A credible garment-factory assessment tests actual conditions against the labor laws in the factory’s jurisdiction and recognized international standards. Use the same five-part framework for every site: core labor rights; compensation and benefits; contracts and human resources; occupational safety and health; and working time. Then triangulate records, workplace observations, and confidential worker and management accounts, documenting the date, scope, evidence, uncertainty, and corrective actions.

What a garment-factory assessment should establish

An assessment is a structured determination of whether a factory’s practices meet applicable requirements. It is not simply a tour, a policy review, or a certificate. The reviewer should be able to answer, for each issue:

  • What national law, regulation, collective agreement, contract, or international benchmark applies?
  • What evidence was examined, and over what period?
  • What did workers, managers, and direct observation show?
  • Is the result a verified compliance finding, a non-compliance finding, an allegation requiring investigation, or an unresolved evidence gap?
  • When should the issue be corrected and how will completion be checked?

Conditions can change after an assessment. Every conclusion therefore needs an assessment date, the facilities and worker groups covered, the methods used, and any limitations on access or disclosure.

Use a framework that combines international rights and local law

Better Work’s Compliance Assessment Tool (CAT) is a useful organizing model. It groups five core international labor-standard areas with working-condition areas drawn from national labor law. Where local law is absent or unclear on a relevant issue, Better Work describes using international standards and good practices as a benchmark. A benchmark must be labeled as such; it is not automatically a local legal requirement.

Assessment domain Questions to localize before the visit Typical evidence
Child labor What is the minimum working age? Are hazardous tasks subject to a higher age threshold? How are ages verified at hiring and during employment? Personnel files, identity and age documents, recruitment records, age-verification procedures, worker interviews, production-area observation
Discrimination Do law and company rules prohibit unequal treatment in recruitment, pay, promotion, discipline, pregnancy or family status, disability, ethnicity, religion, gender, or other protected grounds? Hiring and pay data, promotion and termination records, grievance files, policies, interviews, demographic patterns
Forced labor Are workers free to leave employment? Are recruitment fees, deposits, debt, retention of identity documents, threats, or movement restrictions present? Recruitment contracts, fee records, wage deductions, worker accounts, identity-document procedures, dormitory and gate practices
Freedom of association and collective bargaining Can workers form or join organizations and bargain without interference, retaliation, or discrimination, subject to local law? Registration documents, collective agreements, election records, meeting minutes, grievance cases, interviews with worker representatives
Compensation What minimum wages, overtime premiums, allowances, benefits, deductions, pay frequency, and payslip information does current law require? Payroll, time records, payslips, bank or cash-payment evidence, deduction authorizations, benefit enrollment
Contracts and human resources Are terms written and understood? Are hiring, probation, discipline, termination, leave, and grievance processes lawful and consistently applied? Contracts, handbooks, disciplinary files, termination records, leave registers, grievance logs, worker interviews
Occupational safety and health What rules govern buildings, fire safety, machinery, chemicals, ergonomics, personal protective equipment, first aid, medical care, and emergency preparedness? Risk assessments, permits, inspection certificates, training logs, incident records, chemical inventories, drills, physical observation
Working time What are the legal limits for regular hours, overtime, rest days, meal breaks, night work, and leave? Is overtime voluntary where required? Clock-in data, schedules, production plans, payroll, leave records, worker accounts, supervisor instructions

Translate each row into a checklist for the factory’s country, industry, and workforce. Do not substitute a generic global threshold for a current local requirement.

Set the legal and operational scope before fieldwork

Identify the exact entity and site

Record the legal employer, trading name, physical address, production processes, subcontractors, staffing agencies, dormitories, canteens, and the number of workers on each shift. Confirm whether the review covers one building, a campus, or multiple facilities. A result for a sewing floor cannot automatically be applied to an off-site finishing unit or labor broker.

