To find out whether an employer has sponsored H-1B workers before, search the USCIS H-1B Employer Data Hub, then cross-check the employer in the Department of Labor’s OFLC LCA disclosure files. Treat both as historical evidence, not a promise: a Labor Condition Application (LCA) is not a USCIS petition approval, and neither database tells you whether the employer will sponsor your specific job now. Ask the recruiter or HR contact about the role, worksite, and your circumstances directly.
What the two databases can—and cannot—tell you
The USCIS H-1B Employer Data Hub is the more direct place to check an employer’s historical H-1B petition activity and decisions. The Department of Labor’s Office of Foreign Labor Certification (OFLC) disclosure files show a different step: employer LCA filings and their associated information. These records answer related questions, but they are not interchangeable.
| Record source | What it covers | Best use | What it does not establish |
|---|---|---|---|
| USCIS H-1B Employer Data Hub | Petition data and first decisions. USCIS’s 2026 report describes coverage from fiscal year 2009 through fiscal year 2024, with quarterly updates. | Checking for an employer’s historical H-1B petitions and decisions. | Whether the employer will sponsor a future vacancy or a particular candidate. |
| DOL OFLC LCA disclosure files | Employer LCA applications and attestations, in quarterly disclosure files. | Cross-checking labor-condition filings and examining their recorded details and status. | Whether USCIS received or approved an H-1B petition. |
The USCIS scope above comes from its Characteristics of H-1B Specialty Occupation Workers, Fiscal Year 2024 report, published in 2026. The DOL OFLC Performance Data page listed FY 2025 quarterly files and FY 2026 Q3 data when checked on October 9, 2026; file availability changes, so use the agency page’s current inventory when searching. USCIS and DOL publish separate records because they track different parts of the process.
Think of the databases as answering different historical questions. USCIS records help you ask, “Is there petition history and what decision information is shown?” DOL records help you ask, “Is there an LCA record, and what does its status and detail show?” Neither one answers, “Will this hiring team sponsor me for this opening?” A company can have past records and still decline sponsorship for a particular role, worksite, or candidate. Conversely, not finding a name in one search does not settle the employer’s full history.
Step 1: Search USCIS for the employer’s petition history
- Open the USCIS H-1B Employer Data Hub. Search the employer name you have, including the name used in the job posting or offer materials.
- Try plausible name variants. Search the formal company name as well as abbreviations or alternate forms you can verify from the employer’s own materials. A company may appear under a legal-entity name that differs from its recruiting brand or familiar short name.
- Use available filters to narrow the results. Where the Hub offers them, refine by fiscal year, NAICS code, city, state, or ZIP code. These filters can help separate records associated with different places or kinds of activity, but they do not by themselves prove that a result is the hiring entity.
- Check identity before drawing conclusions. Compare the name and available identifying details with the legal employer named in the job materials. USCIS identifies employers using the last four digits of tax identification numbers. Similar names alone are not enough to establish that a result belongs to the company making your offer.
- Review the results as historical records. Note the fiscal year and petition decision information shown. The Hub’s reported range in the 2026 USCIS report is FY 2009–2024, so a search there should not be treated as confirmation of activity beyond the years covered in that source.
A result is useful evidence that an entity matching the record has petition history. It is not an assurance that a different legal entity in the same corporate family is the petitioner, or that the same employer will sponsor a new hire today. If the name or location does not fit, do not treat the result as a match merely because it looks close.

When you review a result, keep track of the entity name, any available identifier details, location, fiscal year, and decision information. Those details help you compare it with the employer named in your offer or recruiting materials. A city or ZIP code match can be useful context, but it is not proof of corporate identity; likewise, a similar name can belong to an unrelated employer. If you find multiple plausible entries, keep them separate until you can confirm which entity is connected to the job.
Step 2: Cross-check the employer in DOL LCA files
- Open DOL OFLC’s Performance Data page. Locate the LCA disclosure files and the record layouts for the relevant fiscal year or quarter. The layouts explain the fields in each file.
- Search for the employer name. Try the exact legal name and reasonable alternate forms, as you did in USCIS. If the files are organized by period, check the relevant years or quarters rather than relying on a single file.
- Read the record status and fields carefully. Pay attention to whether an LCA is categorized as filed, certified, withdrawn, or otherwise labeled in the particular file. Use the corresponding record layout to interpret what a field means rather than inferring its meaning from a column name alone.
- Compare the employer and worksite details. Look for details that help determine whether a record concerns the same legal entity and relevant location as the job you are considering. A name match without a reliable entity match is not enough.
DOL’s Performance Data page listed quarterly disclosure data, including FY 2025 files and FY 2026 Q3 data at the October 9, 2026 access date. Use the agency’s live inventory to see what is currently posted; do not assume every period is available in every file format or that the latest quarter reflects the employer’s present hiring policy.

