You can make a game inspired by another game, but the safe way to release it is to create your own expression: code, art, music, writing, names, logos, interface, and marketing materials. Use third-party material only when a license or written permission clearly covers game distribution and your intended platforms. A free download is not automatically protected by fair use, so keep a rights record for every asset and remove anything you cannot document.
What “without copyrighted game assets” actually means
Copyright generally protects creative expression, not the broad idea of a game. You may be able to build around a familiar high-level concept, such as arranging falling blocks, exploring a maze, managing a farm, or commanding a party of characters. The risk rises when you copy the original game’s particular expression: its sprites, models, textures, animation frames, music, sound effects, dialogue, maps, written lore, distinctive interface art, extracted code, or recorded voices.
The U.S. Patent and Trademark Office identifies video games, software, music, artwork, movies, and sound recordings as examples of copyrightable creative works. A fan project that reproduces those elements can implicate the owner’s exclusive rights, including the right to authorize a derivative work. Copyright is separate from trademark: an original publisher’s title, logo, character name, or marketing presentation can create additional brand-confusion issues even when a particular graphic is not copied.

Choose a rights strategy before writing game code
Decide what you are making and where it will go before selecting assets. A private prototype has a different exposure from a public download, and a monetized release creates more commercial risk. The table below gives a practical choice of approach.
| Approach | Rights certainty | Brand distance | Suitable scope | Main obligation |
|---|---|---|---|---|
| Original or commissioned assets | Highest when creation and ownership are documented | Can be fully distinct | Private prototype through commercial distribution | Keep contracts, invoices, source files, and contributor assignments or licenses |
| Third-party assets with an explicit license | Depends on the exact license text | Usually distinct unless the asset itself imitates a protected character or logo | Any scope the license permits | Confirm modification, game distribution, commercial use, sublicensing where needed, attribution, and target-platform rights |
| Unlicensed borrowing from the original game | Uncertain and usually weak | Often close to the original identity | Not a dependable release strategy | Replace the material or obtain written permission before public distribution |
“Free” describes the price to the player, not the legal status of the files. A no-cost fan game can still copy protected expression, compete with an official product, or trigger a takedown.
Step 1: Define inspiration at the idea level
Write a short design brief that captures the experience you want without naming copied files. Describe the genre, pacing, camera perspective, control goals, resource loop, difficulty curve, and emotional tone. Then turn those goals into new implementation decisions.
Keep ideas and mechanics, replace expression
- Describe a mechanic as a rule, such as “match three adjacent symbols to clear them,” rather than reproducing the reference game’s exact tiles, effects, text, and level layouts.
- Create new character motivations, dialogue, silhouettes, costumes, names, and relationships.
- Draw maps from your own blockouts instead of tracing the original game’s rooms, routes, landmarks, or map art.
- Write a new user interface hierarchy, icon set, typography treatment, menu wording, and tutorial sequence.
- Implement the systems yourself. Do not extract, decompile, copy, or adapt proprietary source code, scripts, shaders, or data files.
A similar rule set does not give permission to copy a particular implementation or presentation. Your records should show how you moved from an inspiration brief to independent assets and code.

Step 2: Create a distinct identity and brand
Choose a title, logo, character names, fonts, color language, and store description that do not suggest official sponsorship. Avoid the original publisher’s logo, title treatment, taglines, screenshots, character portraits, and promotional phrases. A disclaimer cannot turn copied art or music into authorized material, and it does not cure a misleadingly similar identity.
Use a naming and marketing check
- List every name used in the executable, menus, save files, package metadata, storefront listing, social accounts, and trailer.
- Search your repository for the original title, abbreviations, character names, fictional places, faction names, and logo filenames.
- Replace references that are unnecessary to explain the inspiration. If you mention an influence in a description, make it clear that the project is unofficial and avoid wording that implies approval.
- Review screenshots and video captures for recognizable logos, copied UI layouts, or background art before publishing.
Because trademark and unfair-competition rules vary by country, ask a qualified lawyer to review a public or monetized release whose name or presentation is intentionally close to an existing brand.
Step 3: Make or license every replacement asset
For each visual, audio, written, and technical component, choose one of three documented sources: your own work, a commissioned work with an appropriate written agreement, or a third-party asset whose license expressly covers your use.

Keep editable source files, dated exports, contracts, invoices, and messages that establish who created the work and what rights you received. If several people contribute art, music, writing, or code, record each contributor and the permission or assignment that lets you distribute the finished game. A verbal understanding or a credit line alone may not give you the rights you need.

