Check the exact platform and type of market for the state where you are physically located, then verify both the platform’s current location rules and the latest state, federal, and court records. A site accepting your account or displaying a contract shows practical access at that moment; it does not, by itself, settle whether that product is lawful in your state.
Separate practical access from legal status
“Is a prediction market legal in my state?” can mean two different things:
- Can I use it right now? This depends on the operator’s current eligibility rules, geolocation checks, and any restrictions for a particular contract category.
- Has the legal dispute been resolved? That depends on the applicable laws and any regulator action or court ruling covering the operator and product.
Those answers may not match. A platform may permit access while a state authority challenges its offering, and a lawsuit or cease-and-desist letter is not itself a final court judgment. Treat access as a current platform policy, and legal status as a question that may depend on ongoing proceedings.

Use your physical location
Start with the state where you will be when using the platform. Record it separately from your state of residence: location checks and platform restrictions can be tied to where you are accessing a market.

Name the operator and contract category
Write down the specific platform and whether the contract concerns sports, politics, or another event. Sports contracts have been a frequent focus of state challenges, so a platform’s availability for one category should not be assumed to apply to another.
Check the platform’s current rules
- Open the operator’s current eligibility or location information and check whether your physical state is permitted.
- Review any location check the platform requires, then look for restrictions specific to the market category you want to trade.
- Read the contract’s rulebook or terms. Check how the operator defines the event, who can participate, and whether that contract has its own eligibility rules.
- Record the date you checked and what the platform allowed. Recheck before relying on the result, because access policies can change.
A successful sign-up, a visible market, or an accepted transaction is evidence of practical access at that time—not a conclusive ruling on legality.

Understand the federal position without treating it as a final ruling
Event contracts may fall under the federal Commodity Exchange Act framework. In a March 2026 proposed rule notice, the CFTC said a venue offering swaps or futures to the general public must register as a designated contract market (DCM) and be overseen by the Commission. That describes the federal framework in the notice; it is not a blanket determination that every platform or contract is lawful. Read the CFTC proposed rule notice.

Check state actions and court records
Search the state gaming regulator and attorney general for actions involving the operator and contract category. Then check the court docket or order itself. For each relevant matter, note:
- Who brought the action and which court or regulator is involved.
- The platform and product category covered.
- What the filing or order actually says, and its date and scope.
- Whether an order is temporary, stayed, appealed, or final.
Keep agency statements distinct from judicial holdings. For example, on June 12, 2026, the CFTC said New Mexico had sued Kalshi over sports-related event contracts and that the Commission had filed a federal lawsuit seeking declaratory and injunctive relief. On April 2, 2026, the CFTC also announced suits challenging actions by Arizona, Connecticut, and Illinois against registered markets. The Commission’s claims about federal authority are its litigating position; check the relevant dockets for court rulings and later developments. Read the CFTC’s April 2 release.
Use state-by-state coverage as a lead, not a legal answer
A state tracker can help identify where availability or litigation may differ, especially for sports markets. A CBS Sports review dated October 10, 2026 describes state-by-state differences and ongoing cases. Use it to find issues to verify, then check the platform’s current rules and the official filings or orders; a tracker does not establish a legal availability percentage or settle your specific situation. Write a dated conclusion with clear limits
For a useful answer, state the physical location, operator, contract category, and date checked. Then separate what the platform currently permits from what official legal records establish. If the platform and official sources conflict, or the filings do not resolve the specific product or location, say that the legal position remains unresolved rather than turning access or an agency’s position into a definitive legal conclusion.
