Assess AI regulatory risk by examining the product’s actual intended use and deployment context, mapping the laws and regulated roles in every launch market, classifying each use case, and turning applicable duties into controls and evidence. Finish with a documented release decision and a plan to reassess when the product or its legal environment changes. A model’s name or technical category alone cannot determine its regulatory status.

What an AI regulatory risk assessment should establish

A useful pre-launch assessment answers four practical questions: what the system is intended to do; which laws and actors apply in the places where it will be offered or used; what obligations follow from each use case; and what evidence supports the decision to release. Treat the assessment as a product and deployment review, not just a model review. The same model may raise different regulatory questions when used for different purposes, by different organizations, or in different markets.

This guide explains a repeatable workflow, with the EU AI Act as a concrete example and the NIST AI Risk Management Framework (AI RMF) as a separate, voluntary risk-management aid. It cannot determine the obligations for an unspecified product. A launch-specific answer depends on its use, sector, affected people, company roles, and markets.

Step 1: Describe the product as it will actually be used

Begin with a written description of the complete system and the context in which it will operate. A vague description such as “AI assistant” or “prediction model” is not enough to support a classification. Record the product’s intended purpose, expected users, affected people, inputs and outputs, and how an output can influence a decision or action.

Capture the use case and deployment conditions

  • Purpose: What task is the system designed, marketed, or configured to perform? Distinguish the intended use from other uses a customer might imagine.
  • Users and affected people: Who operates the product, who receives its output, and whose interests, opportunities, or treatment may be affected?
  • Decision pathway: Does an output inform, recommend, rank, generate, or trigger an action? What happens if it is wrong?
  • Human involvement: Who reviews an output, when do they intervene, and what authority or information do they have to challenge it? Record whether review occurs in practice, not only whether a process document says it should.
  • Data and dependencies: Identify the data the system uses and the material components it depends on, including third-party models or services. Record which component performs which function and who controls its configuration.
  • Operating context: Record the deployment setting, the customer or organization responsible for use, relevant sector, and the places where the product will be marketed and used.

These details become the reference point for legal mapping and classification. If the product is sold for one purpose but customers are encouraged to use it for another, resolve that mismatch before classifying the system. Revisit the description if product messaging, features, user access, or deployment changes.

Step 2: Map markets, laws, and your role in each one

Make a market-by-market map rather than assuming a single “AI law” answers every question. For each place where the product will be marketed or used, identify potentially relevant horizontal AI rules, privacy and consumer rules, product-safety requirements, and sector-specific regulation. The applicable set depends on facts about the product and jurisdiction; the title alone cannot establish it.

Also assign the company’s role in each market and deployment. Depending on the arrangement, a company may be a provider, deployer, importer, distributor, or another regulated actor. A company can have different roles across products or transactions, so do not assume a role from its name on a contract or from the fact that it developed a model. Record the reason for the assignment and who owns each obligation.

Use a market-and-role register

Record What to capture
Market Where the product will be marketed and where it will be used; note any difference between the two.
Sector and use The actual task, deployment setting, and sector rules that may apply.
Company role The role the company performs in that market and deployment, with the reasoning and responsible owner.
Potential requirements Relevant AI, privacy, consumer, product-safety, and sector rules to analyze.
Decision and open questions The current conclusion, supporting basis, unresolved facts, and who will resolve them before release.

Keep unknowns visible. For example, if you have not confirmed where customers will deploy the system or which entity controls a consequential decision, record that as a launch dependency. Do not convert an unresolved fact into an assumption that silently narrows the assessment.

Step 3: Classify each use case under the applicable rules

Classify each materially different use case, not merely the product as a whole. For EU exposure, examine whether a use falls within a prohibited practice, a high-risk pathway, or a transparency obligation under Regulation (EU) 2024/1689. The consolidated regulation is the controlling legal source for its scope and requirements: Regulation (EU) 2024/1689, consolidated text.

Write down the facts used to reach the classification. That record should explain the intended purpose, deployment context, relevant category or pathway considered, evidence consulted, conclusion, and any remaining uncertainty. If the conclusion depends on a condition—such as how a customer uses the output—state the condition and how the product or deployment process will enforce or monitor it.

