To check an imported building material, document exactly what it is and where it was made, classify it under the Harmonized Tariff Schedule of the United States (HTSUS), verify country-of-origin marking, identify every partner-agency requirement, and review any antidumping or countervailing-duty (AD/CVD) order whose written scope covers the product. Then file the required entry data, declarations, permits and certifications, and retain evidence supporting each decision.
Building materials is not a customs classification. A shipment’s compliance depends on its material, dimensions, composition, processing, producer, origin and intended use. Without those facts, no exact HTSUS code, duty rate, permit decision or AD/CVD conclusion can be made.
Start with a shipment-specific product description
Before looking up a tariff number or filing an entry, create a technical description that another compliance professional could use to identify the merchandise without seeing the invoice. Include:

- Material and composition, including chemical composition for metal products.
- Dimensions, shape, thickness, grade and finishing.
- Processing performed in each country, such as planing, coating, welding, machining or assembly.
- Intended use and whether the item is a finished article, component, raw material or packaging.
- Manufacturer, producer, exporter and country where the relevant production occurred.
- Commercial documents, specifications, drawings, test reports and photographs that support the description.
U.S. Customs and Border Protection (CBP) expects cargo descriptions to identify the commodity’s size, shape and characteristics. A description such as building materials is too vague. For metal, a useful description might distinguish a beam, plate, pipe, tube or reinforcing bar and state the grade, dimensions and coating. For wood, identify the species or plant components, degree of processing and whether bark remains.

Write the description before asking a broker to classify the item. If the supplier uses a different trade name, map that name to the technical description and resolve discrepancies before shipment. Photographs of labels, bundles, panels and packaging can be valuable when the product is inspected.
Use this compliance workflow
-
Record the material and production facts
Obtain the supplier’s complete specification and manufacturing history. Ask where each major processing step took place, not just where the shipment was loaded. Keep the producer’s legal name and address, because trade-remedy coverage can depend on the producer as well as the origin. For products assembled from several inputs, list each major component and its origin.
-
Determine the HTSUS classification
Use the material’s objective characteristics and condition at import to determine its HTSUS classification. Classification affects duty treatment and can be central to quotas and other restrictions. Several headings may appear plausible for a construction product, so document the reasoning, explanatory notes or rulings used.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy. An HTSUS number is a starting point, not a complete compliance decision. The same number can appear in agency rules or AD/CVD instructions, and a listed number may be only an administrative aid. Do not treat classification alone as proof that an agency permit or trade-remedy requirement is absent.
Review classification whenever dimensions, coating, assembly state, material mix or intended use changes. Keep the complete tariff provision, not just a shortened commercial code, in the file and make sure the number transmitted to the entry matches the approved analysis.
-
Verify origin and marking
Goods imported for use in the United States generally must be marked with their country of origin. Determine origin from the actual production and processing facts; the country from which the cargo ships is not automatically the country of origin.
Check whether the marking is on the product, container or another permitted location and whether it is legible and durable. Origin can also control eligibility for trade remedies and other restrictions, so retain records showing how the origin conclusion was reached. Compare the marking on cartons, bundles and individual articles with the origin shown on the invoice and entry data.

Identify partner-agency controls
CBP entry does not replace requirements administered by other federal agencies. Depending on the merchandise, controls can involve the Environmental Protection Agency (EPA), U.S. Department of Agriculture’s Animal and Plant Health Inspection Service (USDA/APHIS), Consumer Product Safety Commission (CPSC), Department of Transportation (DOT), Food and Drug Administration (FDA) or another agency.
For each applicable agency, determine whether the shipment needs a permit, declaration, certification, product test, labeling, warning, treatment or electronic data message. Confirm whether the agency requirement applies to the material itself, a finished product containing it, or its packaging. Record the agency contact or current instruction used and the date checked.
-
Search current AD/CVD orders by written scope
For steel, aluminum and other products subject to trade-remedy proceedings, review the current Commerce Department order and its written scope using the exact physical and technical characteristics and origin. Commerce states that the written scope controls. HTSUS numbers listed in an order are generally for convenience and do not decide coverage by themselves.

