Check the complete ingredient list on the exact candy package you plan to give or eat—not a package from last year, a different flavor, or a full-size version of the same candy. In the United States, most packaged foods regulated by the FDA must identify the source of any of the nine major food allergens when it is used as an ingredient. If the label is missing, damaged, or unclear, set the candy aside and contact the manufacturer or distributor; do not guess from the product name or wrapper design.
This is a package-by-package check, not a judgment about a candy brand in general. Make the decision for the particular person who would eat the treat, using that person’s allergy-specific medical plan. A clear label can help you identify ingredients, but it cannot answer every question about an individual allergy or every possible cross-contact situation.
How to check a Halloween candy package
Use the wrapper or outer bag for the specific candy and size in hand. Read the entire ingredient list, then look for a nearby “Contains” statement. Check both: a Contains statement may not appear, and its absence does not mean the candy is free of allergens.

- Confirm the exact product. Match the variety and package size. A mini, fun-size, or bite-size piece may have different ingredients from a full-size counterpart.
- Read every ingredient. Look for the allergen relevant to the person eating the candy, including source names and names shown in parentheses. For example, whey identifies milk, flour identifies wheat, and lecithin may identify soy.
- Check the Contains statement, if present. Under FDA guidance, a Contains statement must identify the major allergens used as ingredients. It is an additional place to check, not a replacement for the ingredient list.
- Read any advisory wording without treating it as a safety scale. Phrases such as “may contain” or “made in a facility that also processes” are voluntary and do not have a uniform meaning.
- Pause if anything is unclear. Set the candy aside and contact the manufacturer or distributor named on the package. If you cannot confirm that it fits the person’s allergy plan, choose an appropriate alternative.
FDA food technologist Carol D’Lima advises consumers to read the full ingredient list to see whether an allergen is present. FDA also advises not buying a product when unsure, or checking with the manufacturer or distributor first.

In practice, start by locating the ingredients rather than relying on front-of-package claims, familiar branding, or a picture of the candy. Read from the first ingredient through the last, including any parenthetical explanations. Then compare what you read with the person’s known allergens and the instructions in their medical plan. Do not stop when you spot one relevant word: the list may contain more than one ingredient that matters to that person.
FDA consumer guidance explains that, for most FDA-regulated packaged foods, major allergens used as ingredients must be identified by source name in the ingredient list or in a nearby Contains statement. A source name may be more informative than an ingredient name alone: the examples FDA gives include whey for milk and flour for wheat. If you are uncertain whether a particular term identifies an allergen relevant to the person, do not try to resolve the question by guessing. Ask the manufacturer or distributor listed on the package.
Take care to read the label on the candy itself or on its outer package when that is where the ingredients are printed. A mixed bag can contain more than one variety, and a label for one type of piece should not automatically be treated as the label for every other piece. If individual wrappers do not show the information, keep the original outer package with the candy so that the ingredients and product identity remain available.

U.S. FDA labeling guidance identifies nine major food allergens: milk, egg, fish, crustacean shellfish, tree nuts, wheat, peanuts, soybeans, and sesame. Sesame was added under the FASTER Act. These are the allergens on the major-allergen list; the list does not mean that other foods cannot cause an individual allergy.
| Major allergen | What to check on the package |
|---|---|
| Milk | Milk and ingredients identified as milk sources, such as whey |
| Egg | Egg and any source name identified for egg |
| Fish | Fish and the identified fish source |
| Crustacean shellfish | Crustacean shellfish and the identified source |
| Tree nuts | Tree nuts and the identified nut source |
| Wheat | Wheat and ingredients identified as wheat sources, such as flour |
| Peanuts | Peanuts and ingredients identified as peanut sources |
| Soybeans | Soybeans and ingredients identified as soy sources, such as some lecithin |
| Sesame | Sesame and ingredients identified as sesame sources |
The ingredient examples above are not a complete list of ingredient names that can indicate an allergen. Check the complete label and the person’s allergy-specific plan rather than relying on a short list of familiar terms. Food allergy is also different from an intolerance; follow the individual’s medical guidance.
The nine-item list is a regulatory category, not a checklist that covers every person’s dietary needs. Someone may have an allergy to a food that is not on the major-allergen list. That is why the relevant question is not only “Does this package name one of the nine?” but also “Does this label answer the question for the specific person who will eat it?” Use the person’s known allergens and clinician-provided instructions when reviewing all ingredients.
Sesame’s inclusion is relatively recent compared with some of the other major allergens: it was added through the FASTER Act. When reviewing a label, check the current package rather than assuming an old understanding of label wording applies. FDA’s current consumer guidance lists all nine major allergens, including sesame.

