Use a game file you created or one the rights holder expressly authorizes you to download and use. For commercial games, get digital copies through the publisher’s authorized sales or distribution channels. Then follow the instructions for your exact handheld and firmware to transfer a compatible file. Owning a cartridge, finding a game on a ROM site, or buying a device with games preloaded does not by itself establish that the copy is authorized.
The practical order is simple: check permission first, confirm your device supports the file second, and only then prepare storage and transfer it. These are separate checks. A file that is compatible is not necessarily authorized, and an authorized file may still need a supported format or specific folder to work.
Choose a game source that grants permission
“Legal” depends on the rights in the game and the way you obtain and use its files. A practical first check is whether the rights holder clearly authorizes the download and your intended use. The age of a game, its absence from current stores, or a file-sharing site’s description is not proof that it is free to copy.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsStart by identifying who controls the game’s rights and what the offered license actually permits. Permission to download and play does not automatically mean permission to modify, upload, redistribute, or sell the file. If the creator or publisher states conditions, read them before downloading; if the permission is ambiguous, do not treat silence as consent.

| Source | What to check | What it does not establish |
|---|---|---|
| Homebrew or other independently created games | Read the creator’s license or permission terms. Confirm that they allow downloading and use on your device. | That every game labeled “homebrew” has the same license, or that permission to download includes permission to redistribute or modify it. |
| Commercial games from an authorized channel | Use a sales or distribution channel authorized by the publisher or rights holder, and follow its terms. | That a copy offered by an unrelated file host is authorized just because the game is old or hard to buy. |
| Files from an unlicensed ROM repository or peer-to-peer network | Do not assume the uploader has distribution rights or that the download is permitted. | That the file is lawful because the site calls it a backup, abandonware, or a copy for people who own the cartridge. |
Nintendo’s U.S. Intellectual Property & Piracy FAQ says that Nintendo games shared through peer-to-peer networks or third-party file hosts are unauthorized copies, and identifies the Nintendo eShop and Nintendo website as online sources for authentic Nintendo games. Nintendo states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” That is Nintendo’s statement about Nintendo games; it is not a universal legal ruling for every publisher or country.
For Nintendo games, the company’s FAQ provides a clear example of why a download source matters: a third-party file host does not become an authorized distributor simply because it offers a familiar title. For another publisher’s game, check that publisher’s own authorized sales or distribution channels and terms. Do not rely on a site’s assertion that a file is safe, archival, or intended only for owners unless the rights holder has actually granted the relevant permission.
Do not assume a cartridge gives you a right to download a ROM
Owning a physical game and downloading a separate copy are different acts. The sources available here do not establish a universal right to download a ROM, create a digital dump, or use a copy on another device just because you own the cartridge. Rules for personal copying vary by jurisdiction and may depend on the title and method, including whether access controls are bypassed.

This is why “I own the original” is not a complete answer to the question of whether a separate file may be downloaded or made. A physical cartridge is evidence that you own that object; it does not, by itself, demonstrate that a ROM site has authority to distribute a copy or that every method of making a copy is permitted. Keep the source and method in view rather than treating cartridge ownership as a universal exception.
The U.S. Copyright Office’s 37 CFR 201.40 page describes particular, limited, time-limited exemptions to the U.S. prohibition on circumvention. Those categories are not blanket permission for consumers to dump any cartridge, bypass any protection, or download a game they own. They do not provide a general authorization to copy any title by any method. A definite answer about a particular copy would require the jurisdiction, game, and copying method.

