A GST demand or show-cause notice is not validated by its headline, portal summary, or the fact that it carries a reference number. Check the complete communication against five things: its identity and service record, the allegation and computation, the officer’s statutory authority, the tax period and applicable section, and the limitation and hearing requirements.
The tax period is decisive. The amended sections 73 and 74 framework applies to periods through financial year 2023–24, while section 74A governs later periods under its own rules. A missing attachment, portal mismatch, or clerical error is a reason to investigate and raise a precise objection; it is not automatically proof that the notice is void. This guide covers the central CGST framework in India. State GST laws are generally aligned, but state-specific rules, competent authorities, and notices issued under another law require separate checking.
Start by preserving the complete record
Do not begin with a conclusion that the notice is valid or invalid. First create an evidence file so that dates, versions and attachments cannot be disputed later.

Record the notice’s identity
- GSTIN and the taxpayer’s legal name.
- Name and designation of the issuing officer, office and jurisdiction.
- Reference number, communication number and any other identifiers printed on the document.
- Date shown as the issue date and the date and method by which you actually received it.
- Tax period or periods covered.
- Act, section and rule cited.
- Last date or response period stated in the communication.
Preserve every version and proof of service
Save the full notice as downloaded, every attachment and schedule, the email or message that alerted you, and a screenshot or downloaded copy of the corresponding portal record. Keep the original file names and timestamps where possible. If an accountant, employee or authorised representative received it first, record when and how it was passed to you.
There is no single universal portal path or universal DIN-validation workflow established for every kind of GST communication. Inspect the current portal record and confirm suspicious communications through the issuing authority’s official channels. A portal discrepancy should prompt verification, not an assumption that the document has no legal effect.
Identify what kind of communication you received
Different GST communications have different consequences. A short electronic summary is not necessarily the entire notice, and an order is not the same as a proposal to demand tax.
| Communication or stage | What to inspect | Practical consequence |
|---|---|---|
| Demand show-cause notice | The full notice, facts, legal grounds, computation and accompanying electronic summary | It proposes action and gives the taxpayer an opportunity to make a representation before adjudication. |
| Specified statement | The statement and its electronic summary, including FORM GST DRC-02 where applicable | Its statutory route and response requirements must be checked against the section cited. |
| Adjudication order | The signed or authenticated order, reasoning, amount confirmed and FORM GST DRC-07 summary | FORM GST DRC-07 is treated as the notice for recovery; the underlying order remains essential for understanding what was decided. |
| Recovery communication | The recovery step, the order on which it relies and the payment or stay record | Check whether an enforceable order exists, whether the amount matches it and whether any appeal, stay or payment has changed the position. |
Rule 142 of the Central Goods and Services Tax Rules, 2017 provides the relevant electronic summaries: DRC-01 accompanies a covered notice, DRC-02 is used for a specified statement, DRC-06 records a reply or representation, and DRC-07 is the electronic summary of an order. These forms do not replace the complete notice, statement or order.
Read the full notice, not just the portal summary
Make a side-by-side comparison between the complete communication and its electronic summary. The notice should allow you to understand what the department says happened, why it says tax is payable and how it calculated the proposed liability.
Check the factual allegation
- Is the allegation short payment or non-payment of tax, an erroneous refund, or an input tax credit issue?
- Which transactions, invoices, returns, suppliers, recipients or periods are identified?
- Does the factual narrative match your books, returns, e-invoices, payment records and correspondence?
- Are the documents or data relied on actually attached or otherwise identified sufficiently for you to answer?
Check the legal grounds
Note every section, rule and explanation cited. An allegation of fraud, wilful misstatement or suppression to evade tax is a substantive allegation to examine; the label alone does not establish that the allegation is true. Ask what conduct is said to satisfy the statutory ingredients and what evidence is offered for it.

