If you are an Indian tax resident, profits, dividends and other income from US shares such as Riot Platforms generally have to be considered in your Indian tax return. The result depends first on your residence category, then on whether a sale is short-term, long-term or part of a trading business, and finally on how the income and any US withholding are documented. A US broker may withhold tax on dividends, while an ordinary share-sale gain is generally not taxed by the United States when a nonresident alien was present there for fewer than 183 days during the year, subject to exceptions. India can still tax that gain.

Start with your Indian tax-residence status

Residence status controls whether foreign income is inside the Indian tax net. The Income Tax Department distinguishes between a resident and ordinarily resident, a resident but not ordinarily resident (RNOR), and a non-resident. The scope of taxable income is different for each category, so a rate example is unsafe until you know which status applies for the relevant financial year.

Resident and ordinarily resident

A resident and ordinarily resident is generally subject to Indian tax on worldwide income. That normally brings US-share capital gains, dividends and other foreign investment income into the Indian computation, even though the broker and company are outside India.

RNOR and non-resident taxpayers

RNOR and non-resident rules can limit the foreign income that is taxable in India, depending on the nature and source of the income and the statutory conditions for the year. Do not assume that holding a US brokerage account automatically creates the same Indian liability for every residence category. Establish status from your Indian return records or a tax professional before applying any calculation.

How a sale of Riot Platforms shares is calculated in India

For an Indian taxpayer, a sale is normally analyzed under the Capital Gains head. The ITR-2 FAQ identifies profit or gain from transfer of a capital asset as chargeable under that head. The calculation must be made in Indian rupees, not by simply subtracting the two dollar amounts shown by the broker.

Convert both sides of the transaction to rupees

Use the applicable Indian conversion rules for the sale proceeds and the acquisition cost. Keep the exchange-rate evidence used for each relevant date and transaction. A gain can arise from the share price, from the dollar-rupee movement, or from both. Brokerage, transaction charges and other allowable adjustments must be treated according to the rules for the applicable assessment year.

  1. Record the acquisition date, number of shares, dollar cost and transaction charges.
  2. Convert the acquisition amount to rupees using the applicable prescribed rate for that transaction.
  3. Record the sale date, dollar proceeds and selling charges.
  4. Convert the proceeds to rupees under the applicable rule.
  5. Subtract the allowable cost and expenses from the rupee proceeds, then classify the result as short-term, long-term or business income.
  6. Reconcile the result with the broker’s annual statement and retain both the statement and your exchange-rate working.

Illustrative rupee calculation

Suppose, solely as an example, that 100 shares cost $2,000 when the relevant conversion rate was ₹80 per dollar and were sold for $3,000 when the relevant rate was ₹84. The converted cost would be ₹160,000 and the converted proceeds ₹252,000, producing a ₹92,000 gain before allowable charges. This is an illustration of the method, not a prescribed rate or a prediction of the tax on Riot Platforms.

Long-term and short-term treatment

Long-term framework after 23 July 2024

The Income Tax Department’s current guidance says that, for transfers on or after 23 July 2024, long-term capital gains on listed securities are generally taxed at 12.5% without indexation. The date is important: it is the transfer date, not the date on which you withdraw money from the broker.

That 12.5% figure is not a universal rate for every US share or every investor. Holding period, residence status, the applicable assessment year, surcharge, health and education cess, losses and the exact legal classification all affect the final liability. Confirm that the asset and transaction satisfy the long-term listed-security rules before using the figure in a computation.

Do not assume Section 112A applies

Section 112A has specific statutory conditions, including the securities-transaction-tax framework described by the Income Tax Department. A US-listed share does not automatically satisfy those conditions. Do not mechanically apply an Indian listed-equity exemption or threshold simply because the company is publicly traded. Foreign shares require a fact-specific review of the provision and the year in which the transfer occurred.

Short-term gains and frequent trading

Short-term gains can be taxed differently from long-term gains. The official material establishes the post-23 July 2024 long-term framework but does not settle every foreign-share classification for every assessment year. If you bought and sold frequently, used leverage, or conducted activity in a manner that resembles a trading business, the income-tax department could question whether the receipts are business income rather than capital gains. Keep a consistent position supported by your facts and obtain advice where the distinction could materially change the result.

What the United States generally taxes when you sell

IRS Publication 519 states that capital gains are generally not taxable when a nonresident alien was in the United States for less than 183 days during the year, subject to exceptions. IRS withholding guidance likewise says that capital-gain income is generally not taxable to an NRA under that 183-day condition and is not usually subject to withholding.

The rule concerns US federal taxation; it does not decide the Indian result. A person who spent substantial time in the United States, has a special category of gain, or falls within an exception needs a separate US analysis. Even when no US capital-gains tax is due, the Indian return may still require the gain and the underlying foreign asset to be reported.

Dividends: US withholding, treaty limits and Indian tax

US-source dividends paid to a nonresident alien are reportable and are subject to 30% withholding by default, unless a lower treaty rate is properly claimed. The US–India income-tax treaty’s Article 10 sets a ceiling of 25% of the gross dividend in the ordinary individual case where the beneficial owner is an Indian resident. It also states a 15% ceiling where the beneficial owner is a company owning at least 10% of the voting stock; that corporate ownership rule normally does not describe a retail individual investor.

