To check whether a prediction market is regulated by the U.S. Commodity Futures Trading Commission (CFTC), identify the platform’s legal operator and look it up in the CFTC’s Designated Contract Markets (DCM) records. Confirm that the matching entity’s status is Designated, not Pending, and review its status date, remarks, and linked filings. A designated listing is evidence about the exchange’s recorded status—not proof that every contract is separately approved or that the platform is available to every customer.
What CFTC regulation means for a prediction market
The CFTC describes event contracts as derivatives whose payouts depend on a specified event, occurrence, or value. They are often structured as yes-or-no questions, with examples including economic indicators, corporate earnings, snowfall, and hurricane damages. The CFTC’s overview of prediction markets and event contracts explains the agency’s terminology and consumer guidance.
A designated contract market is an exchange under CFTC oversight pursuant to the Commodity Exchange Act. The CFTC says certain markets that provide trading facilities to people who are not eligible contract participants must apply for DCM designation, subject to applicable exemptions or exclusions. Read the agency’s DCM overview for its description of the framework.
That distinction matters: a consumer-facing brand, an application for designation, an exchange’s designation, and the regulatory treatment of a particular contract are not interchangeable. The status record helps answer whether the identified entity is listed as a designated DCM; it does not settle every legal question about a product or customer.

Check the operator in the CFTC records
- Find the legal operator. Check the platform’s terms, disclosures, or website footer for the company operating the service. Note separately any exchange or trading venue named there. Search for the legal entity rather than relying on the app or brand name.
- Search the CFTC’s DCM filings. Open the CFTC’s Industry Filings: Designated Contract Markets (DCM) page and search for the operator’s name. The agency also provides a filtered listing of designated DCMs.
- Read the status, date, and remarks. Confirm that the relevant entity is marked Designated. A record marked Pending indicates a pending application, not a designation. Review any status date and remarks for details such as assumed names or changes to the entity’s name.
- Open linked documents when names do not match. If the platform brand differs from the name in the CFTC record, do not assume the two are the same. Trace the relationship through the platform’s official disclosures and the filing’s linked documents.
- Record when you checked. The filings page is a live record. Note the date of your lookup, since designations, pending applications, and legal-name remarks can change.
How to interpret the result

Do not treat a marketing claim, a brand-name match, or a pending filing as equivalent to a designated listing. Conversely, do not infer illegality solely from an unsuccessful name search.
Check a contract separately from the exchange
DCM designation concerns the exchange. It does not establish that every event contract has received separate Commission approval, or that every contract is permitted. The CFTC says a DCM may submit a new contract through self-certification that it complies with the Commodity Exchange Act and regulations, or request Commission approval. For a particular event contract, look for its product filing and check current CFTC material. The agency’s event-contract information discusses Regulation 40.11, which prohibits contracts referencing specified categories—including terrorism, assassination, war, gaming, or unlawful activity—subject to the regulation’s terms. Do not turn that list into a blanket conclusion about a contract without checking the operative rule and current agency action.
Verify the official app and know where to raise a concern
The CFTC advises consumers to reach an app through links from the trading website to confirm they have found the official app. Its consumer guidance also identifies complaint channels involving a broker, a DCM, the National Futures Association (NFA), and the CFTC. Use the agency’s prediction-markets guidance to find its verification and complaint information.

Regulatory developments to check before relying on an old result
On March 12, 2026, the CFTC announced a Division of Market Oversight advisory on event-contract listings. The advisory highlights DCM responsibilities under the Commodity Exchange Act and regulations, including surveillance and compliance with core principles; it is directed to DCMs and describes staff views. On March 16, 2026, the CFTC issued an advance notice of proposed rulemaking seeking comments on prediction-market event contracts. An advance notice and request for comments is not a final rule.
