There is no single accuracy score or fairness metric that can establish whether a police AI system is acceptable. A defensible assessment matches the test to the system’s task, local operating conditions, affected people and the decision influenced by the output. It combines documented data provenance, a credible baseline, realistic field testing, group- and intersection-level error analysis, independent review and enforceable monitoring. It also examines what the technology does to policing and communities after deployment.

What a credible assessment must establish

Police AI is not one technology. It includes event detection, person identification, AI-assisted surveillance, investigation tools, forensic analysis, risk scoring used in adverse decisions and geographic crime forecasting. Executive Order 14110 identifies police surveillance, crime forecasting and predictive policing, prison-management tools and forensic analysis among criminal-justice AI areas that require review. A test that is appropriate for a hotspot map cannot validate a facial-recognition match or a person-level risk score.

The central question is not “What is the model’s accuracy?” It is: Does this specific system produce sufficiently valid and equitable information for this specific decision, in this specific environment, with controls that prevent foreseeable harm? Answer that question before normal deployment and revisit it whenever the model, data, policy or operating conditions change.

  • Define the use: what the system receives, produces and influences.
  • Establish validity: show that the output measures the intended target rather than a proxy or recording process.
  • Test against a baseline: compare with current practice or another credible method under realistic conditions.
  • Measure unequal errors: report false positives, false negatives, calibration and other task-specific measures across relevant and intersecting groups.
  • Assess consequences: examine officer behavior, affected communities, rights, safety and feedback loops, not just model outputs.
  • Make controls enforceable: require audit access, monitoring, incident reporting, pause rules and remediation.

Step 1: Specify the system and the decision

Start an assessment record for the exact model and version being considered. A vendor name or product category is not enough; updates can change performance and risk. Record the following before looking at results:

  • Geography, time period, staffing, equipment, lighting, network conditions and other operating constraints.
  • People likely to be affected, including demographic and intersecting groups, people with disabilities and communities that have historically experienced different levels of enforcement.

The NAIAC Law Enforcement Subcommittee’s Findings and Recommendation: Field Testing of Law Enforcement AI Tools (April 2024) is a draft, pre-decisional checklist that calls for a tool description, intended-use statement, impact assessment and baseline. Treat it as a proposed checklist, not as final government policy or a binding legal requirement.

Define “correct” for the decision

Accuracy against historical police records is not automatically accuracy about an underlying crime, a person’s identity, danger or future behavior. State the target and the available ground truth. For example, an arrest record describes an enforcement action; it does not independently prove that the underlying event occurred or that the arrested person was responsible. A model trained on such records can reproduce the process that generated them.

NIST describes validation as objective evidence that requirements for a particular intended use have been met. Write down what evidence would count, who established the reference labels and what uncertainty remains. If the intended target cannot be observed reliably, narrow the claim rather than presenting a proxy as fact.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 2: Audit data provenance, labels and proxies

Request documentation for every dataset used to train, validate and test the system. At minimum, obtain:

  • Data dictionaries and definitions for every field.
  • Collection methods, labeling instructions, annotator qualifications and quality checks.
  • Time and geographic coverage, sampling rules and exclusion criteria.
  • Missing-data rates, transformations, imputation and deduplication procedures.
  • Provenance for records obtained from police, courts, corrections, commercial sources or other agencies.
  • Separation between training, validation and test cases, including any overlap across people, locations or events.
  • Known changes in reporting, dispatch, staffing, policy or enforcement that could alter the labels.

Evaluate completeness, representativeness, balance and the distribution of values within and between groups. NIST’s Measure guidance specifically recommends checking proxy features. Location, prior contact with police, neighborhood, language, disability-related information or other variables may encode demographic or socioeconomic differences even when protected attributes are removed.

Interrogate the reference labels

Ask how a “positive” case was established and whether the label reflects the phenomenon the system claims to predict. A crime report may reflect willingness and ability to report, police presence and recording practices. An arrest may reflect enforcement priorities and available resources. A face image collected during an encounter may be easier to obtain for some populations than others. Document these mechanisms and avoid calling the label ground truth when it is only an administrative outcome.

