An AI pentesting tool is authorized only when the person operating it can prove permission for the specific targets, actions, dates, and conditions of the engagement. A tool’s capabilities, a vendor’s assurances, or a cloud provider’s general policy do not grant that permission. Obtain explicit written approval from the resource owner or an authorized representative, define the boundaries in rules of engagement, verify the provider’s current requirements, and confirm that the agent can enforce those limits before it runs.

What authorization actually covers

Authorization is not a general license to attack anything associated with an organization. It is a bounded agreement covering four elements: who has authority, what may be tested, when testing may occur, and which techniques are permitted. Every one of those elements must match the way the AI system will operate.

Authorization dimension What must be identified Typical failure
Authority The owning organization, the individual approving the work, that person’s role, and the contract or delegation that gives them control of each target An employee approves testing of a supplier-owned service without the supplier’s consent
Targets Exact domains, IP addresses, cloud accounts, tenants, applications, APIs, repositories, identities, and environments A wildcard domain or brand name is treated as permission for every related asset
Time Start and end timestamps, timezone, maintenance windows, blackout periods, and credential expiration An agent continues after the approved window because a scan or exploit is still running
Actions Allowed and prohibited methods, data access, exploitation depth, persistence, lateral movement, social engineering, denial-of-service, and destructive activity Read-only discovery approval is interpreted as permission to exploit a vulnerability
Conditions Rate limits, notification requirements, escalation contacts, stop conditions, data handling, and evidence retention The operator has no defined response when the agent reaches sensitive production data

Microsoft’s Azure guidance states that third parties such as managed security providers, consulting firms, and red teams may test only when they have explicit written authorization from the resource owner. Microsoft also says it does not authorize a test on a customer’s behalf. Read the current Microsoft penetration-testing guidance for the service and region involved.

Prove the authority chain before configuring the agent

Identify the owner for every asset

Start with the legal or operational owner of each target, not the person who supplied a hostname. For an internal system, record the business unit and the technical owner. For a subsidiary, contractor, managed service, or customer environment, retain the agreement or delegation that grants testing rights. If an asset is shared, identify the other parties whose services could be affected and obtain their approval where required.

Verify the approver’s role

Keep a signed letter, statement of work, ticket approval, or equivalent written record that names the approver, their role, the organization, and the authority they are exercising. The document should identify the operator and any subcontractors. If the approver’s authority is unclear, stop and obtain confirmation from a responsible owner or legal reviewer rather than relying on an email that merely says to test a brand or environment.

Separate owner permission from provider permission

Hosting a system in a public cloud does not transfer ownership of the customer’s testing decision to the provider. The resource owner’s authorization and the provider’s acceptable-use or penetration-testing policy are separate requirements. A provider may require advance notice, restrict techniques, or prohibit testing of shared infrastructure. Policies can change, so check the current terms immediately before the engagement and record the policy version or retrieval date.

Write a rules-of-engagement document that an agent can enforce

A rules-of-engagement (ROE) document turns a broad approval into machine-checkable boundaries. The OWASP Autonomous Penetration Testing Standard (APTS) ROE template includes authorization, target lists, temporal boundaries, allowed and prohibited actions, and approval and escalation references. Use it as a field checklist, not as a claim that one form is universally legally sufficient.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Required ROE fields

  • Authority: the owning organization, approving individual, title, contact details, and evidence of delegated authority.
  • In-scope targets: fully qualified domains, fixed IP ranges, cloud account and tenant identifiers, applications, APIs, environments, and test identities. Record whether each item is production, staging, or development.
  • Exclusions: systems, subsidiaries, third-party services, shared networks, data stores, and personnel that must never be touched. Do not assume that a related hostname is included.
  • Permitted techniques: passive discovery, authenticated read-only checks, vulnerability validation, exploitation limits, and any approved data-access method.
  • Prohibited techniques: denial-of-service, destructive changes, persistence, lateral movement, credential attacks, social engineering, malware deployment, or access to real customer data unless each is explicitly approved.
  • Time boundaries: start and end time with timezone, recurring windows, blackout periods, and a rule that unfinished actions stop at the deadline.
  • Operational limits: request rates, concurrency, payload restrictions, source addresses, credential scope, and maximum storage or transfer of discovered data.
  • Notification and escalation: 24-hour contacts where available, incident channels, expected response times, and the person who can order an immediate pause.
  • Stop conditions: out-of-scope discovery, unexpected service degradation, sensitive-data exposure, loss of scope validation, credential misuse, or any indication that a third party is being affected.
  • Evidence and disposal: decision logs, timestamps, command or request records, captured evidence, retention period, encryption, and secure deletion instructions.

Make the boundaries unambiguous

Write targets as exact identifiers rather than informal descriptions. State whether redirects, DNS changes, discovered subdomains, linked cloud accounts, or APIs returned by the application are included. A rule such as “test the company website” is too vague for an autonomous system; list the hostnames and the permitted paths or functions. If a target can change during the engagement, require a human approval before the new identifier is added.

