Short answer: owning a cartridge does not automatically make downloading or creating a ROM lawful. The answer depends on your jurisdiction, the source of the file, the game and device involved, and whether you bypass technological protection. A careful workflow is to verify the local rule first, dump only from a source you are legally allowed to copy, keep the original dump separate from device-ready files, maintain an independent backup, and never distribute copyrighted game files.

Start with the legal question, not the file-management question

“I own the cartridge” and “I may download a ROM” are not equivalent legal statements. Copyright exceptions differ by country and can impose conditions about the source copy, the purpose of the copy, technological protection measures, sharing, and what happens when you no longer own or license the original.

Three activities that are often treated as one are legally and practically different:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Dumping: reading data from your physical cartridge with compatible hardware and creating a digital file.
  • Downloading: obtaining a ROM made by somebody else, usually from a third-party site. Your ownership of a cartridge does not automatically authorize that download.
  • Transferring: copying a file you already lawfully possess to a handheld or memory card. Transfer is not a cure for an unlawful source, and a lawful source does not automatically make circumvention lawful.

The safest practical principle is source control: know exactly where the file came from, preserve evidence of that provenance, and do not treat a cartridge dumper as a legal loophole.

What the cited laws actually establish

United States: a narrow rule, not a cartridge-dumping license

U.S. video-game provisions in 37 CFR 201.40 address defined situations, including certain complete games whose server support has been discontinued and preservation by eligible libraries, archives, or museums. The rule does not establish a blanket personal permission to dump every cartridge you own for play on a different device.

That distinction matters because a personal retro-handheld setup usually involves a consumer, a cartridge, and a current game—not an eligible preservation institution or a qualifying server-dependent title. If your proposed copy involves bypassing a technological protection measure, check the current rule and any other applicable federal or state law before proceeding.

Canada: section 29.24 is conditional

Canada’s Copyright Act section 29.24 provides an example of how specific a backup exception can be. It applies to a person who owns or is licensed to use a source copy, when the source is not infringing, and when the reproduction is made solely as a backup in case the source is lost, damaged, or unusable. The provision also includes conditions against circumventing a technological protection measure, giving reproductions away, and retaining them after the person stops owning or being licensed to use the source.

The statute describes the purpose as “the person does so solely for backup purposes in case the source copy is lost, damaged or otherwise rendered unusable.” That is a Canadian example, not a worldwide rule. A file made for convenience, format conversion, or use on a different platform may not fit the same exception in every situation.

Publisher positions are not a complete statement of local law

Nintendo’s North American support material states the company’s opposition to unauthorized copies, downloading, sharing, and circumvention devices. Nintendo Australia similarly states that, in its view, downloading a Nintendo ROM is illegal even when the person owns an authentic game, and that Australian format-shifting and software-backup rights do not authorize copying Nintendo games into another format.

Those are Nintendo’s positions. They should be taken seriously, but they are not a substitute for the law where you live. Because exceptions and court interpretations change, consult current official legislation or a qualified lawyer if the legality of a particular dump, download, or circumvention step matters to you.

Decide which file you are actually allowed to use

Personal dump from your own cartridge

A personal dump has the clearest provenance: you identify the physical source, read it with hardware that supports that cartridge family, and retain the resulting file for your own use. Even then, local law may restrict reproduction or require that the copy remain strictly for backup. A dumper only performs a technical function; it does not grant permission to copy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

File downloaded from a third party

Do not assume a third-party download becomes lawful because you own the matching cartridge. The uploader may not have permission to reproduce or distribute the game, and your jurisdiction may not provide a personal exception for downloading or using that file. This guide does not direct you to ROM-download sites.

Transfer to a handheld

Once you have a file you are legally entitled to use, moving it to a compatible memory card is an ordinary file-management operation. It does not change the file’s legal origin. Keep the transfer private, avoid cloud links or public folders that expose copyrighted files, and do not send copies to friends or strangers.