Build a current legal register

Collect authoritative, current sources for minimum age, wages, hours, overtime, leave, social insurance, termination, occupational safety, union rights, and required records. Note effective dates, regional or sectoral variations, exemptions, and collective-agreement rules. If a requirement is unclear, document the interpretation used and identify any international benchmark separately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Define the review period and sample

Choose a period long enough to reveal peaks, seasonal hiring, night shifts, and payroll corrections. State the payroll months, time-record months, incident period, and worker sample. Include permanent, temporary, agency, migrant, apprentice, and newly hired workers where they exist. Explain any group that could not be accessed.

Plan the assessment using Plan–Do–Check–Adjust

The International Labour Organization’s 2024 “Good work!” due-diligence tool illustrates a Plan–Do–Check–Adjust cycle for garment workshops in Argentina. The process is transferable, but its legal examples and workshop scope are Argentina-specific; verify every legal reference before using it elsewhere.

  1. Plan: map risks, applicable law, responsible managers, worker representatives, documents, interview arrangements, and a timetable. Define how confidential information will be protected.
  2. Do: collect records, inspect work areas, interview workers and managers, and test a sample of transactions such as hiring, wage payment, deductions, overtime, leave, and incident response.
  3. Check: compare each item with the legal register or clearly identified benchmark. Reconcile conflicting records and seek explanations for missing or altered data.
  4. Adjust: agree corrective actions with an owner, deadline, resources, and verification method. Recheck high-risk issues and update procedures so the problem does not recur.

The ILO examples emphasize that workers should receive legally required wages and benefits, understandable pay information, and verifiable timekeeping. Treat those as control objectives, not as a universal statement of any country’s law.

Gather evidence from three independent channels

Document review

Request source records rather than summaries. Depending on the issue, this may include employment contracts, age documents, recruitment agreements, payroll registers, payslips, bank confirmations, deduction approvals, attendance logs, overtime approvals, leave records, disciplinary and termination files, safety permits, training records, chemical inventories, injury logs, emergency-drill reports, grievance records, and collective-bargaining documents.

Keep a chain of custody for electronic exports and scanned records. Record who supplied each item, the period covered, the system used, and whether the file is complete. Compare payroll totals with bank or cash disbursement records and compare attendance data with production schedules. A policy proves that a rule was written; it does not prove that supervisors followed it.

Workplace observation

Walk every relevant area, including production, storage, maintenance, loading, kitchens, sanitation, first-aid points, exits, and worker accommodation when it is part of the employment arrangement. Observe line speed, machine guarding, blocked exits, alarm visibility, lighting, ventilation, heat, noise, chemical labeling and storage, electrical installations, ergonomic posture, protective equipment, and access to drinking water and toilets. Record the location, time, equipment identifier, and photograph or other evidence where lawful and safe.

Ask to see an emergency response rather than accepting a verbal assurance. Check whether exits open as required, routes are unobstructed, alarms can be heard, extinguishers are accessible, first-aid supplies are maintained, and workers know where to assemble. Do not create a hazard by interrupting production or handling machinery during the inspection.

Worker and management accounts

Interview workers privately and in a language they understand. Use a representative sample across departments, shifts, contract types, genders, tenure, and nationalities. Ask open questions about recruitment costs, pay, deductions, hours, rest, discipline, safety training, injuries, harassment, grievances, representation, and freedom to leave. Never ask a worker to identify a colleague who made a complaint.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Interview managers separately about hiring controls, payroll, timekeeping, production targets, incident reporting, contractor oversight, and corrective actions. Compare accounts with records and observation. A single allegation is not automatically a verified finding, but it is not evidence of compliance either; classify it and investigate without exposing the source to retaliation.

Test each domain with focused procedures

Child labor and young workers

Trace a sample from recruitment to the personnel file and production assignment. Check the authenticity and consistency of age documents, the date of hiring, and any age-verification exception. Identify young workers separately and confirm restrictions on hazardous work, night work, hours, and schooling where local law requires them. Look for inconsistencies such as identical birth dates, missing originals, or workers whose stated age conflicts with records. If a potential child-labor case appears, protect the child immediately and follow the jurisdiction’s referral and remediation requirements.

