not a completed preference.
- Effective-date rules: Verify whether the product was entered, exported or entered for consumption during the period covered by the notice.
Product categories named in the framework
U.S. products entering India
The joint statement names U.S. industrial goods and a broad range of food and agricultural products, including dried distillers’ grains, red sorghum for animal feed, tree nuts, fresh and processed fruit, soybean oil, wine and spirits. These are examples of the framework’s stated scope, not proof that every item in a commercial category receives a lower rate. Confirm the Indian tariff line and all conditions for the shipment.
Indian-origin products entering the United States
The statement describes an 18% reciprocal tariff for specified originating Indian categories, including textiles and apparel, leather and footwear, plastic and rubber, organic chemicals, home décor, artisanal products and certain machinery.

It separately says reciprocal tariffs may be removed for a wider list, including generic pharmaceuticals, gems and diamonds and aircraft parts, subject to successful conclusion of the Interim Agreement. Aircraft and aircraft parts have separate treatment in the statement, while automotive parts are described with a tariff-rate quota. These distinctions matter: a product in one named sector cannot borrow the treatment described for another.
How to read India’s category summaries
A February 9, 2026 Government of India backgrounder reports category-level outcomes for Indian exports, including textiles, leather and footwear, gems and jewellery, home décor, toys, machinery and certain agricultural products. It is useful context, but a government summary does not establish the exact U.S. tariff classification, origin qualification or shipment documentation. For a U.S. import, use the current U.S. legal schedule to determine the duty charged at entry.
Documents to assemble before claiming a lower rate
- Commercial invoice with a precise product description.
- Technical specifications, drawings, photographs or laboratory information supporting classification.
- Bill of materials and manufacturing flow showing where processing occurred.
- Supplier declarations or other records supporting the origin of inputs.
- Purchase orders, production records and transport documents linking the evidence to the shipment.
- Required origin declaration or certificate in the format specified by the current rule.
- Quota allocation, license or end-use records, where applicable.
- A copy of the tariff schedule, implementing notice and rate calculation used for the entry date.
Retain documents for the period required by the administering customs authority. A preference claim should be reproducible by someone reviewing the file after entry, not based on a sales description or an email assertion.

Using the seller’s country as origin
A seller in India may resell goods made elsewhere, and goods shipped through India may retain another country’s origin. Trace production and apply the operative origin rule.

Using a sector label instead of a tariff line
“Food,” “machinery” or “apparel” is too broad to establish a rate. Classification determines which legal text applies.

Treating an announcement as an implemented preference
The February statements describe terms that would be included and work toward finalization. They do not, by themselves, establish a current rate for every product.
Ignoring additional measures
An announced reciprocal rate may sit alongside ordinary duty, another additional tariff, a quota or a trade-remedy measure. Calculate the complete stack for the entry date.
Assuming conditional language is automatic
“Subject to successful conclusion,” an investigation or a quota means another legal step remains. Do not claim the outcome before that step is satisfied.

USTR’s 2026 National Trade Estimate reports India’s 2024 average applied most-favoured-nation tariff rates as follows:
| Measure | India’s 2024 average applied MFN rate | How to use it |
|---|---|---|
| Overall average | 16.2% | National average only; it does not predict a particular tariff line. |
| Non-agricultural goods | 13.0% | Sector-level context, not a preferential or shipment-specific rate. |
| Agricultural goods | 36.7% | National average that cannot establish eligibility for a named food product. |
The Government of India’s 2026 backgrounder reports USD 86.35 billion in exports to the United States in 2024. That is trade context, not a test for whether a product qualifies for a lower tariff.
When to obtain specialist help
Get a customs broker or trade-compliance adviser involved when the product has multiple materials or functions, manufacturing spans several countries, the classification is disputed, a quota is involved, or the origin evidence is incomplete. Ask the adviser to identify the tariff line, legal measure, origin rule, documents and assumptions in writing. No service provider can guarantee a lower duty merely because a product appears in a public category summary.
If the framework becomes an operative agreement, repeat the analysis using the final text and implementing procedures. Monitor notices from U.S. Customs and Border Protection, USTR and the relevant Indian customs or commerce authority, and replace provisional assumptions in the shipment file with the current legal documents.
A practical decision record
Before filing an entry or making a buyer-facing tariff statement, your record should answer these questions in order:
Quick Recap
- Which country is importing the goods?
- What exact tariff code will appear on that country’s entry?
- What ordinary and additional duties apply on the intended entry date?
- What country of origin does the applicable rule assign to the finished product?
- Does the current implementing measure grant a preference to that origin and tariff line?
- What declaration, certificate, production evidence, quota, end-use rule or exclusion applies?
- Who reviewed unresolved classification or origin issues, and what ruling or written advice supports the conclusion?
