Yes—an India-registered business may generally claim GST input tax credit (ITC) on a phone used or intended for use in its business. The purchase is not automatically eligible because it is called a “business” phone. You need a qualifying tax invoice, receipt of the phone, supplier reporting, a valid return, and a defensible business-use connection. If the phone is also used personally, only the business-attributable portion can be claimed; the law does not prescribe one universal phone-use percentage.

The short answer: when a business phone can qualify

Under the Central Goods and Services Tax Act, 2017, ITC is tied to the registered buyer’s business use, not to the phone’s model, price, brand or marketing description. A registered person can generally claim the GST charged on a qualifying phone purchase when all applicable statutory conditions are satisfied.

For a phone bought by a GST-registered business, check these questions before claiming:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Is the purchaser the GST-registered person, and is the phone used or intended to be used in that person’s business?
  • Did a registered supplier issue a valid tax invoice or debit note showing the GST?
  • Has the business received the phone?
  • Has the supplier furnished the invoice details so they are communicated through the GST system as required under section 37?
  • Has the business furnished the relevant return?
  • Is the claim reduced for personal use, exempt-supply use or another statutory restriction?
  • Has depreciation been claimed on the GST component under income-tax law?

These are eligibility questions, not a promise that every invoice appearing in the GST portal can be claimed.

The legal test under the CGST Act

Section 16(1): registered person and business purpose

Section 16(1) of the Central Goods and Services Tax Act, 2017 states:

“Every registered person shall, subject to such conditions and restrictions as may be prescribed and in the manner specified in section 49, be entitled to take credit of input tax charged on any supply of goods or services or both to him which are used or intended to be used in the course or furtherance of his business and the said amount shall be credited to the electronic credit ledger of such person.”

A phone is a supply of goods. The key test is whether it is used or intended to be used in the course or furtherance of the registered person’s business. “Bought for work” is a useful description, but it does not replace evidence of the business connection.

Section 17(1): mixed business and non-business use

Section 17(1) deals with goods used partly for business and partly for other purposes:

“Where the goods or services or both are used by the registered person partly for the purpose of any business and partly for other purposes, the amount of credit shall be restricted to so much of the input tax as is attributable to the purposes of his business.”

Therefore, a phone used for both business calls and personal calls does not normally support a claim for the entire GST amount. The claim must be limited to the portion attributable to business.

Section 17(5)(g): personal consumption is blocked

Section 17(5)(g) blocks credit for goods or services used for personal consumption. Personal use is not converted into eligible use merely because the phone was paid for by the business or appears in the business accounts.

Eligibility checklist before you claim

Check What to verify Why it matters
Registered buyer The GST registration belongs to the person or entity taking the credit. Section 16(1) applies to a registered person.
Business connection The phone is used or intended to be used in the course or furtherance of that business. Business purpose is the starting statutory condition.
Tax document A qualifying tax invoice or debit note from a registered supplier identifies the supply and GST charged. The document supports the amount and the supplier details of the claim.
Receipt The business has actually received the phone. Section 16 conditions include receipt of the goods.
Supplier reporting The supplier has furnished the invoice details, with the required communication through the GST system. Current section 16 text includes this supplier-reporting condition.
GSTR-2B review The purchase is reconciled with the auto-drafted statement, while eligibility is assessed independently. GSTR-2B is a control and reconciliation aid, not automatic approval.
Return filing The relevant GST return has been furnished. Furnishing the return is one of the statutory conditions.
Use allocation Any personal or other non-business use is separated from business use. Section 17(1) restricts credit to the business-attributable amount.
Depreciation treatment Depreciation has not been claimed on the same GST component under income-tax law. Section 16(3) bars ITC on a tax component where such depreciation has been claimed.

How to claim the credit step by step

1. Confirm who is buying the phone

The invoice should support the GST-registered person or entity that will take the credit. A phone purchased in an individual’s name is not automatically transformed into a business asset because the individual works for a registered company. The registered buyer, the payment trail and the business purpose should align.

