Severance normally counts as earnings for Canadian Employment Insurance (EI) and is allocated from the week your job ends, which can postpone when benefits become payable. However, a temporary federal measure applies when a claim or severance allocation starts from March 30, 2025 through October 9, 2027: separation earnings are not deducted from EI, and the waiting period is generally waived for new claims.
This article reflects the rules in force on October 16, 2026. Your result still depends on the payment’s terms, your separation date, normal weekly earnings, claim dates and the reason your employment ended.
How the ordinary EI rule treats severance
Under the permanent rules, severance paid because employment ended is EI earnings. The Employment Insurance earnings chart lists severance under sections 35(2) and 36(9) of the EI Regulations. Service Canada normally allocates it beginning in the week of lay-off or separation, using your normal weekly earnings for that employment and taking other relevant earnings into account. See the Employment Insurance earnings chart and Employment Insurance and the various types of earnings.

- the effective start of an EI claim;
- the week in which the waiting period is served;
- the first week for which EI is payable;
- the amount payable in particular weeks; or
- the date on which the benefit period ends.
Severance therefore does not automatically cancel EI, and it does not produce one universal delay. Service Canada must apply the allocation to your specific employment history and claim.
Payments commonly treated as separation earnings
| Payment | Ordinary EI treatment | What determines the result |
|---|---|---|
| Severance pay | Normally earnings allocated from the separation week | Amount, normal weekly earnings, payment terms and separation date |
| Pay in lieu of notice | Normally separation earnings allocated under the same framework | Whether it represents notice, another entitlement or a different payment |
| Vacation pay paid on separation | Normally included among separation earnings | When it is payable and the terms of the employment ending |
| Closure or lay-off bonus | May be treated as separation earnings | The reason, payer, terms and purpose of the bonus |
| Sick-leave credits or another settlement amount | Requires an individual assessment | Service Canada examines the payment’s true nature |
The table describes the ordinary framework. A temporary measure can suspend the deduction for qualifying claim or allocation dates, as explained below.
The temporary measure currently changes the deduction
For a claim or an allocation that starts between March 30, 2025 and October 9, 2027, separation earnings are not deducted from EI benefits. Employment and Social Development Canada states: Under the temporary measure, if your claim or the allocation starts between March 30, 2025, and October 9, 2027, earnings from separation are not deducted from your benefits.
This wording appears on the official Temporary Employment Insurance measures page.

The measure lists vacation pay, pay in lieu of notice, severance pay, closure bonuses and sick-leave credits among the separation earnings covered by the suspension. The relevant test is the date the claim or allocation starts, not merely the date your employer issued a cheque.

Waiting-period treatment
For new EI claims starting from March 30, 2025 through October 9, 2027, the normal one-week waiting period is waived. The notice says a claimant may choose to serve the waiting period when doing so is advantageous because a Supplemental Unemployment Benefit (SUB) plan provides a top-up. That exception concerns the waiting-period choice; it does not restore an ordinary severance deduction during the temporary window.
Dates at the edges of the window
A claim or allocation that starts before March 30, 2025 or after October 9, 2027 is outside this temporary deduction rule unless a later government measure changes the dates. Claims near either boundary require the actual allocation start date, so keep the employer’s payment statement and Service Canada’s determination.
Severance treatment and EI eligibility are separate questions
Whether a payment is allocated as earnings is different from whether you qualify for EI. Eligibility also depends on your insurable employment, required hours, availability for work and the circumstances in which the job ended. A severance payment alone neither proves misconduct nor guarantees approval.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsThere is a separate temporary rule for the reason for separation. For claims starting October 11, 2026 through October 9, 2027, the assessment uses only the most recent reason for separation. If that most recent job ended through no fault of the claimant, qualifying-period insurable employment and hours are used to establish the claim. This rule addresses the separation reason and qualifying employment; it is not a rule about whether severance is deducted.

