For a first appeal against a GST order that demands penalty but no tax, the pre-deposit is 10% of the penalty under the substituted proviso to section 107(6) of the CGST Act, as described by the Delhi High Court as effective from 1 October 2025. For example, a ₹1,00,000 penalty produces a ₹10,000 pre-deposit. The date the proceedings began can complicate that calculation for some cases, so check the order and notice before relying on the percentage.

Calculate 10% of the penalty demanded

Use this calculation when the order under appeal demands a penalty without involving a demand of tax:

Pre-deposit = penalty amount × 10%

Penalty in the order Calculation Pre-deposit
₹50,000 ₹50,000 × 10% ₹5,000
₹1,00,000 ₹1,00,000 × 10% ₹10,000
₹10,00,000 ₹10,00,000 × 10% ₹1,00,000

Take the penalty amount from the order being appealed. Do not calculate 10% of the disputed tax, turnover, or the total amount of a separate tax demand under this penalty-only rule. The substituted proviso quoted by the Delhi High Court states that an appeal against an order demanding penalty without involving a tax demand cannot be filed unless the appellant has paid a sum equal to 10% of that penalty.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

This is a condition for filing the appeal, not payment of the full penalty. Section 107(7) provides that, once the applicable section 107(6) deposit has been paid, recovery of the balance is deemed stayed. The stay does not remove the need to file the appeal within the permitted period or satisfy the other filing requirements.

Work the arithmetic from the order amount

For a quick check, move the decimal point in the penalty amount one place to the left: 10% of ₹2,40,000 is ₹24,000. The arithmetic is straightforward, but the important first step is deciding whether this is the correct percentage base. A correct multiplication using the wrong base does not establish the right pre-deposit.

Use the penalty imposed in the appealed order, not an amount you estimate from the underlying transaction or a figure from a separate notice. If the order lists more than one amount, first distinguish penalty from tax and from other dues. The penalty-only proviso is framed around the penalty demanded in an order that does not involve a tax demand; it does not say to add unrelated figures together and take 10% of the total.

The cited Delhi High Court judgment describes the new penalty-only percentage as having no ceiling, unlike the capped disputed-tax amount under the former general rule. That is a description of the substituted proviso in the judgment, not a reason to overlook the applicable statutory version. Check the operative text and any later amendment when preparing a real appeal.

First confirm the order is genuinely penalty-only

Read the operative part of the order and identify what it actually demands. A penalty-only order is one that demands penalty without involving a demand of tax. The label used in a notice or summary is not a substitute for checking the order itself.

What the order involves Percentage base described in the relevant rule How to approach the calculation
Penalty, with no tax demand Penalty demanded Under the substituted penalty-only proviso, calculate 10% of the penalty, subject to the transition issue discussed below.
A demand of tax, with penalty or other amounts Remaining disputed tax under the former general rule described in the sources Do not use the penalty-only formula. The former general rule required admitted tax, interest, fine, fee and penalty to be paid in full, plus 10% of the remaining disputed tax, subject to the statutory ceiling. Check which statutory text applies to the case.
Penalty-only order following proceedings begun before 1 October 2025 Depends on how the transition applies to the facts Compare the notice, order and appeal dates, and get jurisdiction-specific advice rather than assuming that the new 10% rule either certainly applies or certainly does not.

The older penalty-specific proviso concerned orders under section 129(3). It should not be confused with the substituted proviso for an order demanding penalty without a tax demand. Likewise, the former general disputed-tax calculation is not a different way to calculate 10% of a penalty: it uses a different base and applies to a different kind of order.

How to classify an order before calculating

  1. Start with the demand: identify whether the appealed order imposes tax, penalty, or both. Look at the operative demand rather than relying only on the document title or a short description.
  2. Separate the amounts: note the penalty amount and any tax demand separately. If tax is also demanded, do not assume that the penalty-only percentage answers the whole pre-deposit question.
  3. Identify the rule path: a genuinely penalty-only order may fall under the substituted 10%-of-penalty proviso. An order involving disputed tax requires a different analysis of the applicable statutory text, including admitted amounts and the disputed-tax base described under the former general rule.
  4. Check the dates: even if the order is penalty-only, proceedings beginning before 1 October 2025 can raise a transition question.
  5. Only then calculate: apply 10% to the penalty demanded if the penalty-only proviso governs the appeal.

