Before hiring a lawyer, verify every jurisdiction where they are licensed, check each jurisdiction’s official attorney profile, record the exact current status, and open any linked discipline orders or docket entries. If the profile is incomplete or its look-back period is limited, contact the state disciplinary agency and consider a written name-verification request to the American Bar Association’s National Lawyer Regulatory Data Bank.
A clean online profile means only that no accessible public record appeared in that system. Confidential matters, sealed files, older records and discipline in another state may not be visible. A disciplinary search is therefore one part of due diligence, not a finding that a lawyer is competent or incompetent.
What a disciplinary-history check can tell you
A bar record can answer several practical questions before you sign an engagement agreement:
- Is the lawyer currently authorized to practice in the jurisdiction?
- Which state bars or other licensing authorities list the lawyer?
- Has a public sanction, judgment or disciplinary order been entered?
- What sanction was imposed, on what date, and under which reference number?
- Can you read the underlying order or docket instead of relying on a summary?
It cannot answer every question a prospective client may have. Public systems generally do not show confidential investigations, sealed proceedings, every complaint, or matters outside the system’s stated time period. A “no public discipline shown” result is not proof that no complaint was ever made, nor is it a guarantee of legal skill, communication, honesty or suitability for your matter.

Before searching, identify the right lawyer and jurisdictions
Collect reliable identifiers
Ask the lawyer for their full legal name as it appears on a bar registration, the state bar number or license number, office city and state, and every jurisdiction in which they are admitted. A lawyer may use a middle initial, a former surname or a firm name that differs from the name in the official record. Keep both the name you were given and the identifiers you used in your search.
Make a jurisdiction list
Start with the state where the lawyer says they practice. Add every other state or jurisdiction the lawyer identifies, appears to serve, or lists in a professional biography. A single state search cannot reveal a public sanction entered elsewhere. Treat a multistate license as separate records to verify, not as one national license.
Step 1: Start with the official state source
Use the licensing authority’s own attorney-search page or the state’s disciplinary-agency directory. The American Bar Association tells consumers that each state maintains current registration and discipline information for lawyers licensed there and directs consumers to the directory of state disciplinary agencies for contact information.

Do not rely on an advertising profile, a law-firm biography, a crowdsourced rating or a search-engine snippet as proof of good standing. Those sources may be outdated, omit a sanction or confuse a lawyer with someone who has a similar name. The official state record is the controlling starting point for current eligibility.
Step 2: Search with enough detail to avoid a namesake
Use the site’s available fields
Enter the lawyer’s first and last name exactly as provided. If the system offers them, add the city, county, bar number or license number. Florida’s official instructions, for example, direct users to enter first name, last name and city, then review the resulting profile. A city filter is useful when several lawyers share a name, but it should not replace checking the bar number when one is available.

Resolve duplicate results
Compare each result’s office location, admission year, attorney number and contact information with what the lawyer gave you. If two records could match, do not choose one based only on a photograph or firm name. Ask the licensing agency to confirm which record belongs to the person you are considering, or ask the lawyer to identify the correct bar number in writing.
Step 3: Confirm current eligibility and save the status
Read the status label exactly as displayed and record the date you checked it. Status wording varies, so do not silently convert a label into “good standing.” Florida profiles, for example, can display “Member in Good Standing” or “Disbarred–Not eligible to practice.” Other systems may use terms such as active, inactive, suspended, resigned or disbarred.
Copy the status, effective date if shown, attorney number, admission year and the profile’s contact details into your notes. A lawyer can have a public discipline history and still be eligible to practice, or can be ineligible even when a separate discipline-history section is empty. Current eligibility and past discipline are different fields that must both be checked.
What an adverse status means
- Suspended: the lawyer’s right to practice is restricted or removed for the period and conditions stated by the authority. Do not hire the lawyer to perform work requiring an active license unless the official record expressly permits it.
- Disbarred or not eligible: the profile indicates the lawyer is not authorized to practice under that license.
- Inactive or other non-practicing status: read the jurisdiction’s definition; the label may mean the lawyer cannot accept new matters even if no misconduct finding appears.
If the status is unclear, contact the licensing authority before paying a retainer. Ask what the label means on the date you plan to sign and whether any reinstatement, pro hac vice or limited-practice order applies.
Step 4: Read the discipline section, not just the headline
Open the profile’s discipline, public-record or disciplinary-history section. Florida describes a “10-Year Discipline History” area that indicates whether details exist and, when they do, lists the sanction, action date, reference number and links to court documents. Record each of those fields instead of relying on a one-line description.

Open every linked order and docket
A summary can omit the conduct at issue, conditions of reinstatement, restitution, monitoring, costs or the expiration date of a sanction. Open the linked order, judgment or docket entry and save the document’s title, issuing body, date and case number. Read the disposition section first, then the factual findings and any continuing obligations. A public order is more reliable than an uncited statement in a profile or biography.
Distinguish the type and outcome of the matter
Discipline records can involve different outcomes. Note whether the document describes a reprimand, admonition, public reprimand, suspension, disbarment, resignation or another sanction. Also note whether the matter was dismissed, resolved by consent, stayed, appealed or modified. The sanction and the underlying findings are separate facts; record both without treating every complaint as a proven violation.
Step 5: Check the time span and request older records
Every system has access rules. Florida says it posts public attorney-discipline documents for the past 10 years and requires a public request for records older than 10 years. California’s State Bar Court says its Attorney Search covers an attorney’s history from admission to the present, while warning that confidential proceedings and sealed records are not available for online public viewing.
These examples show why an empty result needs a qualification. Before concluding that a lawyer has no history, read the search page’s statement about the look-back period, archived files and confidential material. If the period is shorter than the lawyer’s career, ask the agency how to obtain older public orders, docket entries or certified copies. California provides online dockets and a process for requesting certified discipline documents; follow that agency’s instructions rather than treating a missing web result as a complete record.
Step 6: Search every other licensing jurisdiction
Repeat the same process for every state or jurisdiction in which the lawyer is admitted. Compare the current status, admission date, public discipline section and document links in each profile. A sanction in one state may not appear in another state’s abbreviated profile, and a lawyer may remain active in one jurisdiction while suspended in another.