Nintendo’s FAQ is a company statement about Nintendo’s intellectual property, while 37 CFR 201.40 is a U.S.-specific regulation addressing defined circumvention exemptions. Neither should be stretched into a single worldwide rule for all games. If you need a definite conclusion about a personal copy, the important details include where you are, which title is involved, whether you are downloading an existing file or making a copy, and whether the method bypasses an access control.
Keep emulator legality separate from game-file rights
An emulator is software that runs or imitates a game system; a game file is a separate work. The fact that an emulator runs on a handheld does not grant permission to obtain or use a copyrighted game file with it. Likewise, the legality of a particular game file does not by itself answer whether the device supports it or whether any required system files are authorized.
Think of this as two questions, not one: may you use the emulator software, and do you have permission to obtain and use the particular game file? A device may advertise compatibility with a system, but that is a technical capability, not permission to download that system’s commercial games. Similarly, finding an authorized game file does not guarantee that the installed emulator can run it.
Nintendo describes circumvention products as devices or software that bypass security measures to enable unauthorized copying, modification, or play, and says that using them with unauthorized Nintendo copies is unlawful. Treat that as Nintendo’s position about its games and protections, rather than as a rule that every emulator is illegal. Do not treat circumvention as a routine way to make a game file available for a handheld.
Verify that the file is compatible with your specific handheld
Permission and compatibility are separate checks. A file can be authorized but still fail to run if the handheld’s installed emulator does not support its system or format, if it is in the wrong directory, or if the device requires setup the file does not provide.

- The supported removable-card type and capacity, if the device uses a card. Do not assume that a handheld accepts every microSD or TF card size.
- Whether the card needs a particular format and whether first-time setup creates the required folders. Formatting can erase existing card contents, so preserve files you need before following a format instruction.
- Which game systems and file formats the installed software supports. A device’s broad system list is not a promise that every game, revision, or file type will work.
- Whether a system BIOS or other additional file is required, and whether the device maker or rights holder provides an authorized source. A technical requirement does not grant permission to obtain that file from an unverified download.
- Where game files belong, and whether the device needs a rescan, import step, or restart to recognize them.
For a concrete but model-specific example, Anbernic’s RG35XX H product specifications list 64GB TF/MicroSD storage and TF-card expansion up to 512GB. They also list supported systems and user downloads in relevant formats. Those are specifications for the RG35XX H, not universal requirements for retro handhelds; check current documentation for your own model before choosing a card or organizing files.
If your handheld supports removable storage, a compatible microSD or TF card may be a useful accessory for moving authorized files. Verify the actual card type, supported capacity, and setup instructions for your model before buying one. The card is storage only: it does not make the games on it licensed or authorized.
Transfer an authorized file to the handheld
The exact menus and folders differ by device and firmware, so use this general sequence alongside the manufacturer’s instructions rather than treating a folder name or format as universal.
- Identify the device and firmware. Find the model name and firmware version in the device’s system information or documentation. Locate its instructions for storage setup and adding games. Steps for a different model may use a different card layout or menu.
- Confirm the file’s permission and origin. Keep the license or authorized-store information available. Do not use a file merely because it is described as a backup or appears in a preloaded collection. If the license limits use, follow those conditions.
- Check the supported system and format. Compare the game’s system and file format with the list for your installed software. If the manual says a BIOS or other system file is required, use only a source that is authorized to distribute it.
- Prepare storage as directed. If the device uses removable storage, verify the card type, capacity limit, and formatting instructions first. Avoid reformatting a card that contains files you need unless you have backed them up. Use the manufacturer’s setup procedure if it creates folders or configures the card.
- Copy the file to the specified location. Follow the model’s directory layout or import procedure. Do not assume that a folder name from another handheld applies to yours. If the manual calls for an import menu rather than a direct copy, use that process.
- Safely eject and let the device update its library. Eject the card through the computer’s normal controls, return it to the handheld, and follow the manual’s instructions to rescan, import, or restart if required. Do not remove a card while files are being written.
- Check the result without changing the source file’s status. If the game does not appear or run, troubleshoot compatibility and setup using the device documentation. A successful transfer does not change whether the file was authorized.
That sequence deliberately avoids prescribing a universal folder name, card format, or BIOS download location. Those details depend on the model and firmware. The safest next step when a game is missing is to check the device’s supported formats and library-refresh instructions, not to assume that an unauthorized copy will solve a setup problem.

