Publishers can license content to AI companies in three ways: negotiate a direct agreement, use a collective licensing service, or publish machine-readable terms for crawlers and agents. The right choice depends on who controls the rights, whether the use is model training, fine-tuning, retrieval-augmented generation (RAG), AI search or another product feature, and how much control and reporting the publisher needs.
There is no universal price or standard “AI rights” grant. Before discussing money, identify the content and rights you can grant, separate each permitted use, and specify scope, duration, territory, attribution, reporting, payment, security, sublicensing and termination in writing.
Choose the licensing route that fits your content and leverage
A small publisher with a clearly defined archive may be able to negotiate directly with an AI developer. A publisher that wants pooled administration can investigate a collective licence. A website that mainly needs to communicate crawler permissions can publish machine-readable terms such as the Really Simple Licensing (RSL) standard. These routes can coexist; a direct contract can cover an archive while a site-wide policy communicates rules for other access.
Direct licensing with an AI developer
In a direct deal, the publisher grants an AI company access to a specified archive, feed or future content for named purposes. Commercial text-and-data-mining (TDM) licensing existed before generative AI, and the Publishers Association’s March 2026 report says the first AI-training licences appeared as early as 2023. The report found that most responding publishers that made a first AI deal did so in 2024.

Reported deals have included model training, fine-tuning, RAG and the use of other publishers’ content inside proprietary products. Those examples show the range of possible transactions, not a standard package. Deal prices and detailed terms are often confidential, so a publisher should not assume that another organization’s payment, exclusivity or reporting provisions apply to its own negotiation.
Collective licensing
A collective can pool rights and negotiate or administer access for many rights holders. This may reduce the legal and administrative burden for publishers that lack the scale to negotiate separately, but eligibility, repertoire, opt-in rules and payment allocation must be checked carefully.
The Copyright Licensing Agency (CLA) announced work with Publishers’ Licensing Services (PLS) and the Authors’ Licensing and Collecting Society (ALCS) on a Generative AI Training Licence. The announcement described text-based coverage for training, fine-tuning and RAG and targeted a third-quarter 2025 launch. It did not establish that the licence is currently open, which works it covers, or its payment and opt-in terms. Confirm those points with the organizations before treating the service as available or recommending enrollment.

RSL is an open standard for declaring licensing and compensation terms to AI crawlers and agents. Its options include free access, attribution, subscription, pay-per-crawl and pay-per-inference. RSL 1.0 was announced as an official specification on December 10, 2025, with more granular controls for AI-search uses and a contribution option for noncommercial content or data.

The RSL Collective says joining is free and non-exclusive. Its December 2025 announcement reported support from more than 1,500 media organizations, brands and technology companies. That figure represents reported support, not proof that every supporter has implemented the standard or transacts under it. Publishing a policy also does not prove that every AI service will comply or that a site will earn revenue.
Separate the rights instead of granting one vague “AI” permission
“AI use” can describe materially different activities. Treat each as a separate permission, with its own content, payment and controls.
Model training
Training copies or processes content to adjust model parameters. Define whether the licence covers a one-time training run, repeated training, future model versions or all of those. State whether the developer may retain the corpus, intermediate files or derived datasets after the training period.

Fine-tuning
Fine-tuning adapts an existing model to a narrower corpus or task. It may involve a different model, audience and risk profile from general training. Name the model or model family if that matters, and specify whether the fine-tuned system can be offered to third parties.

Retrieval-augmented generation
RAG retrieves passages at query time and supplies them to a model to produce an answer. The Publishers Association reports that RAG licensing is growing and is often usage-based with regular payments. A RAG grant should state which articles can be retrieved, whether full text or snippets are allowed, how often the index is refreshed, and how usage is measured.
AI search and answer features
Search products may crawl pages, create summaries, show attributed extracts or answer questions without a conventional click-through. RSL 1.0 adds controls aimed at AI-search uses. A contract should identify display formats, attribution, links back to the publisher and whether the service may cache or permanently store passages.
Publisher products and other interactive uses
An AI company might embed a publisher’s content in a chatbot, research tool, recommendation engine or another proprietary product. Describe each product and audience, rather than relying on a broad phrase such as “commercial AI purposes.” The Authors Guild’s model language distinguishes training, RAG summaries and other interactive uses and recommends reserving rights that are not expressly granted.
Verify who can grant the rights
Before signing, map ownership and contractual authority for every item in the proposed corpus.

