Short answer: In the United States, check whether your costume, character name, logo, image, listing, or promotion could make buyers think that a trademark owner supplied, sponsored, approved, or is connected with what you sell. Compare the complete commercial impression, the goods or services, and the sales and advertising context. A federal database search is a useful first screen, not a legal clearance or a court decision.
What trademark infringement asks
The central question is likely consumer confusion. The USPTO describes infringement as unauthorized use of a trademark or service mark on or in connection with goods or services in a way that is likely to cause confusion, deception, or mistake about their source. The possible confusion can also concern sponsorship, approval, affiliation, or another connection with the trademark owner.

This is not a test of visual resemblance alone. A costume can resemble a well-known character yet create little trademark risk if buyers would not see the resemblance as a brand or source signal. Conversely, a word, emblem, or presentation that is not identical to an existing mark can still create risk when it conveys a similar sound, appearance, meaning, or overall commercial impression and is used for related goods or services.
Courts weigh multiple facts rather than applying a single bright-line rule. Relevant considerations include the similarity of the marks; the relationship between the goods or services; marketing and sales channels; the likely purchasers and the care they use; the strength and recognition of the earlier mark; actual confusion; and the user’s intent. The importance of each factor varies with the evidence and the particular dispute.

Know what this preliminary check does—and does not—answer
This guide assumes U.S. use and provides general information, not a legal conclusion about a particular design. It addresses trademark issues only. Copyright may protect artwork, character expression, costume graphics, or a film still. A person’s name, likeness, or persona may raise right-of-publicity issues. A license or contract may control use even when trademark confusion seems unlikely. A trademark screen does not resolve those separate rights.
A character name or image can identify a character in a book, game, film, or other creative work without functioning as a trademark for the work’s goods or services. USPTO examination guidance discusses examples involving a game-character image, names of characters in a book series, and an illustration of a frog on a book cover. That principle does not make every character reference free to use, nor does it decide copyright or publicity questions. For your particular commercial use, ask whether the element functions as a source or sponsorship cue and whether consumers are likely to be confused.

Step 1: Describe exactly what you plan to do
Make a written inventory before searching. Preserve the version you actually intend to sell or promote, not an idealized description. Include:
- Every word, character name, slogan, phonetic spelling, hashtag, and URL in the product listing or advertisement.
- Logos, symbols, badges, lettering styles, color arrangements, distinctive patterns, props, and character-specific design elements.
- Photographs, illustrations, generated images, packaging, labels, hangtags, booth signs, social posts, videos, and paid advertisements.
- Where each element appears: on the costume, in a product title, in a search tag, in a backdrop, or only in explanatory text.
- Whether the element is presented as a brand or collection name, or simply describes the character or costume being depicted.
Mark the elements that a buyer would notice first. A name printed as the largest type on packaging is a stronger source cue than a small descriptive note. Keep dated copies of drafts so you can identify what was actually offered if the presentation changes.
Step 2: Define the goods, services, and commercial setting
Write down what customers receive and what you are promoting. The analysis concerns the goods or services connected with the mark, not an abstract similarity between two images. Specify whether you are selling a complete costume, individual accessories, printed merchandise, digital files, photography, event appearances, lessons, or another service.

Then identify the commercial context:
- Buyers: Who is likely to purchase, and how carefully do they choose? A high-cost, specialized purchase may receive more attention than an inexpensive impulse item.
- Channels: Where will buyers encounter and purchase it—your website, a marketplace, a convention booth, a social platform, a physical shop, or an event?
- Promotion: Which channels, keywords, hashtags, search tags, influencers, and advertisements will you use?
- Owner overlap: Is the possible trademark owner known for costumes, toys, apparel, events, entertainment, fan experiences, or other related offerings?
Goods and services can be considered related when they are used together, sold to the same purchasers, advertised together, competitive, or commonly offered through similar trade channels. A different product label does not automatically eliminate relatedness.

