To determine whether a GST rate change applies, work through four facts in order: identify the precise goods or service classification, locate the latest operative rate notification, confirm its effective date and conditions, and apply the CGST Act time-of-supply rule to the supply, invoice and payment dates. An everyday product name or invoice date by itself is not enough.
This method is for Indian GST transactions. The result for a particular item depends on its classification and the notification in force for the relevant date. If the classification is disputed or the tax exposure is material, have a qualified GST professional review the facts.
What decides whether a GST rate changed for your item?
GST rates are attached to legal descriptions, not simply to names used in catalogues, invoices or advertising. For goods, the relevant entry may be a tariff item, sub-heading, heading or chapter. For services, it is the service description and any applicable classification or condition. Composition, processing, intended use, packaging and bundled elements can change which entry fits.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsOnce you identify the entry, the controlling source is the applicable central tax rate notification, together with its amendments, exclusions, provisos and commencement clause. A GST Council announcement, press release or FAQ can help you locate the change, but it is not a substitute for reading the operative notification.

Finally, a rate that changed between two events is a transition question. Section 14 of the Central Goods and Services Tax Act, 2017 determines the time of supply for a change in rate. It considers whether the supply occurred before or after the change and then examines the invoice and payment dates. That is why “the invoice was raised before the change” is not a universal answer.
The repeatable checking workflow
1. Describe what was actually supplied
Start with a factual description rather than a marketing label. Create a short file that states:
- For goods: material or composition, degree of processing, physical form, intended use, packaging and any distinguishing technical characteristics.
- For services: the work actually performed, deliverables, customer and location where relevant, and any ancillary or bundled elements.
- Whether the transaction contains more than one good or service and whether a composite or mixed supply issue may arise.
- The date or dates on which the supply was completed or otherwise treated as made under the applicable time-of-supply rules.
Do not classify an item solely because a seller, customer or older invoice used a familiar commercial name. Preserve specifications, product sheets, contracts, purchase orders and photographs where they help distinguish competing entries.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Clear out junk files and repair common Windows errorsFree Scan →2. Find the candidate classification entry
Use the official CBIC GST goods and services rate tables to locate the likely tariff heading or service description. Read the complete row and all notes, exclusions, provisos and conditions. A table search is a starting point, not proof that the first similar-sounding entry is correct.
For a good, compare the technical facts in your file with the wording of the tariff entry. For a service, compare the activity actually performed rather than the department name or invoice shorthand. If two entries appear plausible, record both and identify the factual distinction that resolves them. Do not manufacture a precise rate for an item whose classification remains unknown.
3. Locate the operative notification
Follow the rate-table reference to the central tax rate notification. Check whether it has been amended, superseded or supplemented by a later notification or clarification. Read the schedule entry itself, not just a headline describing a rate cut or increase.
For the 2025 changes associated with the 56th GST Council decisions, the Ministry of Finance FAQ identified Notification No. 9/2025-Central Tax (Rate), dated 17 September 2025, as the revised CGST goods-rate notification superseding the earlier goods notification. That identification is useful for finding the instrument; the notification and any later amendment remain the legal basis for a transaction.

Separate the date on which a notification was issued from the date on which it takes effect. Read the commencement language and compare it with the classification and transaction date. Confirm all of the following before selecting a rate:
- The entry covers the exact goods or service classification.
- The change applies to the relevant tax component and transaction type.
- No exclusion, proviso, end-use condition, value threshold or special valuation rule removes the transaction from the entry.
- A later notification has not altered or postponed the change.
- Any exception for a specified product category is addressed explicitly.
The Ministry of Finance FAQ on the 56th Council decisions said that most changes took effect on 22 September 2025. It also said specified tobacco-related goods continued under their existing rates and compensation cess pending a later notified implementation date. This example demonstrates why a broad implementation date cannot be applied mechanically to every product.

5. Apply the rate-change transition rule
After establishing the classification and effective date, collect the supply date, invoice date and payment date. Section 14 of the CGST Act governs a change in rate and has separate branches for a supply made before the change and a supply made after it. The following table restates the six principal combinations in practical form.
| When the supply occurred | Invoice timing | Payment timing | Time of supply under section 14 |
|---|---|---|---|
| Before the rate change | After the change | After the change | Earlier of the payment-receipt date and invoice date |
| Before the rate change | Before the change | After the change | Invoice date |
| Before the rate change | After the change | Before the change | Payment-receipt date |
| After the rate change | Before the change | After the change | Payment-receipt date |
| After the rate change | Before the change | Before the change | Earlier of the payment-receipt date and invoice date |
| After the rate change | After the change | Before the change | Invoice date |
These rows are not a shortcut for deciding when the supply occurred. Establish that fact first, then use the matching branch. A contract, delivery record, completion certificate or other evidence may be needed to establish the supply date, especially for services or staged deliveries.
6. Determine the payment-receipt date correctly
Section 14 generally treats payment as received on the earlier of two dates: when the payment is entered in the supplier’s books or when it is credited to the supplier’s bank account. The Act states:
“For the purposes of this section, ‘the date of receipt of payment’ shall be the date on which the payment is entered in the books of account of the supplier or the date on which the payment is credited to his bank account, whichever is earlier.”
The section 14 proviso addresses a bank credit occurring more than four working days after the rate-change date. Keep the bank statement, remittance advice, book-entry record and any evidence explaining the delay. Do not substitute the date a customer initiated a transfer for the statutory receipt date unless the facts support that treatment.
7. Preserve an audit trail
Save the evidence used to reach the conclusion in one transaction folder. At minimum, retain:

- The notification’s effective date and any conditions or exceptions checked.
- Documents establishing the supply date.
- The invoice, credit note or debit note dates.
- Bank and accounting evidence for payment receipt.

