If the IRS mailed you a statutory notice of deficiency, you can generally challenge the proposed tax in U.S. Tax Court without paying the disputed amount first. Your immediate job is to use the notice’s printed last day, prepare a petition under the Court’s current instructions, and make sure the Court receives it on time. Most notices allow 90 days; specified situations involving an address or taxpayer outside the United States can allow 150 days. The statutory deadline is strict.
This is general procedural information, not an assessment of your notice, deadline, or tax arguments. Read the notice itself, preserve the envelope and all pages, and obtain advice from a qualified tax practitioner or a Low Income Taxpayer Clinic if the date or filing requirements are unclear.
What gives you access to Tax Court
A statutory notice of deficiency—often called a “90-day letter”—is the document that opens the prepayment route to Tax Court. The IRS describes it as notice of a proposed adjustment and a right to challenge that adjustment in Tax Court before paying. See the IRS explanation of a CP3219N notice and its explanation of the right to finality.
Not every IRS letter is a notice of deficiency. An examination letter, ordinary bill, math-error notice, collection notice, or request for information can trigger a different procedure. Do not assume that an IRS letter gives you the same Tax Court deadline merely because it mentions additional tax.

How to recognize the relevant notice
- Look for language stating that the IRS determined a deficiency or proposes additional tax, penalties, or additions to tax.
- Look for a section that tells you when and where to file a Tax Court petition and identifies a last day.
- Keep every page, attachment, and the envelope or mailing record. The exact notice and date control your next steps.
The Tax Court generally cannot hear a deficiency case before the IRS issues the statutory notice. If you have only an examination or assessment letter, ask the IRS or a practitioner what administrative step is available instead of filing a petition that the Court cannot accept.
Calculate the filing deadline from the notice
The IRS generally gives 90 days from the notice’s mailing date for a taxpayer in the United States. Official materials describe a 150-day period in specified circumstances involving an address outside the United States and relevant situations in which the taxpayer is outside the country. The notice should state the applicable last day; use that date rather than estimating from the day you opened the envelope. See the IRS guidance on the right to challenge the IRS’s position and the Tax Court’s Court Information.
The Court states that it cannot extend a filing period set by statute. A telephone call to the IRS, a request for reconsideration, an Appeals discussion, or an attempt to negotiate does not by itself change the date printed on the notice. If a deadline is close, file a complete petition using the Court’s current process while obtaining advice about any issue affecting the computation.
Make a deadline-control record
- Write the notice mailing date and the stated last filing day on a calendar used by everyone helping with the case.
- Set reminders well before the last day for drafting, reviewing, submitting, and confirming receipt.
- Record the time zone that applies to an electronic submission. The Court’s DAWSON instructions generally use Eastern Time for the receipt cutoff.
- Save a PDF or paper copy of everything submitted, the confirmation screen or receipt, and any payment or fee-waiver record.
Do not wait for the IRS to answer a question before protecting the statutory date. The Court’s deadline rules include exceptions and details that depend on individual facts; a practitioner or clinic can analyze those details, but cannot promise that a late petition will be accepted.
File through DAWSON or on paper
The Tax Court provides an electronic filing route through its DAWSON system and a paper route. The official How to eFile a Petition page and Starting A Case guidance contain the current steps and forms. Do not send a petition to the Court by ordinary email.