Step 3: Search the USPTO records as an initial screen
Use the USPTO trademark search system to look for the exact wording and plausible variations. Search singular and plural forms, spacing and punctuation changes, abbreviations, alternate spellings, phonetic equivalents, and important words in a compound name. If a design is central, search design records using the system’s design-search tools and relevant design descriptions.
Review both pending applications and registrations. Read the record rather than relying on a search-result title: identify the owner, the listed goods and services, filing and registration status, and any limitations or disclaimers in the record. A result involving unrelated goods may be less relevant than one involving closely connected merchandise or services, but relevance is a factual judgment, not a database flag.
The USPTO performs its own federal-record search when examining an application. That examination and a search you conduct yourself are distinct from a court’s infringement analysis. Federal records are therefore valuable evidence for screening, but finding no obvious result does not prove that a proposed use is clear. The USPTO’s infringement overview also recognizes that rights may exist in marks that are not federally registered.
Step 4: Compare the entire commercial impression
Do not compare one isolated feature while ignoring the rest of the presentation. Put your proposed use and the potentially relevant mark side by side and work through the following dimensions.

| Comparison | Questions to ask |
|---|---|
| Appearance | Do the words, lettering, symbols, layout, colors, or image composition look alike when viewed as buyers would see them? |
| Sound | Would the names or slogans sound alike when spoken, including likely pronunciation or a phonetic variant? |
| Meaning | Do the terms evoke the same character, idea, story world, organization, or commercial message? |
| Dominant elements | Which parts attract attention first, and are those the elements that overlap? |
| Overall impression | Would the complete presentation suggest the same source, an authorized collaboration, or a connection, rather than merely the same theme? |
| Goods and services | Are the offerings used together, competitive, commonly offered by the same businesses, or directed to the same buyers? |
| Channels and advertising | Would buyers encounter both offerings in the same stores, platforms, events, searches, or campaigns? |
Marks do not have to be identical. Similarity in sound, appearance, meaning, or overall commercial impression matters together with the relationship between the goods or services. A changed color, a different font, or an added word may alter the impression, but none automatically resolves the analysis.
Step 5: Examine marketplace signals and evidence
Look at the way a real buyer would encounter the offer, not only at a clean logo file. Packaging, product titles, thumbnails, tags, captions, booth displays, endorsements, and advertising can all communicate source or sponsorship. A statement such as “official,” “licensed,” “authorized,” or an implied collaboration can increase the risk; so can placing the reference where a brand name normally appears.
Collect evidence that may become relevant:
- Customer questions asking whether the item is official or licensed.
- Messages, reviews, or sales records showing mistaken assumptions about affiliation.
- Search results and marketplace listings showing how similar goods are presented.
- Instructions, drafts, or internal messages that show why a particular name or design was selected.
- Any steps taken to distinguish a descriptive character reference from your own brand presentation.
Actual confusion can support a claim, but the absence of reported confusion does not guarantee safety, especially for a new or small offering. Intent can also be relevant, but a good-faith belief is not an automatic defense if the overall circumstances still create likely confusion. These facts contribute to a fact-sensitive record; they are not a mechanical scorecard.
Step 6: Separate a character depiction from a brand claim
Ask what role the reference plays in your offer. A title such as “costume inspired by a space-faring hero” may function differently from printing a distinctive character name as the label of your costume line. A small explanatory reference may be read as description, while a prominent name, emblem, or packaging treatment may be read as the maker’s brand or an official source cue.

A character name or image can function as a trademark in some contexts, and the same element can serve different roles in different presentations. Even when the element is not functioning as a trademark for the creative work, copying the underlying artwork or using a person’s likeness may still implicate other rights.

