In India, seeds are not automatically GST-exempt merely because they are called “seeds.” The nil-rate entry for HSN 1209 covers seeds, fruit and spores of a kind used for sowing. It expressly excludes seeds meant for any other use. To determine the treatment of a particular supply, verify both the correct tariff classification and the goods’ intended or represented use, then retain the records supporting that conclusion.
The wording was added to the exemption notification by Notification No. 9/2021-Central Tax (Rate), dated 30 September 2021, with effect from 1 October 2021. The applicable schedule and classification must still be checked for the transaction date.
The GST answer in one minute
CBIC’s GST goods-and-services rate table lists HSN 1209, “Seeds, fruit and spores, of a kind used for sowing,” at a nil rate. The same entry explains: “This entry does not cover seeds meant for any use other than sowing.” That sentence creates a use-based boundary: a product that is biologically a seed can fall outside the nil-rate entry when the supply is intended for a different purpose.
Consequently, a generic invoice description such as “agricultural seeds” is not enough. You need to establish what the goods are, whether HSN 1209 or another heading applies, and what use the product is represented and supplied for. A tamarind-seed example in the CBIC table illustrates the point: tamarind seeds meant for a use other than sowing are shown under HSN 1209 at 2.5% central tax plus 2.5% state tax, or 5% total for an intra-state supply.

What the official GST material establishes
| Official material | Established point | Practical meaning |
|---|---|---|
| CBIC GST rate table | HSN 1209 covers “Seeds, fruit and spores, of a kind used for sowing” at nil rate. | The goods must fit the tariff description and the sowing-use condition. |
| Notification No. 9/2021-Central Tax (Rate) | The explanation says, “This entry does not cover seeds meant for any use other than sowing.” The amendment took effect on 1 October 2021. | Non-sowing intent takes the goods outside this particular nil-rate entry. |
| CBIC GST rate table | Tamarind seeds intended for a use other than sowing are listed at 2.5% central tax and 2.5% state tax. | For an intra-state supply in that example, the combined GST is 5%; do not assume the same rate for every non-sowing product. |
| PIB FAQ | The sowing exemption is described as applying to all seeds meant for sowing, not only seeds used for agricultural crops. | Crop type alone does not limit the scope, but the goods must still meet the relevant tariff entry. |
| CBIC Circular No. 163/19/2021-GST | The circular discusses the distinction between HSN 1209 seeds meant for sowing and seeds supplied for another use. | Use and classification must be considered together. |
The table is a summary of what those official materials say; it is not a substitute for checking the current rate notification applicable to your supply date.
Why the word “seed” does not settle the tax treatment
“Seed” describes a biological item, not necessarily its GST purpose. The same species can be sold as planting material, an ingredient, a source of oil, a food or industrial input, or another processed product. The nil-rate wording is tied to goods “of a kind used for sowing,” so the commercial context matters.
Classification also matters independently. Some seed-related goods may fall under headings other than HSN 1209 because of their identity, condition or processing. A product cannot be placed in the nil-rate sowing entry simply because a seller uses the word “seed” in a catalogue or invoice.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsThe intended-use test is not the same as asking whether a seed could germinate. A biologically viable seed may nevertheless be supplied for a non-sowing purpose. Conversely, a product’s crop category does not by itself disqualify it: the PIB FAQ states that the sowing exemption is not limited to seeds used for agricultural crops.
Step-by-step method for checking a seed supply
-
Identify the actual goods
Write down the species or variety, the form in which the goods are supplied, and their physical condition. State whether they are whole seeds, treated seeds, processed material, seed mixtures, fruit or spores, or a different seed-related product. Include details such as coating, grinding, roasting, extraction or other treatment where relevant. A description such as “seeds” without these particulars is too broad for a reliable classification decision.
-
Check the tariff heading
Determine whether the product belongs under HSN 1209 or another heading in the current tariff and rate schedule. HSN 1209’s nil-rate entry is specifically for seeds, fruit and spores of a kind used for sowing; it is not a blanket exemption for every product traded as a seed. Compare the product’s identity, condition and processing with the complete heading and relevant explanatory material.