This classification matters because “10%” appears in more than one path but does not mean the same thing in each. In the penalty-only path, the base is the penalty. Under the former general rule for a tax-demand case, the percentage base was the remaining disputed tax after the relevant admitted dues were paid in full, and the disputed-tax percentage was subject to a statutory ceiling. Do not move a percentage from one path to another without checking both the type of order and the governing version of the law.

Check the amendment date and the case timeline

The Delhi High Court has described the substituted penalty-only proviso as coming into force on 1 October 2025. That date matters, but a notice or order falling on one side of it does not, by itself, settle every transitional case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Record the three relevant dates

  1. Show-cause notice: note when the adjudicatory proceedings began, as indicated by the notice.
  2. Penalty order: record the date of the order and when it was communicated to you.
  3. Appeal: record when you intend to file. This date is also important for the ordinary appeal deadline.

In Gaurav Jain & Anr v Joint Commissioner (Appeals-II) CGST, the show-cause notice was issued on 25 June 2025 and the penalty order followed on 16 December 2025. In that case, the Delhi High Court held that the substituted proviso did not govern those petitioners’ appeals because the adjudicatory proceedings had begun before the amendment. The court left the constitutional challenge open and did not decide whether the penalties themselves were justified.

That decision addresses the facts before the Delhi High Court; it is not a nationwide resolution of every case involving a pre-amendment notice and a later order or appeal. The judgment discusses competing arguments over whether the relevant date is when proceedings began or when the appeal is filed. If your show-cause notice predates 1 October 2025 but the order or proposed appeal is later, do not assume that the 10% penalty-only deposit certainly governs—or that it certainly does not. Have the applicable statutory text and current law in the relevant jurisdiction checked before filing.

Apply the transition check to your own dates

Write the dates in sequence rather than considering only the date printed on the penalty order. For example, the case of Gaurav Jain & Anr involved a notice dated 25 June 2025, before the effective date described by the court, and a later order dated 16 December 2025. The court focused on the fact that the adjudicatory proceedings had begun before the amendment when deciding whether the substituted proviso governed those appeals.

That example does not create a universal rule for all notices, orders, or appeals around the effective date. The court left the constitutional challenge open and did not decide the merits of the penalty orders. A taxpayer with the same broad sequence of dates should therefore treat the ruling as relevant authority to review, not as an automatic answer that removes the need to consider jurisdiction and the individual record.

For a transition review, gather the notice, proof of its date or communication, the penalty order, proof of when the order was communicated, and the intended appeal date. Those documents help frame the question the judgment identifies: should the governing date be the start of adjudicatory proceedings, the later order, the appeal date, or another date under the applicable text? If the notice predates 1 October 2025 and the order or appeal follows it, obtain qualified advice before deciding whether to pay under the substituted proviso or relying on a different position.

Do not substitute the old disputed-tax formula

Before the penalty-only proviso, the general first-appeal rule described in the sources required payment of admitted tax, interest, fine, fee and penalty in full, plus 10% of the remaining disputed tax, subject to the statutory ceiling. That formula uses the disputed tax as its percentage base; the substituted penalty-only proviso uses the penalty demanded when there is no tax demand.

For example, if an order involves a disputed tax amount as well as a penalty, multiplying the penalty by 10% does not establish the required deposit under the penalty-only rule. Conversely, if the order is genuinely penalty-only, the older general formula based on disputed tax is not the calculation described by the substituted proviso.