What “may contain” and facility statements do—and do not—tell you
Advisory statements such as “may contain” or “made in a facility that also processes” are voluntary. FDA says they are not required and are not governed by a uniform rule defining their meaning. The wording does not reliably indicate whether cross-contact is more likely or whether the potential amount of an allergen is higher.
Do not rank one advisory phrase as safer than another, or treat the absence of an advisory as proof that cross-contact cannot occur. If the package wording leaves a material question for the person’s allergy, contact the manufacturer and follow that person’s clinician-provided plan.
These statements can alert you to a possible cross-contact concern, but they are not a standardized risk scale. A package that says “may contain” cannot be compared with one that says “made in a facility that also processes” to decide which is safer. FDA guidance says there is no uniform rule for these phrases, and the wording alone does not tell you the likelihood of cross-contact or the amount that might be present.
Likewise, do not read silence as a guarantee. The absence of an advisory sentence does not establish that cross-contact is impossible. If the person’s plan calls for avoiding a product when a particular uncertainty remains, follow that plan. When more information is needed, ask the manufacturer about the specific product and package rather than trying to infer manufacturing details from a short phrase.
Why you need to check each package each time
Ingredients can change. A candy that was suitable on a previous Halloween may not have the same formula now, and an online description or an old wrapper may not reflect the package in the bowl. FARE also warns that mini, fun-size, and bite-size versions can differ from full-size counterparts. Check the exact current package, including its size and variety, each time.
A 2026 FDA allergy alert recalled Halloween Chocolatey Eyeballs for undeclared milk. It is a concrete reason to pay attention to current product information, not evidence about how common undeclared allergens are. If a product or lot is the subject of an alert, follow the details in the current FDA notice rather than relying on a general label-checking rule.
Checking each time does not mean that every candy formula has changed; it means a previous label is not confirmation of the package in front of you. A product may also differ by flavor, size, or variety. Do not transfer a conclusion from a full-size bar to a mini piece, from one flavor to another, or from one bag to another just because the product names or packaging look similar.

Use the physical package as your starting point, especially when Halloween candy has been collected from several homes or stores. An online product page, an older photograph, or a label saved from a previous purchase may describe a different formula or package. If you do consult online information, it does not replace reading the current package you will serve.
The FDA’s 2026 allergy alert for Halloween Chocolatey Eyeballs involved undeclared milk. The alert illustrates why current notices and package information matter; it does not establish how frequently undeclared allergens occur across Halloween candy. If you encounter a recall or alert, check the FDA notice for the affected product and any lot-specific details. Do not assume that a general rule about reading labels settles whether a particular recalled product is affected.
What to do when the label is missing or unclear
- No ingredient label: FARE advises avoiding candy without ingredient information.
- Damaged or unreadable wrapper: Set the piece aside. Do not assume another wrapper in the bowl is identical.
- Ingredient or advisory wording does not answer the question: Contact the manufacturer or distributor named on the package before serving it.
- Still uncertain: Choose an alternative that fits the person’s allergy plan. Do not use a guess, a product name, or an old package as confirmation.
FDA’s packaged-food labeling requirements apply to most foods it regulates under the FD&C Act, but there are exceptions and distinct rules for some products and retail situations. These package-label checks should not be assumed to apply to homemade or unpackaged treats, or food prepared in someone else’s home. When the food has no reliable package label, ask the preparer about ingredients and handling; if the answer is not enough to establish safety for the individual, skip it.
If you need to ask a question, use the manufacturer or distributor contact information on the package and identify the product as precisely as possible: its name, variety, and size. Explain which allergen or ingredient you are trying to verify and ask about the information that is not clear. FDA consumer guidance, quoting food technologist Carol D’Lima, says: “If you’re unsure about whether a food product contains any ingredient to which you are sensitive, don’t buy it, or check with the manufacturer or distributor listed on the food product’s label first to ask what it contains.”
A phone call or message is not a reason to serve the candy if the answer still leaves a meaningful uncertainty for the person’s allergy plan. Set it aside while you check, and choose an alternative if you cannot confirm that it is appropriate. FARE’s Halloween guidance recommends avoiding treats without ingredient labels and contacting manufacturers when questions arise.

