A name, image and likeness (NIL) partnership is a commercial agreement: a college football player grants defined rights to use their identity and performs agreed promotional work in exchange for money, merchandise, services or another documented benefit. A valid Division I deal must include this exchange (quid pro quo); it cannot pay the athlete for participating in a game, achieving an athletic result, or enrolling at or staying with a particular school.
The practical process is contract first, compliance review second, performance and recordkeeping throughout. The athlete and payer define the deliverables, value and usage rights, report covered third-party terms through the NCAA-designated system, and handle taxes on both cash and noncash compensation.
What an NIL partnership actually is
NIL refers to the commercial use of a player’s name, image or likeness. A business, collective, apparel company, media operation or other payer may hire a player to promote goods or services, create content, appear at an event, sign autographs, license merchandise or grant a royalty right. The athlete is not simply being rewarded for being on the roster; the agreement should identify what the athlete will provide and what the payer will provide in return.

In practical terms, that means identifiable value on both sides: for example, a player posts a specified number of sponsored videos and receives a stated fee, or appears at a youth clinic and receives cash and merchandise. The work must be genuine and capable of being completed. A promise to pay only if the team wins, the player starts, or the player reaches a statistical milestone is not a normal commercial exchange and can fall within prohibited athletic-performance compensation.
- Permitted commercial purpose: promoting or endorsing goods or services offered to the general public for profit, with services and rights described in the contract.
- Not a permitted purpose: payment for athletic participation or achievement.
- Not a permitted inducement: compensation conditioned on initial or continued enrollment at a particular institution.
The exact agreement controls. An endorsement, appearance or merchandise arrangement that is lawful for one athlete, payer and jurisdiction may require different terms—or may not be available—to another athlete.

Who pays determines which rules matter
Before negotiating price, identify the payer and the relationship to the school. The same social-media post can receive different scrutiny depending on who is funding it.
| Arrangement | Typical payer | What is exchanged | Important distinction |
|---|---|---|---|
| Independent third-party NIL | A business or other outside organization with no institutional relationship | Promotion, content, appearances, autographs, licensing or another defined service for cash or noncash value | Qualifying Division I agreements must be reported through the designated clearinghouse; the athlete remains responsible for accurate submission. |
| Associated-entity or associated-individual deal | An entity or person associated with the institution, which can include a school-linked organization or individual | The same kinds of commercial services and rights | The clearinghouse examines whether there is a valid business purpose and whether compensation is commensurate with comparable NIL value. |
| School revenue-sharing payment | The athlete’s institution under the applicable settlement and institutional program | An institutional payment or benefit governed by school and association rules | This is not the same contract as an outside brand or collective NIL deal. The materials available here do not provide a complete accounting of every revenue-sharing rule, so consult the school for those terms. |
A collective can be an outside payer, but its label does not decide whether a contract is acceptable. The business purpose, actual services, compensation and relationship to the institution do.
How a partnership moves from offer to payment
1. Confirm the opportunity and the counterparty
Ask who is paying, what business or organization is behind the offer, and whether it is connected to the school. Verify that the counterparty is real, can pay, and is offering a service that can be performed. A vague promise such as “we will pay you to be part of the program” is not a complete NIL proposal.
2. Define the rights and deliverables
Write down the identity rights being licensed and the work being performed. Useful detail includes the number and type of posts, filming dates, event length, appearance location, autograph quantity, approval process, hashtags or disclosures, and whether the athlete must avoid competing sponsors. Specify where the payer may use the content—social platforms, web pages, print, broadcasts or paid advertising—and whether it may edit, sublicense or reuse it.
3. Set value and payment mechanics
State the total value, currency and due dates. Separate a signing amount from per-post or per-appearance amounts, and identify bonuses that are based on completing additional commercial work rather than athletic results. Describe noncash compensation precisely, such as the retail value and delivery date of merchandise, equipment, travel or services. Include who pays production costs and what happens if an event is canceled.

4. Check school, state and NCAA requirements before signing
Campus policies can restrict categories of sponsors, disclosure methods, use of school marks, facilities, uniforms and team schedules. State law can add registration, contract or disclosure requirements. The NCAA’s Division I overview advises athletes to review the institution’s policy and applicable state law. Send the proposed agreement to the school compliance office early enough to resolve conflicts before work begins.

For a qualifying Division I third-party arrangement, submit the agreement’s terms and written documentation through the designated NIL clearinghouse, currently identified by the NCAA as NIL Go. The athlete is responsible for accurate and complete reporting. Keep a copy of the submitted information and any review response.
6. Perform exactly what was promised
Save drafts, approval emails, posting links, attendance records, photographs, invoices and delivery confirmations. If a deliverable changes, document the change in writing and update the agreement or report when required. Do not accept payment for work that will never be performed.
7. Invoice, receive value and preserve records
Use the payment method and schedule in the contract. Keep the signed agreement, amendments, invoices, receipts and evidence of completed work. Those records help with clearinghouse questions, disputes and tax preparation.
Division I reporting: the $600 threshold and status-specific deadlines
Current NCAA Division I guidance says a covered third-party NIL deal valued at $600 or more is reportable. Smaller payments from the same payer are aggregated; once their combined value reaches $600, the arrangement meets the stated threshold. The figure is a reporting threshold, not a typical deal value and not a tax exemption.

