The U.S. Nuclear Regulatory Commission (NRC) licenses commercial nuclear reactors through one of two federal pathways. Under the traditional 10 CFR Part 50 route, a company obtains a construction permit and later a separate operating license. Under 10 CFR Part 52, it seeks a combined license (COL) that authorizes construction and provides conditional authority to operate once the plant passes required inspections, tests, analyses and acceptance criteria (ITAAC). In both pathways, the NRC evaluates reactor safety and environmental effects, and the Atomic Energy Act provides a legally required adjudicatory process.
Who issues a commercial reactor license?
The federal NRC licenses commercial nuclear power reactors in the United States. An applicant must submit enough technical, environmental, financial, antitrust, security, emergency-planning and operational information for the agency to determine whether the proposed facility can be built and operated safely and in compliance with federal requirements.
The NRC process is not a single paperwork approval. It combines a technical safety review, an environmental review and an adjudicatory process in which eligible participants may raise admissible issues. State and local approvals, such as ordinary land-use or water-related permits, may also be required, but they do not replace the NRC license.

Part 52 was established as an alternative licensing process in 1989. Its purpose is to resolve more design and site information before major construction, while Part 50 preserves a more sequential process in which the final operating application can incorporate design development.

How the Part 50 two-step process works
1. Apply for a construction permit
The applicant submits a preliminary safety analysis report describing the preliminary reactor design and safety features. It also files an environmental report addressing the project’s environmental effects and provides required antitrust and financial information. The NRC reviews whether the proposed design assumptions and safety features provide an adequate basis to authorize construction.
A construction permit allows the project to be built within the scope authorized by the permit. It does not by itself authorize commercial operation.
2. Develop and finalize the plant during construction
Because the operating license is a later decision, the Part 50 structure leaves more design flexibility during construction than the COL route. Design changes can be developed and submitted for NRC review as part of the operating-license process. That flexibility does not mean changes are automatically accepted: the NRC must review them against the applicable safety and environmental requirements.
3. Submit the operating-license application
The operating-license package includes a final safety analysis report, technical specifications, fire-protection information, security plans and emergency-preparedness plans. The final safety analysis report reflects the completed design and the analyses supporting safe operation. Technical specifications define important operating limits, surveillance requirements and other conditions that become part of the license.
4. Receive a separate operating license
The NRC evaluates the final package and the results of construction before issuing an operating license. Only then does the Part 50 project have the NRC authority needed for routine commercial operation. The two-step sequence therefore creates a distinct legal decision for construction and a later decision for operation.

How a Part 52 combined license works
1. Submit construction and operating information together
A combined-license applicant generally provides the required facility information up front. The application identifies the plant design, site information, safety analyses, environmental effects, operating programs and the ITAAC that will be verified during construction. The aim is to establish the licensing basis before construction advances too far.
2. Use approved site or design foundations when available
Part 52 supports early site permits and certified standard plant designs. An early site permit can resolve specified site-related issues before a complete reactor application. A certified standard design can be reused as an approved technical foundation for later applications, although a later applicant still has to address its specific site and facility.

A COL authorizes construction much like a Part 50 construction permit. The license, however, also contains conditional authority to operate. The condition is substantive: the licensee must demonstrate that the plant has met the specified inspections, tests, analyses and acceptance criteria.
4. Complete ITAAC and obtain the operating finding
During construction, the licensee performs the ITAAC, submits completion notifications and supports NRC inspections. The Commission must find under 10 CFR 52.103(g) that the acceptance criteria have been met before the reactor may begin operation. Receiving a COL therefore does not mean that the company can load fuel or operate immediately.
What the NRC reviews
Safety review
The safety record addresses the reactor’s accident analyses, engineered safety features, site characteristics and programs for operating the facility. The NRC staff uses standard review plans to examine whether the applicant’s assumptions are technically correct and whether the proposed activities meet applicable safety requirements.

Depending on the licensing route and application stage, the record can include preliminary or final safety analysis reports, technical specifications, fire-protection measures, physical security arrangements and emergency-preparedness plans. These documents are intended to show how the plant prevents accidents, limits their consequences and maintains safe conditions during normal and abnormal operations.

Environmental review
The applicant’s environmental report addresses effects on land, waterways, wildlife and other subjects required by federal law. The NRC conducts its own environmental review and coordinates with agencies such as the Environmental Protection Agency, the U.S. Fish and Wildlife Service and the National Oceanic and Atmospheric Administration when their expertise or statutory responsibilities are relevant.
Environmental review is connected to, but distinct from, the reactor’s radiological safety review. A project must address both tracks; approval on one track does not eliminate the other.
Financial, antitrust, security and emergency information
The licensing record also includes financial and antitrust information and the plans needed to protect the facility and respond to emergencies. These subjects are part of the applicant’s required showing, not optional attachments. The NRC uses them alongside the technical and environmental record when deciding whether the requested authorization is legally supportable.
Why hearings matter and what the public can challenge
The Atomic Energy Act requires a hearing on every application for a combined construction permit and operating license. NRC public notices, application documents, environmental materials and hearing procedures are made available through NRC channels and the Federal Register. Affected people and organizations may raise health and safety issues and, in some circumstances, antitrust issues.