If an employee buys a phone personally and the company later reimburses the employee, the accounting and GST treatment can become fact-specific. Do not assume that reimbursement alone gives the company the employee’s ITC. The registered entity should establish how the supply was made to it and retain the relevant documentation.

2. Obtain and check the tax invoice

Keep the supplier’s qualifying tax invoice or debit note. Check the legal name, GST details, invoice number and date, description of the phone, taxable value, GST charged and supplier details. A retail receipt that does not contain the information required of a tax invoice may not support the same claim.

Do not edit an invoice yourself to correct a mismatch. Ask the supplier to issue the appropriate correction or document and then reconcile the corrected details.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

3. Confirm receipt of the phone

Keep evidence that the business received the handset, such as delivery records, an internal asset register or another contemporaneous record that connects the invoice to the device. Section 16 conditions include receipt of the goods; an invoice alone is not the complete file.

4. Check supplier reporting and GSTR-2B

Review the purchase in the GST system’s auto-drafted statement, commonly used for reconciliation as GSTR-2B. Match the supplier, invoice number, date and tax amount against the books and the physical or electronic invoice.

The GST Portal guidance makes an important distinction: taxpayers must self-assess ITC eligibility. A credit can appear in an auto-drafted statement even though another legal restriction makes it unavailable. Conversely, a missing or incorrect entry may indicate a supplier-reporting or reconciliation problem that needs correction rather than an immediate claim.

5. Determine the business-attributable share

If the phone is used exclusively for business, the use-allocation issue may be straightforward, subject to the other conditions. If it is used for calls, messaging, browsing or applications that are partly personal, identify the portion attributable to business and claim only that portion.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The cited provisions do not set a universal percentage for phone use. A fixed split such as 50:50 or 70:30 is not a phone-specific rule in the CGST Act. The allocation should be supportable from the facts and records of the business.

6. File the return and take the eligible amount

After the invoice, receipt, supplier reporting and use assessment are complete, the eligible ITC is taken through the GST return process and credited to the electronic credit ledger, subject to the applicable conditions and restrictions. It is not normally a cash reimbursement of the phone’s GST paid at the shop. It is a credit within the GST system that can be used in accordance with the law.

7. Check the depreciation treatment

Section 16(3) prevents a taxpayer from claiming ITC on a tax component when depreciation has been claimed on that same tax component under income-tax law. Coordinate the GST return position with the books and income-tax depreciation treatment. The same GST amount should not be used both as an ITC claim and as the depreciable tax component.

How to handle a phone used for both work and personal life

There is no statutory phone percentage

The law gives an attribution rule, not a standard phone formula. The business-use share depends on the actual facts. The cited provisions do not say that every business phone is 100% business-use or that every mixed-use phone must be treated at a particular percentage.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Create a reasonable, contemporaneous basis

A business should be able to explain how it arrived at the business-attributable portion. Depending on its operations, useful records may include:

  • an asset register identifying the device and assigned user;
  • business call or data records where they are available and proportionate to the issue;
  • an internal policy describing permitted personal use;
  • work schedules, customer-contact records or application-use records relevant to the phone’s role; and
  • a written allocation approved in the accounting records, with the factual basis recorded.

These records do not create a statutory percentage. They help show that the claimed allocation was considered rather than chosen arbitrarily.

Illustrative arithmetic, not a legal percentage

Suppose a phone invoice shows ₹3,600 of GST and the business documents a 60% business-attributable share. The arithmetic for the proposed claim would be ₹3,600 × 60% = ₹2,160, before considering any other restriction. The 60% in this example is only an assumed fact for explaining the calculation; it is not a percentage prescribed by GST law.

Review changes in use

If the phone’s use changes substantially—for example, it becomes a personal device after a replacement—review the ITC treatment and the records. A one-time allocation made when the phone was bought should not be treated as proof that its use never changed.

What GSTR-2B can and cannot tell you

GSTR-2B helps a taxpayer reconcile supplier-reported invoices with the purchase ledger. It can reveal missing invoices, duplicate entries, wrong invoice numbers or differences in GST amounts. That makes it an important checkpoint before filing.