| Athlete status | Current timing described by NCAA guidance | Practical action |
|---|---|---|
| Prospective Division I athlete | Within 14 days after beginning full-time classes, or before the first Division I game, whichever comes first | Have the agreement and written terms ready before enrollment and confirm the deadline with the destination school. |
| Division I-to-Division I transfer | Separate transfer rules apply; current instructions include five business days for new or changed deals during such a transfer | Ask both compliance offices which agreement version and date must be submitted. |
| Enrolled athlete in another situation | Timing depends on the current NCAA instructions and the athlete’s circumstances | Use the live NCAA guidance and the school compliance office rather than relying on a deadline remembered from another deal. |
Procedures and deadlines can change. A submission should include the signed or otherwise written documentation and the material terms required by the Division I bylaw, including services, rights granted, term, compensation, payment structure, involved parties and service providers.
Why school-associated deals receive extra review
When an associated entity or individual pays a prospective or enrolled athlete, the clearinghouse tests more than whether a contract has signatures. It asks whether the arrangement has a real commercial purpose and whether the price is comparable to what similarly situated people with similar NIL value would receive.
“An associated entity or individual shall not enter into an agreement with or provide payment to a prospective student-athlete or student-athlete unless the agreement or payment terms, as determined by the name, image and likeness clearinghouse, are for a valid business purpose related to the promotion or endorsement of goods or services provided to the general public for profit, with compensation at rates and terms commensurate with compensation paid to similarly situated individuals with comparable name, image and likeness value who are not prospective student-athletes or student-athletes of the institution.” — NCAA Division I Bylaw 22.1.3
For an athlete, that standard means a contract should explain the commercial audience, the product or service being promoted, the work required and the basis for the fee. A large payment with little or no public-facing work is more difficult to support than a documented campaign with measurable deliverables.

This is permission to negotiate commercial work, not blanket permission for recruiting payments. The judgment does not authorize compensation for athletic performance or achievement, and it does not cover work that will never be performed. A recruit should therefore insist on a genuine commercial scope, written deliverables and a payment schedule independent of the decision to enroll.
Cash, merchandise and services can all create taxable income
The Internal Revenue Service treats NIL income broadly. Cash, property and services received for endorsements, sponsorships, appearances, royalties, merchandise or other work may be income. The duty to report does not disappear because a payer does not send a tax form.
- Cash: Record the gross amount and payment date, including installments.
- Property: Track merchandise or equipment and retain documentation showing its value and when it was received.
- Services in kind: A free service or other noncash benefit can still have taxable value.
- Expenses: The IRS advises tracking potentially relevant expenses and the locations where services are performed.
The IRS NIL guidance describes a $2,000 Form 1099-NEC reporting threshold for qualifying service payments received in 2026, including cash, merchandise or services in kind, and says the threshold will be indexed for inflation. That threshold concerns whether an information return is issued; it does not make income below $2,000 tax-free. All NIL income must still be reported.
Whether an athlete is treated as an employee or self-employed depends on the facts and the relationship with the payer. Estimated tax payments and state tax may apply. Because classification, deductions and state rules are fact-specific, keep complete records and obtain current advice from a qualified tax professional rather than assuming a teammate’s treatment applies.

Examples: commercial exchange versus prohibited structure
Clearly described commercial campaign
A local sports retailer pays a player a fixed fee in three installments. The player records two store videos, attends a scheduled clinic, posts the approved content with the required disclosure and licenses the retailer to use the videos for six months. The agreement identifies the retailer, deliverables, usage period and payment dates. This has an identifiable exchange, subject to school, state and NCAA review.
Noncash arrangement that still needs records
A nutrition company supplies products and a paid coaching service in return for specified posts and an appearance. The athlete records what was received, the stated value, the work completed and any tax documents. The absence of cash does not remove reporting or tax considerations.
Structure that raises a rules problem
A booster-linked organization promises a large payment if the team wins its conference and asks the athlete to sign a one-page form with no promotional work. The payment is tied to athletic achievement, lacks a valid documented commercial purpose and may fail the commensurate-compensation review. The athlete should not perform or accept funds until compliance staff resolve the arrangement.
Common problems and practical fixes
- “The payer said it is NIL, so no filing is needed.” Determine whether it is a covered Division I third-party deal and submit it through the required process.
- Payments arrive from several projects with the same payer. Track the aggregate value; smaller payments count toward the $600 NCAA reporting threshold.
- The agreement is only verbal. Request written terms before posting or appearing, including usage rights and payment dates.
- The brand changes the campaign after signing. Record the amendment and ask whether a new submission or school approval is required.
- No Form 1099 arrives. Report the income anyway and retain bank statements, invoices and noncash-value records.
- A recruit is offered money “for choosing” a school. Separate any genuine commercial service from enrollment. A payment contingent on enrolling or remaining at a particular institution is not the same as a pre-enrollment commercial NIL contract.
- The athlete assumes all states treat the deal alike. Check the state where the athlete lives, performs services and receives relevant income, plus the school’s policy.
A repeatable checklist before signing
- Identify the payer and whether it is associated with the institution.
- List every name, image, likeness and intellectual-property right being licensed.
- Write measurable services, deadlines, approval steps and disclosure requirements.
- Set cash and noncash value, installments, reimbursements and cancellation terms.
- Check campus policy, state law and conflicts with team or conference obligations.
- Obtain written review when the language is broad or the payer is school-associated.
- Submit qualifying terms and documentation through the current Division I clearinghouse process.
- Perform the agreed work and preserve proof of each deliverable.
- Track all payments, merchandise, services, expenses and service locations for tax purposes.
NIL partnerships work best when they look like ordinary, documented commercial engagements: a real payer, a public-facing business purpose, defined work, fair value, transparent reporting and records that show what happened. Keep third-party contracts separate from institutional revenue-sharing questions, and verify current NCAA, school, state and IRS requirements whenever a deal is proposed or changed.