Check for temporal and geographic leakage. A test that includes information created after the decision, or that places records from the same incident in both training and test sets, can produce an inflated result. A model trained in one jurisdiction or era may not transfer to another without new validation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 3: Choose a baseline and run a realistic field test

Choose the comparator before seeing the model’s results. Depending on the use, the baseline might be existing officer practice, a non-AI process, a simple statistical benchmark or another validated system. State why it is credible and what outcome will be compared.

Specify the test plan in advance:

  1. Define the population, geography and time period to be sampled.
  2. Set inclusion and exclusion rules without changing them after results appear.
  3. Separate retrospective analysis from prospective testing. A retrospective test can estimate historical performance; it cannot show how officers and communities will respond in operation.
  4. Recreate the actual workflow, including devices, image quality, network delays, staffing, alert volumes and user training.
  5. Record overrides, disagreements, ignored alerts, repeat searches and actions taken after an output.
  6. Preserve the protocol, data version, code or configuration, results and adverse or inconclusive findings.

The NAIAC draft checklist warns that operational performance can differ from sterile testing or another agency’s report. The DOJ’s final Artificial Intelligence and Criminal Justice report, dated December 3, 2024, recommends an impact assessment before predictive-policing deployment and objective third-party auditing. A field test should therefore precede full integration whenever feasible, with safeguards that prevent test outputs from becoming unreviewed enforcement decisions.

Do not hide unfavorable results

Keep a complete record of test plans and outcomes, including failures, subgroup uncertainty and results that do not support deployment. The NAIAC draft recommends public disclosure of field-test plans and results, but that recommendation is not a universal legal mandate. Agencies should distinguish what they are legally required to publish from what transparency and accountability require as a policy choice.

Step 4: Report accuracy and fairness together

Use measures that fit the task, decision threshold and consequences of errors. Publish denominators, sample sizes and uncertainty with every rate. An aggregate score can look strong while a smaller or intersecting group experiences a much higher error burden.

Use case Questions to test Measures to consider Important limitation
Event or object detection How often are real events detected, and how many alerts are spurious under local conditions? True-positive rate, false-positive rate, false-negative rate, alert volume, detection delay and performance by scene conditions More alerts can overwhelm staff even if the model’s case-level rate improves.
Person identification or facial matching Does the reference set represent operational images, and how often does the system miss a person or match the wrong person? False-match and missed-match rates, rank or threshold performance, image-quality strata and subgroup comparisons No universal threshold is established for every identification application; the agency must justify its threshold and response to a match.
Forensic analysis How reliable is the result for the specimen, instrument and laboratory workflow actually used? Validation error rates, repeatability, reproducibility, invalid-result rate and analyst or instrument effects Laboratory performance may not represent field collection or courtroom use.
Person-based risk scoring What outcome, time horizon and threshold are being predicted, and what adverse action follows? Calibration, discrimination, false positives, false negatives, predictive values and subgroup error rates An observed outcome such as arrest may reflect enforcement and reporting rather than underlying behavior.
Geographic crime forecasting Do predicted areas outperform the selected baseline on an independent period, and how are patrol resources allocated? Prespecified map-level measures such as Predictive Accuracy Index or Recapture Rate Index, coverage, hit rate, resource allocation and comparison with baseline A map-level metric is not person-level accuracy and does not prove that an individual in a predicted area is risky.
Surveillance or investigation support How does the system change search scope, attention and escalation decisions? Alert precision, missed-event rate, operator overrides, downstream action rates and subgroup effects Workflow effects and chilling or displacement effects may not appear in model-only testing.

Use group and intersection-level analysis

Disaggregate results across relevant demographic groups and, when lawful and statistically responsible, intersections such as race and gender or age and disability. Report small sample sizes and confidence intervals or other uncertainty. Do not suppress a group because its estimate is imprecise; explain the uncertainty and whether more data or a different test design is needed.

For score-based tools, check calibration or another validity property suited to the outcome. For thresholded tools, report false-positive and false-negative rates at the threshold that will actually be used. Predictive values depend on prevalence, so a rate measured in a laboratory or a different jurisdiction may change substantially in deployment.