How Service Canada assesses and how you must report the payment
You are responsible for reporting income, benefits and self-employment activity to Service Canada. Report severance even when you believe the temporary measure applies. Reporting allows the department to classify the payment and apply the correct date rule rather than relying on an incomplete record.
Service Canada determines the payment’s true nature by considering:
- the amount and type of payment;
- who paid it;
- why it was paid and the exact terms;
- where the money came from; and
- where it is going or what obligation it satisfies.
For allocation purposes, earnings are considered paid when you receive them and accept them, or when they are expected shortly. They are considered payable when the payer is required to pay and you can legally demand immediate payment. The distinction can matter when an employer promises installments, a settlement is signed, or a payment is disputed. The definitions and reporting obligations are set out in Employment Insurance and the various types of earnings.
Worked example of the ordinary allocation
Service Canada’s published illustration uses employment ending on October 10, 2025, normal salary of $800 per week, $800 in vacation pay and $2,400 in severance. Under the ordinary allocation shown in that example, wages and separation payments are apportioned across weeks beginning with the separation week. The example identifies November 9–15, 2025 as the waiting-period week and shows benefits payable beginning November 16–22, 2025.

This is an explanation of the ordinary mechanics, not a forecast for a claim covered by the temporary measure. A claimant with the same payment but a claim or allocation starting inside the temporary window could have a different result because the listed separation earnings are not deducted there. Read the complete example in Service Canada’s earnings guidance.
How to work out which rule applies to your claim
- Record the separation facts. Write down your last day worked, the employer’s stated separation date and whether the job ended through no fault of your own.
- Identify every payment. Separate severance, pay in lieu of notice, vacation pay, bonuses, sick-leave credits, pension-related amounts and any settlement payment. Keep the letter or agreement that describes each item.
- Record timing. Note when each amount was paid, when it became legally payable and the date your EI claim or an allocation would start.
- Establish your normal weekly earnings. Service Canada uses the normal weekly earnings for the employment when applying the ordinary allocation; include information about other relevant earnings.
- Check the temporary window. Compare the claim or allocation start date with March 30, 2025–October 9, 2027. If it falls in that range, check the no-deduction and waiting-period provisions rather than assuming the permanent allocation applies.
- Report and keep records. Give Service Canada the payment type, amount, payer, reason and terms. Retain the Record of Employment, settlement documents, pay stubs and correspondence in case the classification or dates need correction.
This checklist can organize the facts, but it cannot replace an individual determination. The amount of a lump sum, installment wording, overlapping earnings and a disputed termination can all change the result.
How much EI could be payable after the severance issue is resolved?
The severance rule determines whether separation earnings affect timing or payment; it does not set the weekly EI rate. For regular benefits, most recipients receive 55% of average insurable weekly earnings, subject to the annual maximum. For 2026, Employment and Social Development Canada lists maximum yearly insurable earnings of $68,900 and a maximum regular benefit of $729 per week. These are rate limits, not the amount of severance and not a guarantee that an individual claimant will receive the maximum. Details are on EI regular benefits: How much could you receive.

Common mistakes and boundary cases
Assuming a lump sum always creates a delay
That assumption ignores the temporary window. First determine whether the claim or allocation starts within the stated dates; only then apply the ordinary allocation analysis.

Reporting only the net deposit
Taxes, legal fees or deductions do not by themselves describe the payment’s EI nature. Report the gross amount and the agreement’s terms so Service Canada can assess what the payment represents.
Using the cheque date as the only date
A payment may be payable before it is received, or paid in installments. Service Canada considers both concepts, so provide the contractual due date and actual receipt date.
Confusing a reason-for-separation rule with an earnings rule
The October 11, 2026–October 9, 2027 provision about using the most recent separation reason does not decide whether severance is earnings. Treat eligibility and allocation as separate questions.
Relying on an old article
The temporary measures have explicit end dates. Recheck the current government notice when a claim is close to March 30, 2025, October 9, 2027 or October 11, 2026, because a date-bound exception can change the outcome.