- Identify the rights holder. Separate staff-created work, commissioned material, freelance contributions, photographs, illustrations, databases and licensed third-party material.
- Read author and contributor agreements. Check whether the publisher received an exclusive licence or an all-rights transfer, and whether subsidiary rights include TDM, training, RAG, search and database use.
- Check sublicensing authority. A publisher may not be able to pass a right to an AI company if the original agreement reserves it to the author or prohibits sublicensing.
- Resolve territory and term limits. A contract may grant rights only in a particular country or for a defined period, even if the website is globally accessible.
- Set an income-allocation rule. The Authors Guild notes that, unless the parties agree otherwise, AI-licensing income may be applied against an author’s advance. State how receipts are accounted for, reported and paid.
This review is contract-specific. A general industry practice cannot replace the governing agreement and applicable law for a particular work.
Build a deal brief before negotiating
Give a prospective licensee a precise description of what it may access and do. Use a written schedule or data-room inventory so the scope can be audited later.
- Define the corpus and versions. List domains, publications, books, article IDs, date ranges, formats and language editions. State whether corrections, archives, metadata, comments, images or linked databases are included.
- Name every permitted purpose. Use separate clauses for training, fine-tuning, RAG, AI search, evaluation, safety testing, analytics and use in a named product. If a purpose is not granted, say that it is reserved.
- Set the delivery method. Specify an API, file transfer, feed or crawler access; update frequency; authentication; rate limits; and who bears transfer and storage costs. A live feed is a different commitment from a one-time archive.
- Set duration and territory. State the start and end date, renewal process, countries, language editions and whether the licence covers models or products released after expiry.
- Specify attribution and provenance. Require bylines, publication names, dates, links or other credit where appropriate. Define how provenance metadata travels with extracts and generated answers.
- Define reporting and audit rights. Ask for records of files received, models or indexes using the content, query or inference counts where payment depends on usage, and periodic statements. Set retention periods and a practical audit process.
- Choose the payment basis. Possible structures include a fixed fee, recurring fee, usage-based payment or a combination. Define the measurement unit, reporting period, minimum payment, currency, taxes and payment date. Do not assume an industry rate exists.
- Address derived data and outputs. State who may keep embeddings, indexes, summaries, labels, model weights and evaluation datasets, and whether outputs may reproduce or substitute for the licensed content.
- Set security and retention requirements. Require access controls, encryption or equivalent safeguards, incident notification, deletion procedures and restrictions on onward sharing.
- Control sublicensing. Decide whether affiliates, cloud providers, contractors and downstream customers may access the corpus or resulting system. Require notice, approval or flow-down terms where needed.
- Plan termination. Explain what happens to source files, caches, indexes, embeddings, evaluation sets and trained systems when the licence ends. Include cure periods, suspension rights and treatment of existing user-facing answers.

Understand what the market evidence does and does not show
The Publishers Association’s 2026 member survey reported that ten responding publishers had already agreed one or more licensing deals and that eight additional publishers were expected to enter deals during 2026. The second figure is an association forecast, not a final count. The survey concerns UK book and journal publishers, so it should not be generalized to every publisher, format or geography.

Put web policies into practice without overstating their effect
If you use RSL or another machine-readable policy, publish the policy alongside ordinary access and copyright information, keep the declared terms consistent with your contracts, and maintain a record of policy versions. Decide whether your public terms are free access, attribution, subscription, pay-per-crawl, pay-per-inference or a combination. Explain which content, endpoints and AI-search activities each term covers.
Do not treat a machine-readable declaration as proof of compliance. A crawler may ignore it, interpret it differently or fail to support the standard. For a high-value archive or a use requiring confidentiality, a negotiated agreement with authentication, reporting and remedies provides stronger evidence of the parties’ obligations.
A practical sequence for a publisher
- Inventory rights and content. Create a rights map for each title, contributor and format before contacting an AI company.
- Choose the objective. Decide whether you want archive income, recurring RAG payments, controlled search exposure, a collective administration route or simply a public access policy.
- Prepare a scope sheet. List corpus versions, permitted uses, delivery method, territory, term, attribution and security requirements.
- Set your commercial position. Select a fixed, recurring or usage-based structure and define the metric you can verify.
- Negotiate safeguards. Cover derived data, outputs, sublicensing, audit, deletion and post-termination treatment before discussing a final signature.
- Document contributor accounting. Record how receipts affect advances, royalties or other obligations and how statements will be issued.
- Monitor implementation. Compare reports with delivered files, crawler activity or product behavior, and use the contract’s notice, audit or suspension process when they diverge.
Common mistakes and how to correct them
- Granting “all AI rights” in one sentence. Replace it with separate permissions for training, fine-tuning, RAG, search and interactive products.
- Assuming website accessibility equals permission. A publicly reachable page is not a complete licence. State terms and negotiate where the use is valuable or sensitive.
- Relying on a collective announcement alone. Check current opening status, repertoire, opt-in mechanics, reporting and payment rules before joining.
- Quoting an attractive but unsupported rate. Ask for the measurement method and comparable scope; public evidence does not establish a universal benchmark.
- Ignoring downstream copies. Specify retention and deletion for archives, caches, embeddings, indexes, evaluation sets and trained systems.
- Forgetting contributor economics. Review author contracts and state whether income is credited against advances or paid under another formula.
- Confusing endorsement with implementation. RSL’s reported supporters do not demonstrate that each organization has deployed the standard or that each AI service honors it.
Bottom line
Start with rights ownership and a use-by-use scope. Direct contracts offer the most room to negotiate corpus limits, payment, reporting and remedies; collective licensing may simplify administration when its current terms fit your repertoire; and RSL can communicate web permissions and compensation preferences in a machine-readable form. None supplies a guaranteed price or automatic compliance. A defensible licence is one that names the content, purpose, duration, territory, money, data handling and post-termination obligations clearly enough for the publisher and the AI company to measure and enforce.