Check the computation
Recalculate the tax, interest and penalty from the schedules and source records. Look for duplicate invoices, incorrect tax rates, credit already reversed or paid, wrong tax periods, arithmetic errors and amounts attributed to a registration or entity that is not yours. Preserve your own reconciliation rather than relying on a verbal explanation.
Match the tax period to the correct statutory section
The section printed on the notice must be read with the period to which the demand relates. The Finance (No. 2) Act, 2024 amended sections 73 and 74 so that their current text is limited to earlier periods and introduced section 74A for later periods. The enacted statute and its commencement provisions control; a GST Council agenda describing the change is not a substitute for the law in force.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches| Tax period | Section to examine | Grounds or timing point |
|---|---|---|
| Periods through FY 2023–24 | Section 73 | Cases without the specified fraud-type grounds. The current text provides a three-year order limit, subject to the statutory anchor, notice timing and applicable extensions or exclusions. |
| Periods through FY 2023–24 | Section 74 | Cases alleging fraud, wilful misstatement or suppression to evade tax. The current text provides a five-year order limit, subject to the statutory anchor, notice timing and applicable extensions or exclusions. |
| Later periods | Section 74A | Use section 74A’s own conditions, deadlines and commencement rules. Do not import a section 73 or 74 deadline without checking the law applicable to that period. |
A notice that cites a section inconsistent with the tax period deserves a prompt written objection and professional review. It may be a correctable drafting error, a wrong statutory route or a deeper jurisdictional problem; the document and the applicable law must be examined together.
Calculate limitation from the statutory dates
Limitation is not a universal number of years counted from the day you opened the email. It is calculated under the applicable section from the statutory event specified there.
- Fix the period. Identify the financial year, return or transaction period and whether the demand concerns an erroneous refund.
- Select the governing section. Use section 73, section 74 or section 74A according to the period and allegation.
- Find the statutory anchor date. For the applicable earlier-period provisions, the order period is measured using the statutory annual-return due date or the erroneous-refund date, as applicable.
- Read the order deadline in full. Section 73’s current text provides a three-year order limit and section 74’s provides a five-year order limit for their applicable periods. The exact sub-section and statutory event control the calculation.
- Work backward to the notice requirement. The notice must be issued sufficiently before the order deadline in the manner required by the applicable section. Compare the date on the notice with the statutory record, not merely with the date of service.
- Check adjustments. Examine extensions, stays, exclusions, notifications, amendment commencement and any other legally effective change that affects the computation.
- Document the arithmetic. Keep a dated worksheet showing each anchor date, the statutory deadline, the notice date, service date and the source record for each fact.
For the earlier section 73/74 framework, section 75(10) states: “The adjudication proceedings shall be deemed to be concluded, if the order is not issued within three years as provided for in sub-section (10) of section 73 or within five years as provided for in sub-section (10) of section 74.” That sentence should not be used as the deadline for later periods governed by section 74A.
Check authority and the statutory basis
The communication should identify an officer acting under the relevant law and should connect the allegation to the section invoked. Check the officer’s designation, office and jurisdiction against the communication and the official records available to you.

Questions to ask
- Does the issuing office have authority over the GSTIN, tax period and type of proceeding?
- Does the cited section cover the conduct alleged?
- Is the document a demand notice, a statement, an order or a recovery step?
- Has the department treated an allegation as established merely by calling it fraud or suppression?
- Does the amount in the summary match the complete notice and schedules?
An authority or section mismatch is an important issue to raise, but the legal effect depends on the full statute and record. Do not describe a notice as void solely because a designation is abbreviated, a field is misspelled or a summary contains a clerical inconsistency.
Verify service, response time and the right to be heard
Compare the date printed on the notice with the date and method of actual service. Preserve the email header, portal download record, message, acknowledgement or other evidence that shows when you received it. A response deadline should be calculated from the rule and the facts of service, not from an assumption.
Submit and preserve the reply
- Prepare a point-by-point response addressing jurisdiction, period, limitation, facts, evidence and computation separately.
- Upload or file the representation through the channel stated in the notice and retain the submission receipt, acknowledgement and final uploaded file.
- Where the electronic process uses FORM GST DRC-06, ensure the filed representation and attachments are readable and complete.
- Request a personal hearing where the statute and circumstances provide for one, especially when facts, classification, fraud allegations or disputed evidence are material.
- Monitor for a hearing notice, further query or order and preserve each response.
Section 75 requires consideration of the representation and provides a reasonable opportunity of hearing in the circumstances specified there. An order that introduces grounds or amounts beyond what was proposed may raise a separate procedural issue. Compare the final order with the notice and the record, then obtain advice on the available remedy.
Compare the demand with your own records