Choose fairness measures deliberately

Demographic parity, equal opportunity, equalized odds and simple error-rate comparisons answer different questions and can conflict. Select a metric because it matches the decision and harm being controlled, not because it produces the most favorable result. Document:

  • Which metric and threshold were selected.
  • Why that metric fits the task and affected interests.
  • What trade-offs remain between competing metrics.
  • Who approved acceptable tolerances.
  • What investigation, pause or remediation follows a breach.

NIST’s Measure guidance emphasizes that metric and threshold choices require human judgment and context. A metric is evidence for a governance decision, not a substitute for one.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 5: Evaluate effects on policing and communities

Assess the socio-technical system: model, users, policies, incentives and people affected. Record what an officer sees, how quickly it appears, whether an explanation is available and how disagreement is documented. Compare stated policy with actual behavior during the field test. An “advisory” score that officers rarely override is functionally close to a mandatory rule.

For predictive policing, examine whether deployment changes patrol concentration, stops, searches, arrests, reports and community contact. Compare those changes with public-safety priorities and with crime rates measured independently of the system’s own outputs. The DOJ recommends reevaluation to promote fairness and equity and to minimize feedback loops, as well as routine audits of databases used for person-based prediction.

Consider alternatives and complements. The DOJ report discusses community public-health and social-service interventions as possible responses to underlying needs. An agency should be able to explain why an AI deployment is preferable to, or appropriately combined with, non-policing resources.

Include affected communities and contextual experts

Invite people who understand the local context, including civil-rights, disability, language-access, public-health, legal and community representatives. NIST describes trustworthy AI as socio-technical and notes that interested parties and contextual experts can improve evaluation. Participation should influence the use case, test design, acceptable risk and remediation plan, not merely appear in a post-deployment announcement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 6: Put oversight in contracts and operations

Do not buy a black box and attempt to audit it after an incident. Contract terms should preserve the agency’s ability to validate and stop the system. Require, as appropriate:

  • Documentation of intended use, known limits, data sources, version history and material updates.
  • Access for independent evaluation of the model, source code or other evidence sufficient to test accuracy and bias.
  • Notice before model, data, threshold or interface changes.
  • Incident, complaint and suspected-bias reporting with defined response times.
  • Rights to reproduce tests, retain logs and audit subcontractors or external data providers.
  • Recurring audit obligations and cooperation with objective third-party reviewers.
  • Termination, suspension or rollback rights when performance or safeguards fail.

The DOJ expressly recommends objective third-party audits of models and source code and regular evaluation and auditing as vendor-contract terms. Independent review is especially important when the developer’s test set, labels or operating assumptions cannot be independently verified.

Set a monitoring and stop plan before launch

Write the schedule and triggers before deployment. Identify:

  1. Who owns monitoring and who receives reports.
  2. How often accuracy, calibration, subgroup disparities, data quality and outcomes are reviewed.
  3. Which changes require a new field test, such as a model update, new data source, new geography, policy change, staffing change or altered threshold.
  4. What disparity, error, incident or drift level triggers investigation.
  5. Who can pause or suspend use without waiting for a procurement or political cycle.
  6. How fixes are tested and how the agency verifies that remediation worked.

NIST’s Measure guidance calls for monitoring outputs, periodic updates, testing and recalibration, with action when disparities exceed acceptable levels. Monitoring should use outcomes independent of the model where possible; otherwise a feedback loop can make the system appear to improve by learning from its own interventions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Maintain a public-facing record

Publish, subject to lawful privacy and security limits, the system’s purpose, version, evidence, limitations, assessment dates, group-level findings, complaints, incidents and corrective actions. Explain which uses are prohibited and how a person can challenge an AI-influenced decision. Keep internal logs detailed enough for an auditor to reconstruct the input, output, user action and subsequent outcome.

How to compare two systems or deployment choices

A lower headline error rate does not automatically make one option safer. Compare candidates on the same decision and operating conditions using these axes:

Comparison axis Questions for the decision record
Task and severity What does each system do, and what is the most serious consequence of an error?
Local validity Was it tested prospectively or retrospectively in the intended geography, time period and workflow?
Disparities How do false positives, false negatives, calibration and uncertainty differ across relevant and intersecting groups?
Data provenance Are labels, exclusions, missingness, representativeness and proxy features documented?
Auditability Can an independent reviewer inspect evidence, reproduce tests and obtain version history?
Human workflow Are outputs advisory or determinative in practice? Are overrides, disagreement and training recorded?
Continuous control Are monitoring, community-impact review, incident reporting, pause rights and remediation enforceable?