For homemade or unpackaged treats, the packaged-food label rules described here may not apply in the same way. A treat made in a neighbor’s kitchen is not made easier to assess by comparing its appearance to a wrapped candy. Ask the person who prepared it about ingredients and handling, but do not assume that a brief answer resolves every question relevant to an individual allergy. If the information does not establish that the treat fits the person’s plan, skip it.
FDA oversees food labeling and cross-contact controls and publishes recall alerts when problems are identified, but reading a label is not a guarantee that an undeclared allergen or cross-contact cannot occur. For questions that matter to a particular person’s health, follow the clinician-provided plan and seek manufacturer information when the package leaves a material uncertainty. FDA’s labeling requirements also have exceptions and distinct rules for some foods and retail situations, so do not extend these packaged-candy instructions to every food encountered at Halloween.

Non-food Halloween alternatives
Families can arrange a trade for unsuitable candy using small Halloween party favors, inexpensive trinkets, or toys. FARE also describes non-food treats as a Teal Pumpkin option for hosts. These alternatives avoid the need to assess that particular food package, but a toy or favor is not a way to determine whether any candy is safe for a specific person.
For a household expecting trick-or-treaters, small non-food treats can be offered alongside or instead of candy. For a family reviewing a child’s haul, trinkets can make a simple trade for pieces that do not fit the child’s plan or cannot be verified. Keep this separate from the package check: a toy is an alternative to a food treat, not evidence that a candy is safe, and not a substitute for following the person’s medical guidance.
FARE’s Teal Pumpkin guidance includes non-food treats as an option for hosts. The practical point is to make a non-food choice available without asking a guest to take an uncertain food. Hosts can choose inexpensive party favors or other small trinkets; families can decide what works for them. No particular toy or candy brand should be treated as suitable for every person.

How do I check Halloween candy labels for allergens?
Read the full ingredient list on the exact current package, including source names and parenthetical wording, then check any nearby Contains statement. Compare the ingredients with the person’s allergy-specific plan. If the package is missing, damaged, or unclear, set it aside and ask the manufacturer or distributor rather than guessing.
Does a candy need a Contains statement?
A Contains statement may not be present. For most FDA-regulated packaged foods, major allergens used as ingredients must be identified by source name in the ingredient list or in a nearby Contains statement. Read the full ingredient list whether or not a Contains statement appears; its absence does not mean a candy is allergen-free.
What are the nine major food allergens in the United States?
FDA’s list is milk, egg, fish, crustacean shellfish, tree nuts, wheat, peanuts, soybeans, and sesame. Sesame was added under the FASTER Act. The list does not cover every food that can trigger an individual allergy.

Can Halloween candy ingredients change from year to year?
Yes. FDA notes ingredients can change at any time, and FARE warns that mini, fun-size, and bite-size candy can differ from a full-size counterpart. Check the exact current package each time instead of relying on last year’s label, another flavor, or an online description.
What should I do if candy has no readable ingredient label?
Set it aside. FARE advises avoiding treats without ingredient labels. If the package is damaged or the information does not answer the allergy question, contact the manufacturer or distributor named on the package. If you still cannot confirm that it fits the person’s allergy plan, choose an appropriate alternative.
Do these label instructions apply to homemade Halloween treats?
The FDA labeling requirements discussed here apply to most FDA-regulated packaged foods, with exceptions and distinct rules for some products and retail situations. Do not assume the same package-label rules apply to homemade or unpackaged treats. Ask the preparer about ingredients and handling, and skip the food if the answer does not resolve the concern for the individual.
Does a label check guarantee that candy has no allergen cross-contact?
No. A label review is useful, but it is not a guarantee that undeclared allergens or cross-contact cannot occur. Follow the person’s clinician-provided allergy plan and contact the manufacturer if label information leaves a material uncertainty.
What is the 2026 Halloween Chocolatey Eyeballs alert about?
FDA published an allergy alert recalling Halloween Chocolatey Eyeballs for undeclared milk. Check the current FDA notice for affected product and lot details; the alert is an example of why current information matters, not a measure of how common undeclared allergens are.
The Bottom Line
For Halloween candy, check the complete label on the exact package, size, and variety each time. Read the full ingredient list and any Contains statement; do not treat voluntary advisory wording as a risk scale. If information is missing or unclear, set the candy aside, contact the manufacturer or distributor, and follow the person’s allergy plan. When you cannot confirm that a treat is appropriate, choose a suitable alternative.