Use the record layout alongside the file rather than treating a data row as self-explanatory. The status category matters: a filed record, a certified LCA, and a withdrawn record do not all describe the same outcome. The file may also contain information that helps distinguish employers or worksites, but a matching location or name should be treated as a clue to verify, not as a substitute for checking the legal entity.
How to interpret an LCA record
An LCA is part of the process before an employer can proceed with the USCIS and Department of State process. DOL explains that an employer submits an LCA and that a certified LCA allows it to proceed. That sequence matters: an LCA filing, including a certified one, is not itself proof that the employer filed a petition with USCIS or received an approval.

- Filed does not mean certified. The record shows an LCA filing at the DOL stage; check its status rather than treating every filed record as an approved labor-condition application.
- Certified does not mean USCIS-approved. Certification is a DOL-stage outcome. It does not establish that a corresponding H-1B petition was submitted, approved, or associated with your job.
- Withdrawn or other statuses need their own interpretation. Read the label and record layout for the specific file. Do not count every entry as a completed sponsorship or infer a petition outcome from an LCA status.
- A petition decision is still historical. USCIS data can show past petition activity and decisions, but those records do not state the employer’s current intent for a particular opening.
For that reason, the most useful reading is a staged one: DOL records can show activity at the LCA stage; USCIS records are the more direct public source here for petition history and decisions. Neither replaces a current answer from the hiring employer.
It can help to describe what you found precisely. For example, say that you located an LCA record and identify the status shown, rather than saying that the company “got an H-1B approved.” If you find a USCIS petition record, describe it as historical petition activity and note the year and decision information. Accurate wording avoids turning evidence of one step into a claim about a later step the record does not show.

How to match a record to the company making your offer
Employer searches can be difficult to interpret when a business has subsidiaries, affiliates, acquired companies, or multiple legal names. A parent company’s filing is not automatically a filing by its subsidiary, and a record for a similarly named employer is not automatically connected to your prospective workplace.
- Compare the legal employer named in your offer, application, or recruiting materials with the entity in the record.
- Check whether the result’s location is consistent with the office or worksite relevant to your role.
- Use USCIS’s available employer identifier details, including the last four digits of the tax identification number, where they are available for comparison.
- Keep separate records for a parent, affiliate, or similarly named company unless you can confirm the connection to the hiring entity.
- If you cannot confidently match the entity, describe the result as a possible related record—not proof that your employer sponsored a worker.
A missing result also has limits. The search may use a different legal name or abbreviation, the relevant entity may not be the one you searched, or the period you need may not appear in the dataset you checked. USCIS’s cited Hub scope runs through FY 2024, while DOL posts separate quarterly files. A name not appearing in one search is not proof that the employer has never sponsored an H-1B worker.
Corporate relationships are a frequent source of false certainty. A record under a parent name might be relevant to understanding a company group, but it does not by itself show that the parent is your employer or that a subsidiary will sponsor this role. Acquisitions and abbreviations can also make names differ across materials and records. If the match matters to your decision, ask which legal entity would employ you and whether that entity—not just a related organization—would handle sponsorship.

Ask whether this specific job offers sponsorship
Once you have checked the records—or if the records are inconclusive—ask the recruiter or HR contact directly. Make the question specific enough to distinguish your job from the employer’s general history. For example:
Recommended Free Tools
“Does this specific role and worksite support H-1B sponsorship for my situation? If so, would the company consider a new H-1B petition or a transfer, and are there role, timing, or candidate conditions I should know about?”
You can also ask whether the employer sponsors this job family and whether the answer differs by worksite. If an earlier database result concerns another entity, ask which legal entity would employ you and whether that entity handles the sponsorship. Recruiters and HR can clarify the employer’s current policy; a public filing cannot answer those role-specific questions for them.
Ask early enough in the hiring process to understand whether sponsorship is available before making a decision based on an assumption. If the answer is conditional, clarify what the condition is and whether it applies to this vacancy and your circumstances. A general statement that the organization has sponsored workers before does not settle the question for this opening.
For a useful answer, make clear what you mean by sponsorship. You can ask whether the employer would consider a new H-1B petition or a transfer, whether it sponsors this job family, and whether the worksite affects the answer. Ask about any timing or candidate conditions that matter in your situation. These are questions about the employer’s policy for the vacancy; a database search cannot resolve them, even when it shows prior petition activity.