Check your cartridge family before buying hardware

Cartridge formats are not interchangeable. A reader that handles one family may not read another, and adapters, firmware, save-memory support, or operating-system software may be required. The Provenance-Emu guide lists these category examples:

A jurisdiction-first dumping workflow

  1. Identify your jurisdiction. Record the country, and where relevant the state, province, or territory whose law applies to your conduct. Do not import a U.S. or Canadian exception into another country.
  2. Identify the source. Write down whether the file will come from your own cartridge, a licensed source, or a third-party download. If the source is an unauthorized download, stop rather than trying to justify it with cartridge ownership.
  3. Read the current rule for your case. Look specifically for reproduction, backup, format-shifting, circumvention, and private-copy provisions. Check whether the exception requires a lawful source, backup-only purpose, no sharing, or destruction after loss of ownership or licence.
  4. Identify the cartridge family. Note the system, region, cartridge model, board or revision markings, and whether it contains battery-backed or flash save memory.
  5. Choose hardware with explicit support. Use a dumper that lists your cartridge family and required accessories. Do not infer compatibility from a similar-looking slot.
  6. Install current software from the hardware maker. Confirm firmware, drivers, and operating-system requirements from the current official documentation. Keep installers and version numbers with your project notes if reproducibility matters.
  7. Read the cartridge and save data separately when supported. Follow the dumper’s documented read procedure. If the tool offers separate ROM and save operations, save each output with a clear type label rather than overwriting one with the other.
  8. Verify the dump. Repeat the read if the software provides hashes, verification, or a second-pass comparison. Record the file size, hash, cartridge identity, date, and tool version in a text file.
  9. Store the untouched source dump. Make the first verified image read-only or place it in an “Original dumps” directory. Do not rename it in a way that loses the original identifying information.
  10. Make a working copy for the handheld. Rename, trim, convert, or configure only a duplicate. Keep the source image unchanged so you can return to it if a conversion fails.
  11. Transfer privately. Copy the working file to a memory card formatted and sized according to the handheld’s current documentation. Eject the card safely before removing it.
  12. Document ownership changes. If you sell, give away, or otherwise stop owning or being licensed to use the source, review your local rule immediately. Some exceptions, including Canada’s example, require destruction of backup reproductions at that point.

Organize files so the original dump is never confused with a device copy

Use a predictable folder structure

A simple structure separates preservation from day-to-day use:

Retro-library/
  GB/
    Original-dumps/
    Device-ready/
    Saves/
    Metadata/
  GBC/
    Original-dumps/
    Device-ready/
    Saves/
    Metadata/
  GBA/
    Original-dumps/
    Device-ready/
    Saves/
    Metadata/
  SNES/
    Original-dumps/
    Device-ready/
    Saves/
    Metadata/

Use system folders that match the handheld’s expected layout only in the Device-ready area. Keep the archival tree organized by system and title, not by whichever memory card is currently plugged in.

Choose filenames that preserve identity

A useful filename records the title, region, revision when known, and file role:

  • Game_Title (USA) [Rev A] [OriginalDump].gb
  • Game_Title (USA) [Rev A] [DeviceReady].gb
  • Game_Title (USA) [Rev A] [Save].sav

Keep punctuation consistent, avoid characters your handheld cannot display, and do not replace a verified source filename with a generic name such as game1.gb. If you change a filename, record the old name in metadata.

  • Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft

Record metadata outside the ROM filename

For each title, keep a small text or spreadsheet record containing:

  • Physical cartridge identity, region, and any visible revision marking.
  • Date of the read and the dumper model.
  • Dumper firmware and host-software versions.
  • ROM and save-file sizes.
  • Cryptographic hash, if your operating system provides a hashing tool.
  • Whether the file is an untouched dump, a converted copy, or a handheld-specific copy.
  • Notes about failed reads, retries, adapters, or unusual save behavior.

This record helps you distinguish a bad transfer from a bad source read and makes it possible to reproduce your own workflow without altering the archival file.

Back up the library independently

A handheld’s microSD card is a working medium, not an archival plan. Cards can be lost, corrupted, or reformatted. Keep at least one additional copy on a separate storage device, and do not make the backup dependent on the handheld remaining available.