Prepare the entry and supporting filings
Coordinate the entry type, tariff data, agency indicators and required documents with the filer or broker. CBP’s general sequence is entry declaration, cargo release, entry summary and payment of estimated duties. Make sure the commercial invoice, packing list, bill of lading, origin evidence and any permits or certificates describe the same merchandise.
Ask the filer to confirm which data must be transmitted in ACE and whether an agency message, certificate number or declaration accompanies the entry. Resolve missing information before arrival whenever possible; a late or inconsistent filing can delay release and require correction.
-
Retain the compliance file
Keep supplier specifications, invoices, origin support, classification analysis, permits, certificates, declarations, entry data and correspondence. Set a review date for products whose agency rules or trade-remedy scopes can change. Preserve the version or date of online instructions consulted so a later reviewer can understand the decision.
What must be filed and when
CBP’s general help guidance describes a cargo-release filing within 15 calendar days after arrival and an entry-summary filing within 10 working days after entry or release, with estimated duties deposited on the applicable schedule. The exact deadlines and data elements depend on the entry type, transport mode and current CBP rules, so confirm them for the shipment rather than applying these intervals mechanically.

An importer filing on its own account does not have to hold a customs-broker license. A person conducting customs business for another party must be licensed. A licensed customs broker can help organize classification, entry and partner-agency submissions, but the importer remains responsible for accurate product facts, required permits and truthful filings. Broker service charges and any government fees depend on the transaction; obtain a written quote and clarify which filings are included.
Wood merchandise: distinguish the product from its packaging
Finished lumber and other processed wood
Processing determines which plant-health controls apply. Under the described CBP guidance, finished lumber that is planed on every side and contains no bark does not require fumigation, heating or a USDA import permit. It can still be inspected and may require a Lacey Act declaration identifying the origins of component plant materials.
Logs, unmanufactured lumber and other less-processed wood can require USDA permits and additional plant-health measures. Do not extend the finished-lumber treatment to a different product heading or processing level. Verify the material’s actual condition and the current APHIS scope before shipping. A product that is merely cut to length, retains bark or contains untreated natural wood should not be assumed to qualify as finished lumber.
Lacey Act declarations
The Lacey Act prohibits importing illegally harvested plant products and requires declarations for products within designated HTSUS chapters or headings. APHIS defines the products covered by the declaration requirement. The declaration can require the scientific names and countries of harvest for plant components, so obtain that information from the producer before the cargo is tendered.

Wood packaging
Wood packaging is regulated separately from wood imported as merchandise. Dunnage, pallets, crates and similar packaging must be treated and marked under the applicable official program. CBP considers unmarked regulated wood packaging untreated and noncompliant; the stated remedy is export, not fumigation at the U.S. border.
New wooden products classified in HTSUS 4415 may separately require a Lacey Act declaration. CBP also describes exceptions for certain packaging-only and used, recycled or reclaimed packaging. Apply an exception only after confirming that the packaging’s precise facts meet the current rule. Tell the supplier that packaging marks must be visible and legible before loading, and photograph them as part of the shipping file.
Composite wood and EPA TSCA Title VI
EPA’s Title VI requirements cover hardwood plywood, particleboard, medium-density fiberboard (MDF) and thin MDF, along with covered component parts and finished goods containing those panels. The importer should obtain a written TSCA Title VI compliance statement from the supplier and retain it with the shipment file.
Recommended Free Tools
EPA guidance says to retain bills of lading, invoices or comparable supplier documents containing the compliance statement for three years. If EPA requests records, the importer must make information identifying the panel producer and production date, and the supplier and purchase date, available within 30 days. Ensure the statement travels with records for finished goods, not only raw panels, when the finished product contains covered composite wood.
The referenced EPA page is archived. Before a live entry, verify the current regulation, certification wording, electronic filing instructions and any effective-date provisions rather than relying on an old form or statement. Ask suppliers to update their statement when the panel producer, production date or purchase source changes.
Steel, aluminum and AD/CVD risk
Construction inputs made of steel or aluminum deserve a product- and origin-specific trade-remedy review. Commerce announced final determinations on corrosion-resistant steel products from ten trading partners on August 26, 2025, describing uses in commercial and residential buildings and other construction. That announcement is an example of a proceeding; it does not establish that every steel building product or every country is covered.
How to compare a product with an order
- Match the imported item to the order’s physical description and dimensions.
- Compare chemical composition, grade, coating and surface treatment.
- Review manufacturing steps, including forming, welding, slitting, galvanizing or other processing.
- Read every listed exclusion and its conditions.
- Confirm exporter, producer and country of origin.
- Check the current case instructions for cash-deposit or certification requirements.
Do not stop because the HTSUS number appears in, or is absent from, an order. Commerce’s written scope controls. When a reasonable reading still leaves uncertainty, use the formal scope-ruling process and preserve the request and result in the entry file. Do not rely on a supplier’s statement that a product is not subject to an order unless the physical facts and written scope support that conclusion.
Build a decision record that can be audited
A practical file should let a reviewer reconstruct the decision without relying on a conversation with the supplier. Organize it in this order:
- Product identity: specification, drawings, photographs, composition, dimensions and intended use.
- Supply chain: producer, exporter, manufacturing locations and origin analysis.
- Classification: selected HTSUS provision, alternatives considered and supporting rationale.
- Agency review: permits, declarations, certifications, treatment records and electronic filing confirmations.
- Trade remedies: orders searched, scope comparison, exclusions and any scope ruling.
- Entry evidence: invoice, packing list, transport document, release data, entry summary and duty payment.
- Retention controls: owner of the file, retention period and date for checking rule or scope changes.
Use a shipment or purchase-order identifier on every document. If a supplier sends a revised specification, preserve the superseded version and note which version governed the entry. This prevents a later reviewer from applying a current product description to an earlier shipment.
Compare the available filing routes
| Issue | Primary approach | When another approach may apply |
|---|---|---|
| Lacey Act declaration | File through ACE with the required plant information. | LAWGS may be used for particular circumstances, including specified foreign-trade-zone filings. |
| Customs entry preparation | Importer may file for its own account if it can support the data. | Use a licensed customs broker when another party conducts customs business or the shipment involves complex agency and trade-remedy issues. |
| AD/CVD uncertainty | Compare the merchandise with Commerce’s written scope. | Request a formal scope ruling when the text and product facts do not produce a reliable answer. |
| Wood packaging problem | Prevent loading with untreated or unmarked regulated packaging. | CBP’s stated remedy for noncompliant packaging is export, not fumigation at the border. |
These are not universal choices. The correct route depends on the product, origin, processing, entry type and current instructions.

