Start by identifying the exact GST order, communication date, tax period, jurisdiction and reason for rejecting the input tax credit (ITC). A first appeal under section 107 normally requires a timely FORM GST APL-01 filing, payment of admitted dues and the prescribed disputed-tax pre-deposit, supported by an invoice-level record. The first Appellate Authority may confirm, modify or annul the order, but section 107(11) does not permit it to send the case back to the original adjudicating authority. “Prepare for remand” therefore applies when a competent higher forum has actually ordered a remand or when a later proceeding lawfully requires fresh consideration.
What to do first when ITC is rejected
Do not begin with a generic reconciliation or a standard grounds-of-appeal template. Preserve the order and determine exactly what was disallowed. Download the adjudication order, demand summary, show-cause notice, hearing notices, written replies, annexures and any portal-generated documents. Record the date on which the decision or order was communicated; that date controls the ordinary appeal calculation.
Create a short issue sheet for every disputed item. At minimum, record the invoice or debit-note number, supplier GSTIN, tax period, ITC claimed, ITC disallowed, the statutory provision cited, the officer’s stated evidence and the relief you want. A portal mismatch is a different dispute from failure to prove receipt, non-business use, a blocked credit, apportionment, a payment condition or limitation. The evidence and legal argument must follow the actual ground.

Choose the correct procedural route
| Issue | First appeal under section 107 | Proceeding after a higher-forum remand |
|---|---|---|
| Trigger | An adverse decision or order by the adjudicating authority. | A court, tribunal or other competent higher forum has set aside or returned an issue for fresh consideration. |
| What starts the clock | Communication of the impugned decision or order. | The directions and dates in the remand order, followed by the fresh order’s own communication date for any later appeal. |
| Initial filing | FORM GST APL-01 through the GST Portal, with the required payment and documents. | A written submission and evidence bundle addressing the exact remand directions; a new appeal may be needed after the resulting order. |
| Decision-maker’s authority | Confirm, modify or annul the appealed decision; no referral back to the original adjudicating authority under section 107(11). | The lower authority acts within the scope of the higher forum’s directions and must provide a fresh, reasoned decision. |
| Evidence focus | Show why each finding in the appealed order is legally or factually wrong. | Answer each question returned by the higher forum with indexed, transaction-level proof and comply with its limits. |
Calling an ordinary first appeal a “remand” can lead to the wrong relief and an incomplete record. Conversely, a genuine remand order can impose limits that do not apply to a new section 107 appeal. Read the operative paragraphs, not only the case title or the last page.
Appeal deadline and filing proof
Ordinary three-month period
Section 107(1) provides three months from communication of the decision or order. Section 107(4) permits a further period of one month where sufficient cause prevented filing within the ordinary period. The GST Portal appeal FAQ describes the same three-month period and a possible one-month condonation. Treat the extra month as a narrow statutory opportunity, not as additional planning time. The governing text is available at CGST Act section 107; portal instructions are at GST Portal appeal FAQ.
Calendar the last ordinary day as soon as the order is communicated. Save the communication email, portal download record, dashboard screenshot and order PDF. If several orders or periods are involved, calendar each separately. A pending request for clarification, a rectification application or an informal discussion should not be assumed to stop the section 107 clock.
APL-01, APL-02 and an order that is not uploaded
The GST Portal FAQ identifies FORM GST APL-01 for an appeal against a demand order. The appeal is treated as filed when final acknowledgment FORM GST APL-02 and an appeal number are issued, not merely when a draft is saved or an upload appears successful. Keep the submitted form, attachment list, payment challans, electronic-liability-ledger entries, acknowledgment and appeal number in one controlled folder.
Where the order is not uploaded, the portal instructions call for a self-certified copy within seven days. If that copy is supplied late, the submission date is treated as the filing date under the FAQ instructions. Upload a legible, complete order and retain the upload receipt. Portal labels and workflows can change, so check the live GST Portal immediately before submission.
Calculate admitted dues and the disputed-tax pre-deposit
Section 107(6) requires payment of the amount admitted from the impugned order and a pre-deposit linked to the disputed tax. The GST Portal FAQ describes 10% of disputed tax as the ordinary minimum before filing. Separate tax from interest, fine, fee and penalty, and separate admitted amounts from the portion genuinely challenged. A calculation based on the total demand can overstate or understate the statutory amount.
- Extract the demand components. Make columns for tax, interest, penalty, fee, fine, admitted tax and disputed tax for each order.
- State your admissions. If any tax is not challenged, identify it clearly and pay the amount required for the appeal.
- Compute the disputed-tax percentage. Apply the current statutory rule and portal requirement to the disputed tax, not automatically to interest or penalty.
- Check caps and payment method. The applicable statutory cap, permitted ledger and challan route depend on the law in force and the type of demand. Verify them against the current section 107 text and portal instructions.
- Save proof. Keep challans, debit entries, electronic ledgers and the acknowledgment that links the payment to the appeal.
A February 2026 Telangana government compilation summarizes a decision involving payment of a section 107 pre-deposit through the Electronic Credit Ledger where the demand concerned output tax and a CBIC circular applied. That is a fact-sensitive payment-method issue, not a blanket rule that every ITC appeal pre-deposit can be paid from the credit ledger. Read the compilation at Government of Telangana rulings compilation, February 2026 and verify the rule for your demand.