| Filing route | What the Court supports | Deadline and proof considerations |
|---|---|---|
| DAWSON electronic filing | A guided petition created from online answers, an upload of the Court’s Form 2, or an upload of a petition that complies with the Court’s rules. | The Court generally must receive the electronic petition by 11:59 p.m. Eastern Time on the due date. Keep the submission confirmation, uploaded files, and any docket information. |
| Paper filing | A paper petition prepared and sent according to the Court’s current petitioner instructions and filing address. | Plan mailing and delivery so the Court receives the filing by the statutory date. Retain a complete copy and verifiable delivery or receipt records. |
The Court’s DAWSON information explains the electronic system. The system’s availability, account setup, document format, and confirmation screens can change, so follow the live instructions rather than an old checklist or video.
What to do if electronic filing fails
- Capture the error message, time, and files you attempted to submit.
- Check the Court’s current technical and filing instructions and contact the Court using the contact information on its official site.
- If there is enough time, correct the file and resubmit; verify that a confirmation was actually issued.
- When time is critical, evaluate the paper-filing route and obtain professional help immediately. Do not assume that starting an online form, sending an email, or leaving a voicemail preserves the deadline.
Prepare a petition that protects your information
Your petition should identify the taxpayer, the IRS notice being challenged, the tax year or years involved, and the broad grounds for disagreement. It is not the place to prove every factual issue. The Court’s instructions separately address taxpayer identification information and the copy of the IRS notice.
Keep sensitive identifiers out of the petition
Do not put a Social Security number, taxpayer identification number, employer identification number, bank-account number, or similar financial identifier in the petition. Follow the Court’s redaction and taxpayer-identification workflow exactly. A public court filing can be accessible to others; protecting an identifier after filing can be difficult.
Do not attach your evidence to the initial petition
The Court instructs petitioners not to attach tax returns, receipts, spreadsheets, or other evidence to the petition. Gather those records privately and organize them for later exchanges, settlement discussions, or trial preparation. Attach only the materials the Court’s current filing instructions require, such as the relevant notice copy, with required redactions.
Describe why you disagree
State the adjustments or penalties you contest and the principal reasons you believe the IRS position is wrong. Use plain, specific statements tied to the notice and tax year. Avoid argumentative language, unsupported accusations, and a document dump. You can develop facts and legal authorities as the case proceeds.

Review before submitting
- Confirm that the petitioner’s name and address match the notice and current contact information.
- Check each tax year and the notice date for transcription errors.
- Make sure every required signature, declaration, and identification statement is completed in the format the Court requests.
- Inspect every uploaded or mailed page for hidden identifiers, blank pages, unreadable scans, or the wrong file.
- Keep the final petition exactly as filed, including the date and confirmation.
Pay the filing fee or request a waiver
The Tax Court currently lists a $60 petition filing fee. Its fee guidance provides an application to waive that fee for an eligible taxpayer. Follow the Court’s current fee instructions and submit the payment or waiver application with the petition as directed. The Court warns that a case may be dismissed if the fee is neither paid nor waived.

Decide whether to elect small tax case procedure
For a deficiency dispute, the Tax Court says a taxpayer may qualify to elect small tax case procedure when the disputed amount for any one year—including additions to tax and penalties—is $50,000 or less. The Court must accept the election. The Case Procedure Information page explains the distinction.
| Issue | Regular procedure | Small tax case procedure |
|---|---|---|
| Eligibility | No small-case amount cap, subject to the Court’s jurisdiction and the type of case. | For a deficiency, disputed tax plus additions and penalties must be $50,000 or less for the particular year, and the Court must agree to the election. |
| Formality | Uses the Court’s regular pleadings, discovery, motions, and trial rules. | Designed to be simpler and generally less formal, while still requiring compliance with the Court’s orders. |
| Appeal | A decision may be subject to appellate review under applicable law and procedures. | The decision cannot be appealed. |
| Strategic question | Preserves the regular procedural framework, which may matter in a complex or high-value dispute. | Trades the simplified process for loss of appeal rights; the taxpayer should consider the issues, amount, and desired review before electing. |
The $50,000 test is not a promise that the Court will accept the case as small. Calculate the disputed amount for each year using the notice and include additions and penalties. If multiple years or complicated legal issues are involved, ask a practitioner or clinic to evaluate whether the simplified procedure fits your objectives.
What filing changes while the case is pending
After the Court accepts the petition, the case receives a docket number and proceeds under Tax Court orders and procedures. The IRS and taxpayer may exchange information, discuss settlement, file motions, or prepare for trial. Many cases settle, but settlement is not guaranteed and no official source establishes a typical resolution time or success rate.