The Delhi High Court’s description of the substituted proviso says it does not prescribe a ceiling for the 10% penalty-only percentage, unlike the capped disputed-tax amount under the former general rule. Because the current operative statutory text and any later amendment must control, verify them before relying on that distinction for a filing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Compare the two calculation paths

For a penalty-only order under the substituted proviso, use the penalty as the base: a ₹10,00,000 penalty gives a basic pre-deposit of ₹1,00,000. For an order involving a tax demand, the former general rule described in the authorities instead involved full payment of admitted tax, interest, fine, fee and penalty, plus the prescribed percentage of remaining disputed tax, subject to its ceiling. These are not interchangeable calculations.

Do not treat “penalty plus tax” as a penalty-only order merely because the penalty is the larger figure or the only part you intend to challenge. The relevant comparison is what the order demands, not which amount seems more significant. If the order has mixed components or it is unclear whether it involves a demand of tax, do not calculate the filing amount from the penalty alone until the classification and applicable statutory text have been checked.

Meet the appeal deadline

Section 107 provides an ordinary period of three months from communication of the decision or order to file an appeal. The Appellate Authority may allow a further period of one month if sufficient cause is shown. This possible extension is not automatic, so calculate the ordinary deadline from the communication date and plan to file within it.

  1. Find the date the decision or order was communicated to you; do not use only the date printed on the order if communication occurred later.
  2. Calculate the three-month ordinary appeal period from that communication date.
  3. If you cannot meet the ordinary period, document the reason and seek the permitted further period by showing sufficient cause. Do not treat the additional month as guaranteed.
  4. Complete the applicable pre-deposit and the appeal filing steps within the deadline that applies to your case.

The extension is a limited further period that the Appellate Authority may allow on sufficient cause; it is not an automatic extra month for every appellant. Keep a clear record of when the order was communicated and any circumstances relied on if asking for more time. Paying the pre-deposit does not itself extend the filing period, and a filing within time does not eliminate the need to complete the applicable payment.

Make sure the pre-deposit has actually been paid

A balance visible in the electronic cash ledger may not by itself satisfy the pre-deposit condition. The payment needs to be completed as the required pre-deposit; simply having funds in the ledger is not necessarily the same as debiting them for that purpose.

In Ssukrit Forwarding Agency, the Jharkhand High Court considered a situation where the amount was present in the ledger but had not been debited. In the circumstances of that case, the court said the taxpayer should have been notified of the defect and given reasonable time to cure it. Treat that as a procedural lesson, not permission to leave a required amount undebited.

  • Check that the amount matches the calculation applicable to your order and its transition circumstances.
  • Confirm that the payment has been debited or otherwise completed as the pre-deposit, rather than only appearing as an available ledger balance.
  • Keep the payment and filing records so you can establish what was paid and when.
  • If a filing defect is raised, respond promptly and follow the instructions of the Appellate Authority; do not rely on the possibility of later notice as a substitute for completing payment correctly.

Ledger balance and completed deposit are different checks

Before filing, check both the amount and the status of the payment. The amount can be arithmetically correct while still not having been completed in the required manner. A ledger balance is evidence that funds are available there; the Jharkhand High Court case illustrates why that fact alone may not show that the sum has been debited as a pre-deposit.

Keep records showing the amount, the transaction or debit that completes the payment, and the timing in relation to the appeal. If you discover that the money is still sitting as a balance rather than having been applied as the required pre-deposit, take steps to correct the issue rather than assuming that funds held in the ledger are enough. The decision in Ssukrit Forwarding Agency concerned its particular circumstances and does not guarantee that every defect will be excused or that every appellant will receive extra time to cure it.

A practical calculation checklist

  1. Read the order: determine whether it demands penalty only or also involves a demand of tax.
  2. Identify the relevant dates: note the show-cause notice date, order date, communication date and intended filing date.
  3. Choose the rule path: use 10% of the penalty only if the substituted penalty-only proviso applies to the order and its procedural history. Do not apply it automatically to mixed tax-and-penalty orders.
  4. Calculate the amount: multiply the penalty demanded by 0.10. For a ₹2,40,000 penalty, for example, the arithmetic is ₹2,40,000 × 0.10 = ₹24,000, provided the penalty-only rule applies.
  5. Verify the governing law: check the operative statutory text and current law for the relevant jurisdiction, particularly if the proceedings began before 1 October 2025.
  6. Pay and file: complete the payment as a pre-deposit, file within the applicable deadline, and retain evidence of both steps.

