The GST Council is a constitutional forum where the Union and States coordinate goods and services tax policy. It generally seeks consensus; if a proposal goes to a vote, the Union has one-third of the weighted votes and the States together have two-thirds, and at least three-fourths of weighted votes cast by members present and voting must support it. The Council makes recommendations, not legislation: the Supreme Court held in 2022 that those recommendations are persuasive rather than binding. The Constitution also directs the Council to establish a mechanism for specified Centre–State and inter-State disputes, while the Supreme Court has a separate, limited original jurisdiction over qualifying Union–State disputes.
What is the GST Council, and what does it decide?
The GST Council is a constitutional joint forum of the Union and the States, established under Article 279A of the Constitution of India. Its membership comprises the Union Finance Minister, the Union minister of state responsible for revenue or finance, and a minister nominated by each State Government. Its role is to make recommendations on GST policy to the Union and the States.
The Council’s remit covers core design and coordination questions: which goods and services may be taxed or exempted, model GST laws, principles for levying GST, place-of-supply principles, thresholds, the rate structure, special rates during a natural disaster or calamity, and special provisions for certain States. These are subjects on which coordinated policy matters because the Union and State governments both have roles in the GST system.

The Council is not itself a legislature that enacts every GST rule. A recommendation is the Council’s policy advice within the constitutional framework; a law or other government action must come from the appropriate Union or State authority. That distinction is essential to understanding both what a Council decision accomplishes and why a recommendation can influence policy without automatically binding governments.

How does the GST Council make decisions?
Consensus is the usual approach
The Council’s official description says it generally follows a consensus-based approach. In practical terms, consensus is the preferred way to reach agreement among the Union and State representatives. The constitutional voting formula remains available if a proposal is put to a formal vote; a consensus-oriented practice does not replace or lower that threshold.
Consensus and voting are therefore different stages or modes of decision-making, not competing descriptions of the legal rule. When members reach agreement without a recorded vote, the Council has arrived at a recommendation by consensus. If the proposal is put to a vote, Article 279A(9) determines how the votes are weighted and what level of support is required.
The formal vote is weighted, not one-government-one-vote
Under Article 279A(9), the Union Government has one-third of the weighted votes cast, while all State Governments together have two-thirds. A proposal passes only if it receives at least three-fourths of the weighted votes of members present and voting. These fractions are constitutional rules, not a count of how many individual ministers raise their hands.

| Element | Constitutional rule | What it means |
|---|---|---|
| Union’s share | One-third of weighted votes cast | The Union’s vote carries a defined collective weight in the Council. |
| States’ combined share | Two-thirds of weighted votes cast | State votes are taken together for the weighted calculation. |
| Passage threshold | At least three-fourths of weighted votes of members present and voting | A simple majority is not enough; the proposal needs the constitutionally specified supermajority. |
The arithmetic creates an important limit on what States can do through a formal vote. Even if the States unanimously support a proposal, their combined weight is only two-thirds, below the three-fourths threshold. So, under the stated weighting, a proposal cannot pass without Union support. This is a mathematical consequence of the constitutional fractions, not a claim about a particular Council meeting or vote.
The Constitution’s threshold applies to weighted votes of members present and voting. It should not be simplified to “three-quarters of States,” nor treated as a conventional headcount. The constitutional text and the Council’s official materials set out the weights and the threshold; the Council has also published an agenda note describing a division procedure and a worked voting illustration.
Can the Centre or a State block a GST Council decision?
The answer depends on what “block” means. In the formal voting fallback, the Union’s one-third weight means it can prevent a proposal from reaching three-fourths support: unanimous State backing alone cannot pass it. The rule does not give any single State a comparable veto on the basis of the facts set out in Article 279A(9), because all States collectively hold two-thirds of the weighted votes.

That does not mean a formal vote is the Council’s only way to reach agreement, or that the voting rule itself tells the whole story of negotiations. The official account describes consensus as the general approach. The constitutional fractions explain the result if a vote occurs; they do not establish how members will negotiate a particular proposal or whether a particular proposal will be put to a vote.
Nor should “block a Council decision” be confused with blocking a law. The Council makes recommendations. Its voting rule governs how the Council reaches a recommendation when a proposal is put to a vote; it is not itself a rule that converts every recommendation into legislation or prevents a legislature from exercising its own constitutional authority.
Are GST Council recommendations binding on the Union and States?
No. In Union of India v. M/S Mohit Minerals Pvt. Ltd., decided on 19 May 2022, the Supreme Court held that GST Council recommendations are not binding on the Union or the States. The Court described them as having persuasive value, connecting that interpretation with cooperative federalism and the fact that Parliament and State legislatures have simultaneous GST legislative powers.