Use a risk worksheet instead of a yes-or-no shortcut
Create one row for each potentially relevant mark or character reference. Record the evidence and uncertainty in plain language.
| Field | What to record |
|---|---|
| Proposed element | Exact wording, image, logo, placement, product, and advertisement. |
| Potential earlier mark | Owner shown in the record, status, wording or design, and listed goods or services. |
| Similarity | Appearance, sound, meaning, dominant features, and overall impression. |
| Relatedness | Shared purchasers, uses, channels, advertising, competition, or common offering. |
| Marketplace facts | Packaging, tags, disclaimers, buyer questions, actual confusion, and intent evidence. |
| Unknowns | Unsearched design variants, unregistered use, unclear ownership, or incomplete market information. |
| Next action | Revise the presentation, gather more evidence, pause the launch, or obtain legal review. |
Use practical categories such as “needs redesign,” “requires attorney review,” or “lower concern on the facts currently documented.” Avoid calling a use “cleared” unless a qualified professional has performed an appropriate clearance review and advised you on the actual use.

Assuming only identical copies matter
Trademark comparison is not a pixel-matching exercise. Similar sound, meaning, or commercial impression can matter even when spelling, colors, or artwork differ.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsAssuming a different product category ends the inquiry
Goods or services can be related even when they have different labels. Shared purchasers, complementary uses, common advertising, and overlapping trade channels may connect them.
Treating a database result as permission
A search is an initial screen. It may miss unregistered rights, design similarities, variant spellings, or relevant market facts, and it cannot predict how a court would weigh the evidence.

Relying on a disclaimer by itself
A disclaimer may be one fact in the marketplace record, but it does not automatically cure confusing presentation. Buyers may still see the name, image, or packaging as signaling sponsorship or approval.
Believing changed colors or a “fan-made” label settles the issue
Altered colors, added wording, parody labels, or a noncommercial-sounding description do not produce an automatic answer. The complete presentation and the commercial context remain relevant.

Actual confusion is one possible factor, not a required event before a dispute can arise. A new offer may simply lack enough sales history to reveal confusion.
Ignoring unregistered marks
Federal registration is important evidence, but registration is not the only way trademark rights can matter. Do not limit your assessment to a single database result.
When to stop self-screening and obtain legal review
Seek a qualified trademark attorney for a costly launch, a prominent character or logo, a product line that overlaps with entertainment or merchandise, a planned national campaign, a meaningful investment in inventory, or any situation in which the comparison remains close after your initial screen. The USPTO recommends a comprehensive clearance search for consequential use. That review can examine federal and other relevant records, the actual artwork and wording, market context, and possible conflicts in a way a basic search cannot.
Give counsel your complete worksheet, drafts, packaging, intended channels, target purchasers, search records, and any customer or marketplace evidence. Ask what changes would reduce confusion and whether separate copyright, publicity, licensing, or contract advice is also needed. A search service or attorney can assess risk, but no provider can guarantee that a dispute will never occur.
Quick Recap
A practical pre-launch checklist
- Save the exact names, images, logos, costume details, packaging, listings, tags, and advertisements you plan to use.
- Identify each good or service, purchaser group, sales channel, advertising channel, and possible owner overlap.
- Search USPTO wording records for exact terms and plausible spelling, spacing, phonetic, and plural variants.
- Search relevant design records when an emblem, character image, or distinctive graphic is important.
- Read the potentially relevant records, including owner, status, and goods or services, rather than relying on a result title.
- Compare appearance, sound, meaning, dominant elements, overall impression, goods, purchasers, channels, and advertising.
- Review the real customer-facing presentation for official-sounding wording, source cues, and possible mistaken assumptions.
- Record actual confusion, buyer questions, intent evidence, and uncertainties; do not treat any single factor as decisive.
- Revise or pause a close use and obtain comprehensive clearance advice before committing substantial money or publicity.
- Separately evaluate copyright, right of publicity, licensing, and contractual restrictions.
Bottom line
A careful trademark screen asks whether your complete commercial presentation could make relevant buyers believe that a trademark owner made, sponsored, approved, or is connected with your goods or services. Search USPTO records, but treat the results as one source of evidence. Compare the whole impression and the market context, document what you find, and obtain a comprehensive professional review when the use is consequential or close.