Payment and collection
A deficiency petition generally postpones payment of the disputed tax until the case is decided, and the IRS generally may not try to collect the amount in dispute while the case is pending. This protection concerns the disputed deficiency; it does not automatically resolve other tax debts, previously assessed amounts, penalties outside the case, or every collection action. Continue to read IRS notices and obtain advice if the IRS contacts you about a different balance.
Settlement or trial
Keep organized records supporting income, deductions, credits, basis, filing status, and penalty defenses. The IRS may request documents during the case. A settlement proposal should identify the years and issues it covers and should be reviewed for its effect on tax, interest, penalties, and future returns. If no agreement is reached, the Court can set the matter for trial and issue orders governing evidence and deadlines.
Represent yourself or obtain assistance
You may appear without a lawyer or use a practitioner admitted to the Tax Court bar. The Court’s Guidance for Petitioners directs self-represented taxpayers to clinics and pro bono resources. It expressly cautions: “This guide provides information, but not legal advice, for individuals who represent themselves before the Tax Court.”
When self-representation may be manageable
- The dispute is limited, the records are organized, and you can meet every Court order and deadline.
- You understand the difference between the notice, petition, evidence exchange, motions, and trial proof.
- You can communicate clearly with IRS counsel and respond to procedural requests.
When professional help is especially important
- The deadline, mailing circumstances, or taxpayer identity is uncertain.
- The notice covers multiple years, large adjustments, fraud-related allegations, international issues, or complex business transactions.
- You are considering small tax case procedure and the loss of appeal rights could matter.
- You have received collection notices, an assessment for another period, or a motion that requires a legal response.
- You cannot organize records or meet filing requirements without assistance.
A Low Income Taxpayer Clinic may provide free or low-cost help to qualifying taxpayers. The Tax Court’s petitioner resources identify clinic and pro bono options; eligibility and availability depend on location and circumstances.

Filing the wrong kind of document
An examination response, protest letter, or payment dispute is not a Tax Court petition. Use the Court’s petition process only after confirming that the IRS letter is a statutory notice of deficiency.

Relying on the IRS to extend the date
The Tax Court cannot extend a statutory filing period. Administrative discussions can continue, but they should not replace filing a timely petition when you want Tax Court jurisdiction.
Waiting until the final evening
Uploads can fail, accounts can lock, scans can be rejected, and a paper delivery can be delayed. Build review and confirmation time into your calendar. An electronic form that was started but not successfully received does not establish a filing.
Including private information or evidence
Do not place SSNs, TINs, EINs, financial-account numbers, returns, receipts, or other evidence in the petition unless the Court’s current instructions specifically require a properly redacted item. Keep evidence organized for the later stage of the case.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteIgnoring the fee or waiver
A petition without the required $60 fee or a properly submitted waiver application can be dismissed. Confirm the fee status in the filing confirmation and respond to any Court order.
Assuming small-case procedure is automatically better
Simpler and less formal does not mean risk-free. The Court must approve the election, and a small-case decision cannot be appealed. Compare that finality with the complexity and value of your dispute.
A practical filing-day checklist
- Locate the statutory notice and verify the printed last filing day.
- Identify every tax year and adjustment you intend to challenge.
- Create a petition using DAWSON, Form 2, or a paper format accepted by the Court.
- State the disagreement clearly without attaching unrequested evidence.
- Remove SSNs, TINs, EINs, account numbers, and other protected information from public documents.
- Prepare the required taxpayer-identification statement and a properly redacted notice copy according to the Court’s instructions.
- Choose regular or small tax case procedure only after considering eligibility and appeal rights.
- Pay the $60 fee or submit the Court’s waiver application.
- Submit electronically early enough to confirm receipt by the Eastern Time cutoff, or arrange paper delivery under the Court’s instructions.
- Save the filed petition, confirmation, docket number, fee or waiver record, and a complete private evidence file.
The authoritative starting points are the IRS notice guidance and the Tax Court’s live pages for electronic petitions, starting a case, self-represented petitioners, and case procedure. Use those pages for current forms and instructions, and seek individualized advice when the notice or deadline does not fit the general description above.
