For a new internet shutdown order in India, the starting point is the Telecommunications (Temporary Suspension of Services) Rules, 2024. They place the issuing decision with the Union Home Secretary or the State Government Secretary in charge of the Home Department, require a written and reasoned order, demand consideration of less restrictive alternatives, limit an order to 15 days, require publication, and send it to a review committee within 24 hours. The committee must meet within five days. People affected by the order can seek judicial review, including a petition in a High Court under Article 226.
The Supreme Court’s decision in Anuradha Bhasin v. Union of India (10 January 2020) remains important for the constitutional limits: an internet restriction must be proportionate, last no longer than necessary, and cannot be indefinite. The 2024 Rules now supply the current administrative timetable for new orders; they should not be confused with the earlier 2017 rules or with the Court’s directions responding to gaps in those rules.
Which rules govern a new shutdown order?
The Telecommunications (Temporary Suspension of Services) Rules, 2024 were made under the Telecommunications Act, 2023. For new suspension orders, they supersede the Temporary Suspension of Telecom Services (Public Emergency or Public Service) Rules, 2017. The 2024 Rules contain transition language for orders made earlier, so an existing order issued under the former regime is not automatically treated as if it had been issued under every 2024 procedure.
The distinction matters because the 2017 Rules did not set a maximum duration. In Anuradha Bhasin, the Supreme Court supplied periodic-review safeguards and constitutional requirements to address that problem. The Court’s often-quoted statements concern the 2017 framework then before it: “An order suspending internet services indefinitely is impermissible under the Temporary Suspension of Telecom Services (Public Emergency or Public Service) Rules, 2017.” It also held: “Any order suspending internet issued under the Suspension Rules, must adhere to the principle of proportionality and must not extend beyond necessary duration.” Those principles continue to constrain government action, while the 2024 Rules provide a current 15-day ceiling and a five-day committee-review timetable.

Who can order an internet shutdown in India?
Union Government orders
For the Central Government, the competent authority is the Union Home Secretary. The authority must act within the statutory framework governing suspension of telecom services and record the reasons for the decision.
State Government orders
For a State Government, the competent authority is the Secretary in charge of the Home Department. The designation is attached to the Home Department’s secretary, not simply to any official who happens to be dealing with a law-and-order issue.
Emergency issuance by an authorised officer
If circumstances make it unavoidable to act immediately, an officer of at least Joint Secretary rank may issue the order only when authorised by the relevant competent authority. This is a narrow emergency route, not a general delegation. The competent authority must confirm the order within 24 hours. If confirmation does not occur in that period, the order ceases to exist.

The 2024 Rules require an order to be in writing and to explain why the suspension is being imposed. The document should allow an affected person, a review committee, and a court to identify the legal and factual basis for the restriction rather than leaving the decision as an unexplained announcement.

- Recorded reasons: The order must state the reasons for the suspension and identify the specific reason it addresses.
- Legal objective: The authority must act in relation to the statutory grounds and comply with the requirements in Section 20(2)(b) and Section 20(4) of the Telecommunications Act, 2023.
- Consideration of alternatives: Before issuing the order, the authority must consider whether the objective can be achieved through another reasonable means. A shutdown is therefore not supposed to be the automatic response when a narrower measure could work.
- Geographical scope: The order must define the area covered. It should not leave the affected territory uncertain.
- Service type: It must specify the type of telecommunications service being suspended. The rules do not treat every possible service or every part of a network as an undifferentiated category.
- Duration: A new order may last no more than 15 days under the 2024 Rules. The constitutional rule remains that a restriction cannot continue beyond the time necessary.
- Publication: The order must be published, making its text and reasons accessible to people whose communications, work, education, business, health care, or access to public services may be affected.
What happens immediately after issuance?
- Issue the written order. The competent authority, or an authorised Joint Secretary-rank officer in an unavoidable circumstance, signs an order containing the reasons, statutory purpose, area, service type, and duration.
- Apply the emergency confirmation rule when relevant. If the order came from the authorised-officer route, the competent authority must confirm it within 24 hours or it ceases to exist.
- Publish the order. Publication is an express requirement of the 2024 Rules, not merely a communications preference.
- Send it to the review committee. A copy must reach the appropriate review committee within 24 hours of issuance.
- Operate only within the stated limits. The suspension should remain confined to the published geography, specified service type, and authorised period. Proportionality requires the government to stop when the restriction is no longer necessary.
How are shutdown orders reviewed?
Central review committee
The central committee is chaired by the Cabinet Secretary. Its other members are the Secretary of the Department of Legal Affairs and the Secretary of the Department of Telecommunications.
State review committee
The state committee is chaired by the Chief Secretary. It also includes the Secretary of the state law department or the Legal Remembrancer in charge of legal affairs, and another state secretary who is not the Home Secretary.
Five-day meeting deadline
The relevant committee must meet within five days of the order’s issuance. It records whether the order complies with Section 20(2)(b) and Section 20(4) of the Telecommunications Act, 2023. If the committee concludes that the order is non-compliant, it may set the order aside.

This five-day schedule is the current rule for new orders. It should not be replaced with descriptions of the Supreme Court’s earlier seven-working-day periodic-review direction as though that were the 2024 Rules’ timetable. The Court’s direction arose in Anuradha Bhasin because the 2017 Rules lacked a time limit; the 2024 Rules now combine a 15-day maximum with review within five days.