Third-party licenses
Save the license text as it existed when you downloaded the asset, together with the source page, download date, creator, and file hash or filename. Read the license instead of relying on labels such as “free,” “royalty-free,” or “open.” Confirm all of the following before import:
- Game distribution is an allowed use, including downloads, bundled builds, patches, and demonstrations.
- Modification, resizing, recoloring, remixing, and format conversion are permitted when your pipeline requires them.
- Commercial use is allowed if you might sell the game, accept donations, run advertisements, or use a paid platform.
- Redistribution and sublicensing are covered when the asset is packaged inside your game or delivered through a platform.
- Attribution, notices, source-code disclosure, share-alike, or other conditions can be met in your menus, documentation, and distribution package.
- The license covers every target platform and territory you plan to use.
If the license is silent on a use that matters to you, treat that use as unconfirmed. Contact the rights holder for written clarification or select another asset.
Step 4: Keep a rights ledger
A ledger turns an informal hobby project into an auditable release. Give every imported file an entry, including temporary placeholders that may survive into a build.
| Ledger field | What to record |
|---|---|
| Asset identifier | Stable filename, internal ID, version, and where it appears in the game |
| Type and creator | Sprite, model, texture, font, song, sound effect, voice, text, code, or other type; creator or rights holder |
| Source and date | Download page, commission record, repository location, and acquisition date |
| License or permission | Exact license text or written permission, stored as a local copy or attachment |
| Allowed uses | Modification, game distribution, commercial use, sublicensing, attribution, and platform or territory limits |
| Proof | Invoice, contract, permission email, archive, or other evidence connecting the right to this exact asset |
| Attribution action | Required credit wording and the file or screen where you will provide it |
| Status | Approved, needs clarification, replaced, or rejected; include the reviewer and date |
Keep the ledger under version control with the project. When an asset changes, create a new entry or revision rather than overwriting the old evidence. This makes it possible to identify which build contained a disputed file.

Step 5: Build a clean technical pipeline
Separate original project files from reference material so a copied file cannot accidentally enter a release build.
Recommended project layout
game/for source code, scenes, scripts, and configuration you wrote.assets/original/for art, audio, writing, and fonts created by your team.assets/licensed/for approved third-party files, each in a folder named with its ledger ID.docs/rights/for licenses, contracts, permissions, attribution text, and the ledger.reference-private/for inspiration screenshots or notes that are excluded from builds and public repositories.
Use build rules that include only approved asset directories. Add a continuous-integration check or pre-release script that fails when a file comes from the private reference folder, when a ledger ID is missing, or when a rejected filename appears in the package.
Replace copied material deliberately
- Inventory every image, animation, model, texture, font, audio clip, dialogue line, map, shader, script, and data table already in the project.
- Mark each item as original, commissioned, licensed, unknown, or copied from the reference game.
- Quarantine unknown and copied items so they cannot be included by an automatic build.
- Commission or create replacements that serve the same gameplay function without tracing the original expression.
- Rebuild atlases, audio banks, localization files, and package metadata after replacements; old files can remain embedded in caches or archives.
- Open the final installer or archive as a separate user would and inspect its contents, not only the editor project.
Step 6: Audit the repository and release build
Perform the audit twice: once before a public test and again on the exact build you distribute. Search filenames, source text, binary metadata, and generated archives for the original title, character names, logos, extracted asset labels, and proprietary file extensions. Review unused assets too; a file that is not visible in a normal playthrough may still be shipped.
Visual and audio review
- Play every level and inspect loading screens, pause menus, credits, achievements, controller prompts, and error messages.
- Listen for music or effects that were copied, sampled, or left in an old audio bank.
- Check animation, particles, fonts, and color-coded icons for unintentional remnants of the original presentation.
- Inspect screenshots, trailers, thumbnails, press kits, and social posts as part of the same release package.
Documentation review
- Every shipped asset has a ledger entry and evidence.
- Every required attribution appears in the agreed location.
- Licenses are compatible with the build’s distribution model and platforms.
- Contributors have granted the rights needed for the game and its marketing materials.
- Unknown, disputed, or unverified files are absent from the build.
How fair use fits—and why it is not a safety rule
In the United States, Section 107 describes fair use as a case-specific limitation. Its four factors are the purpose and character of the use, including commercial or nonprofit purpose; the nature of the copyrighted work; the amount and substantiality of what was taken; and the effect on the potential market for the original.
Best Value
- 【No Drill Mounted】Cable management tray can be assembled in as little as 3 minutes or less-simply. Side clips easily clampe the edge of desk, pass through the holes on the sides, and secure excess cables with baskets. Desk cable management supports inward or outward installation to meet your needs in different scenarios, and provides you with great convenience when collecting and organizing wires.
- 【Rubber Pad Protects Desk】Wire organizer under desk built-in soft rubber pads on the clamp protect your desk from scratches, so you will not damage your furniture or office.
- 【Sturdy and Beautiful】Cord management under desk is made of high-quality carbon steel and holds about 15 lbs. The wire basket has 2 holes on each side of the tray to enable your cables to pass freely. Cable baskets are suitable for desk thickness use from 0.4" to 2.4".
- 【Space Saving & Keep Organized】Desk cable management tray holds all your power cords, outlet strips, USB hubs and computer transformers hidden from your feet, and the data cables will not enter the vacuum cleaner to keep your desk clean and tidy. Desk wire organizer is also suitable for use in the kitchen and outdoors.
- 【Reduce Safety Risks】Cable tray under desk keeps all plugs away from your kids, no more worry about tripping. Using 2 holes wire tray saves extra space, helps you easily cabling and wire protection. The mesh design is not easy to accumulate dust, but avoids safety accidents caused by messy wires.
The U.S. Copyright Office states that there is no formula, percentage, word count, or other safe harbor that guarantees fair use. Copying a small file can still be significant if it is the most distinctive part of a work, while a larger use might be defensible in a different context. The analysis depends on the facts and on the jurisdiction.
Applying the four factors to a fan game
- Purpose and character: A nonprofit or free release may help this factor, but it does not decide the case. Donations, advertising, paid access, sponsorship, or a commercial studio can make the purpose look more commercial.
- Nature of the work: Games combine software, music, art, writing, and other highly creative material. Creative works generally receive stronger protection than factual material.
- Amount and substantiality: Consider both quantity and qualitative importance. A recognizable character, signature song, logo, or central level can matter even if the file is short.
- Market effect: A project that substitutes for an official release, uses the same audience, or interferes with licensing opportunities can face a harder analysis.
Only a court can resolve a particular fair-use dispute. The Copyright Office does not provide individual legal advice. For a public, widely promoted, or monetized release, have an attorney familiar with the countries where you distribute evaluate the actual build and marketing. If you are uncertain, permission is the cleaner route.
Permission and derivative-work rights
The Copyright Office explains that only the copyright owner can authorize creation of a new version of a work. Do not assume that a community tradition, a fan-game forum, or another project’s survival proves permission. Contact the rights holder through a verifiable channel and request written terms that identify the specific assets, allowed platforms, territories, duration, attribution, modification rights, and commercial status.