If evidence is missing for a cell, record “not stated” and treat the gap as a procurement and deployment risk. Do not infer quality from a vendor’s marketing claim or from performance reported by another agency.

Common assessment failures and corrections

Relying on one aggregate accuracy number

Failure: A single score hides unequal errors, uncertainty and the consequences of a wrong alert or match.
Correction: Publish task-specific rates, denominators, uncertainty, thresholds and subgroup and intersection results.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Calling administrative records ground truth

Failure: Arrests, stops, calls or reports are treated as neutral observations of crime or risk.
Correction: Describe how enforcement and reporting shaped the label and validate against an independent reference where feasible.

Testing in a laboratory and skipping operations

Failure: Clean images, cooperative users and ideal connectivity produce results that do not survive deployment.
Correction: Run a controlled field test with real devices, staffing, alert volumes, environmental conditions and workflow logging.

Removing protected attributes and assuming bias is gone

Failure: Proxy variables such as location or prior police contact preserve group differences.
Correction: Audit features, distributions and outcomes directly, including intersectional effects.

Treating a draft checklist as binding law

Failure: The April 2024 NAIAC field-testing document is cited as a final government requirement.
Correction: Label it draft and pre-decisional, then separately identify applicable law, agency policy and voluntary guidance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Deploying without a stop mechanism

Failure: Staff continue using a system while incidents, drift or disparities are investigated.
Correction: Set pause authority, trigger levels, response deadlines and verification of remediation before launch.

What the main guidance documents do—and do not—establish

  • DOJ, Artificial Intelligence and Criminal Justice (final, December 3, 2024): recommends impact assessment before predictive-policing deployment, objective third-party audits, routine database audits, periodic reevaluation and audit requirements in vendor contracts. It is a federal report and set of recommendations; the article does not treat every recommendation as a universal legal mandate.
  • NIST AI Risk Management Framework 1.0 (January 26, 2023): voluntary guidance. NIST’s current AI RMF page states that the framework is being revised, so agencies should verify the current version and status before relying on it.
  • NIST Measure playbook: nonbinding, practical suggestions for evaluating performance, bias, uncertainty, context-specific fairness measures, monitoring and remediation.
  • NIST SP 1270 (March 15, 2022): guidance on identifying and managing bias across AI processes, including data, measurement and organizational context.
  • NAIAC Law Enforcement Subcommittee field-testing checklist (April 2024): useful proposed checklist for operational testing and disclosure, explicitly labeled draft and pre-decisional; it is not final policy or a binding requirement.

A deployment-ready assessment checklist

  • Purpose: The exact task, decision point, users, prohibited uses and affected populations are documented.
  • Validity: The target, reference labels, proxy risks and limits of ground truth are explained.
  • Data: Provenance, coverage, missingness, transformations, representativeness and intersectional sample sizes are available.
  • Baseline: A comparator and evaluation design were selected before results were reviewed.
  • Field test: Local operational conditions, user behavior, overrides and downstream actions were measured.
  • Metrics: Relevant error, calibration or map measures include denominators and uncertainty.
  • Fairness: Group and intersection results, metric trade-offs and acceptable tolerances are documented.
  • Impact: Policing patterns, community effects, rights, safety and feedback loops were assessed.
  • Independence: An objective third party can inspect evidence and audit the model or source code where feasible.
  • Controls: Contracts include update notice, logs, incident reporting, audit rights and suspension terms.
  • Monitoring: Owners, review intervals, drift tests, disparity triggers and remediation steps are set before launch.
  • Transparency: The public record explains purpose, version, evidence, limitations, complaints and corrective actions.

Bottom line for decision-makers

Approve a police AI system only when its intended decision is clear, its labels and limits are understood, its local performance beats a credible baseline without unacceptable subgroup harms, and independent oversight can continue after launch. If the agency cannot explain what “correct” means, cannot reproduce the test, cannot inspect the data-generating process or cannot stop the system when conditions change, the evidence is not sufficient for deployment—regardless of the vendor’s headline accuracy.
