Mortgage lenders should govern every AI system that handles borrower information as part of their existing information-security, privacy, and fair-lending control environment. That means knowing what data enters and leaves a system, limiting exposure, assessing vendors, preparing for incidents, and retaining enough insight into AI-assisted credit decisions to give accurate adverse-action reasons. AI does not remove existing legal duties—and the exact rules depend on the lender’s regulator, activities, products, and states.

Start by identifying which rules apply to the lender

There is no single AI-specific data-protection rule that replaces the requirements already governing mortgage lenders. A lender’s AI review belongs within its broader compliance map: applicable Gramm-Leach-Bliley Act (GLBA) privacy and safeguards obligations, the Equal Credit Opportunity Act (ECOA) and Regulation B, the Fair Credit Reporting Act (FCRA), the Home Mortgage Disclosure Act (HMDA) and Regulation C, mortgage origination and servicing requirements, and state laws. The Consumer Financial Protection Bureau’s mortgage resources provide a starting point for mortgage compliance topics, while the FTC’s GLBA overview describes the act’s privacy and security framework.

Do not assume the FTC Safeguards Rule applies to every mortgage lender simply because it is a lender. The FTC says the rule covers financial institutions under FTC jurisdiction that are not subject to another regulator’s GLBA enforcement authority, and it expressly lists mortgage lenders as an example of a potentially covered institution. Coverage depends on the institution’s activities and regulatory jurisdiction, not just its name. The FTC’s Safeguards Rule guide explains the covered entities and the written information-security program requirement. Lenders should map their own charter, regulator, products, servicing activities, and states with legal and compliance counsel.

For covered institutions, the FTC describes a written, risk-based security program suited to the organization’s size and complexity, the nature and scope of its activities, and the sensitivity of the information it handles. This is a useful organizing principle even when a lender’s specific GLBA safeguards regulator is different: controls should reflect the actual data and risks, rather than treating all AI uses alike.

Build an inventory of each AI use and its data

Before approving a tool, document what it is supposed to do and trace borrower information through the whole process. “We use AI” is too broad to assess risk. Customer support, document classification, fraud screening, underwriting assistance, property valuation, and servicing can involve different information, users, vendors, and consequences.

Record the use, inputs, and outputs

For each use case, identify the business owner, purpose, affected process, and whether the output can influence a credit decision or a borrower’s access to service. List the data the system receives: for example, application information, uploaded documents, communications, or information retrieved from connected systems. Distinguish direct identifiers from other sensitive financial or personal information. Record what the system returns and how employees or downstream systems use that result.

Trace copies, access, and retention

Map where prompts, uploaded files, outputs, logs, and backups are stored; which employees and outside providers can access them; and how long each copy remains. Include integrations and exports, not only the AI interface. A document sent to a model can create risk in more than one place if copies persist in a provider’s environment, a lender’s logs, a connected workflow, or a backup.

This inventory is an implementation method for making a risk assessment meaningful; it is not an AI-specific checklist quoted from the FTC. The FTC guide does, however, identify information and system inventories and risk assessment as elements of a covered security program. If a lender cannot say what information a tool receives, where it goes, or who can retrieve it, it does not yet have a sufficient basis for approving that use.

Reduce exposure and match safeguards to the risk

Use the inventory to assess foreseeable threats and determine which information is genuinely needed for the task. Not every useful prompt needs a borrower’s full identity or an entire loan file. Data minimization and tokenization are prudent design choices where they preserve the task’s purpose; they should not be misrepresented as exact wording of the Safeguards Rule.

Choose the least-exposure workflow that works

Ask whether the task can be completed with fewer fields, redacted documents, or identifiers replaced by tokens. Determine whether the system needs access to live borrower records or can work from a controlled, limited dataset. Consider whether a use should be confined to an environment with defined access and oversight rather than an open-ended tool available to staff. These are risk decisions, not universal product rules: the right design depends on the data, the purpose, and the consequences of an error or disclosure.

Apply controls across the workflow

Set access according to job responsibilities and restrict who can submit, view, export, or administer borrower data. Protect sensitive information with appropriate encryption and monitor activity for suspicious or unauthorized access. Test safeguards and train employees on approved uses, data handling, and escalation paths. The FTC guide identifies risk assessment, access controls, inventory, encryption, testing, and training among the safeguards covered institutions should address.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Document why each control fits the risk and how the lender will check that it works. A control that exists only in a policy but is not reflected in permissions, system configuration, employee practice, or oversight does not adequately manage exposure. Revisit the assessment when the AI use, information, integration, provider, or process changes.

Assess AI providers as service-provider relationships

An outside AI platform that receives, maintains, processes, or is permitted access to customer information can raise service-provider oversight issues where the applicable rule covers the lender. Outsourcing a task does not outsource the lender’s responsibility. The FTC’s guide puts it plainly: “If your company brings in a service provider to implement and supervise your program, the buck still stops with you.”

Evaluate security capability and data handling

Before adoption, assess whether the provider can protect the information involved and support the lender’s security program. Ask what data the service receives, where it is processed and stored, who can access it, and whether it is retained or used for purposes beyond the lender’s task. Clarify how the provider handles deletion requests, incident escalation, and any subprocessors involved in the service. These are useful diligence questions; the FTC guide supports provider selection and oversight generally, but does not establish a specific model-training, deletion, location, or subprocessor requirement in the cited excerpts.