Assess whether the AI can enforce the scope

Autonomous systems can select targets, methods, and exploitation steps without a human approving every action. OWASP APTS describes this problem as continuous scope enforcement: This domain defines how an autonomous penetration testing platform ingests, validates, and continuously enforces the boundaries of an engagement: which targets may be touched, at what times, under what conditions, and with what techniques. Review the evolving APTS introduction and its scope-enforcement guidance before relying on any conformance claim.

Scope ingestion and validation

Ask how the tool imports the ROE and how it represents domains, IP ranges, cloud tenants, accounts, identities, and exclusions. Determine whether the system rejects malformed or ambiguous entries, distinguishes production from nonproduction, and requires an approval when a target is added or changed. A screenshot of a scope field is not evidence of enforcement; request documentation, logs, and a controlled demonstration.

Pre-action checks

Every network request, credential use, exploit, file change, or data-access operation should be checked against the current scope before execution. Verify that checks occur after redirects and DNS resolution, not just against the original URL. Ask whether an agent can explain which rule authorized a proposed action and whether it blocks actions when the policy service is unavailable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Drift and discovered-asset handling

Agents often discover links, subdomains, cloud resources, credentials, or internal addresses that were not in the original list. The safe default is to classify them as out of scope until a named approver adds them in writing. Test whether the system halts, asks for approval, or silently follows the discovery. Confirm that an IP changing behind an approved hostname does not expand the engagement to unrelated shared infrastructure.

High-impact action controls

Require separate approvals or hard blocks for denial-of-service, destructive requests, persistence, lateral movement, social engineering, password spraying, mass data retrieval, and changes to production. Check whether rate limits and concurrency are enforced by the execution layer rather than merely displayed in the user interface. A natural-language instruction such as “be careful” is not a control.

Credentials, tenants, and cloud boundaries

Find out how credentials are issued, scoped, rotated, revoked, and prevented from crossing tenants. The agent should use dedicated identities with the minimum permissions needed for the approved method. Test what happens when a token grants access to both an in-scope and an excluded account. Confirm that logs identify the credential or role used without exposing secrets.

Human approval, pause, and recovery

Identify the control that pauses queued and active actions, who can trigger it, and how quickly it takes effect. Determine whether a stopped run can resume only after revalidation of the ROE, or whether queued actions continue from a separate worker. Ask how to revoke credentials, isolate the runner, and preserve evidence after an incident.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Decision logging

Obtain an exportable, tamper-evident record showing the agent’s inputs, proposed actions, scope decision, approver, timestamp, target, result, and any policy exception. Logs should let an independent reviewer reconstruct why each high-impact action occurred. If the product cannot show a complete decision trail, limit it to lower-risk, read-only checks or do not use it in production.

Use this preflight procedure

  1. Assemble the authority record. Name the owner, approving person, operator, subcontractors, and the document that grants testing rights for each target.
  2. Freeze the target list. Record exact domains, IP ranges, accounts, tenants, applications, APIs, environments, and exclusions. Resolve wildcard, redirect, shared-service, and third-party questions in writing.
  3. Define the action matrix. Mark each technique as allowed, prohibited, or requiring a separate approval. Include data-access limits, rate limits, credentials, and destructive-action rules.
  4. Set time and contact controls. Enter start and end times with timezone, blackout periods, notification recipients, escalation paths, and automatic stop behavior at the deadline.
  5. Check provider policies. Review the current rules for the cloud, hosting, DNS, API, identity, and other service providers involved. Record any notice or approval they require.
  6. Map the ROE into the tool. Configure machine-readable scope, exclusions, identities, rate limits, and approval gates. Do not rely on a prompt alone when the system provides policy controls.
  7. Run a controlled validation. In a lab or nonproduction environment, include an allowed asset, an excluded asset, a redirect, an expired window, and a high-impact request. Confirm that the tool blocks or escalates each prohibited case and records the decision.
  8. Obtain final sign-off. Have the owner and operator confirm the exact configuration, policy version, credentials, and test window. Store the signed approval where the operator can access it during the run.
  9. Start with observation. Monitor the first actions, verify source addresses and targets, and compare the live log with the approved scope before permitting deeper testing.
  10. Close and reconcile. Stop the agent at the scheduled end, revoke temporary credentials, export logs, account for collected data, and document any deviation or newly discovered asset.

Operate the test with explicit stop and escalation rules

Authorization is not a one-time launch decision. Assign a person who can order an immediate pause and define the communication channel and expected response time. Stop the run when any of these events occurs:

  • The agent reaches an identifier not on the approved target list or cannot determine whether it is in scope.
  • A redirect, DNS change, cloud role, or shared service makes ownership uncertain.
  • The tool accesses personal, regulated, customer, or otherwise sensitive data outside the approved handling rules.
  • Availability, latency, integrity, or safety is affected beyond the agreed threshold.
  • A credential, tenant, or source address is used outside its approved purpose.
  • The scope service, policy engine, logging pipeline, or human-approval channel fails.
  • The end time arrives, even if a queued action has not completed.