Discrimination and equal treatment

Compare hiring, starting pay, overtime access, promotion, training, discipline, absence, and termination data by relevant worker characteristics, while protecting personal information. Review pregnancy-related decisions, accommodation requests, harassment complaints, and recruitment advertisements. Ask whether workers can report concerns safely and whether managers apply rules consistently. A statistical disparity is a signal for investigation, not proof of unlawful discrimination by itself.

Forced labor and recruitment practices

Map every recruiter and fee. Verify who paid each charge, whether debt remains, whether wages are withheld, and whether identity documents are retained. Ask workers whether they can resign, leave the premises, refuse unsafe work, and return home without threats or financial penalties. Check dormitory access, gate controls, disciplinary practices, and language used in contracts. Coercion can be hidden in debt, deception, threats, or restriction of movement even when a written contract exists.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Freedom of association and bargaining

Confirm which worker organizations are legally recognized and whether representatives were chosen freely. Review registration, elections, meeting access, dues, bargaining notices, agreements, and disputes. Compare treatment of representatives with other workers and examine dismissals, transfers, or disciplinary actions following organizing activity. Distinguish a legal restriction on a particular form of organization from unlawful interference or retaliation.

Compensation and benefits

Recalculate a sample of pay from hours, rates, overtime, allowances, deductions, and benefits. Compare the result with the current legal register and any collective agreement. Confirm that workers receive understandable pay information and can challenge errors. Test deductions for written authorization and legal limits; include recruitment, housing, meals, uniforms, tools, loans, and disciplinary deductions. Reconcile payroll with attendance and production incentives so unpaid time is not hidden in a piece-rate system.

Contracts and human resources

Read contracts in the worker’s language and compare them with actual practice. Check job, location, pay method, hours, probation, leave, benefits, notice, termination, and grievance terms. Review whether temporary or agency workers receive the protections required for their status. Sample disciplinary cases for notice, an opportunity to respond, proportionality, and consistent application. Examine whether complaints are logged, investigated, resolved, and protected from retaliation.

Occupational safety and health

Identify hazards by process: cutting, sewing, pressing, dyeing, printing, laundering, maintenance, warehousing, and transport. Check machine guards, lockout procedures, electrical safety, fire systems, evacuation routes, chemical safety data, ventilation, heat and noise controls, ergonomics, personal protective equipment, first aid, medical referral, and incident investigation. Verify that training is understandable and repeated when work or equipment changes. Compare reported injuries with clinic, insurance, absenteeism, and production records to detect under-reporting.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Working time

Reconcile clock records, schedules, payroll, supervisor instructions, and worker accounts. Test ordinary hours, overtime, meal and rest breaks, weekly rest, night shifts, public holidays, and leave against current law. Look for off-the-clock preparation, mandatory pre-shift meetings, home-based finishing, altered time entries, and production targets that make recorded hours implausible. Separate authorized overtime from hours workers felt unable to refuse, and document the rule that governs each conclusion.

Classify findings and preserve the reasoning

Use a consistent finding record for every issue:

  • Requirement: the exact legal provision, agreement term, policy commitment, or identified international benchmark.
  • Condition: what was observed or documented, including dates, locations, and sample size.
  • Evidence: record identifiers, interview notes, photographs, system extracts, and corroboration.
  • Assessment: compliant, non-compliant, allegation requiring investigation, or insufficient evidence.
  • Risk: severity, number of workers affected, likelihood of recurrence, and urgency.
  • Action: immediate protection, root-cause correction, responsible owner, deadline, and verification evidence.

Do not call an issue compliant merely because no evidence was found. “Not verified” is different from “compliant,” particularly when records are missing or workers could not speak freely.

Turn findings into a corrective-action plan

Prioritize imminent danger, child labor, forced labor, severe fire or structural hazards, and retaliation risks. Immediate protection may be necessary before a full root-cause analysis. For other findings, require a specific action rather than a promise to improve. Examples include correcting wage arrears, reimbursing unlawful recruitment fees, repairing guarding, revising timekeeping, training supervisors, changing production planning, or establishing an independent grievance channel.