Be cautious with handhelds sold with games preloaded
A seller’s claim that a large preloaded library is included, or that the files are “free,” is not proof that the seller has permission to distribute them. Nintendo specifically warns that unauthorized preinstalled copies of its games on look-alike retro devices infringe its rights. That statement concerns Nintendo games; for other titles, check the relevant rights holder’s authorization rather than assuming a bundled card is legitimate.
Separate the device purchase from the game files: verify the files’ rights independently, and do not upload or redistribute copies unless you have permission to do so. A memory card provides storage, not a license. The fact that a seller has already copied files onto a card, or that a device boots directly into a game menu, does not establish the rights behind those files.
Before relying on a bundled collection, ask what titles are included and who authorized their distribution. If the seller cannot point to clear authorization, do not treat the bundle as permission. This caution does not mean that every device sold with software is unlawful; it means the seller’s marketing claim alone is not proof that a particular game file is authorized.
What to do when the answer is unclear
- The game is old or unavailable for purchase: Treat that as an availability issue, not proof that copyright has ended or that downloads are permitted. Look for an explicit license or rights-holder authorization.
- You own the cartridge and want a digital copy: Do not assume ownership settles the question. The answer depends on jurisdiction, the particular game, and the copying method.
- A download page says “abandonware” or “backup”: Look for actual permission from the rights holder. A site’s label alone does not establish it.
- The device asks for a BIOS or other system file: Check the exact device documentation for the requirement and an authorized source. Do not assume that the game download or emulator includes permission to obtain one.
- The game does not appear after transfer: Recheck the supported format, folder or import procedure, card setup, and rescan instructions for your exact firmware. Do not solve a compatibility problem by downloading a different copy from an unverified source.
- You are unsure whether a method is permitted where you live: Do not infer a worldwide answer from a U.S. rule or a publisher’s statement. The jurisdiction and details of the method matter; seek jurisdiction-specific guidance if you need a definite legal answer.
When in doubt, choose the route with clear permission: a creator’s expressly licensed homebrew release or a commercial download from an authorized publisher channel. Then match the file to the handheld using that model’s official setup instructions.
Frequently Asked Questions
Where can I find legal games for a retro handheld?
Look for homebrew or independently created games with an explicit license that permits your intended use, or use a commercial game offered through a publisher- or rights-holder-authorized channel. For Nintendo games, Nintendo identifies its eShop and website as sources for authentic games. A third-party file host’s label is not proof of permission.

Can I download a ROM if I own the cartridge?
Do not assume that cartridge ownership gives you a universal right to download a separate ROM, create a digital dump, or use a copy on another device. The answer can depend on jurisdiction, the game, and the copying method, including whether access controls are bypassed.
Are emulators illegal?
The legality of an emulator program and the rights in the game file used with it are separate questions. Running an emulator does not by itself authorize a copyrighted game download. Nintendo’s statements about circumvention and unauthorized Nintendo copies should not be generalized into a claim that every emulator is illegal.
Is a game legal to download if it is old or labeled abandonware?
Not on that basis alone. Age, lack of current sales, or an “abandonware” or “backup” label does not establish that copyright has ended or that the uploader has permission. Look for an explicit license or authorization from the rights holder.
Can I trust a handheld that comes with games preloaded?
A preloaded library or seller claim is not proof of authorization. Nintendo specifically warns about unauthorized preinstalled copies of its games on look-alike retro devices. Verify the rights for the games independently; a memory card is storage, not a license.
What should I check before copying an authorized game to my handheld?
Use the exact model and firmware documentation to confirm supported card type and capacity, required formatting, supported systems and formats, any required BIOS or other files and their authorized source, and the correct folder or import and rescan procedure. Compatibility does not establish permission, and permission does not guarantee compatibility.
Does every retro handheld use the same microSD card size and folders?
No. Requirements vary by model and firmware. For example, Anbernic lists 64GB TF/MicroSD storage and TF-card expansion up to 512GB for the RG35XX H; those figures are not general requirements. Check your own device’s current specifications before buying or formatting a card.
The Bottom Line
Use only games you created or files the rights holder expressly authorizes you to download and use. Cartridge ownership, an emulator, an old release, or a preloaded card does not by itself grant permission. Once the source is authorized, follow the exact handheld and firmware instructions for storage, format, folders, and library refresh; legality and compatibility are separate checks.
