There is no universal yes-or-no rule. A mural visible in a public place may still be copyrighted artwork. Before you post, publish, license, advertise with, or print a mural photograph, identify the country, define exactly how the image will be used, read the local exception for public art, and check the location’s access rules. If no clear exception covers both the mural and your intended use, obtain written permission from the rights holder.
Start with the decision that matters: what will you do with the image?
“Can I take a picture?” can describe several legally different acts. Keeping a photograph privately is not the same as communicating it to the public, licensing it to a client, or reproducing it on products. Analyze the most extensive use you expect, not merely the moment you press the shutter.

A single photograph can involve several permissions: permission to be on the property, copyright in the mural, copyright in the photograph, and sometimes contractual or moral-rights conditions. Keep those questions separate.
Understand the two copyrights in a mural photograph
The mural may be a protected visual work
Original paintings and other original visual works can be protected by copyright. Protection generally arises when the work is fixed; a mural painted on a wall is still a work of visual art even though it is outdoors and publicly visible. The artist is generally the initial copyright owner, subject to arrangements such as a work-made-for-hire rule, an assignment, or a commission contract that changes ownership.

Copyright owners control specified uses, including reproduction, distribution, public display, and certain adaptations, subject to statutory exceptions and limitations. The fact that anyone can see the mural does not by itself authorize making and distributing a faithful image of it.
The U.S. Copyright Office also explains that “The public display of artwork, in and of itself, does not constitute publication.” Public display and permission to reproduce are different concepts.
Your photograph can be a separate work
The person who takes an original photograph is generally its initial copyright owner. That ownership covers the photographer’s creative choices—such as composition, timing, lighting, and perspective—but does not automatically transfer or cancel rights in the mural depicted. A photographer can therefore own copyright in the photo while the mural artist, commissioner, or assignee retains rights in the artwork.

If a client hired you, check the contract before assuming you own the photograph. A work-made-for-hire clause, an assignment, or a broad licence may change who can publish or license the image. That contract still does not necessarily answer whether the mural itself may be reproduced.

Check the country and the market where the image will be used
Record the country in which the mural is located and, where relevant, the territory or locality. If you will publish or sell the image in several countries, examine the important destination markets as well as the place where you took the photograph. Copyright exceptions are territorial; a rule that works in one country cannot be assumed to travel with the file.
Search the current legislation or guidance of the relevant government copyright office for terms such as freedom of panorama, public-place exception, incidental inclusion, or works permanently situated in a public place. Read the actual text, including definitions and subsections. Check five details:
- Whether two-dimensional paintings or graphic works are covered, rather than only buildings or three-dimensional works.
- Whether the work must be permanently situated in a public place.
- Whether the exception distinguishes private or non-commercial use from commercial use.
- Whether it permits only making the photograph or also its distribution, communication, licensing, or sale.
- Whether other conditions, such as attribution or limits on editing, apply.
“Freedom of panorama” is a label, not a single worldwide rule. Countries can use the term for materially different exceptions, and some do not provide a broad exception for murals at all.
What the cited country examples show
The following examples demonstrate why the exact statutory wording matters. They are not a complete survey and are not a substitute for checking the current law of the country involved.

In the United Kingdom, the statutory wording says that, for the categories covered by the subsection, “The copyright in such a work is not infringed by—(a) making a graphic work representing it, (b) making a photograph or film of it, or (c) making a broadcast of a visual image of it.” The categories in the preceding subsection are the reason you must verify whether the mural fits; the quotation is not a general mural licence.
Use a practical clearance sequence
- Pin down the jurisdiction. Write down the mural’s country and, if relevant, state, province, territory, or local authority. List every important country in which the finished image will be released, sold, or displayed.
- Describe the image and the use. Note whether the mural is the main subject, how much of it appears, whether you will crop or alter it, and whether the use is private, social, editorial, educational, promotional, commercial, or merchandise-related.
- Treat the mural as potentially protected. Identify the artist, the commissioning body, and the date or project under which it was created. Ask whether a contract assigned copyright or granted a public-art licence.
- Read the local exception. Use the current government legislation or copyright-office guidance. Confirm the covered work type, permanence and public-place requirements, commercial restrictions, and whether distribution or communication is included.
- Check access and site terms separately. Determine whether you were lawfully in the location. Read posted signs, ticket conditions, venue policies, filming rules, and property-owner instructions. A wall visible from a public street may stand on private property.
- Document the result. Save the relevant rule, the date you checked it, site photographs of any posted terms, and correspondence with the artist, owner, or venue. Record the exact version of the image and the uses approved.
- Ask for permission when the answer is uncertain. Obtain a written licence before a high-value, broad, or commercial release. If the rights holder cannot be found, make and document a diligent search rather than silently assuming that public visibility is consent.
Find the person who can grant permission
The person who owns the wall is not necessarily the person who owns the mural copyright. Start with the artist’s signature, the project’s website or plaque, municipal or arts-agency records, the property owner, and the organization that commissioned the work. A city may own the physical wall while the artist retains copyright; alternatively, a commission contract may have assigned rights.
Ask specifically who owns copyright, who can license the requested use, and whether any co-creators or incorporated third-party material must also consent. Keep names, dates, and written confirmations in your project file. If a rights holder has died or a company has dissolved, determine who legally succeeded to the rights before relying on an informal contact.
What a written licence should identify
- The exact photograph or crop, with a file name or attached proof.
- Every medium and platform: website, social networks, print, packaging, video, outdoor display, or stock licensing.
- Territory, term, number of reproductions, and whether the licence is exclusive.
- Whether advertising, sponsorship, merchandise, resale, or sublicensing is permitted.
- Allowed edits, overlays, cropping, color changes, and combinations with logos or text.
- Required credit, notices, artist approval, takedown procedure, and fee.
Do not rely on a verbal “sure” for a campaign or product run. The permission should match the real use, not merely the act of taking the picture.

