In the United States, federal law provides a civil route for some people whose intimate images are shared without consent, and the TAKE IT DOWN Act creates criminal prohibitions for specified publications, including deepfakes. In the European Union, an AI Act prohibition on certain AI-generated or manipulated intimate depictions is due to apply on 2 December 2026, while a separate directive requires Member States to criminalize specified nonconsensual public dissemination. Which law applies depends on the conduct, consent, intent, the person depicted, and where the activity occurred.
This overview covers U.S. federal law and EU-level rules as of 13 October 2026. It is not legal advice; state law in the U.S. and each EU country’s implementing law may add important details.
What laws may apply to an AI-generated intimate image?
There is no single law that covers every creation or sharing of a nonconsensual intimate image. The U.S. federal civil action and TAKE IT DOWN Act focus on specified sharing or publication. The EU AI Act addresses certain AI-system generation or manipulation, while Directive (EU) 2024/1385 addresses specified public dissemination and requires national criminal-law implementation.

How does U.S. federal civil law work?
The Violence Against Women Reauthorization Act of 2022 added a federal civil cause of action at 15 U.S.C. § 6851. The Department of Justice (DOJ) says it can cover intimate images, explicit pictures, recorded videos, or other depictions shared without consent, including over the internet or social media. Agreeing to take an image or sending it privately to one person does not, by itself, mean agreeing to wider distribution. See the DOJ’s guide to sharing intimate images without consent.

What a plaintiff must establish
According to DOJ guidance, a plaintiff must show that the defendant shared an intimate image without consent and knew the sharing was nonconsensual or recklessly disregarded that fact. Whether a particular AI-generated depiction meets the statute’s definitions and requirements depends on the circumstances; the existence of a deepfake alone does not establish every element of a claim.
Potential civil remedies and exceptions
A court may order the defendant to stop sharing the images, award financial losses or an amount up to $150,000, and award attorney fees and court costs. The amount is a statutory maximum described in DOJ guidance, not a guaranteed award. The statute also contains exceptions, including specified good-faith disclosures for law enforcement, legal proceedings, and medical reasons. DOJ notes an exclusion for commercial pornography unless production involved force, fraud, misrepresentation, or coercion.

What does the TAKE IT DOWN Act prohibit?
Congress passed the TAKE IT DOWN Act on 28 April 2025. DOJ describes it as criminalizing nonconsensual publication of intimate images, including deepfakes. Its criminal route is distinct from the civil action: it concerns prohibited publication and government enforcement, rather than a private damages claim.

The legal elements and exceptions matter; this summary should not be treated as a rule that every synthetic sexual image automatically results in criminal liability. DOJ’s release about seizure of domains publishing nude digital forgeries reports that a federal judge found probable cause supporting seizure warrants. Probable cause is a preliminary legal finding, not a conviction.

DOJ also announced in May 2026 that two individuals had been arrested in a case alleging publication of AI-generated deepfake pornography under the Act. The arrest announcement describes allegations; the defendants are presumed innocent unless and until proven guilty.
What does EU law say about generating and sharing these images?
AI Act: a rule about certain AI systems
The amended EU AI Act prohibits placing on the market, putting into service, or using an AI system that generates or manipulates realistic images, videos, audio, or similar material depicting an identifiable person’s intimate parts or sexually explicit activity without that person’s freely given, specific, informed, unambiguous, and explicit consent for that generation or manipulation. The prohibition concerns the covered AI-system activity, not just later public posting. The Act’s provisions address the scope of covered material and exceptions, including certain non-realistic artistic depictions and lawful medical uses. The consolidated AI Act text sets out the rule.

The relevant prohibition is adopted law, but it is not yet applicable on 13 October 2026: the EU’s AI Act implementation summary gives its application date as 2 December 2026. That date matters when assessing conduct before it.
Directive 2024/1385: a rule Member States must implement
Directive (EU) 2024/1385 addresses nonconsensual public dissemination of images, videos, or similar material depicting sexually explicit activity or intimate parts. Its recitals say the offense should include nonconsensual production, manipulation, or alteration using AI when the resulting material is subsequently made publicly accessible. The directive includes deepfakes that appreciably resemble a real person and falsely appear authentic.

A directive is not proof that every EU country already has identical domestic wording or penalties. The precise national offense, defenses, sanctions, and implementation status need to be checked in the relevant country. The text of Directive (EU) 2024/1385 provides the EU-level framework.

The applicable law depends on where the person is, where the sharing occurred, the depicted person’s age, whether the person is identifiable, the image’s content, the nature of the publication, consent, and any relevant intent or exception. A lawyer or victim-support organization can help assess which route fits the facts; this overview cannot determine whether a particular claim or prosecution will succeed.
- Keep records of the post, account or site, URL, dates, and relevant messages. Preserve evidence without reposting or forwarding the image more widely.
- Use the platform’s reporting process and, where appropriate, contact law enforcement. A report or removal request does not itself determine whether a law was violated.
- For U.S. federal information and links to legal-aid and victim-support resources, consult the DOJ’s know-your-rights page.
- Check local law as well as federal law in the United States. DOJ’s federal guidance does not resolve every state’s civil or criminal rules, including each state’s treatment of AI-generated depictions.
Why location and legal definitions matter
The U.S. federal rules described here do not provide a complete state-by-state survey. State laws may address additional conduct or define offenses differently. In the EU, the directive’s criminal-law requirements depend on Member State implementation, and the AI Act has its own application date and scope. Identifiability, consent, public concern, intent, public dissemination, and statutory exceptions can change the analysis, so do not assume that one country’s rule or one enforcement announcement settles a different case.