  • Keep the original dumps and metadata together on primary storage.
  • Copy them to an independent backup on a different device.
  • Periodically open the backup and compare hashes or file sizes with the primary copy.
  • Protect the backup from accidental synchronization into a public or shared folder.
  • Back up save files separately if you care about progress; a save can change even when the ROM does not.

Use encryption and access controls appropriate to your situation, especially if the backup is portable or stored with other people. Privacy and reliability measures do not create a copyright exception, so keep the files private regardless of where they are stored.

  • Required folder names and whether the device creates them automatically.

A compatible microSD card is a reasonable accessory when the handheld supports it, and a card reader can simplify transfers. Neither is universal: the device specification controls compatibility. Format the card using the handheld’s documented method, then copy only the device-ready working files. Keep your archival folders on primary storage rather than placing the only copy on the card.

Common failure modes and recovery

The dumper does not detect the cartridge

  • Confirm that the dumper supports the exact system and cartridge family.
  • Check that the required adapter is installed and fully seated.
  • Update firmware or host software only from the hardware maker’s current documentation.
  • Clean the cartridge contacts using the manufacturer’s recommended method; do not force a connector.
  • Try a known-good cable or USB port if the device is not detected at all.

Do not interpret detection failure as evidence that a different dumper will make an unsupported cartridge safe or lawful. Recheck compatibility before buying another device.

The dump has an unexpected size or fails verification

Stop copying the file to the handheld. Reseat the cartridge, repeat the read, and compare verification data from multiple attempts. Record each result. If repeated reads disagree, preserve all diagnostic notes and seek cartridge-specific support rather than silently choosing one file.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The game appears in the menu but will not boot

  • Confirm that the file is for the handheld’s supported system and format.
  • Check whether the device requires a particular folder or filename convention.
  • Replace the device-ready copy with a fresh duplicate from the untouched original dump.
  • Verify that the memory card uses the filesystem and capacity the manufacturer specifies.
  • Test the card in another reader or re-copy the file after safely ejecting it.

Save data is missing or resets

ROM data and save data are separate concerns. If the dumper supports save reading, create a dedicated save file and label it with the same title, region, and revision as the ROM. Confirm that the handheld uses the expected save format, and keep an untouched backup before experimenting with conversion or emulator-specific formats.

Sharing, resale, and disposal decisions

Do not upload ROMs, attach them to forum posts, place them in public cloud folders, or send them to friends. A private backup workflow is different from distribution. If you sell or give away the cartridge, revisit the law in your jurisdiction before retaining any reproduction. Canada’s section 29.24 example expressly addresses destruction after a person stops owning or being licensed to use the source; other countries may use different rules.

If a handheld is sold, remove the card and inspect synchronized folders, automatic backups, and recycle bins. Deleting a shortcut is not the same as removing the copyrighted file from every copy you control.

A practical decision checklist

  • Have you identified the governing country and any relevant state, province, or territory?
  • Is the source your own non-infringing cartridge or another source you are legally entitled to use?
  • Does your local rule permit this kind of reproduction, and does it restrict circumvention?
  • Are you creating a backup, or are you downloading someone else’s distributed file?
  • Does the dumper explicitly support the cartridge family and required adapter?
  • Have you kept the untouched dump separate from renamed or converted copies?
  • Have you recorded cartridge identity, tool versions, date, size, and verification data?
  • Is there an independent backup outside the handheld’s memory card?
  • Does the handheld’s current documentation confirm the card format, capacity, and folder layout?
  • Are all copies private, with no sharing or public synchronization?
  • What will you do with the files if you no longer own or license the source?

Bottom line

Back up only from a source you are legally allowed to copy or use, and check the current law where you live before dumping or bypassing any protection. Ownership of a cartridge is not a universal ROM-download permission. Once your legal basis is clear, use supported cartridge-reading hardware, preserve an untouched original dump, create separate device-ready copies, document the files, maintain an independent backup, and keep every copyrighted copy private.