In paragraph 148(i)(a), the Court explained: “The deletion of Article 279B and the inclusion of Article 279(1) by the Constitution Amendment Act 2016 indicates that the Parliament intended for the recommendations of the GST Council to only have a persuasive value, particularly when interpreted along with the objective of the GST regime to foster cooperative federalism and harmony between the constituent units;”
“Persuasive” does not mean inconsequential. The Council is a constitutional institution intended to coordinate GST policy across the Union and States. Its recommendations can guide that coordination and may underpin later legislation or executive action. The legal distinction is that a Council recommendation is not, by itself, binding legislation: the governments and legislatures retain authority within the constitutional scheme.
Recommendation, law, and action are distinct
| Step or instrument | Role | Legal significance |
|---|---|---|
| GST Council recommendation | Coordinates policy advice on matters within the Council’s remit. | Persuasive, not binding on the Union and States, as held in Mohit Minerals. |
| Union or State legislation | Enacts a legal rule through the relevant legislature. | Exercises the legislative authority preserved within the constitutional framework. |
| Government action | Implements a policy through the appropriate authority and instrument. | Must be distinguished from the Council’s recommendation itself. |
This distinction helps answer a common follow-up: a Council recommendation may be widely followed because coordination is the point of the institution, but its practical influence should not be misstated as a rule that the recommendation automatically binds every government.

How does the Constitution address Centre–State GST disputes?
Article 279A(11) directs the GST Council to establish a mechanism to adjudicate specified disputes. The clause covers disputes arising out of the Council’s recommendations or their implementation. It identifies disputes between the Union and one or more States; between the Union and some States on one side and one or more other States on the other; and between two or more States.
The constitutional clause establishes a mandate for a dispute mechanism, but it does not, by itself, tell a reader the mechanism’s current membership, filing process, procedure, or case history. Those operational details should not be inferred from the mandate alone. The existence of the constitutional direction and the present-day operation of a particular process are separate questions.
How is the Article 279A(11) mechanism different from the Supreme Court’s jurisdiction?
The Supreme Court separately describes its exclusive original jurisdiction over qualifying disputes between the Union and States. For that jurisdiction to apply, the dispute must involve a question—of law or fact—on which the existence or extent of a legal right depends. Whether a particular disagreement qualifies depends on the nature of the dispute and the legal rights at issue.

This jurisdiction should not be presented as automatically displacing or replacing the mechanism contemplated by Article 279A(11). The Constitution provides the Council with a mandate to establish a mechanism for the specified recommendation- or implementation-related disputes; the Court’s original jurisdiction is a separate constitutional route for qualifying Union–State disputes. The available descriptions do not establish how these routes interact in every possible case, so it is safer to distinguish them than to claim that one always takes precedence.
| Route | What the constitutional description establishes | What should not be assumed |
|---|---|---|
| Article 279A(11) | The Council is directed to establish an adjudication mechanism for listed intergovernmental disputes arising from Council recommendations or their implementation. | Its current composition, procedure, filing requirements, and operational history are not specified by the clause alone. |
| Supreme Court original jurisdiction | The Court has exclusive original jurisdiction over qualifying Union–State disputes involving a question on which a legal right’s existence or extent depends. | It is not established that this jurisdiction automatically replaces the Article 279A(11) mechanism or applies to every GST disagreement. |
How to read a GST Council decision in practice
When a Council outcome is reported, separate three questions that are often collapsed into one:
- What did the Council recommend? Identify the policy subject—such as rates, exemptions, thresholds, model laws, or place-of-supply principles—and distinguish the recommendation from any later government action.
- How was the outcome reached? The Council generally uses consensus. If a proposal was put to a vote, assess it under the one-third Union and two-thirds collective State weighting and the three-fourths threshold for members present and voting.
- What makes the outcome legally operative? A Council recommendation is persuasive rather than binding under Mohit Minerals. Look separately to the relevant Union or State law or action rather than treating the recommendation alone as enacted law.
- What kind of dispute has arisen? If it concerns a recommendation or its implementation between the Union and States, or among States, Article 279A(11) is relevant. A claim that the Supreme Court can hear it requires the separate jurisdictional question: does it qualify as a Union–State dispute involving a question on which a legal right depends?
This framework avoids two opposite errors: treating the Council as if it directly enacts every GST rule, and treating its recommendations as merely informal suggestions with no institutional significance. The constitutional design combines coordinated recommendations with legislative authority retained by the Union and the States.