If the person responding cannot show that they control the relevant rights, the permission may not cover the work. Plan for different release scopes
| Release stage | What to do | Why it matters |
|---|---|---|
| Private prototype | Use isolated reference notes, but keep copied material out of shared repositories and any build that leaves your control. | Friends, contractors, cloud services, and automated backups can turn a private experiment into a broader distribution. |
| Closed playtest | Distribute only a clean build; provide testers with a confidentiality and feedback process; maintain the ledger. | Testers may stream, record, mirror, or upload files, so the package should already be releasable from an asset-rights perspective. |
| Public free release | Complete the audit, attribution, brand review, takedown contact, and jurisdiction check before publishing. | Public visibility increases the chance of complaints and makes removal more disruptive. |
| Monetized release | Obtain legal advice, verify commercial permissions, review storefront and advertising terms, and document contributor rights. | Revenue, promotion, and market substitution can increase both legal exposure and the practical cost of a dispute. |
Prepare a takedown and replacement plan
A rights-conscious project assumes that a platform or rights holder may question an asset even when you believe your use is permitted. Publish a contact address that you monitor, keep versioned builds and release dates, and know how to disable a download without deleting your evidence.
- Record the complaint, the identified file or scene, the claimant, and the affected build.
- Pause new distribution of the disputed build while you review the ledger and permission evidence.
- Remove or disable the disputed asset if you cannot promptly establish the right to use it.
- Produce a replacement, rebuild all packages, and check that caches, patches, trailers, and screenshots no longer contain the file.
- Respond accurately and keep copies of communications; do not make legal admissions or threats without counsel.
- Document which versions were withdrawn and which clean version replaced them.
Do not destroy the original records after a replacement. Your evidence should show what changed, why it changed, and which rights applied to each release.
Geography and legal advice
This article’s fair-use discussion describes U.S. law. Other countries may use different exceptions, tests, notice systems, and remedies; some recognize fair dealing or narrower specific exceptions rather than the U.S. fair-use framework. Distribution through a global storefront can expose one build to several legal systems. Identify the countries where you will host, sell, or promote the game and obtain local advice when the project is public, monetized, or deliberately close to an existing brand.