Record the date on which you performed the check. Revisit the file if a later notification, circular, FAQ or amendment changes the entry or clarifies its scope.
How to handle goods classification
Technical facts matter more than the product name
Two goods with similar commercial names can fall under different tariff entries because their composition, processing, form or use differs. Conversely, a manufacturer’s preferred label does not create a new GST category. Gather objective facts before searching the rate table and explain why the chosen entry fits those facts.
Read the whole entry
Rate schedules often contain subordinate descriptions, exclusions and conditions. A percentage shown beside a broad heading may not apply to every item under that heading. Check whether the entry is restricted by material, value, packaging, end use or another stated characteristic. If the table directs you to a note or another schedule, follow it.

When classification remains uncertain
List the competing entries, the factual difference between them and the evidence available for each. Do not pick the lower rate merely because it is commercially preferable. A qualified GST professional can assess the tariff interpretation and advise whether a formal clarification or ruling route is appropriate.

How to handle services and bundled supplies
Describe the activity delivered
For a service, state what the supplier did, for whom, and under what contract. A department name such as “support” or “consulting” may conceal several activities. Identify ancillary work, licensing, goods supplied with the service, reimbursements and separately charged elements.
Check whether the entry has conditions
Service-rate entries may depend on the nature of the recipient, the place or manner of performance, or another condition stated in the notification. Match each condition to contract and delivery evidence. Do not copy a rate from a similar service without checking the complete description.
Apply section 14 to the service timeline
Services can have milestones, recurring periods or advance payments. Establish when the relevant supply took place under the applicable rules, then apply the same six section 14 combinations. An invoice issued before a rate change does not by itself settle a service supplied after the change, and an advance payment does not automatically answer every transition question.
Using the 22 September 2025 change as a case study
The 56th GST Council decisions illustrate how to verify a recent announcement without overgeneralising it. The Ministry of Finance and Press Information Bureau material described HSN-wise changes in annexures and planned implementation for services and most goods from 22 September 2025. The FAQ separately identified specified tobacco-related goods whose existing rates and compensation cess continued until a later notified date.
A sound check for a transaction around that date would therefore ask:
- What exact goods or service classification appears in the relevant schedule?
- Which notification and amendment were operative for that entry?
- Does the entry commence on 22 September 2025, or does it specify another date or exception?
- When did the supply occur?
- When was the invoice issued?
- When was payment received under the statutory definition?
The example is not evidence that every item changed on that day, nor that no later changes occurred. Always check the latest notification for the actual transaction.
Worked transition examples
The following examples use hypothetical rates solely to demonstrate the decision process. They do not state the rate for any real product or service.
Supply before the change; invoice before; payment after
Assume a supply occurred on 18 September, the old-rate invoice was issued on 19 September and payment was received on 25 September. This is the “supply before, invoice before, payment after” row. Under section 14, the invoice date controls the time of supply. The classification and notification still determine what the old rate was.

Supply before the change; invoice after; payment before
Assume the supply occurred on 20 September, payment was received on 21 September and the invoice was issued on 23 September. The payment-receipt date controls under the corresponding before-change branch.
Supply after the change; invoice before; payment after
Assume the supply occurred on 24 September, an invoice was issued on 20 September and payment was received on 30 September. The payment-receipt date controls for this after-change combination. The invoice’s earlier date does not automatically preserve the old rate.
Supply after the change; invoice after; payment before
Assume payment was received on 20 September, the supply occurred on 24 September and the invoice was issued on 26 September. The invoice date controls under the after-change branch. Whether the transaction qualifies for any other treatment depends on the complete facts and notification conditions.

A one-page decision checklist
- Write a technical goods description or precise service description.
- Identify the candidate tariff heading, sub-heading, tariff item or service entry.
- Read the full official rate-table row and its notes.
- Locate the current central tax rate notification and all relevant amendments.
- Record the notification’s commencement date, conditions and exclusions.
- Confirm whether the item is covered or expressly excepted.
- Establish the supply date from delivery, completion, milestone or other evidence.
- Record invoice and payment dates separately.
- Calculate payment receipt using the earlier book-entry or bank-credit date, subject to the statutory proviso.
- Apply the matching section 14 combination.
- Save the classification rationale and source documents.
- Escalate an uncertain classification, disputed timeline or significant liability to a qualified GST professional.
When professional advice is essential
Obtain advice before filing or correcting a return when the product could fit multiple tariff entries, the notification contains conditions you cannot verify, the transaction spans several milestones, the payment date is disputed, or the tax difference is material. Provide the adviser with the complete description, contracts, delivery evidence, invoices, accounting entries, bank records and notifications consulted. A professional can assess the legal classification and transition facts; a generic rate chart cannot.

This process can show which official entry and transition branch should be examined for a transaction. It cannot supply an exact rate for an unnamed product or service, resolve a classification dispute without facts, or guarantee that a later notification has not changed the position. The 2025 implementation example is date-specific and should not be treated as a permanent schedule.
The Ministry of Finance FAQ-3 on the 56th GST Council decisions, published 18 September 2025, states the transition issue in these words: “As per Section 14 (a)(i) of CGST Act, 2017, in case the goods or services or both have been supplied before the change in rate of tax, and the invoice for the same has been issued after the change in rate of tax, then the time of supply i.e. date of liability to pay tax on such supply will be as follows:” The FAQ then sets out the combinations reflected above. Read that explanation with the statutory text and the operative notification for the transaction.