Check the EU pathways in a deliberate order

  1. Prohibited practices: Determine whether the intended use is within a prohibited practice. If it may be, stop the release assessment for that use until the issue has been resolved against the regulation.
  2. High-risk classification: Test whether the use meets a high-risk pathway. Do not infer that a system is outside high-risk scope simply because its model is general-purpose, marketed as an assistant, or supervised by a person.
  3. Transparency duties: Assess whether the product or interaction triggers applicable transparency obligations even if the use is not high-risk.
  4. Document the rationale: If an Annex III system is assessed as not high-risk, the consolidated Act says that assessment must be documented before market placement or service, with registration obligations. The Act also states that profiling of natural persons remains high-risk in the specified Annex III context. Record the conclusion and check the exact provision and scope in the consolidated text.

The European Commission’s guidelines for providers and deployers of high-risk systems are useful classification material, but the available guidance is described as draft and non-binding. Treat the regulation as controlling, and verify the guidance’s status before relying on it for a launch decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 4: Turn the classification into controls and evidence

A classification is not the end of the assessment. For every applicable obligation, identify the control that addresses it, the person responsible, the evidence that shows the control exists, and the point in the product lifecycle when it must be completed. This makes the assessment operational: reviewers can see what is required, who will do it, and what remains incomplete.

For EU high-risk systems, the Act requires a risk-management system that is established, implemented, documented, and maintained as a continuous, iterative lifecycle process. Article 9 explains that requirement: European Commission AI Act Service Desk, Article 9. The point is not to write a one-time risk memo and leave it untouched; the system and its risks need ongoing management.

Article 11 requires technical documentation before market placement or service and ongoing updates. Provider obligations also include quality management, recordkeeping, conformity assessment before market placement or service, a declaration of conformity, CE marking where applicable, and registration. The Commission’s Navigating the AI Act FAQ provides an overview of conformity-assessment and quality-system matters. Confirm the applicable route and scope against the regulation rather than assuming that every listed obligation applies identically to every system or actor.

Build an obligation-to-evidence register

Field What it should contain
Requirement The specific legal or policy obligation and the market and use case it covers.
Control The design, operational, organizational, or deployment measure intended to address it.
Evidence The documentation, test result, decision record, or other artifact that demonstrates the control.
Owner and timing The accountable role and when the control or evidence must be completed or updated.
Status and residual risk Whether the item is complete, what remains unresolved, and what risk is accepted or mitigated.

Evidence should be tied to the version of the product and deployment that was assessed. A classification rationale written for one purpose, model configuration, or customer workflow may no longer describe the system after a significant change.

Step 5: Determine whether a fundamental-rights impact assessment is required

Do not assume that every AI company or every AI system must complete a fundamental-rights impact assessment under Article 27. The requirement applies to certain deployers of specified high-risk systems before deployment. It is therefore important to establish both the system’s status and the organization’s role before deciding whether the duty applies. See the European Commission AI Act Service Desk explanation of Article 27.

Where the specified duty applies, the assessment considers the planned use, the period and frequency of use, groups likely to be affected, specific risks of harm, human oversight, and mitigation measures. Treat it as a deployment assessment: the deployer’s intended setting and affected groups matter, not just the provider’s description of the technology.

In the release record, state whether Article 27 applies, why that conclusion follows from the facts, who is responsible for the assessment, and whether it is complete before deployment. If the provider and deployer are different organizations, identify the information and coordination needed for the deployer to assess its own use. Do not present a voluntary internal impact review as proof that a statutory assessment has been satisfied unless the applicable requirements have actually been addressed.

Step 6: Use NIST AI RMF as a voluntary work organizer, not a legal substitute

The NIST AI RMF is a voluntary framework intended to improve how trustworthiness considerations are incorporated into the design, development, use, and evaluation of AI products, services, and systems. NIST describes it as intended for voluntary use: NIST AI Risk Management Framework. It can help teams organize identification, measurement, management, and governance work, but using it does not itself establish compliance with binding law.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

NIST’s trustworthiness characteristics include validity and reliability; safety; security and resilience; accountability and transparency; explainability and interpretability; privacy enhancement; and fairness, with harmful bias managed. Use these as prompts for product-risk work and connect each concern to a system behavior, control, owner, and evidence. For example, a team can ask what evidence supports a system’s reliability in the intended context, how a harmful output is detected and handled, and how people responsible for decisions understand the system’s limits.