Documents commonly needed
- GST registration details and amendments.
- Returns, reconciliations, payment challans and electronic liability ledgers.
- Sales and purchase registers, invoices, credit notes and debit notes.
- Input tax credit workings, reversals and supplier communications.
- Bank statements or payment evidence relevant to the disputed tax.
- E-way bills, e-invoice data, contracts, delivery records and correspondence.
- Earlier replies, audit communications, orders, appeals, stays and payment records for the same period.
Reconcile each amount
For each line in the notice, identify the underlying transaction, tax period, tax rate, taxable value, tax paid, credit claimed or reversed, interest period and penalty basis. Mark items that are unsupported, duplicated, outside the stated period or already discharged. Do not delete disputed items from your worksheet; label them and preserve the evidence that supports your position.
Separate a serious defect from a correctable error
The following points justify investigation and a precise objection:
- The notice concerns a period governed by a different section than the one cited.
- The apparent limitation date has passed under the applicable statutory calculation.
- The notice was not served through the recorded channel or the actual service date is materially different.
- The communication omits the facts, legal grounds, computation or evidence needed to answer.
- The officer, GSTIN, tax period or entity is wrong.
- The order confirms tax, interest or penalty on grounds or amounts that were not proposed.
- The DRC summary and full document materially conflict.
- The department relies on an amount already paid, reversed, refunded or covered by an earlier final proceeding.
None of these points should be described as automatically void without reviewing the complete record and current law. Some defects may be curable, some may affect natural justice or jurisdiction, and some may be harmless clerical errors. State the defect, its evidence and the prejudice it causes instead of using a conclusory label.

- Day one: secure the file. Download the notice and attachments, capture the portal entry, record service details and calendar the stated deadline.
- Classify the stage. Decide whether you have a notice, statement, order or recovery communication and locate any DRC-01, DRC-02 or DRC-07 summary.
- Build the period-and-section map. List each tax period separately and assign the section that the current law appears to require.
- Run the limitation worksheet. Record the statutory anchor, order deadline, notice date, service date and legally relevant extensions or exclusions.
- Test the authority and allegations. Check jurisdiction, the officer’s role, the legal ingredients of the allegation and the evidence cited.
- Reconcile the money. Recalculate tax, interest and penalty against returns, ledgers and source documents.
- File a complete reply. Answer every allegation, attach indexed evidence and preserve the DRC-06 or equivalent acknowledgement.
- Ask for a hearing where appropriate. Make the request part of the record and attend with a clear issue list.
- Review the order immediately. Compare it with the notice, your reply and the proposed amount; check whether new grounds or amounts appear.
- Escalate before the next deadline. If an order, recovery action, attachment or appeal period is involved, obtain advice without waiting for informal portal corrections.
Common mistakes and how to avoid them
Relying on a one-line portal summary
A summary can omit the factual narrative, schedules or evidence. Download and read the underlying notice and every attachment.

Limitation generally turns on statutory dates tied to the relevant return or refund event and the applicable section. Receipt is important for response and service analysis, but it is not a universal limitation starting point.
Best Value
Assuming “fraud” is proved because it is printed
Fraud, wilful misstatement and suppression are allegations that require factual and legal examination. Identify the conduct and evidence said to support each element.
Ignoring an imperfect notice
Even a potentially defective communication can lead to an order or recovery step if no response is filed. Raise objections in the reply while preserving every procedural point.
Using a section 73 or 74 deadline for a later period
Check whether section 74A applies and verify commencement and later amendments before calculating any deadline.
Failing to preserve the acknowledgement
A reply without proof of filing is difficult to establish later. Save the receipt, uploaded document, attachments and any hearing record in more than one location.
When to obtain professional help
Seek prompt advice from a qualified GST practitioner or tax lawyer when the response deadline is close, the amount is material, fraud or suppression is alleged, limitation appears expired, the department has issued an order, or recovery has begun. A notice-specific opinion requires the complete communication, service facts, tax period, returns and underlying records. A general checklist can identify issues, but it cannot conclusively determine validity without those materials and the law in force for the relevant date.