Assign one accountable owner and a realistic completion date for each action. Define evidence of closure: corrected payroll and worker repayment, a functioning time-record sample, an inspection certificate, interview confirmation, or a follow-up observation. Reassess whether the action changed outcomes, not merely whether a new policy was issued.

How to interpret public factory information

The Better Work Transparency Portal publishes assessment information for participating factories in selected country programmes. Its own description cautions that results reflect compliance at the time of assessment and that coverage and displayed data are limited. Use a listing as a dated evidence point, not a warranty of present conditions.

Before relying on a public entry, confirm the factory’s legal identity, country, assessment date, covered issues, programme participation, and disclosure limitations. Absence from the portal does not establish either compliance or non-compliance. Request current records and conduct proportionate due diligence when the decision involves a new supplier, a high-risk process, or a major change in production.

Compare two factories without creating a misleading score

Apply the same domains, legal baselines, sample periods, interview approach, and severity definitions to both sites. Present the evidence behind each result rather than ranking factories by an unexplained number.

Comparison question What to report
Are the same labor rights covered? Child labor, discrimination, forced labor, freedom of association and bargaining, plus compensation, contracts and HR, safety and health, and working time
Are legal baselines comparable? Country, region, sector, collective agreement, effective date, and any exemptions
Is the evidence equally strong? Records reviewed, worker sample, observation time, management access, and unresolved gaps
Are results equally current? Assessment date, payroll period, incident period, and follow-up date
Are disclosure limits visible? Subcontractors, agency workers, dormitories, off-site units, and data withheld from publication

A factory with fewer reported findings may simply have a narrower scope, older data, or weaker disclosure. State those differences before drawing a procurement or remediation conclusion.

Common assessment failures and how to correct them

  • Checking policies instead of practice: sample transactions, observe work, and interview workers.
  • Using one announced visit: include unannounced or varied-shift checks where lawful and safe, and test records over time.
  • Applying foreign thresholds: verify current law for the factory’s jurisdiction and label international benchmarks.
  • Ignoring subcontracting: map production and labor intermediaries beyond the main building.
  • Accepting management-selected workers: create a confidential, varied sample and protect identities.
  • Treating missing evidence as compliance: record the gap and seek independent corroboration.
  • Publishing undated scores: attach assessment date, scope, method, and limitations to every public result.
  • Closing findings after paperwork only: verify changed conditions and worker experience.

A practical field checklist

  1. Confirm the legal employer, sites, processes, contractors, workforce profile, and shifts.
  2. Compile and date the country-specific legal register and any collective agreements.
  3. Set the review period, sample, confidentiality protocol, and escalation rules.
  4. Request complete payroll, time, HR, recruitment, safety, grievance, and representation records.
  5. Conduct private worker interviews and separate management interviews.
  6. Inspect production, storage, emergency systems, welfare facilities, and accommodation in scope.
  7. Reconcile records with observation and accounts; classify each issue and uncertainty.
  8. Protect people from immediate harm and agree corrective actions with owners and deadlines.
  9. Verify closure through records, observation, and worker feedback.
  10. Report results with the date, scope, method, legal basis, evidence limits, and follow-up status.

What the available programme statistics do—and do not—show

A 2025 Better Factories Cambodia and International Labour Organization report describes 381 garment-factory assessments conducted in Cambodia in 2024. That number belongs to the Cambodia programme’s 2024 dataset; it is not a count of assessments worldwide and does not establish the condition of any particular factory. Use programme statistics to understand the scope of a dataset, then examine the individual site and assessment date.

Final decision rule

Approve, improve, escalate, or pause a supplier only after considering both the severity of findings and the quality of evidence. A serious, credible risk may require immediate action even while facts are being verified. Conversely, a clean visit cannot outweigh missing records, restricted worker access, or an assessment too old to represent current conditions. The defensible conclusion is the one that states what was tested, what the evidence supports, what remains unknown, and how the next verification will occur.