Dimension EU AI Act NIST AI RMF
Legal force Binding law within its scope. Voluntary risk-management framework.
Coverage EU rules apply according to the regulation’s scope, relevant system, market, and actor. Can be used to structure AI risk work; it is not a jurisdiction-specific legal classification.
Assessment role Determine applicable duties and complete required processes and evidence. Organize consideration of trustworthiness risks and their management.
Relationship Legal obligations remain controlling where they apply. May complement a compliance program but does not replace legal analysis.

Keep the two tracks distinct in the documentation. A NIST-aligned risk activity may provide useful evidence or improve a control, but the legal register should still identify the applicable statutory duty and show how it is met.

Step 7: Set a release gate and maintain the assessment

Before launch, assemble a versioned decision record that connects the intended purpose to the legal map, classification, required controls, impact assessments where applicable, and remaining risks. The gate is a recommended operational workflow based on lifecycle duties and risk-management practice; it is not a verbatim legal checklist for every product.

Release decision record

  • Product and system version, intended purpose, deployment context, and affected groups.
  • Markets and sectors assessed, company roles, and applicable requirements.
  • Classification rationale for each use case, including prohibited-practice, high-risk, and transparency analysis where relevant.
  • Required controls, completed evidence, accountable owners, and any Article 27 determination or assessment.
  • Known limitations, unresolved facts, mitigations, residual risks, and the person or body approving release.
  • Conditions of release, such as limited deployment scope or required human review, with an owner responsible for checking them.
  • Reassessment triggers and the location of the current approved record.

Set the release decision only after material requirements and controls have an owner and a disposition. A release can be blocked, limited to a defined context, or approved with documented residual risks, depending on the applicable rules and the organization’s governance. Do not describe an internal approval as a substitute for a required conformity assessment or other external or statutory process.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Reassess when facts change

Review the assessment when the model, data, intended purpose, users, deployment conditions, or applicable law changes. A change can alter the risk profile, company role, or classification. Keep prior versions so the organization can show what was assessed and approved at a particular point, and update controls and evidence when the product changes.

EU AI Act timing to check before launch

The European Commission’s regulatory framework overview reports that transparency rules take effect in August 2026. It also reports that, following the political agreement on the AI Omnibus, rules for specified Annex III high-risk use cases apply from 2 December 2027, while rules for high-risk AI embedded in regulated products apply from 2 August 2028. These dates concern different categories; they are not a single start date for every AI Act obligation. See the Commission’s AI Act regulatory framework overview.

Reported timing Coverage as described by the Commission overview How to use it
August 2026 Transparency rules. Check which transparency provision applies to the product and interaction.
2 December 2027 Rules for specified Annex III high-risk use cases, following the political agreement on the AI Omnibus. Confirm that the use is within the specified category and check the latest legal text.
2 August 2028 Rules for high-risk AI embedded in regulated products. Check whether the AI is embedded in a regulated product and which requirements apply.

These are volatile legal dates and the overview is a policy summary. Before giving launch advice or setting a compliance schedule, verify the current consolidated regulation, applicable implementing material, guidance status, harmonized standards, and relevant national materials. Do not infer from a future application date that no other requirement applies before that date.

Common assessment failures to avoid

  • Classifying the model instead of the use: A model label does not explain who uses the system, who is affected, or what consequences follow from its output.
  • Writing a broad conclusion without supporting facts: Record the use case, pathway tested, and rationale, including when an Annex III assessment concludes the system is not high-risk.
  • Confusing provider and deployer duties: Assign roles for each market and arrangement; the Article 27 assessment duty is not universal across all providers and systems.
  • Treating a framework as law: NIST AI RMF can support risk work, but it is voluntary and does not replace jurisdiction-specific compliance analysis.
  • Leaving controls as intentions: Give each applicable requirement an owner, due point, and identifiable evidence artifact.
  • Freezing the assessment at launch: Put reassessment triggers in the record so changes to the system, use, deployment, or law reopen the analysis.
  • Relying on stale timing or draft guidance: Check current official materials before making a launch decision, especially where dates or guidance status may have changed.
