No. GDPR compliance is essential when an AI workflow processes personal data, but it does not establish that a tax practice meets the separate requirements of the EU AI Act. The two frameworks work alongside one another: assess each system and use, the data it handles, the practice’s role, and the obligations that apply.
Why GDPR alone does not settle AI readiness
GDPR governs the processing of personal data, including personal data handled during an AI system’s development or use. The European Data Protection Board (EDPB) says Union data-protection law remains fully applicable across an AI system’s lifecycle and describes data-protection law and the AI Act as complementary and mutually reinforcing. See the EDPB Statement 3/2024 and its Opinion 28/2024 on personal-data processing in the context of AI models.
The AI Act is a separate framework for AI systems and the people and organisations operating them. It includes requirements for high-risk systems and transparency duties. Which rules apply depends on the system, its intended use, the organisation’s role, and the relevant provision—not simply on whether a tax adviser has satisfied GDPR obligations. The consolidated AI Act text sets out the scope and operator framework.

Start with the specific AI use, not the label “AI”
Client intake, document handling, research, drafting, and workflow automation are examples of possible tax-practice uses, not legal categories established by the EU-level sources cited here. A task’s label alone does not determine its AI Act classification. Record what the system does and how it is used, then assess the relevant rules.
For each use, capture:
- System and purpose: Which system is involved, what is it intended to do, and where does it fit into the client workflow?
- People and roles: Who selects, configures, supplies, uses, or operates it? Assess the practice’s role under the AI Act independently of its GDPR role.
- Data: Does the workflow process personal data? What categories are involved, for what purposes, and for how long are they retained?
- Consequences and controls: What could happen if an output is wrong, incomplete, or misunderstood? Who checks it, and who can intervene?
- Vendor and changes: What does the provider say about data handling, and how will the practice learn about system or service changes that could affect its assessment?
This inventory is a practical way to organise the assessment, not an official tax-adviser checklist or a substitute for determining the law that applies.

Check GDPR duties for personal-data processing
Where an AI workflow processes personal data, the practice should be able to explain the purposes and categories of data, identify its legal basis, tell affected people what is required, and set appropriate retention practices. The European Commission’s GDPR obligations guidance explains information duties and data protection impact assessments.
Decide whether a DPIA is required
A data protection impact assessment (DPIA) is required when processing is likely to result in a high risk to people’s rights and freedoms. The Commission gives examples including systematic and extensive evaluation of personal aspects through automated processing and large-scale processing of sensitive data. These examples do not mean every AI use requires a DPIA.

- SWISS ENGINEERED DESIGN: Built by Cryptnox as a single card for authentication and access control and backed by a 2 year warranty
If the assessment shows a DPIA is required, carry it out before processing begins. Treat it as a living tool: revisit it when the purpose, data, system, or workflow changes in a way that affects the risks. A DPIA addresses the data-protection assessment; it does not, on its own, establish compliance with the AI Act.
Assess the AI Act separately
For each system and use, determine whether the practice is acting as a provider, deployer, or another operator, then identify the provisions that apply. GDPR roles can be relevant to data-protection responsibilities, but they do not answer every AI Act question. Requirements depend on the system and the specific circumstances of its use.

Check whether transparency rules apply
The European Commission’s 20 July 2026 announcement says transparency obligations under the AI Act began applying on 2 August 2026. It describes Article 50 guidance for providers and deployers of certain systems. Do not infer that Article 50 applies to every AI tool or every interaction: check the provision and guidance against the particular system and use.

Check the applicable date for each requirement
The AI Act entered into force on 1 August 2024, but its provisions have phased application. The Commission reports that some high-risk-system requirements apply from December 2027; that does not mean every high-risk requirement, or every AI Act obligation, starts on that date. Use the relevant transitional rule and the system’s category to determine the date that matters. The Commission’s AI Pact and AI Act timeline page summarizes implementation timing.

Make AI literacy and ownership operational
Staff capability is part of organisational readiness, not a box to tick by buying a tool. The Commission’s AI literacy guidance describes measures for providers and deployers to support relevant staff and others using or operating systems on their behalf. It says the measures should take account of people’s knowledge, experience, education, training, and the context in which the system is used.
For a tax practice, translate that principle into role-specific expectations: people should know what a system is intended to do, what its output can and cannot establish, when to verify it, and how to raise concerns. Assign an owner for deciding whether to use a system, monitoring changes, handling incidents and data-subject requests, and reviewing whether the tool remains appropriate. These are practical governance measures drawn from the frameworks’ duties, not a regulator-issued checklist for tax advisers.
Use a repeatable review for each workflow
- Describe the use: Record the system, purpose, users, workflow stage, and the output people rely on.
- Map personal data: Identify data categories, purposes, legal basis, information provided to individuals, and retention. If the processing may create high risk, assess and complete a DPIA before it begins.
- Determine AI Act roles and rules: Establish the practice’s role for that system and use, then check the system category and applicable provisions, including any transparency duty.
- Set human and staff controls: Decide who reviews consequential outputs, what they must verify, and what training and escalation route they need.
- Assign ongoing responsibility: Name who monitors system changes, incidents, requests, and whether the use remains suitable; update the assessment when the workflow changes.
This sequence is an editorial discussion guide, not an official scoring system or assurance of compliance. A checklist or governance product cannot determine the practice’s legal duties without an assessment of its actual system, purpose, data, role, and context.

What this EU-level guidance cannot decide for a practice
The EU framework does not, by itself, establish a tax-adviser-specific AI Act category or a single checklist for every tax workflow. The sources discussed here also do not settle national professional rules. A practice should verify the current consolidated law and relevant guidance, then check the rules of the Member State where it operates and the facts of the particular use.