Are shutdown orders and review findings published?
The order itself
Yes. The 2024 Rules expressly require publication of every suspension order. Publication gives affected people the information needed to determine what was restricted, where, for how long, and for what stated reason. Without the order, a person may know that connectivity has failed but cannot reliably assess whether the restriction is within legal limits or decide what to challenge.
Review committee findings
The rule text expressly addresses publication of the suspension order. In a separate 2024 proceeding concerning Jammu and Kashmir, the Internet Freedom Foundation reported that the Supreme Court took the prima facie view that review committee findings should be published, while committee deliberations need not be. That point should be understood as the applicant organisation’s account of the Court’s view in that proceeding, rather than as a quotation from a Court-hosted order reproduced here. It is distinct from the clear publication requirement for the original order.
What constitutional limits apply?
Speech and expression
The Supreme Court held that freedom of speech and expression over the internet is protected by Article 19(1)(a), subject to restrictions that satisfy the Constitution. A shutdown that blocks online speech must therefore have lawful authority and survive constitutional scrutiny.
Trade and profession
The freedom to practise a profession or carry on a trade over the internet is protected by Article 19(1)(g). The effect on businesses, workers, students, journalists, medical services, and other internet-dependent activity is relevant to whether a measure is proportionate, even though the constitutional test is not simply an economic-loss calculation.

Proportionality and duration
Proportionality asks whether the measure is connected to a legitimate statutory objective, whether a less restrictive reasonable option could achieve that objective, and whether the burden imposed is excessive in relation to the purpose. The Supreme Court’s rule is direct: an indefinite suspension is impermissible, and a restriction must not extend beyond the necessary duration. The 15-day ceiling in the 2024 Rules is a maximum, not an entitlement to keep a shutdown running for 15 days regardless of changing circumstances.

Start with the published document
Obtain the published order and preserve the version, date, issuing authority, stated area, service type, reasons, and duration. If the order is not available, record where publication was expected and what information was communicated publicly. The details matter because a challenge usually turns on the legal text and the factual scope, not only on the experience of lost connectivity.
Check the procedural requirements
- Was the order issued by the Union Home Secretary or the State Home Department Secretary?
- If an authorised officer issued it, was that officer at least Joint Secretary rank and was the order confirmed within 24 hours?
- Are reasons and the specific statutory purpose recorded?
- Does the order identify a definite geographic area and service type?
- Is the duration no more than 15 days and tied to what is necessary?
- Does the order show that reasonable alternatives were considered?
- Was it published and sent to the review committee within 24 hours?
- Did the appropriate committee meet within five days and assess compliance with Sections 20(2)(b) and 20(4)?
A defect does not automatically determine the outcome of every case, but each missing requirement can provide a concrete ground for asking a court to examine legality, necessity, and proportionality.

Use judicial review
The Supreme Court held that judicial review of a suspension order is available and cannot be removed or made ineffective. It specifically identified a challenge in a High Court under Article 226, while also referring to another appropriate forum. Affected individuals, organisations, or businesses can ask the court to examine the order’s statutory authority, reasons, scope, duration, alternatives analysis, publication, and compliance with constitutional proportionality.

The court’s role is not limited to checking whether an official signed a document. It can test whether the restriction is legally authorised, whether the stated objective supports the selected geography and service type, and whether the suspension continued after its necessity ended. Depending on the record and the relief sought, judicial review can lead to effective directions concerning an unlawful or overbroad order; the availability of review itself cannot be defeated by keeping the order unpublished or by allowing it to expire before any meaningful examination.

What policy concerns remain relevant?
A Standing Committee on Communications and Information Technology report submitted on 1 December 2021 recorded concerns about undefined suspension grounds and review committees composed largely of executive officials. It recommended clearer parameters for “public emergency” and “public safety,” a mechanism to assess whether a shutdown is justified, uniform guidance for states, more inclusive review committees, selective restrictions rather than disabling the whole internet, and study of effects on the economy, press, education, health, and shutdown effectiveness.
Those recommendations are policy context, not extra binding conditions added to the 2024 Rules. They are nevertheless useful when assessing whether a particular order is narrowly designed and whether a less disruptive response was realistically available. No single shutdown-frequency or impact statistic is necessary to apply the legal procedure, and the cited materials do not establish a suitable original-publisher figure for this explainer.
A practical checklist for affected users
- Save the published order, public notices, and any later extension or modification.
- Write down when service stopped, which services failed, and the locations and users affected.
- Compare the actual disruption with the order’s stated geography and service type.
- Check the reasons, statutory grounds, alternatives analysis, and 15-day limit.
- Look for evidence that the order was sent to the review committee within 24 hours and that the committee met within five days.
- Collect concrete effects on speech, work, trade, education, health care, or access to essential services.
- Seek legal advice promptly about a High Court petition under Article 226 or another appropriate forum, especially while the order remains in force.
The central question is not merely whether connectivity was interrupted. It is whether the government used the authority assigned by the 2024 Rules, explained the decision, chose a proportionate scope and duration, subjected it to timely review, and kept the restriction open to effective judicial scrutiny.