Build an invoice-level evidence record
An appellate authority should be able to move from each finding in the order to one exhibit and one explanation. Use a master schedule with these columns: invoice or debit-note number and date; supplier GSTIN; taxable value and tax; purchase or service description; relevant return period; ITC claimed; ITC disputed; rejection reason; exhibit number; page number; and the precise relief requested.
Core file for every appeal
- Show-cause notice, adjudication order, demand summary, hearing notices, hearing submissions and written replies.
- Tax invoices, debit notes, import bills of entry or applicable ISD documents, with readable supplier and tax details.
- Purchase orders, contracts, statements of work, delivery challans, goods-receipt notes, service-completion records and inventory or project records.
- GSTR returns, supplier statement or portal data, electronic-liability and credit ledgers, and a reconciliation explaining each mismatch.
- Bank statements or payment records, supplier correspondence and internal documents showing business use where that issue is contested.
- A chronology of the transaction, notice, reply, hearing and order, plus an index and page numbering for the bundle.
This is an organizing framework, not proof that every item is required in every case. The decisive documents depend on the denial ground, the statutory version for the period and the facts. Section 16 and Rule 36 provide the legal context for entitlement and documentary support.
Match proof to the stated reason
| Rejection theme | Questions to answer | Typical records to map |
|---|---|---|
| Document or formal defect | Is the document of a permitted type, correctly identifies the parties and tax, and relates to the claimed period? | Invoice or debit note, import bill of entry, ISD document, purchase order and correction trail. |
| Receipt or supply disputed | Can you demonstrate that goods or services were actually received and used in the business? | Goods-receipt note, delivery evidence, service deliverables, inventory entries, project records and correspondence. |
| Supplier reporting or portal mismatch | Is the difference caused by a reporting period, amendment, wrong GSTIN, duplicate entry or data-transmission issue? | Supplier statement, return extracts, portal screenshots, supplier confirmation, reconciliation and amended invoices. |
| Payment condition | What payment was made, to whom, on what date and against which invoice? | Bank records, remittance advice, vendor ledger and supplier correspondence. |
| Blocked credit or apportionment | Does a statutory restriction apply, or is the officer’s classification and allocation wrong? | Use description, contracts, employee or asset records, allocation workings and the provision in force for the period. |
| Time limit or procedure | Which statutory date applies, when was communication made and was notice or hearing adequate? | Portal timestamps, communication records, notices, adjournment requests, hearing minutes and replies. |
Do not submit a large undifferentiated document dump. Explain in the written grounds what each exhibit proves and identify any missing record honestly. A mismatch that remains unexplained after a reconciliation is not cured by attaching more unrelated invoices.
Draft grounds that invite a merits decision
Use one ground for each material finding. For every ground, write five parts:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Finding challenged: quote or accurately paraphrase the order’s conclusion and identify the invoice, period and amount.
- Applicable rule: cite the section, rule, notification or amended wording that governed that tax period.
- Record evidence: give the exhibit and page, then explain the fact it establishes.
- Error in reasoning: show the factual omission, wrong legal test, unexplained mismatch or procedural failure.
- Exact relief: ask for deletion of the identified disallowance, correction of the computation or another legally available order.
Keep procedural objections tied to the record. An inadequate notice or hearing argument is strongest when the notice, request, adjournment and order demonstrate what was not put to you or considered. Avoid asserting that a defect automatically wins without explaining prejudice and the relief available under the governing law.
Section 107(12) requires a written appellate order stating the points for determination, the decision and the reasons. Ask for a reasoned finding on each ground, not merely a direction to “recheck” the documents. A complete first-appeal record reduces the risk that a later forum sees an argument as an afterthought.
Can the first GST Appellate Authority remand the case?
Section 107(11) says the Appellate Authority may confirm, modify or annul the appealed decision or order and “shall not refer the case back to the adjudicating authority that passed the said decision or order.” The quoted restriction is part of the statute, not a discretionary practice preference. Prepare your section 107 appeal for a merits decision by the Appellate Authority.