After a stop, preserve the relevant logs, revoke or rotate credentials if necessary, notify the escalation contacts, and obtain updated written authorization before resuming. Do not treat a verbal instruction during an incident as a permanent expansion of scope; record it and replace it with formal approval as soon as practicable.

Common authorization mistakes and their fixes

Mistake Why it is unsafe Corrective action
Relying on a vendor’s statement that its product is safe or compliant Product claims do not establish the operator’s right to test a target Obtain owner-specific written approval and verify the tool’s actual controls in a test environment
Assuming a parent company’s approval covers subsidiaries or suppliers Ownership and contractual rights may differ by entity List each owner and retain evidence of authority for each asset
Using a wildcard domain as the entire scope Subdomains can be owned by third parties or route to shared infrastructure Enumerate approved hostnames and define how newly discovered names are handled
Allowing the agent to follow every link it finds Discovery can cross into excluded applications, tenants, or vendors Require a scope check and human approval before adding discovered assets
Approving “penetration testing” without technique limits The phrase can encompass exploitation, persistence, data access, or disruption Classify each method and explicitly prohibit or separately approve high-impact actions
Ignoring the provider’s policy because the customer owns the account Provider terms can restrict testing of shared or managed infrastructure Review current provider rules and satisfy any notice or approval requirement
Stopping the user interface but leaving workers active Queued jobs may continue after the operator believes testing has stopped Test emergency pause behavior, revoke credentials, and isolate execution workers
Keeping only a final vulnerability report A summary cannot show whether every action was authorized Retain time-stamped decisions, requests, approvals, and exceptions
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

How to compare AI pentesting tools for an authorized engagement

Do not compare products by autonomy or the number of vulnerabilities they claim to find. Compare the controls that prevent an authorized test from becoming an unauthorized one. Require product-specific evidence and your own controlled tests for each axis.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Comparison axis Questions to ask Evidence to require
Target and time-boundary enforcement Can the system represent exact targets, exclusions, timezones, blackout periods, and automatic expiry? Configuration export, expiry test, and logs showing blocked post-deadline actions
Pre-action checks and drift detection Is scope evaluated before every request and after redirects, DNS changes, or discovered assets? Demonstration with an excluded redirect and an unlisted discovered host
Destructive and high-impact controls Are denial-of-service, persistence, lateral movement, social engineering, and destructive actions blocked or separately approved? Policy test, approval record, and proof that rate limits are enforced by workers
Credential, tenant, and cloud handling Can identities be least-privilege, isolated, rotated, and prevented from crossing tenants? Role design, secret-handling documentation, and cross-tenant negative tests
Approval and emergency stop Who can approve, pause, revoke, and resume, and what happens to queued jobs? Runbook, timing test, worker shutdown result, and reauthorization requirement
Decision logs Can an independent reviewer reconstruct each proposal, scope decision, result, and exception? Exportable, time-stamped logs with integrity protection and retention controls

A tool that cannot demonstrate these controls may still be useful for isolated laboratory exercises, but it should not be given autonomous access to production systems until the gaps are resolved and documented.

What established guidance does—and does not—say

The NIST SP 800-115 technical guide, published on September 30, 2008, provides a foundational planning and assessment framework and discusses benefits and limitations of testing methods. It predates current AI agents and modern provider terms, so use it for planning concepts rather than as an AI-specific authorization rule.

NIST SP 800-53A Revision 1 describes penetration testing as a controlled attempt to assess security controls under agreed rules of engagement. That document is an older revision and is supporting context, not a universal legal standard.

The U.S. Election Assistance Commission’s penetration-testing guidance illustrates a signed ROE identifying targeted systems, scope, constraints, notifications, and disclosures, with testing scheduled on predetermined systems. It is government service guidance, not a rule that automatically settles authorization in every jurisdiction or contract.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Neither these sources nor a provider policy can decide every legal question. Jurisdiction, contracts, privacy obligations, sector rules, and the facts of deployment matter. When ownership, authority, third-party impact, or permitted conduct is uncertain, pause the test and obtain qualified legal or organizational review.

Final decision checklist

Proceed only when every answer below is yes and the evidence is available to the operator:

  • Is the owner or authorized representative identified for every target?
  • Is there explicit written approval naming the operator, targets, dates, and permitted methods?
  • Are exclusions, third-party dependencies, credentials, data handling, and stop conditions written down?
  • Have the current cloud and service-provider testing rules been checked?
  • Does the AI system validate scope before each action and stop on drift or ambiguity?
  • Are high-impact actions blocked or separately approved?
  • Can an authorized person pause execution, revoke access, and prevent queued work from continuing?
  • Will the logs prove what the agent proposed, why it was allowed, and what it actually did?
  • Has the configuration passed negative tests in a controlled environment?

If any answer is no, the tool is not ready for that engagement. Narrow the scope, add the missing control, obtain new written approval, or use a supervised method that keeps every action within the authority you can prove.