The 10% figure and the three-month period with a possible further month are statutory requirements described in the cited authorities, not empirical estimates. The transition issue and payment mechanics can affect an individual filing even when the arithmetic is straightforward.

What to gather before you calculate

  • The complete order being appealed, so the amounts and operative demand can be classified.
  • The show-cause notice and its date, because the beginning of proceedings can matter in a transition case.
  • Evidence of when the order was communicated, which starts the ordinary three-month appeal period under section 107.
  • A separate note of the penalty, tax, and any other amounts shown in the order, rather than a single combined figure.
  • Payment records showing that the deposit was completed, not just that funds were available in an electronic cash ledger.

This file helps avoid two common errors: using 10% of the penalty when the order also involves a tax demand, and using the right formula but not completing the payment as the required pre-deposit. Where the notice predates 1 October 2025, it also gives a qualified adviser the chronology needed to assess the transition issue in light of Gaurav Jain & Anr and current law.

No separate empirical statistic is needed to calculate the amount: the 10% rate, the effective date described by the Delhi High Court, and the section 107 appeal period are legal figures, not estimates about typical taxpayer outcomes. The practical uncertainty lies in identifying which statutory path applies to a particular order and transition timeline.

Frequently Asked Questions

How much is the GST pre-deposit for a penalty-only order?

If the substituted penalty-only proviso to section 107(6) applies, the first-appeal pre-deposit is 10% of the penalty demanded. For example, a ₹50,000 penalty produces a ₹5,000 deposit. The penalty-only formula does not apply automatically if the order also involves a tax demand.

Is the 10% calculated on the penalty or the disputed tax?

For an order demanding penalty without involving a tax demand, the base is the penalty. The former general rule described for orders involving disputed tax used the remaining disputed tax as the percentage base, after admitted tax, interest, fine, fee and penalty were paid in full, and was subject to a statutory ceiling.

When did the penalty-only 10% rule take effect?

The Delhi High Court describes the substituted proviso as effective from 1 October 2025. Transitional cases can be fact-sensitive. In Gaurav Jain & Anr v Joint Commissioner (Appeals-II) CGST, a notice issued on 25 June 2025 was followed by a penalty order on 16 December 2025; the court held the substituted proviso did not govern those petitioners’ appeals because proceedings had begun before the amendment. It left the constitutional challenge open.

What is the deadline to file a first GST appeal?

Section 107 provides three months from communication of the decision or order. The Appellate Authority may allow a further month where sufficient cause is shown, but that extension is not automatic. Calculate from the communication date and file within the applicable period.

Does money in the electronic cash ledger count as the pre-deposit?

Not necessarily. The required amount must be completed as the pre-deposit; an amount that remains as an undebited ledger balance may not complete payment. In Ssukrit Forwarding Agency, the Jharkhand High Court said that, in the circumstances there, the taxpayer should have been notified of the defect and given reasonable time to cure it. Do not treat that case as permission to leave the deposit undebited.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does paying the pre-deposit mean the whole penalty has been paid?

No. The deposit is a statutory condition for filing the appeal, not payment of the entire penalty. Once the applicable section 107(6) deposit is paid, section 107(7) provides that recovery of the balance is deemed stayed.

The Bottom Line

For an appeal against an order demanding penalty without involving a tax demand, the substituted section 107(6) proviso calls for a pre-deposit of 10% of the penalty, as described by the Delhi High Court as effective from 1 October 2025. Confirm that the order is genuinely penalty-only, check the notice, order and appeal dates for transition issues, calculate from the penalty demanded, complete the payment as a debit, and file within three months of communication unless a further month is allowed for sufficient cause.