Establish represented and actual use
Examine how the goods are presented and what the transaction shows about their purpose. Review the package label, product catalogue or technical description, invoice wording, purchase order, buyer’s stated requirement and surrounding commercial facts. These records are practical evidence to review, not a statutory document checklist or automatic safe harbour.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy. -
Review quality and certification material
Where relevant, collect germination information, seed-quality records, certification documents, treatment records or other technical material. Such documents can help explain the character of the goods, but no single certificate automatically determines GST treatment. The legal entry focuses on the sowing-use description, while quality, processing and condition may affect the classification analysis on particular facts.
-
Apply the use boundary
If the evidence supports that the goods are of a kind used for sowing and the classification fits HSN 1209, the nil-rate entry may apply. If the goods are meant for another use, the explanation excludes them from that entry. At that point, identify the correct heading and rate for the actual product; do not assume that every non-sowing seed has one universal alternative rate.
-
Document the conclusion
Keep the classification basis and the evidence supporting intended use with the transaction records. For unusual, dual-purpose, processed, disputed or high-value goods, obtain advice based on the exact facts and the rate schedule in force on the supply date. Record the date checked, because GST notifications and tariff treatments can change.
What evidence can show that seeds are meant for sowing?
No cited official source provides one exhaustive checklist that conclusively proves sowing intent in every case. The strongest file is usually a consistent set of records rather than one isolated label.

Product and packaging description
Labels that identify the variety and describe planting, cultivation or sowing use can support the position. The description should match the goods actually delivered. If packaging instead describes food, extraction, animal-feed, industrial or other use, that information may point away from the sowing entry.

Invoices and purchase orders
Use a precise description that identifies the goods and their purpose. “Seeds” alone leaves the central issue unresolved. A purchase order requesting planting material, for example, provides context that a generic invoice line would not. The wording must be truthful and consistent with the product specification.
Catalogues and technical specifications
Keep the catalogue page, technical data sheet or product specification in force when the supply occurred. These documents can show whether the goods are sold as planting material, whether they are treated or processed, and what the supplier says about their intended application.
Buyer and transaction context
Consider the buyer’s business, order correspondence, delivery destination and any stated application. Context is supporting evidence, not a replacement for classification. A buyer involved in food processing does not automatically prove a non-sowing use, and a farming customer does not automatically prove sowing use; the particular goods and order should align.
Quality, germination and certification records
Seed-quality or germination evidence may help characterize a product as suitable for planting. It is not conclusive by itself. The official rule asks whether the goods are of a kind used for sowing and whether the tariff entry applies, not merely whether a laboratory test shows that a seed can germinate.
How to treat seeds intended for another use
When the evidence shows a non-sowing purpose, the HSN 1209 sowing entry does not apply because of its express explanation. The next step is classification under the heading that actually describes the goods and then checking the rate attached to that heading on the relevant date.
The CBIC table’s tamarind example is useful because it shows a concrete consequence without creating a general rule. Tamarind seeds meant for a use other than sowing are listed at 2.5% central tax and 2.5% state tax. For an intra-state supply, that is 5% combined GST. That figure should not be copied to other species, processed products or supply arrangements without checking their own entries.

Do not infer an alternative rate merely from the fact that the nil-rate entry is unavailable. Other headings may have different rates, conditions or descriptions, and the applicable treatment can depend on processing and product identity.

Does a seed label or certification decide GST?
No. A label or certificate is evidence, but neither is an automatic legal test stated in the cited exemption entry. The label should accurately describe the goods and their intended use, while certification can support quality or planting suitability where relevant. The classification and use analysis remains necessary.
This distinction matters when documents conflict. For example, a package may carry a planting-oriented name while the technical specification and order show that the material is supplied for extraction. Conversely, a certificate may show germination capability while the buyer’s order clearly requests a non-sowing input. Resolve the inconsistency by examining the complete transaction record and the actual goods, not by selecting whichever document favors a preferred rate.
How supply date affects the analysis
Notification No. 9/2021-Central Tax (Rate) is dated 30 September 2021 and made the sowing-use explanation effective from 1 October 2021. For supplies on or after that date, use the wording in the applicable notification and current rate table. For an earlier or later transaction, verify the notification and schedule that governed that date rather than applying today’s wording automatically.
Rate schedules can be amended. A classification conclusion should therefore identify the supply date, the notification or rate table consulted, and any conditions attached to the entry. If a contract covers multiple deliveries, review the relevant date and documents for each supply where the law or facts changed.