It is not an automatic eligibility certificate. The taxpayer still has to apply the business-purpose test, the mixed-use restriction, the personal-consumption block, the receipt requirement, the depreciation rule and other applicable restrictions. An invoice shown in GSTR-2B can therefore require a reduced claim or no claim.

When a phone invoice is absent or incorrect, compare the supplier’s invoice with the purchase records, ask the supplier to correct its reporting where appropriate, and avoid claiming an amount that cannot be reconciled to a valid document.

Common situations and the likely GST question

Situation Question to resolve Practical treatment
Phone used only for business duties Are the registered-buyer, invoice, receipt, supplier-reporting and return conditions met? A full claim may be supportable if no other restriction applies.
Phone shared between business and personal use What portion is attributable to business? Restrict the claim to the supportable business portion; personal consumption is blocked.
Invoice is in an employee’s personal name Who received the supply and who is the registered claimant? Establish the factual supply and reimbursement arrangement before claiming; do not assume the company automatically owns the employee’s ITC.
Invoice appears in GSTR-2B but the phone is personal Does portal visibility override the personal-consumption restriction? No. Self-assess eligibility; portal appearance does not remove statutory restrictions.
GST component included in income-tax depreciation Was depreciation claimed on that same tax component? Section 16(3) bars ITC on that component.
Business makes exempt as well as taxable supplies Is an additional apportionment or restriction required? Obtain a fact-specific assessment before claiming; the general business-use rule alone does not resolve every exempt-supply case.
Supplier has not furnished the invoice details Has the section 16 supplier-reporting condition been met? Reconcile and resolve the reporting issue before treating the credit as claimable.

Frequent mistakes and how to correct them

Claiming the invoice total because the phone is expensive

Phone price, storage, operating system and business reputation do not determine ITC eligibility. Return to the statutory tests: registered buyer, business use, documentation, receipt, reporting and restrictions.

Treating “business use” as an all-or-nothing label

A phone can have a genuine business purpose and still have personal use. Separate the business-attributable share rather than claiming the entire GST amount by default.

Using GSTR-2B as the only test

GSTR-2B is a reconciliation aid. It does not decide whether a personal-use restriction, depreciation issue or another statutory condition applies.

Claiming GST and depreciating the same tax component

Coordinate the GST and income-tax records. Section 16(3) specifically addresses this overlap.

Calling ITC a refund

ITC is credited to the electronic credit ledger and used under the GST framework. It is not automatically the same as a cash refund of the GST shown on a phone invoice.

A practical file to keep for the phone

For each business phone on which ITC is considered, keep a coherent record set:

  • the tax invoice or debit note;
  • proof that the supplier is registered and that the invoice details were reported;
  • delivery or receipt evidence;
  • the GST return and reconciliation supporting the claim;
  • the business-use allocation and the records behind it, where use is mixed;
  • the accounting entry and asset identification; and
  • the income-tax depreciation treatment for the GST component.

Recordkeeping does not make an ineligible purchase eligible, but it makes the business’s reasoning and calculation auditable.

When professional advice is appropriate

General rules can identify the issues, but a particular claim may depend on facts not visible on the invoice. Obtain tax advice when the phone is shared by several people, bought through an employee reimbursement arrangement, used for both taxable and exempt activities, supported by incomplete supplier reporting, or recorded with a disputed depreciation treatment.

The cited official materials establish the statutory framework, not a calculation for a particular taxpayer. Verify the current Act, rules and GST Portal filing guidance before acting because law and portal processes can change.

Decision checklist

  1. Confirm that the claimant is GST-registered.
  2. Explain the phone’s business purpose and identify any personal use.
  3. Collect a qualifying invoice or debit note from the registered supplier.
  4. Confirm receipt of the phone.
  5. Reconcile the invoice with supplier reporting and GSTR-2B.
  6. Self-assess eligibility instead of relying on portal visibility alone.
  7. Reduce the amount to the business-attributable share where use is mixed.
  8. Check for personal-consumption, exempt-use or other statutory restrictions.
  9. Ensure the same GST component has not been used for income-tax depreciation.
  10. Furnish the relevant return and retain the supporting records.