What Form W-8BEN does

A valid Form W-8BEN establishes that you are a foreign person and supports a claim for an eligible treaty withholding rate. Give it to the broker or withholding agent when requested and keep track of its status. It does not eliminate all US tax, convert a capital gain into a dividend, or guarantee that every payment qualifies for the treaty rate. If the form is missing, expired or inconsistent with your account information, the default withholding rate may be applied.

India still taxes the dividend

India can tax the dividend under its domestic rules when it is within your taxable income. The Income Tax Department explains that foreign income can be taxable in India and that treaty provisions apply where they are more beneficial. Therefore, the treaty’s 25% ceiling limits US withholding; it does not make the dividend tax-free in India.

Foreign-tax credit

A resident can generally seek credit in India for foreign tax paid on income that is also taxed in India, subject to the prescribed process and documentation. The credit is not an automatic refund of every dollar withheld. It is tied to the same income, is limited under the applicable rules, and can be denied or delayed if the return, proof of withholding or other required records are incomplete. Preserve the broker’s dividend statement, the amount withheld, the payment date and the exchange-rate basis used in your Indian computation.

Do not assume that Riot Platforms paid a dividend in a particular year. Verify an actual dividend declaration and payment before entering dividend income; a US-stock holding by itself does not prove that a dividend exists.

Indian return and foreign-asset disclosure

The ITR-2 FAQ places capital-asset transfer gains under Capital Gains, but the correct return and schedules depend on your residence status, income mix and filing year. A person with business or professional income may need a different return from an investor whose income is limited to salary, capital gains and investments. Use the instructions for the year being filed rather than copying a prior-year form.

Tax liability is different from disclosure

No US capital-gains tax does not mean no Indian reporting. Foreign shares may have to be disclosed in the foreign-asset section or other applicable schedules even when the sale produces no taxable US amount, a loss, or an Indian tax credit. Disclosure requirements depend on status and the return form; verify the current instructions for the relevant year.

A practical filing sequence

  1. Confirm your residence category for the financial year.
  2. Download every broker statement, trade confirmation and dividend statement for the year.
  3. Separate sales, dividends, interest and fees; do not combine a dividend with sale proceeds.
  4. Convert each relevant amount to rupees under the applicable Indian rule and retain the supporting rate record.
  5. Classify each sale as short-term, long-term or potentially business income.
  6. Compute any Indian tax, including the effects of losses, surcharge and cess where applicable.
  7. Record US tax withheld on dividends and complete the prescribed foreign-tax-credit process with the required evidence.
  8. Complete the foreign-asset and income schedules required by your status and the filing year.
  9. Reconcile the filed figures to the broker’s year-end statement and keep the working papers after filing.

Records to keep for a Riot Platforms investment

  • Broker account statements showing holdings and cash movements.
  • Trade confirmations with execution dates, quantities, prices and charges.
  • Dividend statements showing gross amount, US withholding and net payment.
  • Your submitted or current W-8BEN status and any broker confirmation of treaty treatment.
  • Exchange-rate records and the method used to convert each purchase, sale and dividend.
  • Evidence of remittances and funding transfers linking the investment to your records.
  • Indian return computations, foreign-tax-credit documents and acknowledgements.

These records matter because a broker’s dollar statement is not, by itself, an Indian-rupee capital-gains computation. They also help distinguish a tax liability from a disclosure obligation if the account is reviewed later.

Common mistakes and how to avoid them

Using the 12.5% rate for every transaction

The 12.5% long-term figure applies to the framework published for listed securities transferred on or after 23 July 2024, not to every US-stock transaction. Check holding period, the asset’s legal classification, the assessment year and your own tax profile.

Applying Section 112A automatically

The provision has conditions linked to the securities-transaction-tax framework. A US listing alone is not proof that those conditions are met.

Reporting only the money withdrawn to India

Tax generally follows the income or transfer, not the date on which you move cash from the broker to an Indian bank account. A gain can be reportable even if you leave the proceeds overseas.

Treating W-8BEN as a complete exemption

W-8BEN supports foreign status and an eligible treaty rate for withholding. It does not erase Indian tax, and it does not guarantee a reduced rate when the form or beneficial-ownership facts are wrong.

Ignoring currency movement

Converting only the dollar profit can materially misstate the Indian gain. Convert cost and proceeds under the applicable rules and retain the rates used.

Confusing no US tax with no reporting

The US 183-day capital-gains rule is a US tax result. It does not remove Indian capital-gains tax or foreign-asset disclosure duties.

When professional advice is especially useful

Get advice for the relevant assessment year if you changed residence status, spent significant time in the United States, traded frequently, used options or leverage, received corporate actions, carried forward losses, held the shares through a company or trust, or need a foreign-tax credit. The official sources establish the general principles, but they do not resolve every foreign-share classification or filing choice for every taxpayer.

For a straightforward investor, the safest approach is disciplined documentation: establish residence status first, compute each transaction in rupees, classify the holding correctly, report dividends and foreign assets separately, and claim any eligible US tax credit through the prescribed Indian process.