Put expectations in the contract and monitor performance

Contracts should set appropriate safeguards and define the provider’s responsibilities, including how the lender will receive information needed to monitor compliance and respond to an incident. Establish practical review points and reassess the provider periodically and when material changes occur. The FTC guide calls for selecting providers with appropriate safeguards, setting expectations contractually, monitoring providers, and periodically reassessing them.

For procurement, compare deployment choices using the same questions rather than relying on a broad label such as “enterprise AI” or a provider’s general assurance. Relevant dimensions include borrower-data sensitivity, whether information leaves lender-controlled systems, retention and secondary use, access and encryption controls, auditability, incident support, and the ability to explain credit outcomes. These are decision criteria for the lender’s assessment, not a regulator ranking or endorsement of particular products.

Keep credit decisions explainable enough to comply with ECOA

When AI contributes to a credit decision, the creditor remains responsible for accurate, specific principal reasons when it takes adverse action. The CFPB’s guidance on credit denials involving artificial intelligence states that there is no special AI exemption. Its Circular 2022-03 says a creditor cannot justify noncompliance with ECOA and Regulation B because its technology is too complicated or opaque to understand.

The operational test is whether the lender can identify the actual principal reasons behind an adverse decision and communicate them accurately. A notice that lists generic categories, or reasons that do not describe the factors considered, is not made adequate by the complexity of the model. The CFPB’s Regulation B resource is a useful navigator for the rule; legal researchers should confirm requirements against official CFR and Federal Register materials.

Test the decision path before relying on it

Involve compliance and fair-lending specialists before an AI output is used in underwriting or another credit decision. Trace how inputs become outputs, how those outputs influence the decision, and how the lender turns the actual factors into an adverse-action notice. Test whether the reasons generated in representative cases correspond to the factors that drove the decision. Keep records sufficient to reconstruct how an AI output informed the outcome; this is a practical control to support oversight and accurate notices, rather than a specific recordkeeping mandate established by the cited excerpts.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the lender cannot reliably determine and state the principal reasons for an adverse action, it should not rely on the system for that decision pathway until it can. Model opacity is a governance problem to resolve before deployment, not a reason to weaken a notice.

Prepare for incidents involving internal systems and providers

An incident plan should cover AI-related systems and provider relationships, not just the lender’s own network. Define how staff escalate suspected exposure, who coordinates investigation, and how the lender will determine what information was involved, whose information it was, whether it was encrypted, and how many consumers may be affected. Assign responsibility for coordinating with providers and evaluating notices to regulators, consumers, or other parties.

Under the FTC Safeguards Rule guide, a covered institution must notify the FTC of a qualifying notification event involving unauthorized acquisition of unencrypted customer information of at least 500 consumers. The notice must be made as soon as possible and no later than 30 days after discovery. The threshold and deadline are specific to that federal rule; other reporting duties can apply independently, so the lender should not treat this as its only incident clock. The FTC guide also says the qualified individual reports in writing on the information-security program to the board or governing body, or an appropriate senior officer, at least annually.

Turn the controls into an operating review

A lender can make AI governance actionable by assigning each use case an accountable business owner and control owners from security, privacy, compliance, and technology. The review should produce a record of the purpose, data flow, assessed risks, safeguards, provider terms, decision impact, and incident contacts. Approval should be conditional on resolving unknowns that affect data exposure or legal compliance, rather than treating procurement as a one-time vendor questionnaire.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Describe the use: State what the system does, who uses it, and whether it can affect a credit decision, borrower communication, or servicing action.
  2. Map information flows: List inputs, outputs, connected systems, storage locations, access roles, provider access, logs, backups, and retention.
  3. Assess and reduce risk: Identify foreseeable threats, remove unnecessary data where feasible, and select safeguards proportionate to sensitivity and use.
  4. Review the provider: Evaluate security capability, agree on safeguards and oversight, clarify relevant data-handling practices, and plan periodic reassessment.
  5. Validate decision accountability: For credit-related use, test that actual principal reasons can be identified and stated accurately in adverse-action notices.
  6. Set monitoring and response: Name the people who review changes and incidents, establish escalation routes, and track whether controls continue to work.

Keep this review connected to the lender’s broader mortgage compliance program. HMDA and Regulation C apply to many covered institutions and require collection, reporting, and disclosure of specified mortgage-lending information; the CFPB’s Regulation C resource is a navigator, not a substitute for checking the official rule. The relevant set of obligations varies by institution, so legal and compliance review should confirm the rules that govern each use and jurisdiction.

What a sound decision looks like

Approval should rest on a documented understanding of the system and its data, safeguards proportionate to the risk, provider oversight, an incident path, and—where credit decisions are involved—the ability to explain outcomes accurately. If those conditions are not established, narrow the use, reduce the information exposed, or defer deployment until the lender can govern it. The objective is not to ban useful automation; it is to ensure that automation does not create an untracked data flow or an unexplainable credit decision.