This limitation does not mean every higher court or tribunal lacks power to return a matter. A court or competent higher forum may issue a remand under its own jurisdiction and directions. That is a different procedural event from the first Appellate Authority exercising section 107 powers.
How to prepare when a higher forum has actually ordered remand
Read the operative directions literally
Obtain the signed remand order and mark every direction. Identify the questions returned, findings left undisturbed, evidence permitted or excluded, hearing rights, deadlines, authority required to decide and any instruction to pass a speaking order. Do not assume that the entire assessment has reopened if the order remanded only one issue.
Rebuild the record around the remand scope
- Prepare a direction matrix. Put each remand paragraph in one column and your response, exhibit and requested finding in the next columns.
- Update the chronology. Include the original notice and order, earlier appeal, higher-forum proceedings, remand date and every post-remand communication.
- Refresh the invoice schedule. Reconcile the exact population returned for fresh consideration; do not silently add unrelated periods or credits.
- Index and paginate. Use a master index, exhibit numbers, bookmarks in the PDF and a short factual summary so the authority can test each transaction.
- Answer limits and objections. If the department or authority seeks material outside the remand directions, state the objection while still supplying the evidence the order permits.
- Request a hearing and speaking order. Ask the authority to address every remand question and explain how each accepted or rejected document was treated.
The cited materials do not establish one universal remand procedure for every court, tribunal, State GST law or case. The specific remand order controls. Obtain professional advice where the order is ambiguous, limits new evidence or sets a short compliance date.
What happens after the fresh order
Read the new order as a new decision. Check which remand directions were followed, which ITC remains disallowed, the communication date, the amount admitted and any new computation. The GST Portal FAQ lists orders against remanded cases among demand orders for which an appeal option is available. Confirm that the resulting order is appealable, then calculate the applicable deadline and payment requirements afresh; an earlier appeal does not automatically preserve a later appeal deadline.

Rectification does not automatically stop the appeal clock
Section 161 rectification may address an apparent clerical or computational error. Filing rectification should not be treated as an automatic suspension of the section 107 limitation period. Calendar and protect the appeal deadline unless a competent authority or binding law clearly provides otherwise.
A February 2026 government compilation summarizes a Punjab and Haryana High Court ruling in which time spent bona fide pursuing rectification was excluded on the facts before that court. That is a reported, case-specific position, not a universal guarantee. Read the full judgment and governing jurisdictional law before relying on an exclusion. The compilation is available at Telangana Commercial Taxes Department compilation, February 2026.

Further appeal to GSTAT: check the live position
Section 112 provides a further appeal to the GST Appellate Tribunal from specified section 107 or 108 orders. Its commencement and deadline language has been tied to notified dates and subject to extensions. The GSTAT homepage notice referred to a 31 July 2026 extended last date; that date had passed by 13 October 2026 and is not a current future deadline.
Before relying on any tribunal filing date, check the live GSTAT portal, the latest notification and the section 112 text at CGST Act section 112. Confirm whether the tribunal is accepting the relevant category of appeal, what order date qualifies, the prescribed form, fees, pre-deposit and condonation rules, and how a remanded matter is classified.
Common mistakes and how to correct them
Using the order date instead of the communication date
Problem: The taxpayer counts from the signature date printed on the order even though it was communicated later, or cannot prove when it was received.
Correction: Preserve the portal, email and download evidence, state the communication date in the appeal and calendar both the ordinary three-month period and the possible one-month condonation window.
Calculating 10% of the whole demand
Problem: Interest, penalty, fine, fee and admitted tax are mixed with disputed tax.
Correction: Attach a component-wise computation that ties every figure to the order and verify the current statutory cap and payment route.
Appealing with only a portal reconciliation
Problem: The submission shows that two return totals differ but does not prove receipt, business use, payment or the correct invoice.

- Helpful in various ways
Correction: Add transaction records and supplier communications that answer the particular rejection ground, then map each item to an exhibit.
Requesting a remand from the first Appellate Authority
Problem: The prayer asks for the case to be sent back even though section 107(11) bars that referral.
Correction: Seek confirmation, modification or annulment on the evidence and request a reasoned order under section 107(12). Preserve a legal objection if the authority nevertheless attempts an impermissible remand.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteAssuming a rectification application preserves limitation
Problem: The taxpayer waits for a rectification decision and files the appeal late.
Correction: File the appeal within section 107 time unless a clearly applicable rule or binding order supports another calculation; mention the rectification separately.
Treating an old GSTAT notice as current
Problem: A published extension date is copied into a new filing plan after it has expired.
Correction: Check the live tribunal portal and current notifications on the day of filing.