Keep a jurisdiction-by-jurisdiction log so you can tell which agencies were checked, on what date, with which identifiers and under what access limits. If the lawyer says they are licensed somewhere but no record appears, stop and resolve the discrepancy before hiring.
Using the ABA National Lawyer Regulatory Data Bank
The ABA’s National Lawyer Regulatory Data Bank is described as the only national repository of information concerning public regulatory actions relating to lawyers throughout the United States. It can perform national name searches of public regulatory actions when an inquirer submits a written verification request and confirms the request in writing.
Use this service as a supplemental national check, not as a replacement for the state agency. The ABA is not a licensing or disciplinary authority and says it has no power to investigate complaints or act on them; each state has its own agency for those functions. Begin with the state where the lawyer is known to be licensed, then use the Data Bank when you need a broader public-action search or want to verify a name across jurisdictions.
What “no discipline found” does—and does not—mean
Records that may be unavailable
- Confidential investigations or diversion matters.
- Sealed proceedings and records restricted by court order.
- Older public records outside the website’s look-back period.
- Complaints that did not result in a public order.
- Actions recorded in another state or under a different legal name.
Arizona explains that diversion records are confidential and that records tied to sanctions generally become public after an order is entered. That distinction matters: a complaint, a confidential diversion, and an entered sanction are not interchangeable events. Ask the agency what categories it publishes and what remains confidential under its rules.

If a record raises concern, give the lawyer the case number and ask for a written explanation of the outcome, current obligations and whether the order is final. You are not required to accept the explanation without checking the source document. Compare the response with the order and with the current status shown by the licensing authority. If the lawyer refuses to identify a bar number or jurisdiction, treat that refusal as a reason to pause, not as proof of misconduct.

How to compare two or more candidates
When several lawyers remain under consideration, use the same criteria and the same search date for each. Texas states that public disciplinary history, including recent public judgments, appears on an attorney’s online profile. Record what the profile actually shows rather than assigning an informal score.

A past sanction is not automatically disqualifying, and an empty profile is not automatically reassuring. Consider the conduct, age, severity, recurrence, final disposition and relevance to your matter. For example, a resolved administrative issue may call for different follow-up than a recent order involving client funds or a current suspension. The official order, not a generalization about the lawyer, should drive that assessment.
When and how to contact a disciplinary agency
Contact the agency before signing when
- The profile shows suspended, disbarred, inactive or otherwise unclear status.
- The lawyer’s claimed bar number or admission state does not match the profile.
- The site indicates that records are older than its online period.
- A linked order is missing, unreadable or appears inconsistent with the summary.
- You find a similarly named lawyer and cannot establish identity.
Prepare a precise request
Include the lawyer’s full name, known bar number, city, admission state, former names if relevant, and the specific years or case number you are asking about. Ask whether the agency can provide public orders, docket entries or certified copies, what fees or identity confirmations apply, and whether the response covers confidential or sealed material. Agencies can explain their records; they generally cannot tell you whether a lawyer is a good choice for your personal circumstances.

A practical documentation checklist
- Write down the lawyer’s full name, bar number, firm, office city and every claimed jurisdiction.
- Search the official profile for each jurisdiction using the same identifiers.
- Capture the exact current-status label and the date checked.
- Record admission year, attorney number and any alternate-name information.
- Read the discipline section and list every sanction, action date and reference number shown.
- Open and save each linked order, judgment or docket entry.
- Read the site’s look-back and confidentiality notices.
- Request older public records or certified documents when the online period is incomplete.
- Use a written ABA Data Bank verification request when a supplemental national public-action search is warranted.
- Keep the notes and documents with your engagement paperwork so you can distinguish what was verified from what was merely represented.
Common mistakes that produce a false sense of security
- Searching only the firm name: discipline is usually indexed to the individual licensee, not the marketing name of a firm.
- Stopping at the first matching name: confirm city, admission year, bar number and contact details.
- Reading only the status badge: current eligibility does not summarize past sanctions or continuing conditions.
- Treating “no results” as “no complaints”: confidential, sealed, older and out-of-state matters may be excluded.
- Ignoring the document link: the order may contain restitution, monitoring, practice restrictions or deadlines absent from the profile summary.
- Assuming the ABA can investigate: the ABA Data Bank is a repository and verification service; the state agency handles licensing and discipline.
- Using an undated screenshot: status can change, so retain the date and, where possible, the downloaded order or page.
Deciding what to do with the result
If the lawyer is active, the identity matches, the records are within the stated scope and any public orders are understandable and resolved, you can move to the separate questions of expertise, fees, conflicts, communication and fit. If the status is adverse, an identity mismatch remains, or the record cannot be explained from official documents, do not pay a retainer until the licensing authority clarifies the situation. You can also consult another lawyer about the significance of a particular order, especially when it concerns your type of legal matter.