When professional help is warranted
Use a licensed customs broker or trade-compliance professional when the product combines materials, has several production countries, falls near an AD/CVD scope boundary, includes regulated wood or composite panels, or requires multiple agency submissions. Give the professional the underlying technical and manufacturing records; a broker cannot cure an inaccurate product description or missing origin evidence.
Recommended Free Tools
For a straightforward product, an importer may perform the review internally, provided it can support classification, origin, agency compliance and entry data. In either model, repeat the analysis when the supplier, design, processing, destination use or applicable order changes.
Frequently Asked Questions
Is an HTSUS number enough to prove that a building material can enter the United States?
No. Classification is a necessary starting point, but it does not replace origin marking, partner-agency permits or declarations, or a comparison with the written scope of an AD/CVD order.
Can I use the country where the shipment was loaded as the country of origin?
Not automatically. Determine origin from the actual production and processing history, then use that conclusion for marking, entry data and any origin-sensitive trade remedy.
Do all imported wood products need fumigation or a USDA permit?
No. The described CBP guidance treats finished lumber planed on every side and free of bark differently from logs and less-processed wood. Check the exact product heading, processing and current APHIS requirements.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
How is wood packaging treated?
Regulated pallets, crates, dunnage and similar packaging must be treated and officially marked. CBP considers unmarked material untreated and states that the remedy is export rather than fumigation at the U.S. border.
Where do I file a Lacey Act declaration?
ACE is CBP’s primary channel. LAWGS may be available for particular circumstances, including specified foreign-trade-zone filings. Confirm the route and data fields for the entry.
What records are needed for composite wood?
Obtain a written TSCA Title VI compliance statement and retain it with bills of lading, invoices or comparable supplier records for three years. Be prepared to provide panel producer and production-date information, plus supplier and purchase-date information, within 30 days of an EPA request under the cited guidance.
Does a CBP import specialist’s opinion settle AD/CVD coverage?
No. Commerce’s written scope controls, and an informal CBP opinion is not a binding scope determination. Seek a formal scope ruling when the product remains uncertain.
When should I hire a customs broker?
Consider a licensed customs broker when the shipment has multiple materials or production countries, regulated wood or composite panels, several agency filings, or a close AD/CVD scope question. The importer still must provide accurate facts and remains responsible for compliance.
The Bottom Line
There is no one customs rule for building materials. Build a product-specific file, classify the merchandise, establish and mark origin, screen every partner-agency requirement, and compare steel or aluminum products with the current written AD/CVD scope. File the correct entry and declarations on time, retain the supporting records, and obtain a formal ruling or professional help when the facts remain uncertain.