If a recruiter says the company has sponsored before, follow up with whether the same policy applies to this role and the legal entity hiring you. If the answer is “it depends,” ask what it depends on and whether the condition can be evaluated before you accept an offer. A clear, role-specific response is more useful than an informal assurance based only on the employer’s past filings.
What to do when the records and the employer’s answer differ
A discrepancy does not automatically mean that either the records or the employer’s statement is wrong. The search may have matched a related entity, an abbreviated name, or a different worksite. The databases also represent different stages and periods, while an employer’s answer should address its current policy for the role.
- Ask which employing legal entity is relevant. Compare its name with the name on the record and with the employer named in your job materials.
- Ask what the record represents. If the employer recognizes the filing, clarify whether it was an LCA or a USCIS petition and which stage or outcome it reflects.
- Check the period and status. Make sure you are not treating an older record, a filed LCA, or a withdrawn item as a current approval or policy statement.
- Request a clear answer for the vacancy. Confirm whether the company supports sponsorship for this job, worksite, and candidate situation, rather than relying on a general company-level answer.
DOL’s H-1B public-access rules provide another route for reviewing LCA materials: a worker or member of the public may inspect them at the employer’s principal place of business or the worksite within one working day of filing. This access concerns LCA materials; it does not turn those materials into USCIS petition decisions.
If a record appears to conflict with what you were told, use the distinction between stages as a starting point. The company may have an LCA record without a corresponding USCIS petition approval in the data you checked; the USCIS and DOL files also have different coverage and update schedules. Ask the employer to explain the specific record and separately confirm the current policy for your job. Do not use an old company-level filing as a substitute for that confirmation.

- Calling every LCA a sponsorship approval. An LCA is a DOL-stage record, not a USCIS petition decision.
- Assuming a past petitioner will sponsor you. Historical activity cannot confirm the employer’s current decision about a particular job or candidate.
- Counting a parent or affiliate as the hiring employer. Verify the legal entity instead of assuming that company-group relationships make records interchangeable.
- Reading a blank search as proof of no history. Check name variants, entity details, filters, and dataset coverage before interpreting no result.
- Using an unrelated credential as a shortcut. E-Verify enrollment is a separate employment-verification program, not evidence that an employer sponsors H-1B workers.
- Relying on unofficial sponsor lists as if they were agency records. For this check, USCIS and DOL provide the relevant public datasets; third-party compilations should not replace verification against the underlying records.
Also avoid treating a count of past records as a prediction of your chances. These public datasets describe prior activity and outcomes; they do not establish an employer’s likelihood of sponsoring a particular applicant or its intentions for a specific vacancy. The useful next step after a historical search is verification, not an assumption.

A practical decision rule
Use USCIS to look for historical petition activity and decisions, and DOL to cross-check LCA activity. Verify that any result belongs to the legal entity relevant to your offer, and interpret each record according to its stage and status. Then ask recruiting or HR whether the specific role and worksite supports a new H-1B petition or transfer for your circumstances. That direct, role-specific answer—not a company’s historical filing count—is what resolves whether this job offers sponsorship.
Frequently Asked Questions
How do I check if a company sponsors H-1B visas?
Search the company in the USCIS H-1B Employer Data Hub for historical petition activity and decisions, then search DOL OFLC’s LCA disclosure files for labor-condition filings. Compare legal names, available employer identifiers, locations, years, and record statuses. Then ask recruiting or HR whether the specific role and worksite supports sponsorship for your situation; neither database confirms current policy for a vacancy.
Does an LCA mean the employer sponsored an H-1B worker?
No. An LCA is a Department of Labor-stage filing. DOL explains that a certified LCA allows an employer to proceed with the USCIS and Department of State process, but the LCA itself does not establish that a USCIS petition was filed or approved. Check the LCA status and use USCIS petition records for historical petition activity and decisions.
Can I tell from a past USCIS petition that this job offer includes H-1B sponsorship?
No. A historical petition record shows past activity and decision information for an entity; it does not state whether the employer will sponsor this opening, worksite, or candidate. Ask the recruiter or HR contact whether the specific job supports a new petition or transfer and what timing or candidate conditions apply.
What if I cannot find the employer in the USCIS or DOL records?
Do not assume a missing result proves the employer has never sponsored. Try the legal name and verified abbreviations, check relevant fiscal years or quarters and available filters, and consider whether a subsidiary, affiliate, or other legal entity is involved. USCIS’s FY 2024 report describes Hub coverage through FY 2024, while DOL posts quarterly files. Confirm current policy directly with the employer.
Can I inspect an employer’s LCA materials?
DOL public-access rules allow a worker or member of the public to inspect LCA materials at the employer’s principal place of business or the worksite within one working day of filing. Those materials concern the LCA stage; they are not USCIS petition decisions.
The Bottom Line
USCIS is the more direct public source for historical H-1B petition activity and decisions; DOL LCA files show a separate stage and do not prove petition approval. Match records to the right legal entity, then ask HR or recruiting whether this specific job and worksite supports sponsorship for your circumstances.