Apply the rules to common situations
Taking a phone picture for yourself
First confirm that photography is allowed at the location and that you are not trespassing or violating a venue condition. Private storage usually involves fewer distribution questions than publication, but it does not create a right to enter restricted property or defeat a posted no-photography rule.
Posting the mural on a personal account
A public post makes the image available to others and can reproduce and communicate the mural. Check whether your country’s exception covers graphic works and non-commercial communication. A personal account may still carry advertising, sponsorship, paid promotion, or merchandise links, which can change the analysis. Avoid tagging a business or presenting the artist’s work as an endorsement unless you have permission.
Using the image in a news or educational article
Assess whether the mural is incidental background or the article’s principal subject. Editorial purpose may be relevant under some laws, but it is not a universal defence. Keep the image proportionate to the reporting, identify the artist when known, and obtain clearance if the mural is the feature image, the article is monetized, or the governing exception is unclear.

Assume that commercial clearance is needed unless a clearly applicable local exception says otherwise. Advertising can imply sponsorship or association, and a prominent mural may be the visual asset that sells the product. Obtain a licence that expressly covers paid media, client use, territory, duration, edits, and re-use.

Printing it on shirts, posters, or other merchandise
Merchandise normally involves repeated reproduction and distribution. A permission to post a photograph online does not automatically authorize manufacturing goods. Get a product-specific licence, including the permitted quantity or term, and confirm whether the artist requires approval of the final design.
Separate copyright from property and privacy issues
Copyright is only one part of the clearance. A mural may be on private land, inside a transit system, at a festival, or in a venue with contractual photography terms. A street view does not prove that you were entitled to enter the site or that the owner permits commercial photography. Check signs, tickets, leases, event rules, and instructions from security or management.
Other people, trademarks, logos, or private information captured in the frame can create separate issues. Reframe or blur unrelated material where appropriate, but do not assume that editing a mural photo removes the mural’s copyright. If the image will be used commercially, obtain releases or remove incidental people and identifiers when your legal review requires it.

Common mistakes and how to correct them
- “It is outdoors, so it is public domain.” Outdoor location does not erase copyright. Recheck the artwork’s authorship and the local exception.
- “I took the photo, so I own everything in it.” You may own the photograph while another person owns the mural. Separate the two rights.
- “Freedom of panorama covers every public artwork.” Compare the statute’s work categories and commercial limits; some rules focus on buildings or three-dimensional works.
- “A social post is private.” Public posting communicates the image to others. Analyze it separately from private storage.
- “Permission from the property owner is enough.” Wall ownership and mural copyright can belong to different people. Obtain consent from the party authorized to license the artwork.
- “A credit line substitutes for permission.” Attribution may be required or courteous, but it does not itself grant reproduction rights.
- “A verbal approval covers future campaigns.” Get the platforms, territory, term, edits, and commercial context in writing.
Keep a one-page clearance record
For each mural image, record:
- Location, date, and how you accessed the site.
- Artist, commissioner, property owner, and contact details, if known.
- The country and other markets in which the image will appear.
- A plain-language description of every planned use.
- The official rule reviewed, its date, and the specific work category and conditions relied on.
- Copies of site rules, permissions, licences, emails, and attribution instructions.
- Any unresolved issue and the person who approved proceeding.
This record will not create an exception that the law does not provide, but it prevents the most common factual mix-ups and gives your publisher or client a clear basis for the decision.
When to obtain legal advice
Consult a lawyer in the relevant jurisdiction when the image is central to a paid campaign, a large merchandise run, a high-traffic publication, a dispute, or a project spanning several countries. Advice is especially important when ownership is disputed, the artist cannot be located, the mural contains multiple contributors, or a public-art contract has unusual terms. A lawyer can assess the current statute and the specific facts; a generic online statement cannot do that for an unidentified mural.