An AAR ruling is applicant-specific. Do not turn a listing or an isolated ruling into a universal rule without reading the underlying decision, checking its jurisdiction and comparing its facts with your goods. A ruling about processed material, a particular seed quality or a specific buyer’s use may not resolve a different product or transaction.
Worked fact patterns
Planting material sold with sowing instructions
A supplier sells identified varieties in packages that describe planting, provides technical specifications for cultivation and receives an order for sowing use. Those facts support considering the HSN 1209 sowing entry, provided the product’s physical form and classification fit the heading and the records are consistent.
Tamarind seeds sold for a non-sowing purpose
The CBIC table specifically illustrates tamarind seeds meant for a use other than sowing. That product is outside the nil-rate sowing entry and is shown at 2.5% central tax plus 2.5% state tax, totalling 5% for an intra-state supply under the table’s example.
Viable seeds supplied for processing
Germination potential alone does not establish sowing intent. If the order, catalogue and transaction show that the seeds are supplied for processing or another non-sowing use, analyze the applicable heading and rate for that product rather than relying on biological viability.
Dual-purpose or ambiguous goods
Where the same goods could reasonably be used for sowing or another purpose, collect the contemporaneous evidence that explains the actual supply: labels, specifications, order terms, buyer communications and quality records. If the conflict cannot be resolved, treat the matter as uncertain and obtain fact-specific professional advice before adopting a nil-rate position.
Recordkeeping checklist
- Species, variety and exact product description.
- Physical condition, treatment and processing details.
- HSN heading considered and the reason it fits.
- Package labels and product literature in force at the time of supply.
- Invoice, purchase order and buyer-use statements.
- Relevant germination, quality or certification records.
- Supply date and the GST notification or rate table checked.
- A written explanation linking the evidence to sowing or non-sowing use.
- Advice or an advance-ruling analysis for unusual, disputed or high-value supplies.
This checklist is a practical way to organize evidence; the cited rule does not prescribe it as a universal safe harbour.
Common mistakes to avoid
- Assuming every seed is exempt: the nil-rate entry is limited to goods of a kind used for sowing.
- Using HSN alone: classification does not eliminate the separate use condition.
- Treating germination as proof: a seed can be viable yet supplied for a different purpose.
- Relying on one document: labels, certificates and invoices should be read together and should describe the actual transaction.
- Copying the tamarind rate to all products: the 5% intra-state example is product-specific and does not establish a universal non-sowing rate.
- Ignoring processing or condition: treated, processed or otherwise altered goods may require a different classification analysis.
- Applying a current rate to an old supply: check the notification effective on the transaction date.
- Generalizing an AAR: an applicant-specific ruling must be assessed against its jurisdiction and facts.
A practical decision framework
- Describe the actual product, including species, form, condition and processing.
- Compare that description with HSN 1209 and any potentially applicable alternative heading.
- Identify the use represented in labels, catalogues, invoices and orders.
- Test whether the surrounding transaction facts support that represented use.
- Use quality or certification material as supporting evidence, not as an automatic decision rule.
- Apply the sowing-use explanation and then check the rate for the correct heading and supply date.
- Preserve the analysis and escalate fact-specific uncertainty before filing returns or issuing invoices.
The result is a documented classification decision, not a shortcut based on the word “seed.”

Start with the current CBIC GST goods-and-services rate table and the notification governing the relevant date. Read Notification No. 9/2021-Central Tax (Rate) for the 1 October 2021 wording, and consult CBIC Circular No. 163/19/2021-GST for the sowing-versus-other-use distinction. PIB’s FAQ provides scope guidance that the sowing exemption is not restricted to agricultural-crop seeds. If your product resembles an AAR dispute, read the underlying ruling and assess its jurisdiction and facts rather than relying on a case listing alone.
For a disputed or high-value supply, a tax professional should review the exact product, documents and transaction date. The official materials establish the use boundary, but they do not provide a single bright-line test that resolves every seed-related product.
