You cannot determine whether a server or GPU shipment needs a U.S. export license from the product name alone. First establish whether the item is subject to the Export Administration Regulations (EAR), identify its current Export Control Classification Number (ECCN) or EAR99 status, and then check the destination, all relevant parties, end use, and any available authorization or License Exception. A server may contain separately classified hardware, software, or technology, so assess the items in the shipment rather than assuming the entire system has one classification.
Use the checklist below for a U.S. EAR analysis. It is a decision process, not a shipment-specific determination: the result depends on the equipment’s technical details and the transaction facts.
1. Gather the item and transaction details
Before checking a control list or destination chart, record the facts that determine which rules apply. Include:

- The purchaser, consignee, intermediate parties, and ultimate end user. Record ownership or headquarters details that may matter to the recipient analysis.
- The intended end use, including who will operate the equipment and for what purpose.
- The server and GPU make, model, configuration, and relevant technical specifications. Include separately classified hardware, software, or technology where applicable.
BIS’s About Licensing overview describes the separate steps of determining EAR coverage, classification, and licensing. Destination, recipient, and use all matter; a shipping label by itself does not establish the full transaction.

2. Confirm whether the item is subject to the EAR
Determine jurisdiction and EAR scope before using an ECCN or the Commerce Country Chart to decide whether a license is required. If the item is not subject to the EAR, the EAR classification-and-license workflow does not answer its export-control status; other jurisdictional rules may need to be considered. BIS separates the scope question from classification and licensing in its licensing guidance.
3. Establish and verify the classification
For each relevant item, obtain the manufacturer or developer’s ECCN and supporting classification information, then verify that classification against the current Commerce Control List (CCL). Classifications and rules can change. An exporter with appropriate technical and EAR knowledge may classify the item using the EAR’s CCL Order of Review, or request a BIS commodity classification through SNAP-R. BIS explains these options in Classify your item.
ECCN and EAR99 are not tariff codes
An ECCN is an export-control classification, not an HTS or Schedule B tariff code. If an item is subject to the EAR but is not described by an ECCN, it is generally classified as EAR99. That does not mean it is automatically free of controls: destination, restricted-party, and end-use rules can still require a license.

Ways to establish an ECCN

BIS describes these classification paths in its classification guidance. A classification is a necessary input to the license analysis, not by itself a decision that the shipment may proceed.
4. Apply the ECCN controls to the ultimate destination
For an ECCN, read its License Requirements entry and identify each applicable reason for control. For chart-based controls, compare the relevant reason-for-control column with the country of ultimate destination in the Commerce Country Chart. Also follow any special references in the ECCN to other EAR provisions: a Country Chart result does not resolve every possible requirement. BIS explains this process in EAR Part 738.
Record the result for each applicable reason for control and any additional provision the ECCN identifies. Do not treat a destination-chart result as the entire analysis.

5. Screen the parties and analyze the end use separately
Review the parties required by the applicable rules, not only the consignee shown on the package. Depending on the transaction, the analysis can include applicants, purchasers, consignees, intermediaries, and the ultimate end user. BIS notes that restricted-party controls can apply to EAR99 items as well as CCL items; its end-user, end-use, and U.S. person controls guidance explains the separate review.
Check the current Consolidated Screening List and relevant underlying lists, and assess the intended use and possible diversion indicators. The MEU List is not exhaustive, so screening alone does not replace due diligence. EAR Part 744 can impose a license requirement based on end user or end use even where the ECCN-and-destination analysis does not show one; see EAR Part 732 and BIS’s control guidance.
6. Check the current advanced-computing rules for GPUs and systems
Do not assume a GPU-equipped server is ordinary hardware. The accelerator’s and system’s exact parameters may place an item in an advanced-computing ECCN or related category. Check the current CCL entry and applicable EAR provisions for the specific configuration.

In guidance dated May 31, 2026, BIS said a license is required for specified advanced-computing items to entities headquartered in Country Group D:5 or Macau, and to entities whose ultimate parent is headquartered there, even if the entity itself is located elsewhere. The guidance describes this as the continued application of a preexisting headquarters-based requirement and says: “Exporters should continue to seek BIS licenses for such transactions, unless a license exception specified in § 740.2(a)(9)(ii) is available.” The notice distinguishes that requirement from certain destination-based requirements covered by a non-enforcement policy. Read the dated guidance at BIS’s May 31, 2026 advanced-computing guidance, then check for newer guidance and the current rule text before making a decision.

If the analysis indicates a license requirement, check whether a License Exception or other authorization is available for this particular item and transaction. Review every condition, including eligible destinations and end users, item limits, notifications, reporting, and recordkeeping. An exception is usable only when all applicable criteria are met; its name is not blanket approval.
Advanced-computing exceptions can be especially fact-specific. Review the current text of EAR Part 740 and the provisions cited by the applicable ECCN. If a license is required and no exception or other authorization applies, do not export before authorization.

8. Keep a decision record and resolve uncertainty before shipment
Retain the technical specifications and classification evidence, the parties and destination reviewed, screening results, end-user and end-use information, the destination-control analysis, and any exception or authorization analysis. Record the rules and guidance checked and the date of the decision, because the EAR, CCL, lists, and guidance can change.
If technical parameters or transaction facts are too uncertain for a confident conclusion, request a BIS classification through SNAP-R or seek qualified export-control advice. For a license application, BIS directs applicants to SNAP-R through its licensing information. A static article cannot establish whether a particular shipment is authorized.