Participation is not an unrestricted opportunity to object to any aspect of a project. A person or organization seeking to intervene generally must demonstrate standing and submit at least one admissible contention tied to the licensing proceeding. The contention must identify a genuine dispute with the application or the agency’s analysis and fall within the issues that the particular proceeding can decide.
Challenges during the main licensing case
In the main adjudicatory process, eligible participants can contest material health, safety and certain antitrust questions. Environmental documents are also available for review, and environmental issues can be addressed through the applicable hearing procedures for the proceeding. The exact opportunities and deadlines depend on the notice and the docket for the application.
The separate ITAAC hearing
For a planned first fuel load, the NRC publishes a Notice of Intended Operation 210 to 285 days before the scheduled loading date. Members of the public then have 60 days after publication to request an ITAAC hearing.
An ITAAC request is narrower than a challenge to the original license application. The requester must demonstrate standing and present an admissible contention about whether the acceptance criteria have been, or will be, met. Environmental contentions are excluded from this ITAAC proceeding. The hearing therefore focuses on construction verification and the operating gate, not on reopening every environmental question decided earlier.
What ITAAC means in practice
ITAAC stands for inspections, tests, analyses and acceptance criteria. Each item identifies a verification activity and the objective standard that must be satisfied. The majority of ITAAC typically come from the reactor technology’s certified design; the remainder are site-specific.

- Plan the verification work: the COL identifies the ITAAC that apply to the facility.
- Perform inspections, tests and analyses: the licensee carries out the required activities as construction progresses.
- Document completion: the licensee submits completion notifications and supporting records.
- Support NRC oversight: NRC inspectors examine the work and the evidence supporting the notifications.
- Obtain the Commission’s finding: under 10 CFR 52.103(g), the Commission must find that the acceptance criteria are met before operation begins.
This sequence explains why a COL is best understood as construction authorization plus conditional operating authority. The license exists before construction is complete, but the final permission to operate is gated by objective verification and the NRC finding.
How long does a combined license last?
The NRC states that a COL is valid for 40 years from the date of the Commission’s 10 CFR 52.103(g) finding that the acceptance criteria are met. The NRC also states that the COL can be renewed for an additional 20 years. The 40-year period therefore starts at the operating finding, not simply on the day the COL is issued.
That duration concerns the federal COL. It does not eliminate the need to maintain compliance with license conditions, technical specifications, inspection requirements or other applicable federal and state obligations during the plant’s life.
Which route fits a project?
Part 50 may be attractive when design evolution is expected
The two-step route offers a clearer separation between building and operating. A developer can obtain construction authority based on a preliminary design, continue engineering work, and present the final design in the operating-license application. The tradeoff is a second major licensing decision after construction has begun, with the associated review and adjudicatory work.
Part 52 may be attractive when early certainty is the priority
A COL can integrate construction and conditional operation in one licensing framework and can use early site permits or certified standard designs. The tradeoff is that more information must be complete and fixed earlier, and changes that were not approved in the licensing basis generally have less flexibility during construction.
Questions a developer should answer
- Is the reactor design mature enough to provide the required information up front?
- Would an early site permit or certified standard design reduce later duplication?
- How much design change is realistically expected during construction?
- Can the project organize the evidence, inspections and notifications needed for ITAAC?
- Which hearing milestones and public-notice deadlines will affect the schedule?
A practical licensing checklist
- Choose the Part 50 two-step route or the Part 52 combined-license route.
- Prepare the applicable safety analysis, environmental report and site information.
- Submit required financial, antitrust, security, emergency-planning and operational information.
- Track NRC review requests, public notices, Federal Register publications and docket filings.
- For Part 50, obtain the construction permit, finalize the design and submit the operating-license package.
- For Part 52, define the ITAAC and preserve the approved licensing basis during construction.
- Complete inspections, tests, analyses and acceptance criteria and provide completion notifications.
- For planned first fuel loading under a COL, monitor the Notice of Intended Operation and the 60-day ITAAC-hearing window.
- Do not begin operation until the NRC has made the required 10 CFR 52.103(g) finding.
- Separately verify state permits, local requirements and any later changes to NRC regulations or the project docket.
What this process does—and does not—decide
NRC licensing decides whether a commercial reactor may be constructed and operated under the federal nuclear-safety framework, subject to the conditions in the permit or license. It does not guarantee a particular construction schedule, resolve every state or local approval, or prevent later NRC enforcement if the licensee fails to meet its conditions. Project-specific status, reactor technology, docket history and regulatory changes must be checked in the current NRC record rather than inferred from the general Part 50 or Part 52 structure.
